The paper considers the perennial issue of youth crime, which pervades the media
and public consciousness in the UK19. The incoming Coalition government
proposed changes to the Youth Justice System (YJS); but in November 2011
withdrew them leaving the basic structure in place. This approach is predicated
on concepts of risk and actuarial justice, and it is an area of social work in
England and Wales that is theoretically driven. In addition, the YJS is
underpinned by partnership and inter-agency working and social workers work
within multi-agency Youth Offending Teams (YOTs). Research highlights that
young people within the YJS are often vulnerable with multiple needs and the
statutes establish that all YOTs must have a qualified social worker. The paper
proposes a method whereby social workers promulgate social work values within
actuarial systems. The ideas are relevant to those working with young people and
delinquency in a world where notions of acceptable risk appear to diminish and
evidence-based practice and actuarial justice are privileged.
YJS in the UK risk based, theorised system of social work intervention
Social workers within the Youth Justice System (YJS), engage differently with
the service user group than they might, for example, within other social work
areas in England and Wales. Within the YJS, their work is associated with
particular interventions that engage convicted offenders seeking to rehabilitate
and reduce crime (Liebman, 2007). In general, their work is delineated by
different practice methods and governed by different legislation (principally,
although the Children Act, 1989; and 2004 still applies). Nonetheless, the ethical
codes and the basic social work training that underpins their practice remains the
same.
The difference is therefore focussed upon the highly theorised nature of practice
in the YJS, which distinguishes it strongly from other areas of social work
practice within the England and Wales. The YJS within England and Wales is a
risk-based system, which from the beginning assesses and measures the nature of
the problem using an actuarial assessment system, Asset20. All interventions are
then graded, according to a Scaled Approach, again based on actuarial risk and

the principles and theory of risk (for example, Farrington, 1996 & 2002). This
determines both the types of intervention offered and their intensity and duration.
This can be affected by professional discretion but the ability to do so is limited
and professionals have expressed their dissatisfaction that this can negatively
affect their ability to form relationships and reward success, for example by
varying the frequency and intensity of interventions. In this way the Scaled
Approach serves as an example of some current criticisms of the modernising
agenda, which suggest that professional decision-making is limited and curtailed
by managerial or actuarial systems in social care (Saenz de Ugarte and MartinAranaga, 2011). However, there are also benefits to such systems, and evidence
reviewed by Shlonsky & Wagner (2005) regarding actuarial, consensus and
clinical decision making found that actuarial assessment was on the whole more
accurate and comprehensive because it forced the practitioner into a wider
consideration.21
The Youth Justice System (YJS) has a plethora of underpinning legislation
relating to children and young people who commit criminal acts (Crime and
Disorder Act, 1998; Youth Justice and Criminal Evidence Act, 1999; Criminal
Justice Act, 2003; Anti-Social Behaviour Act, 2003; Criminal Justice and
Immigration Act, 2008). The overarching aim is:
to work to prevent offending and reoffending by children and young
people under the age of 18, and to ensure that custody for them is safe,
secure, and addresses the causes of their offending behaviour (Youth
Justice Board, 2010).
Within the YJS practitioners from a number of professional backgrounds work
together in YOTs which were created by the Crime and Disorder Act (1998) and
which have responsibility for young people aged 10-18. Every Local Authority
(LA) in England and Wales has a multidisciplinary YOT and although they vary
and are shaped by local custom and issues, they must be composed of
representatives from the police, Probation Service, social services, health,
education, and may also contain drugs and alcohol workers and housing officers
(Youth Justice Board, 2010).
Asset is a comprehensive assessment in its scope, but its questions are focussed
towards offending and the potential for the young person to cause harm.
Nonetheless, it is should also identify areas for potential/actual harm to the young
person and areas of need. It is based on assessing and counting static and
dynamic risks within four domains:
family
community
school
personal or individual factors.

Much of the work on risk factors has been undertaken as longitudinal, prospective
or retrospective studies and these continue to influence much of the work in this
area. Prospective studies have found it harder to definitively use the identified
factors to predict behaviour and often result in a high proportion of false positives.
However, the retrospective studies show a high correlation between identified risk
factors and the characteristics of the sampled populations. Put simply, those who
are offenders will have the characteristics which comprise identified risk factors;
the difficulty is so will a considerable number of other people who do not go on to
become offenders. The calculations of risk are based on probability and the
evidence is emergent. Much has been done on risk but the tools are being
consistently refined and improved for example how can we understand better
whether particular risk factors in combination will lead to certain outcomes? At
this time risk factors are better at identifying risks across a group, than identifying
particular individuals; thus a young person may have characteristics, which for a
group of individuals indicate that their probability of behaving in a certain way in
the future is elevated; but this does not mean that this particular young person
will. Because it is not yet possible to predict or identify the salient factors
adequately, much interest has focussed in recent years on protective factors and
resilience. These factors may help explain why, when dreadful things happen or a
high conglomeration of risk factors occur in someones life, they appear to live
happy, non-offending, settled lives when the research would suggest the
probability of such an outcome is low. Risk factors can only indicate that
someone may commit offences in the future they cannot tell that this will
happen. Similarly, the protective factors which the YJS also seeks to measure can
only tell us that a young person is in school, lives with one or both parents, and is
not materially deprived; nonetheless some of these young people (girls convicted
of low level violent offences for example) will find themselves within the YJS
(Arnull and Eagle, 2009). Actuarial assessments are therefore important tools and
the predictive accuracy for Asset with regard to recidivism is about 60-70%
(APSIS 2008:17); but they do not tell the whole story.
Assessments within the YJS are therefore research informed and
methodologically driven. This at the outset was seen as exciting and rigorous; a
measurable form of assessment underpinned by evidence, which would indicate
the appropriate intervention and intensity in line with the RNR22 principles
(Andrews and Dowden, 2006). The other advantages were clarity about what was
intended and what the outcomes should be; this would counter previous concerns
about social work assessments which showed a lack of clarity, with the issues
requiring assistance undetermined and no apparent reason for the interventions
proffered.
Structurally social workers are creations of the statute, therefore, a practitioner
working in either the welfare or justice specific system would for the most part
have very different legislation underpinning agency policy and therefore their
practice. However, many children and young people who are the subject of one

form of assessment and intervention will find that, at some point in their young
lives, they are subject to the other form. For example, research has shown that
38% of frequent offenders in the YJS had been accommodated in LA care at some
point in their lives, compared with 0.5% of the general population (Arnull et al.,
2005).
New Labour who were responsible for the creation of the Youth Justice BoardYJB (1998) and the current structure of the YJS and Children Act (2004) can be
seen to have accepted the risk based work and allowed this to influence their
social policy direction (Arnull forthcoming; Garside, 2009). It is congruent with
their Fabian, socialist basis which seeks to mitigate and counter structural
discrimination, embracing conceptions of agency and looking for long-term,
welfare based solutions. It also supported their concerns for social cohesion postThatcher, their notions of a modernised state (Modernising Government 1999)
and their conceptions of a need to reinvigorate respect for the self and others
(Arnull 2013: Arnull, 2007). Risk based research could provide empirical data
which said that factors could be identified and thus tackled; it said that we could
prevent crime. It suggested that there were things, which were done to some
children and young people and some for which they were responsible and that if
you were able to identify both you might intervene and change the future
trajectory for the young person. Criticisms of Modernising agendas suggest that
they are an organisational response to the ...post-modern, post-industrial, posttraditional (Saenz de Ugarte and Martin-Aranaga, 2011) societies we now have.
And that they are a technocratic and bureaucratic solution which lacks an ethical
dimension and thus are, or will become, irrational processes.
Therefore, we argue that it is not the processes and organisation of those
processes, which are at fault, it is our failure to knowingly and intelligently use
those processes, as our ethics would demand. It is possible to do so and to use the
information, which those technocratised systems have to hand to argue for
resources. Coming from a slightly different perspective this paper supports Saenz
de Ugarte and Martin-Aranaga (2011) and suggests another medium in which the
professional exercise of social work in the two areas of intervention of social
action with the greatest shortfalls the economic and political... might be taken
forward: through the judicious use of data over which social workers in a
technocratised, risk based systems have control.
Young people who are delinquent
The social work with children and young people within the UK is governed by
The Children Act (2004) which significantly increased the role of partnership
working and monitoring of outcomes between agencies and also introduced the
five principles of the Every Child Matters agenda which identified good outcomes
for children and young people: be healthy; stay safe; enjoy and achieve; make a
positive contribution; and achieve economic well-being (Children Act, 2004).
This applies to those who are naughty as well as those who are not and who
come to the attention of the authorities because of behaviour of their parents (or

sought to ensure this by bringing together professionals with skills in dealing with
crime, social need, health and education with the intention to overcome the
structural separation that existed between these services and achieve a joined up
approach (Modernising Govt, 1999).
What are the difficulties posed for social workers in risk based YJ systems?
Do risk based, actuarial assessments of necessity take into account less structural
understanding? How much does any system of UK social work analysis and
assessment take account of structural factors? And in fact by specifying the areas
to be assessed and analysed, might risk based actuarial systems in fact accord
higher status and/or gather more evidence? The corollaries between child
poverty, social and economic inequality, youth crime and criminalisation are
undeniable (Goldson and Muncie, 2008: 222) and poverty has been identified as
a defining feature of many social work service users and a perennial social issue
that the social work profession has done little to address or change (Cree, 2010;
Cunningham and Cunningham, 2008). Some of the current interests in the YJS
focus on particular risk factors which some C&YP within the system appear to
share, for example learning difficulties where one in five of those imprisoned are
said to have some form of learning disability (Bryan et al., 2007). However, it is
also argued that young people with learning disabilities have often originated
from lower socioeconomic backgrounds as do many young offenders; one might
therefore expect an over-representation, as one might of other factors affected by
structural factors, for example racism. A social work interest in and motivation
towards tackling poverty might seem well-focussed therefore and both risk based
systems, as well as welfare ones, might serve to highlight the issues.
Attitudes, assumptions, values, discrimination and bias can play a part in
assessment and more proscriptive forms such as Asset go some way to
ameliorating the potential for discrimination, because they ensure consistency in
the factors considered as part of an assessment and ask for scoring mechanisms
and evidence. The assessment process is one which is essentially about
professional judgement, and social workers undertaking assessment should guard
against allowing bias and discriminatory thinking to pervade their assessments.
They should moreover remain alive to the possibility that nothing is required, and
that the best outcome might be for no further form of involvement. The potential
power of assessment is to ensure that it leads appropriately into justifiable
intervention. In so doing it also has the potential to enable social workers to
demonstrate whether or not they do things differently or more expertly (Rees
and Wallace, 1982) than people who are not social workers. Rees and Wallace
outline the perennial problem for social work, which is to clearly explain what it
does and the difference it can make thus that it produces better outcomes. Might
actuarial systems have the greatest potential to do this most effectively?

contained the notions of and evidence for the importance and impact of structural
factors: it is this strand of evidence that we have made little of to date.
Social work can struggle to be clear about what drives it theoretically and
professionally and we have seen the harm this can do (Munroe, 2011). A fault
may be in expecting a large and diverse profession, such as social work, to
espouse one theoretical base or professional motivation there is no reason why
social workers should not come from diverse perspectives and offer different and
sometimes competing explanations for human behaviour (as other social scientists
do). Explicitness about the perspective, about how the practice is theoretically
informed, how the practitioner will engage with the service user, how the service
users perspective may (or may not) inform the assessment and intervention
process and a clarity of what the practitioner would expect the outcomes of their
proposed interventions to be, should however be generic.
Is there an ethical challenge and if so what is it?
Social works own ethical base would suggest that some weight at least is given to
the structural disadvantage which many young offenders will have experienced;
but our values also urge us to acknowledge the agency which service users have
and to seek to empower them to draw on and develop this to help them counter
disadvantage. Offending can and does cause real harm and it is important that
those working within the YJS help young people to think about, understand and
accept responsibility for their behaviour, helping them to form strategies for living
effectively in the community without causing harm to others.
Some, such as Dugmore et al. (2006) argue that within the YJS there is an
irresolvable tension between welfare and justice approaches which is specific to
YJ work and which by implication makes it harder to apply social work values.
However, there is a tension, which lies at the heart of all social work practice and
is most palpable where social workers exercise care and control functions:
balancing the concern for the individual alongside a concern to uphold state
values regarding acceptable behaviour and levels of care. These tensions
manifest, with regard to the levels of care which are considered acceptable for a
parent to give to a child, or a carer to an elderly or disabled person, or with regard
to establishing someones mental health and fitness to make decisions for
themselves or live within the community, or to determine their age and their right
to asylum on that basis. On each occasion the social worker is asked to form a
judgement. There is therefore an intrinsic tension in the very notion of social
work.
Social work frame its values to allow social workers to form these judgements
whilst also upholding the rights and freedoms of others: often working and
intervening with those who have less power and are less able to uphold those
rights for themselves for structural or social reasons (BASW, 2012). The agreed
acceptance in the professional role of the social worker is of the right to form a
judgement and to step in when occasion demands on behalf of the state/society
whilst ensuring the human rights and dignity of the individual are maintained.

This is why it is so important for social workers as a profession and as individuals to be quite
sure about their values and be able to form judgements about the acceptability of what they are
being asked to do on behalf of the state. It is also why there is an inherent tension between social
workers and the state negotiating for example levels of provision, risk and care to children or in
the case of adoption balancing long-term outcomes and identity; both areas inform current
concerns in the UK with the Coalition.

attention and provided platforms for dialogue about delinquency, offending and
C&YP within the UK (for example, Arnull and Eagle 2009). It would seem
however that the national planning, research and guidance mechanisms have been
adopted locally without changing the nature of local practice. YOTs have been
busy doing and it is less obvious that they have been enabled by the tools at their
disposal to be more proactive, reflective, or challenging. The systems, have
therefore on occasions, become utilitarian and bureaucratic. Research
recommendations have shown how the tools can be used, for example, to
aggregate evidence reasonably easily to campaign for resources and/or change
(Arnull et al., 2005). The challenge is for those of us working in researching or
teaching others about the YJS to ensure that the tools are used and young people
championed.
Social work has consistently had an uneasy relationship with offenders, and
those who work with adult offenders are no longer trained social workers in the
UK. Many social work students question learning about YJ and youth offending
and yet work with delinquent and offending C&YP is, and remains, the preserve
of social work, even in a multi-disciplinary framework. It is among the most
theorised and focussed area of social work practice it is clear about its
theoretical framework, the tools it uses and how this will shape and affect the
interventions on offer and in this it is clear with its service user. The actuarial,
risk based system of youth justice which exists in England and Wales has without
doubt many faults, but it also offers social workers opportunities to put their
ethical imperatives in place. The systems can be used to support, demonstrate and
campaign for social justice, highlighting the needs of young people, used as part
of a reflective cycle and because they count they provide the evidence of harm
and need which we can use to campaign for change and resources. We need to
value young people who are delinquent and use our social work skills, intelligence
and ability to campaign effectively for social justice.
