A proposal form issued by the insurance company contained a questionnaire. The insured
did not disclose in the proposed form a fact that they had undergone a caesarean operation
some time before she had taken a policy of insurance. Based on the proposal form a life
insurance policy was issued by the insurance company. On the death of the insured (policy
holder) a claim was made to recover the compensation. But the insurance company wants to
deny the claim. Argue on behalf of the insurance company and decide.

Mr. Kiram entered into a service agreement with a company which manufactured and
marketed textiles, whereby he was appointed managing director of the company for a period of
5 years. The agreement provided:

Mr. kiram would not disclose or use any confidential information or trade secrets
belonging to the company which came into possession while he was in its service, and,

That during his appointment he would not without the companys consent engages in
any business other than the companys business. When the service agreement had
two years to run, Mr. Kiram wrote a letter to the companys chairman purporting to
resign as managing director and there after carried on business in competition with
the company. But, the company did not accept the resignation and brought an action
against Mr. Kiram to restrain him from disclosing of using any confidential
information or trade secrets of the company. Mr. Kiran argued that the service
agreement had been terminated by him unilateral repudiation of it and that the
restriction of disclosure of confidential information and trade secrets after termination
did not thereby restrict the use of such material. Decide

As Mr. Pankaj Kumar was in need of money and he sold his vehicle to Mrs. Kanyaka for Rs.
15 lakhs. He could have easily sold it for Rs. 16 lakhs. Before the vehicle was delivered on the due
date the necessity for the money had gone away. Therefore, Mr. Pankaj Kumar refused to deliver
the vehicle. How can the parties be remedied as per the provisions of the Indian contract Act,
1872 and case law?

1. Simplify the following passages by using plain English language:
A. Promptly after receipt of notice by an indemnified party under section 1(g), 8 (a) or 8 (b)
hereof of notice of commencement of any action, such indemnified party shall, if a claim in
respect thereto is to be made against an indemnifying party under such section, give notice
to the indemnifying party of the commencement thereof, but the failure so to notify the
indemnifying party shall not relieve it of any liability that it may have to any indemnified

application in the law. Is it fair to conclude that because our Constitution in Article 72 expressly
contemplates the exercise of pardoning power by the President of India and Governor of a State

way of what is implied in the text of Article 72?
