MUNICIPAL ORDINANCE NO. 08 2008


AN ORDINANCE ADOPTING R.A. 9482, KNOWN AS AN ACT PROVIDING FOR
THE CONTROL AND ELIMINATION OF HUMAN AND ANIMAL RABIES,
PRESCRIBING PENALTIES FOR VIOLATION AND APPROPRIATING FUNDS
THEREOF.

BE IT ORDAINED by the Sangguniang Bayan in session assembled that:


Section 1. TITLE An Ordinance implementing the Anti-Rabies Advocacy Campaign.
Section 2. DECLARATION OF POLICY It shall be the policy of the Local Government of
Guinobatan to protect and promote the right to health of its constituents. Thus, to
reduce and prevent the incidence of rabies, it must undertake necessary preventive
action to stop the rapid spread of animal rabies.
Section 3. COVERAGE It shall be implemented and conducted in the Municipality of
Guinobatan, Albay with its 44 barangays, by the anti-rabies committee in coordination
with the Department of Education for the Information and Education Campaign, the
DA and other line agencies and NGOs.
Section 4. DEFINITION OF TERMS For the purpose of this Ordinance, the following terms
shall mean:
a. Bitten refers to an act by which a Dog seizes, cuts or grips with its teeth so that the
skin of a person has been wounded, pierced or scratched.
b. Concerned officials refers to Barangays officials, health workers, police officers or
government veterinarians.
c. Direct Supervision refers to the range supervision where physical presence if the
veterinarian within the Barangay is necessary.

d. Dog refers to a common quadruped domestic animal belonging to the order


carnivore (male or female), scientifically known as canis familiaris.
e. Euthanasia refers to the process of painless death to Dogs and other animals.
f. Impound - refers to seize and hold in the custody of the law.
g. Owner - refers to any person keeping, harboring or having charge, care or control of
a Dog including his/her representative.
h. Pound refers to public enclosure for stray animals.
i. Public Place refers to any place open to the public like parks, malls, markets,
streets, etc.
j. Rabies refers to a highly fatal diseases caused by a Iyssa virus, transmitted mainly
through the bite of an infected animal and is characterized by muscle paralysis,
hydrophobia and aerophobia and other neurological manifestations.
k. Rabies transmission refers to the transmission or passage of the Rabies virus
through a bite by an infected animal, or through contamination with virus-laden saliva
on breaks in the skin and mucous membranes such as the eyes, the lips, the mouth, or
the genital organs.
l. Rabies Vaccination/Immunoprophylaxis of Humans refers to the inoculation of
humans, with modern day rabies vaccines or Rabies immunoglobulin, by a trained
doctor or nurse under the supervision of a qualified medical practitioner.
m. Rabies Vaccination of Dogs refers to the inoculation of a Dog with a Rabies
vaccine by a licensed government or private veterinarian or trained individual under
the direct supervision of a licensed veterinarian. The services of the said trained
individual shall be limited only to Rabies Vaccination Injection in Dogs and only
during government mass vaccination campaigns.
n. Post-exposure Treatment (P.E.T.) refers to an anti-Rabies treatment administered
before an exposure to Rabies to those who are at high risk of getting Rabies.
o. Pre-exposure Prophylaxis (P.E.P.) refers to Rabies vaccination administered before
an exposure to Rabies to those who are at high risk of getting Rabies.
p. Stray Dog refers to any Dog leaving its Owners place or premises and to longer
under the effective control of the Owner.
q. Veterinary or Human Barbiturates refers to drugs that depress the function of the
central nervous system.
Section 5. RESPONSIBILITY OF PET OWNERS All pet owners shall be required to:
a. Have their pet animals regularly vaccinated against rabies.
b. Submit their pet animals for mandatory registration to identify ownership.
c. Maintain/Control over their pet animals and not allow it to roam the streets or any
public place without a leash.
d. Be a responsible pet owner by providing their pet animals with proper grooming,
adequate food and clean shelter.
e. Report immediately within 24 hours any biting incident to the concerned officials for
appropriate action.

f. Registration fee is not less than PhP 100.00 per pet animal. Pet dogs shall have each a
registration card stating the name of the owner, the dogs age, gender, particular
physical distinct marks.
g. Be responsible for any expenses that may be incurred by a victim if his/her pet
dog/animal bites a person or causes any damage to a persons property.
Section 6. RESPONSIBILITY OF BARANGAY OFFICIALS
a. Appropriate funds to support the program.
b. Observe and implement yearly pet animal vaccination and registration.
c. Continuous information/education campaign on anti-rabies ordinance.
d. Make precautionary measure to support the campaign/program.
e. Capture stray animals and to put them in the animal impound.
f. Put up an animal impound where unregistered, stray and unvaccinated dogs shall be
impounded until such time their owners come forward to claim them or, in the case
no one claims the animal, until the time comes for them to be disposed of humanely
by personnel from the Municipal Agriculture Office.
Section 7. APPROPRIATION the amount of PhP 100,000.00 shall be appropriated by the
LGU as counterpart to the DA fund for the current 2008 FY. For the succeeding years
the amount shall depend on the DA appropriation and on the dog population.
Section 8. PENALTIES
A. Pet owners who failed to comply the responsibilities of pet owners as stated under
Sec. 5 of this ordinance shall be given penalties, such as:
1. FIRST OFFENSE
2. SECOND OFFENSE
3. THIRD OFFENSE

PhP 500.00
PhP 1,000.00
PhP 2,500.00 and/or imprisonment for 3 to 6
months.

B. Barangay Officials who fail to implement/support the said ordinance will be dealt
administratively.
Section 9. PROCEEDS OF THE FINES, FEES AND PENALTIES.
a) Penalties/fines under this ordinance shall accrue to a Rabies Control Trust Fund to be
used for rabies control programs of the LGU.
b) Registration fees 25% of the fee shall go to the miscellaneous income of the
barangay where the registration is made, 75% shall accrue to the Rabies Control Trust
Fund of the LGU.
c) Provided, that if the barangay was the one that purchased the vaccines, the
registration fees shall accrue to the funds of the barangay. However, panalties under
paragraph (c) shall be distributed equally 50% to the Rabies Control Trust Fund of the
LGU of Guinobatan, Albay.
Section 10. SEPARABILITY CLAUSE. In case any provision of this Ordinance is declared
unconstitutional, the other provisions shall remain in full force and effect.
Section 11. EFFECTIVITY. This Ordinance shall take effect upon its approval on review by the
Sangguniang Panlalawigan and posting in at least three (3) public places in the
municipality.
