‘On 05/10/2011 at approximately 2217 hrs, while on routine patrol, Patrolman
Birckhead DSN 189 and | made contact with the French Village Motel employee ANITA
R. COLEMAN, F/B, DOB: 03/10/59.
Coleman stated she has been having problems with a black female staying at the
motel. Coleman stated the suspect was staying In the front apartment at the motel,
Coleman stated the suspect has been going from door to door at the motel harassing
other customers. She stated the suspect was also being loud and obnoxious as she
walks around outside at the motel. Coleman stated she received verbal complaints
from other customers about the suspect harassing them. Coleman stated she
confronted the suspect and told her she needed to vacate the premises. She stated
she told the suspect she was no longer welcome at the motel and would have to leave
immediately. Coleman stated the suspect refused to leave the property and said, “I'm a
grown woman" and “You can't tell me what to do." Coleman stated she wished to
pursue charges against the suspect for trespassing on the property. Coleman stated
she did not was Smoot back on the property ever again.
Patrolman Birckhead and | walked to the front apartment, where the suspect was
staying and | attempted to make contact with the suspect by knocking loudly on the door

and announcing, “Fairview Heights Police." | could hear movement inside the motel
room, but no one would answer the door. | again knocked loudly on the door as |
announced, “Fairview Heights Police.” The suspect then came to the door and only
opened it a few inches where | could see her face. The suspect asked what | wanted
and | advised her | needed to speak with her. The suspect stated she needed to put
some clothes on and | advised her to go ahead and get dressed. The suspect closed
the door again and | spoke with Coleman who identified the subject who opened the
door as the suspect whom she was speaking of.
‘A few moments later the suspect opened the door and before | could say
anything she stated, “I got to get up early. | don’t have time for this shit.” | asked the
suspect why she refused to vacate the property after receiving notice from Coleman to
do so. The suspect stated, "I'm 32 years old, I'm a grown woman, and she can't tell me
what to do.” | advised the suspect she was under arrest for trespassing and advised
her to place her hands behind her back. The suspect refused to place her hands
behind her back and dialed a number on a cell phone, which she was holding in her
hands. Patrolman Birckhead and | gave the suspect loud verbal commands to put down
the phone and place her hands behind her back, but she again refused. | took the
suspect by her left arm in an attempt to secure her in handouffs behind her back, but
she quickly pulled away from me. | grabbed the suspect again by her left arm while
Patrolman Birckhead attempted to gain control of her right arm. The suspect continually
pulled away from and pushed against Patrolman Birckhead and | in an attempt to break
free of our hold and avoid being handcuffed. As we struggled with the suspect, |
observed her cell phone fell from her hand and we all fell onto the bed. The suspect

continually tried to pull her hands beneath her stomach as she was lying face down on
the bed. After struggling with the suspect for several moments, | advised her she would
be sprayed with pepper spray if she continued to resist and would not place her hands
behind her back. The suspect still refused to comply and | gave the suspect one spray
of pepper spray to her face. | observed the suspect continued to resist, but with much
less force than before she was sprayed. Patrolman Birckhead and | were soon able to
secure the suspect in handcuffs behind her back.
The suspect was then identified via Illinois driver's license as PHILANA M.
SMOOT, F/B, DOB: 03/09/79. | observed Smoot was wearing only socks and no shoes.
| observed Smoot's shoes lying nearby and offered to assist her in putting them on her
feet, but she refused. | escorted Smoot to my patrol unit while she continually pulled
away from me. | advised Smoot if she returned to the French Village Motel again she
would be arrested for trespassing. | secured Smoot in the rear of my patrol unit and
transported her to the FHPD. Once at the FHPD, | immediately allowed Smoot to flush
her eyes out with running water for several minutes to wash out the pepper spray.
Smoot was soon booked per department procedures and secured in a cell
| issued Smoot non-traffic citation 1117400 for criminal trespass to real property,
which was signed by Anita Coleman and non-traffic 1119030 for resisting a peace
officer, Smoot was soon released after posting cash bond.
