The report submitted to the Board of Trustees for payables is not going to
change.
For additional information contact the Finance Department to review payables
information prior to the Board of Trustees meeting.

of the two failed HVAC roof top units at the Parks & Recreation Building.
Supervisor Grewal inquired about the age of the failing HVAC roof top unit at the Parks
& Recreation Building.

Director Kurt Weiland commented that the unit has been in place since approximately
1983.
Trustee Yi inquired about the brand name of the replacement HVAC unit.

Adopt a resolution to amend the 2012 Parks Millage Budget, 2012 Refuse Budget
and 800MHz Budget Res # 12-48.
Moved by Clerk Israel, supported by Trustee Hunt to adopt Resolution #12-48; a
resolution to amend the 2012 Parks Millage Budget, 2012 Refuse Budget and 800MHz
Budget.
Trustee Krone inquired about background information on the resolution.
Supervisor Grewal commented that Resolution #12-48 is amending 2012 budgets by
moving funds around within each of these fund balances to meet statutory requirements.

11.11 Approve agreement between Recycle Ann Arbor and Pittsfield Charter Township
for services associated with the Clean-Up Voucher Program, subject to Township
Attorney approval.
Moved by Trustee Hunt, supported by Treasurer Scribner to approve agreement
between Recycle Ann Arbor and Pittsfield Charter Township for services associated
with the Clean-Up Voucher Program, subject to Township Attorney Approval.
Supervisor Grewal commented:
Advertisement of the Recycle Ann Arbor for Clean-Up Day Voucher Program.
More proactive use of tax payers dollars and more environmentally responsible.
Trustee Krone inquired about the estimated cost for the voucher program.
Director Lyon commented that cost per vehicle is estimated around $23.00 per vehicle
based on volume and number the Township experienced during the Clean-Up programs.
Trustee Krone inquired if it cost $3.00 per vehicle today how did the Township arrive at
an estimated cost of $23.00 for the Township.
Supervisor Grewal commented that this is a free service to the residents and the $23.00
will be funded by the Township.
Director Lyon commented that the cost is based on an average volume and that volume
is much greater than what a person can take to Recycle Ann Arbor.
Supervisor Grewal commented:
Residents feedback stated they can actually use the service and dont have to be
limited to two calendar days to recycle items.
Numbers increasing in usage can bring down cost to the Township in 2014.

Trustee Krone inquired about the estimated usage of this voucher program by the
residents.
Director Lyon commented that numbers will be 500-700 cars equivalent to previous
years Clean-Up Day programs.

Clerk Israel commented that this addition will help the Townships standing for grants
for the non-motorized parkways.
Trustee Yi inquired about the future plan for the donated park land, expansion of the
parking lot and the taxes accumulated from the developer.
Supervisor Grewal commented the Township is determining whether or not to move
forward with the donation of Centennial Commons park land.
Trustee Yi inquired about the current taxes being collected for this property.
Supervisor Grewal commented that tax information can be obtained from the
Treasurers department.
Treasurer Scribner commented that the vote today is to get things started with the
donation.
Supervisor Grewal commented that time frames are subject to the approval of the
donation.
Trustee Yi inquired about the maintenance costs to maintain this park land are.
Supervisor Grewal commented that maintenance cost will be determined by which
amenities the Township decides to include.
Trustee Krone commented about transfer costs with the developer for the acceptance of
the land.
Supervisor Grewal commented:
Developer is expecting $0 from the Township.
Cost included in resolution language is for the board consideration.
Clerk Israel commented:
Taxes assessed to the land.
Wetland is not buildable and used strictly as park land.

Supervisor Grewal commented that 1/3 of the park land is wetland area.
Backflow connection that can lead into the Township clean water and cause
contamination.
Cross Connection Ordinance being consistent with the DEQ and universal
plumbing codes.
Trustee Yi inquired about the inspection of residential homes in relation to the Cross
Connection Ordinance.
Director Lyon commented that inspections will primarily focus on commercial
property the greatest threat.
Director Lyon stated that residential homes can be inspected for cross connections but
will not have a mandatory yearly inspection. They are required to have a back flow
prevention system.
Trustee Yi inquired that about the possibility of the language being changed to state
industrial users are the main concern and not include residential.
Director Lyon commented that the language is generic due to all connections posing a
possible threat to the system.

Supervisor Grewal commented that all corrections will go to the Township attorney for
recommendation.
Clerk Israel commented:
Township has to have the right to inspect cross connections in residential areas.
Cost is greater to re-sanitize the water than to inspect every Township home.
Director Lyon commented that Pittsfield Charter Township currently has a Cross
Connection policy in affect.
Trustee Lotfian inquired where there will be a need for an additional employee for
inspections if this ordinance is adopted.
Director Lyon commented that all existing employees will be used for inspections.
Trustee Yi inquired about the cost for fixing a failed cross connection.
Director Lyon commented that the homeowner will have to replace the irrigation
systems by default if the cross connection fails.

The following preamble and resolution were offered by Trustee Krone and supported by Clerk Israel.
WHEREAS, the Uniform Budgeting and Accounting Act, Act 2 of 1968, Budget Sections as amended through Act 493 of
2000, 141.437 Section 17 (1) states that any deviation from the original general appropriations act shall not be made
without amending the general appropriations act,
WHEREAS, the legislative body of the local unit shall amend the general appropriations act as soon as it becomes
apparent that a deviation from the original general appropriations act is necessary and the amount of the deviation can be
determined,
WHEREAS, an amendment shall indicate each intended alteration in the purpose of each appropriation item affected by
the amendment,
WHEREAS, if during a fiscal year it appears that the actual and probable revenues from taxes and other sources in a fund
are less than estimated revenues, amendments to the revenue appropriations shall be recommended to meet sufficient
balance in the general appropriations act,

The township adopts by reference the "Water Supply Cross Connection Rules of the Michigan
Department of Public Health" Michigan Department of Environmental Quality being R 325.11401 to R
325.1124078 of the Michigan Administrative Code.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to
them in this section, except where the context clearly indicates a different meaning:

Department means the township utilities departmentDepartment of Utilities and Municipal Services and
the township Bbuilding and zoning Ddepartment, acting singularly and jointly as one department.

This article shall be enforced by the department. The township board by resolution shall designate those
persons within the department who are authorized to enforce this article and issue and serve
appearance ticketsmunicipal civil infraction citations for violations of this article.

(a) The following premises which are provided water service by a public or private water system, upon
which exist or proposed to exist any of the following systems or conditions, are subject to this article:

(10) Any premises where contamination exists, or conditions exist, or are substantially likely to
occur, which are, or reasonably likely to pose, a threat to the public water supply, being injurious to
the public health, safety and welfare.

(b) Except as provided in subsection (a)(10) of this section, the following premises are not subject to
this article:

(1) Any premises that contains only structures not exceeding two stories in height and utilizes
only such plumbing fixtures as drinking fountains, lavatories, water closets and urinals, or
appliances such as residential dishwashers or residential clothes washing machines.

(2) A boiler, at a residential structure, serving less than six dwelling units, which utilizes no
chemical treatment. All properties served by the public water supply are subject to provisions of
this article including, but not limited to, Residential, Commercial and Governmental.

When the department is notified, or has reasonable cause to believe, that contamination or alleged
contamination of potable water may exist at any premises, the department is authorized to enter any
premises within the corporate limits of the township for purposes of investigation and shall take
necessary or proper action to protect the public health, safety and welfare. The department shall cause
inspections to be made of all properties served by the public water supply where cross connections with
the public water supply are deemed possible. The frequency of inspections and re- inspections based
on potential health hazards involved shall be as established by the township utilities department and as
approved by the state dDepartment of public health. Environmental Quality. The department shall have
the right to enter at any reasonable time any property served by a connection to the public water supply
system of the township for the purpose of inspecting the piping system for cross connections. On
request, the owners, lessees or occupants of any property so served shall furnish to the department any
pertinent information regarding the piping system on such property. The refusal of access, when
requested, shall be deemed evidence of the presence of cross connections.

(a) Site plan review. The township clerk shall notify the township utilities department of all matters
before the township planning commission and township zoning board of appeals that pertain to
premises being subject to this article. The department may review all applications and plans submitted
to the planning commission or zoning board of appeals and submit a written report to the respective

(b) Building and plumbing permits; certificate of occupancy. The department shall review all
applications for building and/or plumbing permits for construction, repair or alteration to assure that the
application is in compliance with this article. The department shall not issue a building or plumbing
permit in violation of this article, nor shall a certificate of occupancy be granted until a certificate of
compliance, as provided for in subsection (e) of this section, has been issued.

(c) Plans, specification, information. The department may require an applicant for site plan review,
variance, building or plumbing permit to provide complete sets of plans and specifications of the piping,
devices, equipment, building and uses that may be necessary or proper to determine the applicant's
compliance with this article.

(d) Authority to conduct tests. Prior to the issuance of a certificate of compliance, the department is
authorized to conduct, or cause to be conducted, or require an owner to have conducted, any tests of
any new or existing piping, arrangement, device, equipment, facility or appurtenances the retention of
which the department has reason to believe may result in contamination of potable water, or when the
department has reason to believe that there is evidence that cross connections do not meet the
limitations prescribed in this article, or at a prescribed frequency to ensure proper functioning of
protective devices or methods. Tests shall be conducted by persons certified by an organization
approved by the department. A full written record of test conditions, of test methods, and of test results
obtained by the department, or by others, shall be maintained by the department and made available for
review by the owner.

(1) Test facilities and access. It shall be the responsibility of the owner of the operation tested to
provide, at his expense, reasonable and necessary openings in the piping system, appurtenances,
equipment or facilities, and safe and easy access to the system, to permit technically valid
measurements and samples to be taken. All new piping equipment or facilities that provide
potential for cross connection may be required by the department to provide adequate openings in
the piping system, appurtenances, equipment or facilities, and safe and easy access to the
system, to permit technically valid measurements and samples to be taken. If a person refuses to
supply test openings, access scaffolding, and other pertinent facilities requested for the purpose of
conducting valid hydraulic tests by the department, the department shall notify such person to
show cause before the department on a day certain, not less than ten nor more than 20 days from
the date of the notice, why piping or appurtenances, equipment or facilities should not be sealed.

(2) Sampling. The department is authorized to sample or cause to be sampled water or other
fluid flowing in, or having potential for flowing in, any piping system subject to this article.

(e) Certificate of compliance. Upon completion of the work authorized by an issued building or
plumbing permit for work and premises being subject to this article, the department shall issue a
certificate of compliance, which certificate shall state that the premises are in compliance with this
article. The owner or person responsible for the new, expanded or altered piping systems, devices,

secondary water supply on the premises, or that the owner is operating the piping system in a manner

risk because of complexity of the piping systems, the department shall require the owner, at the owner's

water shall be uniformly painted a distinguishing bright blue color and so maintained that each

painted brown. In instances where these colors conflict with established systems of painting in a
particular establishment, the department may allow the use of other colors of equal brightness and
distinction, provided that the alternative color code is submitted to and accepted by the
department prior to painting of the pipe. Any color code shall be posted on the premises at
locations approved by the department.

brown paint are used at intervals of not more than 25 feet and at points where exposed piping

of permanently attached durable sign or tag of acceptable design on each piece of pipe in each line not

of public health or meeting the requirements of the American Society of Sanitary Engineering or of other
professional or testing organization.

(b) Accessibility. The backflow prevention device shall be located in a well-drained area of sufficient
size, not less than eight feet in height, to permit a person to have convenient access for inspection,
testing and repair purposes. Installation of the device below grade or in a meter pit is not acceptable

installed on the supply line within five feet of the point of entry to the structure within the same room.

(c) Maintenance and re-inspection. All devices installed in a potable water system for protection
against backflow shall be maintained in good working condition by the owner or his agent. The
department may inspect such installed devices and if found to be defective or inoperative shall require

without the approval of the department.

(d) Testing of Backflow Prevention Assemblies. All testable backflow prevention assemblies shall be
tested initially upon installation to be ensure that the assembly is working properly. Subsequent testing
of assemblies shall be on an annual basis as required by the Township and in accordance with
Michigan Department of Environmental Quality requirements. Only individuals that are registered
approved by the Township and State of Michigan certified shall be qualified to perform such testing.
That individual(s) shall certify the results of his/her testing.

department. For closed vessels, e.g., pressure sterilizers, etc., the top of the device shall be
treated as the flood level rim, but in addition, a check valve shall be installed on the discharge side

may be installed so that they are continuously subject to static line pressure, i.e., a valve may be
installed downstream from the vacuum breaker. Pressure vacuum breakers shall be installed a

(3) Installation of check valves. All required check valves, including those which are spring
loaded, shall be installed so that the force of gravity will assist in closing and holding the disc or
clapper on the seat. No check valves shall be installed in the vertical position on downfeed supply

piping. Horizontal lift check valves should only be installed in the horizontal position. If horizontal
swing check valves are installed in vertical piping, the direction of normal flow shall be up, and
there shall be internal evidence of a hinge pin to establish the type of check valve.

(fg) Safe air gaps. Safe air gaps shall be maintained between the water supply inlet and the maximum
overflow level of any fixture, tank or container. Safe air gaps shall be determined as follows:

supply system in violation of any provision of this article.

arrangement, construction, devices, facilities and equipment set forth in such approved plans and

authorized shall be deemed a violation of this article and punishable as provided by subsection (e)
and/or (f) of this section.

(c) Notice of violation. Except as provided for in subsection (c)(1), the department shall serve a notice
of violation on the owner of the premises or person responsible for the violation of a detailed statement
or a plan approved under this article. Such notice shall direct the discontinuance of the illegal action or
condition and the abatement of the violation.

(1) Exception, notice of violation, immediate danger. Where the department has reasonable
cause to suspect that a condition exists that poses an immediate threat of contamination to the
potable water supply system, the department need not provide notice of violation as provided by
this subsection but may take such action as provided by law to protect the health, safety and

(2) Termination of water service. After notice of violation, the violator shall have seven business
days from date of mailing, excluding Saturday, Sunday and legal holidays, to contact the
department issuing the notice of violation. If the violator fails, refuses, neglects or for any reason
does not contact the department, the department shall, by registered mail, send a notice of
termination of service directed to the last known address of the violator or post notice on or near
the premises at which the violations have occurred. If the violation continues seven business days
after mailing of notice of termination, excluding Saturday, Sunday and legal holidays,, the
department may terminate water service to that portion of the violator's premises in violation of this
article, or terminate water service to the entire premises if necessary to prevent potential
contamination from reaching the water utility's water lines. It shall be unlawful for any person to
resume water service to such premises unless authorized in writing by the department to do so.

(d) Prosecution of violation. If the notice of violation is not complied with promptly, or an immediate
threat of contamination to the potable water supply system exists, the department shall request the legal
counsel of the jurisdiction to institute the appropriate proceeding at law or in equity to restrain, correct or
abate such violation or to require the removal or termination of the unlawful use of the building or
structure in violation of the provisions of this article or of the order or direction made pursuant to this
article.

(e) Violation penalties. Any person who shall violate a provision of this article, or code adopted in this
article, or shall fail to comply with any of the requirements of this article, or who shall erect, construct,
alter or repair a building or structure in violation of an approved plan or directive of the department, or of
a permit or certificate issued under the provisions of this article shall be responsible for a municipal civil
infractionguilty of a misdemeanor, punishable in accordance with section 2-241 and all equitable relief
available by statute1-13. Each day that a violation continues shall be deemed a separate offense.

Abatement of violation. The imposition of the penalties prescribed in this section shall not preclude
the township attorney from instituting appropriate action to prevent unlawful construction or to restrain,

Two armed men held up a payday loan and check cashing business on Washtenaw Avenue in Pittsfield Township Friday evening,
fleeing with cash and employees cellphones, Pittsfield Township police said.
The men entered the business, near the intersection of Washtenaw and Golfside Drive, and ordered the employees to the floor, said
Pittsfield Township Deputy Police Chief Gordy Schick. No one was injured.
The robbers were last seen fleeing west from the business on foot, Schick said. Ypsilanti police responded with a dog to attempt to track
the suspects, two black men wearing all black.
The robbery occurred shortly after 5 p.m. No further information was immediately available.

The Pittsfield Township Department of Public Safety is advising area residents to be cautious of text message scams,
including a recent trend of messages offering free gift cards.
The advisory presents a scenario in which a text message is received claiming the recipient won a gift card to a major
retailer like Best Buy, Target or Walmart.
Typically the scam message offer instructions to go to a website and enter a PIN to get the card, according to the
Department of Public Safety.
The website link will direct the recipient to a scam website that will look authentic, such as a scam for a Best Buy gift
card linking to a website that uses Best Buy's proper company colors and logo from its' actual website.
Police advise resident to ignore instructions in the message to text STOP or NO to prevent further messages, as
scammers can use this ploy to confirm they found an active phone number. Texts can be forwarded to 7726, which
spells spam on most number pads. This alerts the cell phone service to block further texts from the sender's number.
The advisory message states: "As always, if you think getting a free $1,000 gift card seems too good to be true, it
probably is."
Another type of text message scam is a type of phishing where the recipient is asked to provide sensitive personal or
financial information from a sender claiming to be a business like a cell phone company, according to the Department of
Public Safety. Police say cell phone providers will not ask customers to verify sensitive personal information in an
unsolicited text message.

The developers of Centennial Park and Centennial Farms in Pittsfield Township are seeking to donate nearly 50 acres of park land
to the township.
Wexford-Centennial VI, along with another company, informed Township Supervisor Mandy Grewal that it wants to donate the
land known as the Centennial Commons.
Craig Welch, a representative for Wexford, wrote that the developers have spent more than $100,000 on improvements to courts,
fields, playground equipment and parking facilities, which will also be included in the transfer.
The land is located along the southern portion of Textile Road between State Road and Lohr Road.
"We have discussed this donation with the homeowner boards of both the Park and the Farms," Welch wrote. "They were both
wholly supportive. In addition, they have surveyed their owners and they too responded with overwhelming support."
The original park covenants allow the developers to reserve the right to grant the parklands to the township for use as a public park
for the use by all township residents.
If approved by the board of trustees, the supervisor and clerk are authorized to negotiate and approve any necessary agreements
and documents at a cost not to exceed $50,000, according to the documents.
The trustees will vote on the transfer agreement at 6:30 p.m., Wednesday during their next meeting at the Pittsfield Township

A suspect in an strong-arm robbery early Sunday remains at large after fleeing police during a traffic stop and assaulting a Pittsfield
Township resident.
Police in Pittsfield Township said they were assisting deputies from the Washtenaw County Sheriff's Office during a traffic stop around 4
a.m. Sunday on Textile Road near Ann Arbor-Saline Road when the suspect fled on foot.
Officers from Pittsfield, the Michigan State Police and Ypsilanti's and Ann Arbor's K-9 unit all worked to try and track down the suspect.
Two residents of the same Pittsfield Township subdivision told police they came in contact with a person matching the suspect's
description.
The first, a homeowner who lives on Crooked Stick Court, said the suspect knocked on his door and had asked to use a phone but was
refused assistance.
Later, a resident on the 1700 block of Inverness Court called to tell police a subject matching the same description had been at his home.
The resident told police he gave a the man, who was barefoot, a pair of boots before the man assaulted him and left on foot with his
phone.
Police said the resident sustained no injuries from the assault.
The suspect is described as a thin black man in his early 20s, 5-foot-8 with curly hair that was covered in burrs at last sighting. K-9

A woman was hit by a vehicle Friday evening while she was trying to cross Carpenter Road south of Washtenaw
Avenue in Pittsfield Township.
The 23-year-old Tecumseh woman died from injuries she suffered when struck by a southbound vehicle, according to
the Pittsfield Township Department of Public Safety.
She was hit at about 9:33 p.m. Friday.
The driver of the vehicle involved was not injured.

Meijer outlot development: 3 national restaurants could open on Ann Arbor-Saline Road

A Southfield-based real estate company is under contract to purchase the Meijer outlot properties on Ann
Arbor-Saline Road.

A Southfield-based real estate firm is under contract to purchase the Meijer (http://www.meijer.com/) outlot property on Ann ArborSaline Road, which could pave the way for a major development project.
Versa Development (http://www.versacos.com/) plans to purchase the properties fronting Meijer from the Grand Rapids-based
grocery store chain, according to Meijer real estate manager Roger DeHoek.
Several parcels fronting the Pittsfield Township store were put on the market last year (http://www.annarbor.com/businessreview/meijer-hopes-to-sell-outlot-properties-at-ann-arbor-saline-road-for-development/), after the township completed a redesign of
its master plan. The redesign favors mixed-use development at the site off Ann Arbor-Saline Road, said Pittsfield Township
Supervisor Mandy Grewal.
"The vision we have in the township(is to) increase density through infill development, and our hope is to partner with existing
developments to sort of promote that vision," Grewal said. "(This project) fits with that vision."
Michael Lippitt of Landmark Commercial (http://www.landmarkcres.com/), the broker who is marketing the outlot properties for
lease, said development plans would include constructing three full-service restaurants and two retail/fast casual restaurant
buildings.
If all goes according to plan, we could have a couple (leases) signed by the end of January, Lippitt said.
A berm currently separates the Meijer parking lot and Ann Arbor-Saline Road, which extends from Oak Valley Drive to Lohr Road. A
total of five buildings would be constructed along that stretch of land.

Lippitt said family-style restaurant chains would occupy three of the buildings, although he declined to reveal any possible tenants.
Versa marketing materials list Cheddars (http://www.cheddars.com/), Longhorn Steakhouse
(http://www.longhornsteakhouse.com/) and Bonefish Grill (http://www.bonefishgrill.com/), but Lippitt said the materials are outdated
and just examples of the types of tenants that could open.
We have commitments on all three of the restaurant buildings, he said. It could be some of those (tenants), but not all of those.
He added: The intention is that all three will be of national caliber. We have strong interest levels, so were confident thats what will
happen.
In addition to the restaurants, two 6,000-square-foot retail buildings would be constructed for fast casual restaurants, retail or
professional use. Lippitt said tenants such as a sandwich or coffee shop, and medical or professional office could open in those
buildings.
We have a variety of letters of intent on those as well, he said.
If plans are approved by Pittsfield Township, Lippitt said the project could break ground in spring 2013 and open in spring 2014.
The Ann Arbor-Saline and Lohr Road intersection is one of the most highly trafficked in the area. It leads to the Target
(http://www.target.com/) shopping center on the west side of Ann Arbor-Saline and a shopping complex with Best Buy
(http://www.bestbuy.com/), Kohls (http://www.kohls.com/), Big Lots (http://www.biglots.com/) and Dicks Sporting Goods
(http://www.dickssportinggoods.com/home/index.jsp)on the east side.
Just across the street from Meijer, developers have targeted a vacant plot of land (http://www.annarbor.com/business-review/owners
-of-target-shopping-center-on-ann-arbor-saline-reveal-long-term-redevelopment-plans/) behind Chuck E. Cheeses
(http://www.chuckecheese.com/) for a multi-family residential project. The owners of the Target shopping center intend to build an
apartment complex and eventually redevelop the shopping center.
Grewal said the township is in discussions with the Washtenaw County Road Commission to look at the traffic impact of both
developments off Ann Arbor-Saline Road and how to best ease traffic congestion in the area.

A thief or thieves smashed a glass door and stole an undisclosed amount of merchandise from the Sprint store at 4039 Carpenter
Road in Pittsfield Township early Wednesday morning.
Police were dispatched at 4:48 a.m. to Arbor Plaza for an alarm and discovered the front glass entrance door was smashed.
There were no suspects in the store when officers checked, according to a release from the Pittsfield Township Department of
Public Safety, but items were missing from the store.
The incident remains under investigation. Anyone having witnessed the incident is asked to contact the Pittsfield Township
Department of Public Safety at (734) 822-4911.

been no homicides this year to date, and one (1) for last year.
One (1) forcible sex offenses (CSC) occurred this December compared to three (3) last
December. Overall, year to date (YTD), CSCs have decreased 10% compared to the same period
last year (18 this year compared to 20 last year).
~ Three robberies occurred this December compared to three last December. YTD, robberies
showed no change from the same period last year (21 robberies this year compared to 21
robberies last year).
Assaults decreased 44.1% this December (19 incidents) compared to last December (34
incidents). YTD statistics reflect a decrease of 28.2% this year from last year (251 this year
compared to 350 last year).
Burglary/Home Invasion showed an increase of 25% this December (10 incidents) compared to
last December (8 incidents). YTD, there has been an overall increase of 20.4% this year from
last year (171 this year compared to 142 last year).
)..- Larceny incidents decreased 30.2% this December (30 incidents) compared to last December (43
incidents). YTD, there l1as been an overall decrease of 18.1% (405 this year compared to 495
last year).
Motor vehicle theft showed a decrease of 40% this December (3 incidents) compared to last
December (5 incidents). YTD, there has been an decrease of 8.7% in the number of motor
vehicle thefts (63 this year compared to 69 last year).
;.. Malicious damage to property showed a decrease of 21.4% this December (11 incidents)
compared to last December (14 incidents). YTD, there has been an overall decrease of 24.4%
( 180 this year compared to 238 last year).

Position Summary:
Under the direction and supervision of the Deputy Clerk, coordinates all routine and complex
clerical and administrative tasks related to departmental functions. Responsible for timely and
accurate processing of all Freedom of Information Act (FOIA) requests and Industrial Facility
Tax (IFT) Abatement applications received by the Township. Performs other related duties as
assigned. Maintains confidentiality of sensitive or personal information, in accordance with
Township policy.
Essential Job Functions:
An employee in this position may be called upon to do any or all of the following essential
functions. To perform this job successfully, an individual must be able to perform each essential
function satisfactorily with a high level of proficiency as well as independent judgment.
Oversees and coordinates Election Specialist and Department Assistant II in areas relating
to workload efficiency and accuracy.
o Ensure timely and efficient compliance with department workflows.
o Coordinate special projects under the jurisdiction of the Clerks Office as needed;
compiles information for special projects as assigned.
o Provide written and verbal reports on performance metrics as it relates to efficiency and
accuracy of workload; work with Deputy Clerk to modify work flow and seek out and
initiate appropriate training opportunities for staff as identified from performance metrics.
Oversee and complete all aspects of Freedom of Information Act (FOIA) requests through to
completion
o Primary contact in receipt of all FOIA requests
o Route FOIA requests to appropriate Departments. Work with Township Attorney to
insure compliance with statutes
o Gather information in appropriate format (as requested)
o Correspondence with Requestor; addresses questions from staff & requestor
o Logging of all transactions related to FOIA

This contract begins January 1, 2011 and ends on December 31, 2012. The
parties agree that the County shall have the option to extend this contract by an
additional year, The County shall exercise its option by giving Contractor written notice
of its election prior to the end of the initial contract term.
ARTICLE IV- INDEMNIFICATION AGREEMENT
Only to the extent allowed by law, Township and County will protect, defend
and indemnify each other, their officers, agents, servants, volunteers and employees
from any and all liabilities, claims, liens, fines, demands and costs, including legal fees,
of whatsoever kind and nature which may result in injury or death to any persons,
including the their own employees, and for loss or damage to any property, including
property owned or in the care, custody or control of Washtenaw County in connection
with or in any way incident to or arising out of the occupancy, use, service, operations,
performance or non-performance of work in connection with this contract resulting in
whole or in part from negligent acts or omissions of the respective party, any
sub-contractor, or any employee, agent or representative of the party or any
sub-contractor.

Pittsfield Charter Township Water and Sewer Ordinance, Ord. # 12-300, Revisions to Chapter 36 Utilities,

BACKGROUND: In accordance to the requirements set forth by the Michigan Department of
Environmental Quality (MDEQ), Pittsfield Charter Township (the Township) has adopted in the past the
state of Michigan Cross Connection Rules to protect the public water supply system. However, from time
to time, as changes occur, amendments are required to be in compliance with MDEQ regulations.
A cross connection is defined as a connection or arrangement of piping or appurtenances through which
a backflow could occur. Backflow is defined as the undesirable reversal of flow of water of questionable
quality, wastes or other contaminants into a public water supply. The purpose of this program is to avoid
contamination of the public water supply by preventing and eliminating cross connections. It is the
Townships intent to carry out a comprehensive and effective Cross Connection Control Program (CCCP)
to ensure public health is protected and the requirements of the Michigan Safe Drinking Water Act are
complied with.

This email is to confirm our recent telephone conversation pertaining to what types of accounts are
expected to have cross connection inspections performed and what actions should be taken when a
building or facility owner does not comply with corrective actions requested by the public water
supply.
The Michigan Plumbing Code expressly prohibits Cross Connections except where approved
protective devices are installed. The Safe Drinking Water Act and Administrative Rules pertaining to
Cross Connections are found in Part 14 of the Michigan Safe Drinking Water Act, 1976 PA 399, as
amended (Act 399). Rule 1404 (1) states: a water utility shall develop a comprehensive program for
the elimination and prevention of all cross connections. Rule 1404(2)(b) states: A time schedule for
inspection and reinspection of all water utility customers' premises for possible cross
connections. The periodic reinspection shall be to ascertain if safe air gaps or required backflow
preventers are in place. This implies that all buildings connected to a public water system must be
inspected and periodically re-inspected for cross connections. This includes, but not limited too;
businesses, schools, commercial, industrial, municipal and residential buildings (homes).
Furthermore, regarding what actions a water utility should take if a building owner does not comply
with the utilities requirement to remove or eliminate a cross connection by installing an air gap or
backflow preventer; Administrative Rule 1405 (2) of Act 399 states: The total time allowed for
completion of the necessary corrections shall be contingent upon the degree of hazard involved and
include the time required to obtain and install equipment. If the cross connection has not been
removed, after a reasonable period of time, the water utility shall physically separate the public water
supply from the onsite piping system in a manner that the 2 systems cannot again be connected by
any unauthorized person. The DEQ believes that the termination of water service should only be
done as a method of last resort. However, after repeated unsuccessful attempts to have building
owners to remove or eliminate a cross connection, the public water system has no choice but to
terminate service.
Please keep in mind that if a utility is aware that a cross connection exists and does not take the
proper actions to remove it and a backflow event occurs, they leave themselves open to not only

enforcement actions from the DEQ but liability claims from others that may have been harmed from
the backflow event as well.

Community Water System Approach to Residential Cross Connection Control
History
To best implement the new requirements for community water systems to have a program to
eliminate and prevent cross connections in the 1970's, the State of Michigan encouraged
communities to focus their efforts primarily on water customers which posed the highest risk.
This led to communities targeting commercial and industrial customers. Water systems that
made good progress protecting the potable system from the high risk customers were generally
regarded as doing a good job in cross connection control by the state. Residential customers
were not thought to pose as high of a hazard as non-residential customers.
Current Status
Most community water supplies now have an active cross connection control program (CCCP)
that has been in place nearly as long as the Michigan Safe Drinking Water Act. The status of
individual programs tends to fluctuate over the years depending on CCCP personnel, managerial
support, economics, etc. Although hard numbers are difficult to ascertain, it's believed that the
majority of communities do a satisfactory job controlling cross connections at commercial and
industrial accounts. There are also several communities that do not. Again, although hard
numbers are difficult to ascertain, there appears to be very few communities statewide that are
effectively eliminating and preventing cross connections at residential accounts.
Current Problem & Why Action is Needed
With regard to implementing residential cross connection control, there are two problems with the
status quo. First, the water systems with good CCCPs are in a better position to include
residential accounts as part of their overall CCCP. Therefore, the natural tendency of the DEQ is
to encourage these supplies to expand their programs to pick up residential accounts. As a result
of doing a good job, they are being asked to do more. While the systems that are not keeping up
with the most critical accounts, are currently not being asked by DEQ staff to pick up the
residential accounts. Rather, DEQ efforts are focused on directing these communities to
implement the program at the accounts already on their list to inspect. That sends the improper
message that a community does not have to incorporate residential accounts into their CCCPs if
they do a poor job on their commercial and industrial accounts. The second problem is even if a
water supply endeavors to take on the residential sector, the DEQ does not currently have a good
model for what a residential program should consist of. While the department recognizes that
each community will have a unique approach based on their unique needs, a model is needed for
those communities seeking guidance on how to best implement their program. Of the few
communities that have started some form of a residential cross connection control program, the
scope varies. For example, some are using service line containment, some are simply requiring
assembly testing, and others are doing full inspections.
Since the arrival of Act 399, many new residential water uses (water assisted sump pumps, snow
melt systems, automatic lawn fertilizing systems, solar panels, etc.) have been introduced that
arguably elevate the level of risk a residential account could pose. Although, one can argue that
improvements to the Ml Plumbing Code have contributed to safer water connections, required
plumbing permits are not always applied for, especially in the residential setting.
In addition, over the past few years the DEQ has been making a concerted effort to require small
Type I systems (manufactured home communities, apartment complexes, condominium
associations, etc.) which are predominately residential and privately owned, to have an approved
written program and submit annual report forms of their cross connection control efforts*.

supplies (regardless of size) except for licensed facilities which were specifically excluded. The December
2009 rule changes only remove the exemption for licensed facilities.

premises within the corporate limits of the township for purposes of investigation and shall take
necessary or proper action to protect the public health, safety and welfare. The department shall cause
inspections to be made of all properties served by the public water supply where cross connections with
the public water supply are deemed possible. The frequency of inspections and re- inspections based
on potential health hazards involved shall be as established by the township utilities department and as
approved by the state Department of Environmental Quality. The department shall have the right to
enter at any reasonable time any property served by a connection to the public water supply system of
the township for the purpose of inspecting the piping system for cross connections. On request, the
owners, lessees or occupants of any property so served shall furnish to the department any pertinent
information regarding the piping system on such property. The refusal of access, when requested, shall
be deemed evidence of the presence of cross connections.
Sec. 36-156. - Certificate of compliance.
(a) Site plan review. The township clerk shall notify the township utilities department of all matters
before the township planning commission and township zoning board of appeals that pertain to
premises being subject to this article. The department may review all applications and plans submitted
to the planning commission or zoning board of appeals and submit a written report to the respective
body, a copy of which shall be mailed or hand delivered to the applicant, concerning violations or
requirements of this article.
(b) Building and plumbing permits; certificate of occupancy. The department shall review all
applications for building and/or plumbing permits for construction, repair or alteration to assure that the
application is in compliance with this article. The department shall not issue a building or plumbing
permit in violation of this article, nor shall a certificate of occupancy be granted until a certificate of
compliance, as provided for in subsection (e) of this section, has been issued.
(c) Plans, specification, information. The department may require an applicant for site plan review,
variance, building or plumbing permit to provide complete sets of plans and specifications of the piping,
devices, equipment, building and uses that may be necessary or proper to determine the applicant's
compliance with this article.
(d) Authority to conduct tests. Prior to the issuance of a certificate of compliance, the department is
authorized to conduct, or cause to be conducted, or require an owner to have conducted, any tests of
any new or existing piping, arrangement, device, equipment, facility or appurtenances the retention of
which the department has reason to believe may result in contamination of potable water, or when the
department has reason to believe that there is evidence that cross connections do not meet the
limitations prescribed in this article, or at a prescribed frequency to ensure proper functioning of
protective devices or methods. Tests shall be conducted by persons certified by an organization
approved by the department. A full written record of test conditions, of test methods, and of test results
obtained by the department, or by others, shall be maintained by the department and made available
for review by the owner.
(1) Test facilities and access. It shall be the responsibility of the owner of the operation tested to
provide, at his expense, reasonable and necessary openings in the piping system, appurtenances,
equipment or facilities, and safe and easy access to the system, to permit technically valid
measurements and samples to be taken. All new piping equipment or facilities that provide
potential for cross connection may be required by the department to provide adequate openings in
the piping system, appurtenances, equipment or facilities, and safe and easy access to the
system, to permit technically valid measurements and samples to be taken. If a person refuses to

supply test openings, access scaffolding, and other pertinent facilities requested for the purpose of
conducting valid hydraulic tests by the department, the department shall notify such person to
show cause before the department on a day certain, not less than ten nor more than 20 days from
the date of the notice, why piping or appurtenances, equipment or facilities should not be sealed.
(2) Sampling. The department is authorized to sample or cause to be sampled water or other
fluid flowing in, or having potential for flowing in, any piping system subject to this article.
(e) Certificate of compliance. Upon completion of the work authorized by an issued building or
plumbing permit for work and premises being subject to this article, the department shall issue a
certificate of compliance, which certificate shall state that the premises are in compliance with this
article. The owner or person responsible for the new, expanded or altered piping systems, devices,
equipment or facility shall notify the department when the work is completed and ready for final
inspection, which inspection shall be made promptly after such notification.
Sec. 36-157. - Survey.
The township Department of Utilities and Municipal Services shall identify all premises subject to this
article, classify each premise according to degree of hazard to the potable water system, initiate
inspections based on the health hazard potential and issue certificates of compliance in accordance
with section 36-156.
Sec. 36-158. - Periodic inspection.
The township utilities department shall cause to be made periodic inspections of all premises and
facilities subject to this article. The frequency of inspections and re-inspections shall be based on the
potential health hazards as established by resolution of the township board.
Sec. 36-159. - Prohibitions and technical requirements.
(a) Cross connections prohibited. Cross connections between potable water systems and other
systems or equipment are prohibited. A secondary water supply shall not be connected to the premises'
potable water distribution piping without the approval of the department.
(b) Service connections. The township utilities department is prohibited from installing and/or
maintaining a water service connection to a person's premises where a cross connection or secondary
water supply is maintained contrary to the provisions of this article, unless the public potable water
supply is protected against backflow by installing an approved backflow prevention device or method at
the service connection.
(c) Risk of contamination. When the department determines that there is a cross connection or a
secondary water supply on the premises, or that the owner is operating the piping system in a manner
that could adversely affect the public system, or when the department determines that there are
frequent changes to the piping and related equipment, or the department determines that there is
undue risk because of complexity of the piping systems, the department shall require the owner, at the
owner's expense, to:
(1)
Install an approved backflow prevention device at each service connection to his premises;
(2) Install an approved backflow prevention device annually or more often when deemed
necessary; and

(3) Properly repair and maintain such devices and keep adequate records of each test and
subsequent maintenance and repair, including materials or replacement parts.
(d) Location of backflow prevention device. No connection shall be made to the service line between
the meter and the backflow prevention device, except for the meter bypass line connection. If a bypass
around the backflow prevention device is installed, a similar backflow prevention device shall be
installed on the bypass. If the service is unmetered, the backflow prevention device shall be installed
near the property line upstream from the first outlet or branch connection.
Sec. 36-160. - Piping systems identification.
(a)
Color code.
(1) In every instance where multiple piping systems exist, all exposed piping carrying potable
water shall be uniformly painted a distinguishing bright blue color and so maintained that each
pipe may be readily traced in its entirety by such color. All lines that carry secondary water shall
be painted brown. In instances where these colors conflict with established systems of painting in
a particular establishment, the department may allow the use of other colors of equal brightness
and distinction, provided that the alternative color code is submitted to and accepted by the
department prior to painting of the pipe. Any color code shall be posted on the premises at
locations approved by the department.
(2) Color coding requirements will be deemed to have been met if three-inch bands of blue or
brown paint are used at intervals of not more than 25 feet and at points where exposed piping
passes through walls, floors or roofs. The bands shall be applied to the piping on both sides of the
walls and both above and below the floor or roof.
(b) Signs or tags. Where maintenance of color coding is impossible, the department may permit use
of permanently attached durable sign or tag of acceptable design on each piece of pipe in each line not
to exceed 25 feet between signs or tags, and at each valve. The following are acceptable designs:
(1) Secondary water may be indicated by use of a durable tag in the shape of a four-inch
equilateral triangle bearing the legend "Water Unsafe" in letters not less than 7/16 inch in height.
(2) Potable water may be indicated by use of a durable circular tag of three-inch diameter
bearing the legend "Safe Water" in letters not less than one-half inch in height.
(c) Posting of secondary water supplies. All openings from which secondary water may be obtained
shall have at all times a sign prominently posted within two feet of the opening bearing the following
warning:

Such sign shall be at least eight inches by ten inches in size, prominently lettered in contrasting colors,
with no letters less than one inch in height. Signs are to be furnished and maintained by the owner of
the secondary supply and must be of materials and design acceptable to the department.

(d) Testing of Backflow Prevention Assemblies. All testable backflow prevention assemblies shall be
tested initially upon installation to ensure that the assembly is working properly. Subsequent testing of
assemblies shall be on an annual basis as required by the Township and in accordance with Michigan
Department of Environmental Quality requirements. Only individuals that are registered approved by
the Township and State of Michigan certified shall be qualified to perform such testing. That
individual(s) shall certify the results of his/her testing.
(e) Acceptable backflow prevention devices. Backflow prevention devices shall be accepted in
accordance with the Michigan Plumbing Code and Department of Environmental Quality Cross
Connection Rules Manual. Where there is a conflict, the more stringent requirement shall apply.
(f) Installation requirements. Backflow prevention assemblies, devices and methods shall be installed
in accordance with the requirements of the Michigan Plumbing Code and Department of environmental
Quality Cross Connection Control Rules Manual.
(g) Safe air gaps. Safe air gaps shall be maintained between the water supply inlet and the maximum
overflow level of any fixture, tank or container. Safe air gaps shall be determined as follows:
(1) Circular openings. Circular water supply inlet openings shall have an air gap equivalent to
twice the diameter of the orifice, but not less than one inch and need not be more than 12 inches.
(2) Other openings. For water supply openings other than circular, the air gap shall be 2 times
the square root of the area of the opening; or in equation form:
G = 2D for circular openings
G = 2 for other openings
(3) Exceptions. On opening greater than four-inch diameter or of equivalent area if the opening
is other than circular, the department shall be consulted for minimum air gaps.
(g) Overflow protection for air gaps and vacuum breakers. Air gaps and vacuum breakers shall be
installed above the spill line of the fixture or device; or positive spill openings to the outside of the flush
tank device.
(h) Installation of reduced pressure principle backflow preventers. A reduced pressure principle
backflow preventer shall be installed above grade or at an elevation not subject to flooding, inside a
heater structure to prevent freezing, in a horizontal position, and otherwise in accord with the
manufacturer's instructions.
(i) Lawn irrigation systems. Lawn sprinkler systems shall be equipped with a vacuum breaker on the
discharge side of each of the last valves.
(1) Manifold systems. If a lawn sprinkler system is installed so different areas sprinkled are each
controlled by a valve on the discharge side of the main control valve on the main distribution
branch to the entire lawn sprinkling system, the system shall be protected by one of the following
methods:
a. Area controls. An acceptable vacuum breaker may be installed on the discharge side of
each area control valve.

b. Multiport zone control valves. Where the supply of water to the various zones is
controlled by an acceptable automatic multiport zone control valve, at least one port of which
is always open, an acceptable vacuum breaker may be installed downstream from the main
control valve and upstream from the multiport valve.
c. Backflow preventer. A reduced pressure principle backflow preventer may be installed
on the main distribution branch to the sprinkler system in close proximity to the main control
valve.
d. Pressure type vacuum breaker. An acceptable pressure type vacuum breaker may be
installed between the main control valve and the zone control valves.
e. Other systems of protection. If it is proposed to protect the water supply to a zoned
sprinkling system by a method other than one of those set forth in subsection (i)(1)a.d. of
this section, complete mechanical and topographical plans of the proposed installation shall
be submitted to the department, before the work is done, for examination to determine the
acceptability of the installation from the standpoint of protection of the water supply and from
the standpoint of potential nuisances.

(3) Signs are to be furnished and maintained by the owner and must be of materials and design
acceptable to the department.
(4) In the supply line to each antifreeze system, there shall be a U loop provided in the supply
piping. The down leg (supply side) of the U loop shall drop at least 1.25 times the amount of rise of
the up leg of the U. The minimum length of the down leg shall be four feet. Refer to National Fire
Protection Association Standards, N.F.P.A. #13, as may be revised, for further details.
(5) Where a system using an antifreeze solution approved by the department is connected to the
potable water system, a reduced pressure principal backflow preventer assembly incorporating
outside screw and yoke valves shall be provided in the branch serving the antifreeze system and
above the highest point in the line containing antifreeze solution.
(6) Where a system using an antifreeze solution approved by the department is connected to a
separate fire protection system, a single check valve and outside screw yoke valve in the supply
branch to the antifreeze system shall suffice when the primary fire system is protected with a
reduced pressure principal backflow preventer.
(7) When requested in writing by an owner, the department may permit use of antifreeze
solutions not approved by the department, provided a reduced pressure principle backflow
preventer is installed at the connection to the potable water system.
Sec. 36-166. - Plumbing code.
The potable water supply provisions of the Michigan Plumbing Code are incorporated in this article. In
case of conflicts between the plumbing code and this article, the more stringent of the two shall apply.
Sec. 36-167. - Violations.
(a) Unlawful acts. It shall be unlawful for any person to cross connect into the public potable water
supply system in violation of any provision of this article.
(b) Compliance with permits and certifications. Building and plumbing permits and certificates of
compliance issued on the basis of approved plans and applications authorize only the use,
arrangement, construction, devices, facilities and equipment set forth in such approved plans and
applications; and any other use, arrangement, devices, facilities and equipment at variance with that
authorized shall be deemed a violation of this article and punishable as provided by subsection (e)
and/or (f) of this section.
(c) Notice of violation. Except as provided for in subsection (c)(1), the department shall serve a notice
of violation on the owner of the premises or person responsible for the violation of a detailed statement
or a plan approved under this article. Such notice shall direct the discontinuance of the illegal action or
condition and the abatement of the violation.
(1) Exception, notice of violation, immediate danger. Where the department has reasonable
cause to suspect that a condition exists that poses an immediate threat of contamination to the
potable water supply system, the department need not provide notice of violation as provided by
this subsection but may take such action as provided by law to protect the health, safety and
welfare.
(2) Termination of water service. After notice of violation, the violator shall have seven business
days from date of mailing to contact the department issuing the notice of violation. If the violator

fails, refuses, neglects or for any reason does not contact the department, the department shall,
by registered mail, send a notice of termination of service directed to the last known address of the
violator or post notice on or near the premises at which the violations have occurred. If the
violation continues seven business days after mailing of notice of termination, the department may
terminate water service to that portion of the violator's premises in violation of this article, or
terminate water service to the entire premises if necessary to prevent potential contamination from
reaching the water utility's water lines. It shall be unlawful for any person to resume water service
to such premises unless authorized in writing by the department to do so.
(d) Prosecution of violation. If the notice of violation is not complied with, or an immediate threat of
contamination to the potable water supply system exists, the department shall request the legal counsel
of the jurisdiction to institute the appropriate proceeding at law or in equity to restrain, correct or abate
such violation or to require the removal or termination of the unlawful use of the building or structure in
violation of the provisions of this article or of the order or direction made pursuant to this article.
(e) Violation penalties. Any person who shall violate a provision of this article, or code adopted in this
article, or shall fail to comply with any of the requirements of this article, or who shall erect, construct,
alter or repair a building or structure in violation of an approved plan or directive of the department, or of
a permit or certificate issued under the provisions of this article shall be responsible for a municipal civil
infraction, punishable in accordance with section 2-241 and all equitable relief available by statute.
Each day that a violation continues shall be deemed a separate offense.
(f) Abatement of violation. The imposition of the penalties prescribed in this section shall not preclude
the township attorney from instituting appropriate action to prevent unlawful construction or to restrain,
correct or abate a violation or to prevent illegal occupancy of a building, structure or premises or to stop
any illegal act, conduct, business or use of a building or structure on or about any premises.
Sec. 36-168. - Appeal.
Any person aggrieved by a decision of the department shall have the right to appeal to the township
construction board of appeals. An application for appeals shall be based on a claim that the true intent
of this article or rules legally adopted under this article have been incorrectly interpreted, the provisions
of this article do not apply, or an equivalent form of construction, device or arrangement can be used.
Sec. 36-169. - Publication.
This ordinance shall be effective after legal publication and in accordance with the provision of the Act
governing the same.
This Ordinance was duly adopted by the Pittsfield Charter Township Board of Trustees at its regular
meeting held on the 9th day of January 2013, and was ordered given publication in the manner
required by law.
