Dear Administrator McCarthy, Assistant Administrator McCabe and Director Grundler:
We would like to open the door to a discussion about the future of biodiesel. The leaked proposal
sends a strong message to our industry that we will forever be a 1.28 billion gallon industry. It is difficult
for us to believe that that is the future that EPA, this Administration and our Industry has been working
towards. 1.28 billion gallons is 2% of the diesel pool. The diesel pool is growing.
We would like to set this leaked document aside for a few minutes and have a serious discussion with
your leadership team and your biofuels team about the future of our industry. We cannot grow without
your leadership and guidance and we don't know what the plan is for the future.
Although we still consider the issues of the day urgent. We would agree to put advocacy aside for a
necessary discussion with your team about a future strategy for biodiesel.
If possible, we would like to meet this week.

Subject: Biodiesel Meeting Second Request

Administrator McCarthy:
We are writing to request a meeting with you regarding the leaked EPA proposal on the RFS program
that would limit the "Biomass-based Diesel" volume requirement to 1.28 billion gallons and the
"Advanced Program" to 2.21 billion gallons. While we understand that this may not be the final
proposal, we believe a direct meeting is needed to convey our industry's alarm over the dire scenario
laid out in this proposal.
In 2013, the biodiesel industry, of which approximately 113 producers are members of the National
Biodiesel Board (NBB), will produce more than 1. 7 billion gallons. The draft proposal would establish a
2014 volume of 1.28 billion gallons - a reduction of more than 420 million gallons, or 25%.
Under this scenario, NBB anticipates that dozens of small- and medium-sized biodiesel producers would
shut their doors, leading to the loss of some 8000 jobs. We know this because this year, just 22 of our
largest companies are on track to produce 1.28 billion gallons. That leaves more than 90 additional
companies in our membership with little to no market. Attached is a confidential list of those companies
that would be in significant jeopardy, located in nearly every state in the country.
Many of these are small businesses whose founders invested their life savings into their companies
based on the promise of the RFS and because they believed the US, in a bipartisan way, was truly serious
about developing cleaner alternatives to petroleum. They also took cues from the Obama
Administration, which for the past five years has sent strong signals that it will continue supporting the
development of the Advanced Biofuel industry. They are shocked by this draft proposal because they
know that the biodiesel industry has been a tremendous RFS success that has over-delivered on its goals
and proven that commercial-scale production of Advanced Biofuels is possible.
Under this proposal, not only would their investments likely disappear but so too would future
investment and financing for the industry, creating new and possibly insurmountable hurdles for
remaining producers to grow and expand.
Biodiesel is an overwhelming RFS success story, in that it is the commercial scale fuel that meets "all" of
the objectives of this Administration - by creating jobs, diversifying our fuel supplies, strengthening our
energy security, and reducing harmful emissions.
We urge you to continue to support this fragile, young and growing industry with a reasonable RFS
volume increase for 2014 that is at least consistent with current-year projected production of 1. 7 billion
gallons, and to allow it to grow responsibly beyond that in 2015.
We respectfully request a meeting with you to discuss alternative workable options.
