On Saturday, April 12, 2014, at approximately 0915 hours, Sergeant Parsons, Investigator
Horner, and NTSB Investigator Panagiotou conducted an interview with Driver Duran, at the
CHP Willows Area office. Also present during the interview was Passenger Joe Duran, spouse
of Driver Duran. The interview was concluded at approximately 0953 hours. The interview was
digitally recorded with the Durans knowledge and permission and the audio file will be retained
by the CHP Willows Area. The following is a summary of the information gathered during the
interview:

Driver
Duran began driving between approximately 1700 and 1715 hours, when they departed Willows.
This was the last stop they made prior to the collision. The weather was beautiful. It was clear
and sunny, and it was not breezy.
She did not use cruise control while driving, as she preferred to have a little bit more control of
the vehicle. Driver Duran mostly traveled in the right lane except when passing slower traffic.
She preferred driving in the slower lane. Driver Duran was driving at approximately 70 miles
per hour and she considered traffic to be heavy; not rush hour, but not smooth sailing. She was
maintaining speed with the flow of traffic.
She approached the bus (Setra) traveling in front of her in the #2 lane and merged to the left, into
the #1 lane to pass it. She was not going much faster than 70 miles per hour when she passed the
Setra. She did not recall looking at the speedometer when passing the Setra because the freeway
was not wide-open. She was not paying attention to, keeping it down, referring to her speed.
Driver Duran thought there were other vehicles between her and the Setra after she passed it.
She recalled they had not passed the Setra fast; it was more of a slow pass. As they passed the
Setra, they talked about how it looked brand new. She could not tell if it was a charter bus or a
recreational type bus. She had passed the Setra and merged in front of it. There were no
vehicles directly in front of her, slowing me down or anything.

Passenger Joe Vidal Duran

On Saturday, April 12, 2014, at approximately 0915 hours, Sergeant Parsons, Investigator
Horner, and NTSB Investigator Panagiotou conducted an interview with Passenger Joe Vidal
Duran, at the CHP Willows Area office. Also present during the interview was DriverBonnie
Duran, spouse of Passenger Duran. The interview was concluded at approximately 0953 hours.
The interview was digitally recorded with the Durans knowledge and permission and the audio
file will be retained by the CHP Willows Area. The following is a summary of the information
gathered during the interview:
Passenger Duran was traveling in the right-front passenger seating position in the Nissan. After
getting back on the freeway, the Durans had short, intermittent conversations while Driver Duran
was driving. As the Durans came upon a bus (Setra), he thought it looked really new, like a
Mercedes looking type bus. He thought it might be entertainers. The Setra caught his attention
because the Durans had been talking during their vacation about purchasing a recreational
vehicle.
Driver Duran began passing the Setra. Passenger Duran recalled they were not going fast. After
passing the Setra, Driver Duran merged into the right lane. He could not remember talking about
anything specific.
Passenger Duran suddenly heard Driver Duran yell or scream something, and he looked in her
direction. He just remembered seeing the truck (Volvo) coming directly at them prior to the
collision, like a big wall. Passenger Duran did not see a fire. He recalled it looked like a ride
at Disneyland, where something comes out from the side at you. He knew it was going to
collided with them. Passenger Duran then felt the impact.
Passenger Duran recalled everything got dusty and dark. His airbag did not deploy. Passenger
Duran felt like they floated down into the ditch where the Nissan stopped. After the collision,
Passenger Duran helped Driver Duran out the right-front passenger door of the Nissan. She was
pretty shaken. He noticed everything was in flames behind them. Passenger Duran used his
cellular telephone to take some pictures of the Nissan and videos of the fire.

On Tuesday, April 22, 2014, at approximately 1240 hours, Investigator Horner and NTSB
Investigator Kaminski conducted an interview with Passenger
at
residence.
Also present during the interview was

interview was concluded at approximately 1327 hours. The interview was digitally recorded
with Passenger
knowledge and permission and the audio file will be retained by the
CHP Willows Area. The following is a summary of the information gathered during the
interview:
Passenger
arrived at Los Angeles Union Station at approximately 0530 hours. The tour
bus (Setra) was scheduled to depart between approximately 0600 and 0700 hours. The students
were separated into two groups alphabetically. The tour bus transporting students with last
names starting with M through Z departed first, during the scheduled departure times. The
Setra did not arrive until approximately 0900 hours. The students had to walk across the street to
a city bus stop since the Setra did not have permission to load at Los Angeles Union Station.
The driver of the Setra did not explain where the emergency exits were or that they were
required to wear the seatbelts.
Approximately five to ten minutes after leaving Los Angeles Union Station, the Setra was
involved in a minor traffic collision. The driver of the Setra attempted to make a right turn. City
streets in Los Angeles are narrow, so the driver partially merged into the lane to the left in order
to make the right turn. A vehicle attempted to beat the Setra and make the turn as well.
thought the Setra collided with a curb at first, but realized it collided with a vehicle. The driver
of the Setra pulled over and both drivers exchanged information. The driver of the Setra took
pictures of the Setra. Approximately 30 minutes passed and the Setra began traveling again.
The driver of the Setra did not explain what had occurred.
While traveling, the students were all talking and watching movies. The Setra stopped
approximately one to two hours past Six Flags amusement park at McDonalds. The driver of
the Setra attempted to wash the damaged area of Setra with either water or Windex. The damage
was by the right-side tire. Passenger
did not eat at McDonalds because felt it was too
busy and had brought snacks.

While traveling to Sacramento, Passenger Myvett was seated near the back of the Setra. The
Setra made a stop where the Sacramento Kings play. Passenger
asked Passenger Myvett
if they could stop at this location because there was an In-N-Out Burger. There was also a
KFC/A&W All American Food, Taco Bell, and a small shopping center. They stopped for
approximately 30 minutes. During this stop, they had a new driver switch with the original one.
This time it was a female (Driver Lealao-Taiao). Driver Lealao-Taiao did not provide any
instruction as to the safety equipment or emergency procedures while traveling on the Setra.
Passenger
remembered the Setra made a weird stop approximately 45 minutes after
leaving Sacramento.
was not sure why Driver Lealao-Taiao stopped the Setra at a rest area.
thought it was so they could use the restrooms, but Driver Lealao-Taiao was the only one that
exited. She then returned to the Setra and again exited. When she returned to the Setra the
second time, they continued traveling on the freeway.
One of the students had an auxiliary cord and Passenger
connected
telephone to the
Setra speakers to listen to music. Passenger Castro said he had better music and went to the front
to connect his telephone to the speakers of the Setra. Passenger
fell asleep seated upright
with
seat partially reclined.
Because the seating diagram presented to Passenger
during the interview was numbered
differently than the configuration of the seats of the Setra,
location relative to other
passengers was used to determine positions on the bus and not the seat number stated during
the interview.

The Setra stopped approximately three to four hours after leaving Los Angeles. The Setra
stopped for approximately 30 minutes to allow students to use restrooms and eat. The place they
stopped had a McDonalds and Carls Jr. The students were watching movies and listening to
music while the Setra was traveling. Students seated in the rear of the Setra were talking more
than the students in the front. Students seated near the front of the Setra were using their phones.
After continuing north, the Setra traveled approximately four to five hours and stopped again.
This location had more places to eat. The male driver of the Setra took his bag and said he
would see the students on their return home. A female driver (Driver Lealao-Taiao) took over
driving the Setra. The students only had 20 minutes before they had to be ready to start traveling
again. Passenger
stated Driver Lealao-Taiao was also a very good driver.
Passenger Myvett was seated in the back of the Setra trying to be interactive with the students.
He moved back to the front of the Setra prior to the collision. There was another student seated
next to Passenger Myvett in the front of the Setra. The Setra was equipped with seatbelts, but no
one was wearing them.

When they arrived at Orland Memorial Hall, their vital signs were checked. Those that had
minor injuries were separated from other students that required more attention. Passenger
thought there were approximately 16 students that were transported to Orland Memorial Hall.
There were seven students that remained at Orland Memorial Hall, and the others were
transported to various hospitals. There were 43 students on the Setra, 3 chaperones, and
Driver Lealao-Taiao. Passenger
believed there were nine people, seven students and two
adults, deceased.

Passenger
began
day waiting with other students for two tour buses that were
supposed to take students to Humboldt State University for a preview of the campus. The first
tour bus arrived approximately 20 minutes late. It left with the students whose last name began
with M through Z. The other tour bus (Setra), with the students whose last name began with
A through L, left approximately one and a half hours later. The driver of the Setra did not
provide any instruction as to the safety equipment or emergency procedures while traveling on
the Setra. Passenger
was aware the Setra seats were equipped with seatbelts, but was
not wearing
seatbelt.
The Setra was involved in a minor collisionapproximately ten minutes after leaving Los Angeles
Union Station. The Setra was attempting a right turn and had to make a wide turn. The other
vehicle attempted to make the right turn instead of allowing the Setra to complete its right turn.
The Setra stopped near Bakersfield to allow students to eat. There was a driver switch in
Sacramento. The second driver of the Setra (Driver Lealao-Taiao) did not provide any
instruction as to the safety equipment or emergency procedures while traveling on the Setra. She
traveled safely and seemed to obey the speed limit. After leaving Sacramento, the Setra stopped
at a rest area for approximately one or two minutes. Passenger
did not know why they
stopped. After leaving the rest area, Passenger
fell asleep immediately.

handing out cards with a triage tag to identify their name and extent of injuries. The students
were then separated into groups depending on how serious each injury was. The students with
more severe injuries were transported to hospitals from the scene.

CHP Willows Area. The following is a summary of the information gathered during the
interview:
Passenger Carabez arrived at Los Angeles Union Station at approximately 0530 hours. The bus
(Setra) she was supposed to travel in was late by approximately two hours. The students had to
cross the street to load their belongings in the Setra. Prior to departing, no one provided safety
information about the Setra. Passenger Carabez was aware the Setra was equipped with
seatbelts, but she was not wearing her seatbelt.
Approximately five minutes after departing Los Angeles Union Station, the Setra was involved
in a collision. The Setra was attempting to make a right turn and a vehicle was in the Setra
drivers blind spot. It took the driver of the Setra and the driver of the other vehicle
approximately 30 minutes to exchange information. The driver of the Setra did not provide any
instruction as to the safety equipment or emergency procedures while traveling on the Setra. The
Setra was attempting another right turn and she thought the Setra was grinding against the wall,
but the Setra never stopped.
The Setra stopped near Bakersfield. The stop lasted approximately 30 minutes. The second stop
was in Sacramento. The first driver of the Setra exchanged driving with another driver
(Driver Lealao-Taiao) in Sacramento. Driver Lealao-Taiao did not provide any instruction as to
the safety equipment or emergency procedures while traveling on the Setra. She drove smoother
than the first driver. Passenger Carabez fell asleep for an hour and a half while Driver LealaoTaiao was driving.

Vialovos conducted an interview with Passenger Elijah Carranza at Orland Memorial Hall. The
interview was concluded at approximately 0356 hours. The interview was digitally recorded

CHP Willows Area. The following is a summary of the information gathered during the
interview:
He arrived at Los Angeles Union Station at approximately 0450 hours. He was the
first to arrive. The first of two buses arrived at approximately 0630 hours. The students were
separated alphabetically by their last name. The first bus left Los Angeles Union Station with
students with last names that began with L through Z. The remaining students were not able to
load at Los Angeles Union Station. They had to walk across the street to load. The first thing
they did on the bus (Setra) was count how many students were on board. There were 43 students
and he was the only student from his school on the Setra. The first driver of the Setra was an
elderly male. Passenger Carranza knew the Setra was equipped with seatbelts, but he was not
wearing his seatbelt. He knew of one student wearing a seatbelt. He believed that if the students
were all wearing their seatbelts, they would not have been able to exit the Setra, after the
collision. The Setra did not depart until approximately 0930 hours.
The Setra was involved in a collisionapproximately ten minutes after leaving Los Angeles Union
Station. Another vehicle pulled out and collided with the Setra. The driver did not know the
collision occurred until a student told him. The driver of the Setra pulled over and exchanged
information with the driver of the other vehicle. The Setra was stopped for approximately 15
minutes. As the driver of the Setra continued to drive, he ran over a curb, prior to reaching the
freeway. Passenger Carranza characterized the driving of the first driver as bad. He did not
feel safe while traveling with the first driver of the Setra. He seemed to be swervy on the
freeway.

Passenger Castillo was dropped off at Los Angeles Union Station to be picked up by the bus
(Setra). The Setra was late to pick up the students. The driver of the Setra did not provide any
instruction as to the safety equipment or emergency procedures while traveling on the Setra.
Passenger Castillo observed the Setra was equipped with seatbelts, but he was not wearing his
seatbelt. Prior to entering the freeway, the Setra was involved in a minor traffic collision. He
barely even felt the impact from inside the Setra.
The Setra stopped at a McDonalds near Bakersfield. The second stop was where a new driver
of the Setra (Driver Lealao-Taiao) began driving. Passenger Castillo was not sure where the
location of the second stop was.
Passenger Castillo was seated in the last row, on the right side of the Setra, and in the window
seat. He did not know where anyone else was seated in the Setra.
The Setra traveled a long time prior to the collision occurring. Passenger Castillo was
listening to music on his headphones, and was starting to fall asleep when he felt the driver of the
Setra begin to brake and turn the Setra. He had his seat reclined, but sat up when he felt the
Setra slow because of the braking. When the impact occurred, he flew forward out of his seat.

After arriving at Los Angeles Union Station, Passenger Clavijo waited approximately three hours
for the bus (Setra) to arrive. There were two tour buses taking students to Humboldt State
University. The first tour bus arrived on time, but the Setra arrived one hour late. He boarded
the Setra. The first driver of the Setra did not provide any safety information about the Setra.
He observed the Setra was equipped with seatbelts, but he did not wear his seatbelt.
Approximately 10 to 20 minutes after the Setra departed Los Angeles Union Station, it was
involved in a minor collisionprior to entering the freeway. A vehicle collided with the right side
of the Setra. The driver of the Setra stopped in order to exchange information with the driver of
the other vehicle. The Setra was stopped for approximately five minutes.
During the first portion of the trip, the students were watching a movie called Captain Phillips.
Prior to the movie ending, the Setra stopped at a truck stop. The students were able to
purchase food. Passenger Clavijo went with some other students to Carls Jr. The Setra was
stopped for approximately 30 to 40 minutes prior to continuing.
After leaving the truck stop, the students were talking and joking with Passenger Myvett. He
was standing in the aisle talking to the students. He was telling the students about how he
proposed to his fianc, Passenger Haywood.

Center Pediatric Burn Unit in Sacramento, California. The interview was concluded at

following is a summary of the information gathered during the interview:
She departed her residence and arrived at
Los Angeles Union Station at approximately 0545 hours. The students were split into two
groups alphabetically by their last name. The first tour bus arrived at Los Angeles Union Station
at approximately 0715 hours and took the students with the last names beginning with M
through Z. Her tour bus (Setra) did not arrive at Los Angeles Union Station until approximately
0800 to 0815 hours. A security guard told them that they would have to load the Setra on the
opposite side of the street, in front of the Los Angeles Union Station parking lot.
Because the seating diagram presented to Passenger Corro during the interview was numbered
differently than the configuration of the seats of the Setra, her location relative to other
passengers was used to determine positions on the bus and not the seat number stated during the
interview.
Since Passenger Corro was near the front of the line, she was able to pick a window seat on the
right side of the Setra, near the middle. She was seated on the right side, approximately five or
six rows from the front, next to the window seat. Passenger
was seated in the aisle seat
next to her. The first driver of the Setra was an adult Hispanic male. The driver of the Setra did
not provide any instruction as to the safety equipment or emergency procedures while traveling
on the Setra.
As the Setra left the station, Passenger Myvett kept the students happy by making jokes and
other comments from the front of the Setra. They stopped at a McDonalds somewhere near
Bakersfield. The students had approximately 30 minutes to purchase food and use the restroom.
Once all the students boarded the Setra, they continued.

Passenger Crumble was dropped off by her mother at Los Angeles Union Station at
approximately 0600 hours. The bus (Setra) was scheduled to depart at 0700 hours, but it was
late. The Setra did not depart until approximately 0800 hours. The students had to walk across
the street from Los Angeles Union Station to board the Setra. The driver of the Setra and the
chaperones did not provide any instruction as to the safety equipment or emergency procedures
while traveling on the Setra. Passenger Crumble observed the Setra was equipped with seatbelts,
but she was not wearing her seatbelt.
The Setra was involved in a separate collisionprior to entering the freeway. The Setra scratched
the side of a vehicle. The driver of the Setra and the driver of the other vehicle exchanged
information, and the Setra did not enter the freeway for another 30 minutes. The Setra did not
stop until Bakersfield between approximately 1000 and 1100 hours. After continuing on, the
Setra made another stop. There were places to eat at the second stop. She remembered an In-NOut Burger and Taco Bell. The first driver of the Setra switched with another driver (Driver
Lealao-Taiao) during the second stop. Driver Lealao-Taiao did not provide any instruction as to
the safety equipment or emergency procedures while traveling on the Setra.
Passenger Crumble was seated on the right side, near the rear, and in the window seat. Passenger
was seated behind her, but she thought moved prior to the collision. Passenger
Castro was initially seated in front of her, but moved to the front of the Setra, prior to the
collision.

Passenger Delgado was scheduled to arrive at Los Angeles Union Station at 0600 hours. The
tour buses were scheduled to leave at 0700 hours. The students were separated into two groups
alphabetically by their last names. Students with last names beginning with M through Z
departed on the first bus at approximately 0715 hours. The bus (Setra) she traveled on did not
arrive until between approximately 0800 and 0815 hours. The first driver of the Setra did not
provide any instruction as to the safety equipment or emergency procedures while traveling on
the Setra. She observed the Setra was equipped with seatbelts, but no one was wearing them.
She was not wearing her seatbelt.
Approximately five minutes after leaving Los Angeles Union Station, the Setra was involved in a
collision with another vehicle. The Setra was stopped for approximately 15 minutes while the
driver of the Setra exchanged information with the driver of the other vehicle.
The Setra stopped in Bakersfield and the students were given 30 minutes to use the restroom and
purchase food. The Setra continued north until it stopped in Sacramento. One of the chaperones
allowed the students to exit the Setra and use the restrooms and purchase food. A new driver
(Driver Lealao-Taiao) began driving the Setra after the Sacramento stop. Driver Lealao-Taiao
did not provide any instruction as to the safety equipment or emergency procedures while
traveling on the Setra.

another vehicle while attempting a right turn. The Setra had to stop so the driver of the Setra
could exchange information with the driver of the other vehicle. This delayed the trip another 30
minutes.
The driver of the Setra did not provide any instruction as to the safety equipment or emergency
procedures while traveling on the Setra. Passenger

On Friday, April 11, 2014, at approximately 0515 hours, Investigator Newton conducted an
interview with Passenger
at Glenn Medical Center. Also present during the
interview was
Glenn County Health Services. The interview was concluded at
approximately 0545 hours. The interview was digitally recorded with Passenger

following is a summary of the information gathered during the interview:
Passenger
State University.
The bus (Setra) was scheduled to depart Los Angeles Union Station at 0600 hours. There
were two tour buses at Los Angeles Union Station. The students were split up alphabetically, A
through L and M through Z.
The first driver of the Setra was male. The Setra left Los Angeles Union Station late, at
approximately 0830 hours. The Setra was involved in a collisionshortly after leaving Los
Angeles Union Station. The Setra was attempting to make a right turn and a Honda attempted to
beat the Setra and also make a right turn. The Setra collided with the Honda. Due to the
collision, the Setra stopped for approximately 30 minutes. The students remained on the Setra.
The driver of the Honda was not happy and was taking pictures. The Setra left Los Angeles at
approximately 0900 hours.
thought the first driver might have traveled onto a curb prior to
entering the freeway.
While traveling, the students were talking, watching movies, and listening to music. There were
approximately 42 students, 3 advisors, and the driver of the Setra. The Setra stopped at
approximately 1130 hours. Passenger
was not sure where they stopped. The Setra
stopped again at approximately 1630 hours in Sacramento. The driver of the Setra switched with
a female driver (Driver Lealao-Taiao).
After leaving Sacramento, the Setra stopped just prior to the collision. Driver Lealao-Taiao
stopped the Setra on the side of the road, exited, and checked the Setra. The Setra was stopped
for less than two minutes prior to the Setra continuing.

The bus (Setra) was approximately one hour late departing. The driver of the Setra announced
that everyone should be seated while on board the Setra, and there was a first aid kit located in
the front of the Setra. While the driver of the Setra was explaining the rules for riding on the
Setra, the students in the rear were not listening. The chaperones attempted to quiet them, but
were unable to do so. Passenger
did not think the driver of the Setra was loud enough
to be heard over the noise in the rear of the Setra.
was aware the Setra was equipped with
seatbelts, but
was not wearing
seatbelt.
The Setra was involved in a separate collisionas it was departing Los Angeles and had to stop,
which further delayed the trip. They entered the freeway and traveled a while prior to stopping
in Bakersfield to eat. The second stop was in Sacramento to eat and for a new driver (Driver
Lealao-Taiao) for the Setra. Driver Lealao-Taiao did not provide any instruction as to the safety
equipment or emergency procedures while traveling on the Setra. The Setra traveled through a
rest area, but Passenger
did not remember it stopping in the rest area. There was
nothing unusual about the driving of Driver Lealao-Taiao.

The collision with the truck (Volvo) occurred approximately two hours after leaving Sacramento.
Passenger
looked forward and saw the Volvo coming toward the Setra. Passenger
thought the Setra came to a complete stop prior to the Volvo colliding with the Setra.
When the Setra stopped,

heard a lot of screaming at the back of the Setra. Someone was attempting to break a

Emergency personnel took a while to respond, and many vehicles had stopped to help. When
emergency personnel arrived on scene, they focused on the most severely injured. The students
were put into groups by the severity of their injuries. Passenger

one other bus traveling on the trip.
was late getting to Los Angeles Union Station to catch
the bus.
was scheduled to be there at 0600 hours. The Setra was late leaving, so

was on the waiting list to go on the trip. The Setra finally left Los Angeles
Union Station at approximately 0800 hours. The Setra was the second tour bus to leave.
Approximately two blocks from Los Angles Union Station the Setra was involved in a
collisionwith another vehicle. The driver of the Setra and the other driver exchanged
information quickly.
At approximately 1100 hours, the Setra stopped for a break prior to reaching Bakersfield at a
McDonalds. The Setra continued until reaching Sacramento and stopped at an In-N-Out
Burger. A new driver (Driver Lealao-Taiao) began driving. The first driver was male and
Driver Lealao-Taiao was female.
Because the seating diagram presented to Passenger
during the interview was
numbered differently than the configuration of the seats of the Setra,

The Setra entered the freeway at approximately 0900 hours. One of the students stated, Damn,
this trip already started out bad. We shouldnt even go anymore. After the Setra got on the
freeway, Passenger
fell asleep.
The Setra stopped at a McDonalds and a Carls Jr., after passing Bakersfield. Everyone exited
the Setra. Most of the students went to McDonalds. The students were given 30 minutes to eat
and use the restrooms.
The students boarded the Setra and continued watching a movie, Captain Phillips, which had
been playing prior to stopping. The students began watching another movie, but it had weird
scenes, so the chaperones turned it off. Passenger
was talking to students seated behind
and next to
.
The Setra stopped in Sacramento. It was not a scheduled stop to allow students off the Setra, but
it was just for the drivers to switch. Driver Lealao-Taiao did not provide any instruction as to the
safety equipment or emergency procedures while traveling on the Setra. Passenger Myvett asked
the driver of the Setra if the students could exit because they had not had a break in a while. The
students were given 20 minutes to purchase food. There was In-N-Out Burger and other places
to eat. Passenger
went to In-N-Out Burger and ordered a milkshake. After returning to
the Setra, the chaperones counted students and thought there was one missing. Once all students
were present and accounted for, the Setra continued north on the freeway. The Setra briefly
stopped in a rest area.
After stopping at the rest area, a
student in the rear of the Setra wanted to use
iPod to
listen to music. The
student gave
iPod to a male student and he took it to the front of
the Setra and sat next to Passenger Myvett. Passenger Myvett was initially seated in the rear of
the Setra talking to the students.

brakes hard and steered it to the left. He observed a fire at the front of the Setra. He was at
a window that was already broken. The window was still in the way so he broke it more.

Investigator Barth conducted an Interview with Passenger Melvin Harris III at his residence.
The interview was concluded at approximately 2052 hours. The interview was digitally recorded

Passenger Harris arrived at Los Angeles Union Station at approximately 0600 hours. There were
two tour buses transporting the students and were scheduled to depart at 0600 hours and 0700

with last names beginning with M through Z traveled on another. The first tour bus departed
at approximately 0700 hours. The Setra was two hours late and departed at approximately 0800

approximately 0630 hours. There were two buses transporting students to Humboldt State
University. The students were grouped alphabetically by their last names. Students with last
names beginning with A through L traveled on a bus (Setra) and students with last names
beginning with M through Z traveled on another bus. The first bus left between approximately
0600 and 0700 hours.
The Setra arrived at approximately 0840 hours and they boarded it. When the Setra was passing
Chinatown, it was involved in a traffic collision. Then, the Setra entered the freeway and
traveled approximately two hours prior to stopping at a McDonalds, near Bakersfield.
The second stop was in Sacramento at In-N-Out Burger. The students were given 20 minutes to
eat. A new driver (Driver Lealao-Taiao) began driving from Sacramento. Driver Lealao-Taiao
was female. After leaving Sacramento, the Setra stopped at a rest area. Driver Lealao-Taiao
exited, but no students exited. The Setra continued on the freeway for less than one hour prior to
the collision.

a summary of the information gathered during the interview:

was the only student from
school on the bus (Setra). The Setra was late
arriving at Los Angeles Union Station. The Setra departed approximately two hours late.
Approximately two minutes into the trip, a vehicle collided with the side of the Setra. The driver
of the Setra and the female driving the other vehicle exchanged information. After leaving the
minor traffic collision, the Setra collided with a curb entering the freeway. No one was hurt in
either incident. The Setra stopped at In-N-Out Burger.

There were two drivers for the Setra. The second driver (Driver Lealao-Taiao) was female.

approximately 20 to 30 minutes at a Carls Jr., near Bakersfield. The chaperones thought they
lost a student, so they recounted the students and realized all the students were accounted for.
The next stop was at an In-N-Out Burger and Taco Bell. A new driver (Driver Lealao-Taiao)
began driving at this location. The students were given time to eat while the drivers switched.
Driver Lealao-Taiao did not provide any instruction as to the safety equipment or emergency
procedures while traveling on the Setra. The Setra continued for a good while prior to the
collision.
The Setra made an approximate two to three minute stop at a truck stop. The Setra continued
on the freeway.

with L through Z departed on the first bus. The bus (Setra) traveled on arrived late, and the
students could not board at Los Angeles Union Station. The students had to walk across the
street to board the Setra.
did not notice anything out of the ordinary with the driving of the
first driver.
Approximately five to ten minutes after leaving Los Angeles Union Station, the Setra was
attempting to make a wide turn. A small vehicle attempted to speed up, try to make the turn as
well, and the vehicles collided. The Setra stopped and the driver exited to talk to the other
driver. The Setra continued approximately 20 to 30 minutes later.
The Setra stopped approximately two hours later, at a McDonalds and a Carls Jr. The Setra
continued on the freeway and stopped in Sacramento. There was In-N-Out Burger, Taco Bell,
and a Sizzler. This is where the driver of the Setra changed with a new female driver
(Driver Lealao-Taiao). The Setra continued on the freeway. The Setra traveled through a rest
area approximately 30 minutes prior to the collision. Passenger
did not remember the
Setra stopping in the rest area.
While traveling, Passenger
had snacks shared with other students. The students
were talking about music. Passenger Myvett was seated in the front of the Setra for a portion of
the trip, but came back to create conversation with the students. Just prior to the collision,
Passenger Myvett moved back to the front of the Setra.

Passenger Kosar was the only student from her school on the bus (Setra). The Setra was
involved in a minor collisionjust after leaving Los Angeles Union Station. A vehicle collided
with the side of the Setra. The driver of the other vehicle was female.
Passenger Kosar was seated in the approximate middle of the Setra on the right side, and in the
window seat. Passenger
was seated next to her in the aisle seat.
The Setra was traveling north on Interstate 5, when Passenger Kosar heard people screaming.
She saw the truck (Volvo) cross the median and collide with the Setra head-on. After the
collision, the Setra was on fire, and everyone was running to the rear to escape. There was a
male in front of her attempting to exit a window. He was taking too long so she pushed him out.
She was getting burned and could not stand the flames. Other students were pushing and exiting
the windows of the Setra.
Passenger Kosar sustained a second degree burn to her right arm, head, and right ear. She also
sustained first degree burns to her left ear, and thermal respiratory burns to her throat and lungs.

Burger, the Setra continued north on the freeway.

were separated into groups. The bus (Setra) that was scheduled to pick him up was late. The
Setra arrived between approximately 0800 and 0900 hours and the students boarded.
The first driver of the Setra did not provide any instruction as to the safety equipment or
emergency procedures while traveling on the Setra. The chaperones showed the students the
windows could pop out. They told them to kick out the window in order to open it. The
chaperones mentioned the handle, but told the students to kick the window, to open it. Passenger
Lopez did not know the Setra had seatbelts until after the accident. Prior to leaving Los Angeles,
a vehicle attempted to overtake the Setra. The vehicle scraped the Setra. The Setra stopped and
the driver exchanged information with the driver of the other vehicle.
The Setra entered Interstate 5 and began traveling north. At approximately 1100 hours the Setra
reached Bakersfield. The Setra stopped and the students were able to eat lunch. The students
were watching the movie, Captain Phillips. The Setra continued driving until Sacramento. The
Setra stopped in Sacramento between approximately 1400 and 1600 hours. During this stop, the
Setra switched drivers. In Sacramento, Passenger Lopez ate at KFC/A&W All American Food.
The Setra continued traveling north on Interstate 5.

interview:
She arrived at Los Angeles Union
Station at approximately 0510 hours and waited for the buses to arrive. The first bus arrived and
students with the last name beginning with L through Z boarded it. After the first tour bus left,
she waited approximately two hours prior to when the bus (Setra) she traveled on arrived. She
was on a wait list and since there was room on the Setra, she was able to board it. The first
driver was a male.
Approximately five minutes into the ride, the Setra was involved in a traffic collision. The
collision occurred on city streets. The Setra stopped for approximately 30 minutes so the driver
of the Setra could exchange information with the driver of the other vehicle.
The students began watching the movie, Captain Phillips. Between approximately 1000 and
1100 hours the Setra stopped in Bakersfield to let the students purchase food. The students
boarded the Setra and they did a head count. After the Setra left Bakersfield, the students
finished watching Captain Phillips and began the movie, Wolverine, but no one was watching it.
The students began listening to music.
The Setra stopped in Sacramento to switch drivers. The second driver (Driver Lealao-Taiao)
was a female. The Setra was stopped for approximately 30 minutes. The Setra continued on for
approximately one to two hours and Driver Lealao-Taiao traveled into a rest area. She opened
the door and stood at the bottom of the stairs. She looked out the door, then returned to the
drivers seating position and continued onto the freeway.

The second place the Setra stopped was in Sacramento. The chaperones allowed the students
approximately 20 minutes before they had to be back on the Setra. The students were able to eat
at Taco Bell, In-N-Out Burger, and Panda Express Chinese Kitchen. Passenger
went to
In-N-Out Burger because it was the closest restaurant. Sacramento is where they switched out
drivers of the Setra. The chaperones counted the students to make sure they were all accounted
for prior to leaving Sacramento.
The Setra continued and the students began to watch the movie, Her. The chaperones turned the
movie off due to the sexual content at the beginning of the movie. After leaving Sacramento,

fell asleep.
awoke to the Setra stopping. The driver (Driver Lealao-Taiao)
exited the Setra and then returned. The area where
stopped was grassy. After the Setra

the second row on the right side. The male student was seated in the window seat and the female

the aisle seat.

Driver Evans drove north to Weed, California, and arrived to complete a meet and turn with
at approximately 1445 hours. Driver Evans and

entered Interstate 5, traveling north from the Sacramento Area.

State Route 162 was approximately 20 miles north of the Maxwell Safety Roadside Rest Area,
and 16 miles south of the collision scene in Orland, California.
Driver Duran became the driver as they departed the ARCO ampm gas station. Driver Duran
entered Interstate 5 and drove north toward the collision scene. Driver Duran observed the
weather was clear and sunny and, to her, the traffic was congested.
Passenger Myvett was seated in seat #4 on the right side of the Setra. Passenger Castro was
seated in seat #3 on the right side of the Setra. Passenger Jimenez was seated in seat #8 on the
right side of the Setra. Passenger Gomez was seated in seat #7 on the right side of the Setra.
Just prior to the collision, Driver Duran approached the Setra in the #2 lane and changed lanes to
the #1 lane to pass the Setra. Driver Duran was driving the Nissan at approximately 80 miles per
hour as she passed the Setra.
According to GPS
data provided by FedEx Freight Inc., the last reported speed of the Volvo was approximately
59.5 miles per hour, approximately 6 minutes prior to the collision. South of the Rolling Hills
Casino, the Volvo passed
. Driver Evans steered the Volvo to the right and
merged into the #2 lane and continued south.

As the Volvo neared the oleanders, Driver Duran, Driver Lealao-Taiao, and
began to take evasive actions to avoid a collision with the
Volvo.
At-Impact
The front of the Volvo collided with the oleanders and continued in a southeasterly direction,
maintaining a nearly constant southeasterly heading. Driver Duran steered to the right and then
applied the brakes of the Nissan. Driver Lealao-Taiao applied the brakes of the Setra and then
steered to the right. The Volvo traversed the northbound #1 lane and the left front of the Volvo
collided with the left side of the Nissan, causing the tie rod to separate from the right steering
arm of the Volvo. This caused the right tire of axle #1 of the Volvo to turn to the left and create
a skid mark.
As the Nissan decelerated, the
motion of the Durans in the Nissan was toward the left front of the Nissan. The steering wheelmounted airbag, left-side curtain airbag, drivers seat side-torso airbag, and the webbing
pretensioners of the Nissan deployed.
After the Volvo and Nissan reached maximum engagement, they began to separate. The motion
of the Volvo continued to the southeast, with little to no deviation in the heading of the Volvo.
The Nissan rotated in a counterclockwise direction, about its vertical axis, as it was redirected in
a northeasterly direction.
The right front of the Volvo collided with the right front of the Setra. As the Volvo rapidly
decelerated, the motion of Driver Evans was toward the right front of the Volvo. As the Setra
rapidly decelerated, the motion of the occupants was toward the left front of the Setra.

The Nissan rotated in a counterclockwise direction about its vertical axis as it traveled in a
northeasterly direction onto the vegetation-covered downslope. The Nissan rotated nearly 360
degrees. The rotation of the Nissan nearly stopped as it continued in a northerly direction. The
Nissan came to rest on its wheels facing in a northerly direction, at the base of the vegetationcovered downslope east of Interstate 5.

Conclusions
Environmental Factors
There were no weather conditions that caused or contributed to the cause of this collision.
The roadway pavement and pavement delineation did not cause or contribute to the cause of this
collision.
The rumble strips in the shoulders adjacent to the traffic lanes had a portion of them covered by
the 2009 construction project described below. From collision scene measurement data, the
rumble strip at the approximate locations where the Volvo crossed the southbound and
northbound left (inside) shoulders varied between approximately 1.8 and 2.3 feet wide. The
detail in the 1992 and 1994 as-built plans indicated the rumble strips were 3 feet wide by 0.1 foot
(1.2 inches) deep and spaced at 8 inches (0.67 foot) on center. The 2009 construction project asbuilt plans directly reference the Caltrans Standard Plans dated May 2006, which were used in
conjunction with the project plans. Plan A40A of these standard plans contained the rolled-in
indentation details which showed the rumble strips to be 1 foot wide by 1 inch deep and spaced
at 1 foot on center. Even though partially covered by the 2009 construction project asphalt
overlay, the shoulder rumble strip remaining after the project, and present during the time of the
collision, met or exceeded the Caltrans standards at the time of the project.
The average median width determined from collision scene measurement data was
approximately 58.5 feet. The median width indicated on the 1964 construction plans was 60
feet. The placement of roadway painted lane and edge lines is dependent on pre-paint
preparation and the ability of the driver of the striping truck. Considering measurements of the
pavement edge, the minor difference between the 1964 as-built plans and the measured median
width can be attributed to the stripe location and not construction of the median, shoulders, and
lanes.
A review of the most recent construction plans for that section of Interstate 5 indicated three
major construction projects had occurred within the area of the collision. One construction
project occurred in 1992, which affected the southbound pavement. The second occurred in
1994, which affected the northbound pavement. The two construction projects overlaid the lanes
and shoulders with asphalt concrete and placed the rumble strips that were present at the time of
the collision. The third construction projected occurred in 2009 and included paving only the
northbound and southbound lanes with approximately 0.1 foot thick of open-graded rubberized
asphalt concrete. The placement of open-graded rubberized asphalt concrete did not provide a
pavement rehabilitation benefit, but was used as a wearing surface and reduces vehicle tire water
spray during rain. None of these three projects changed the roadway geometrics, including the
vertical and horizontal alignments, nor lane, shoulder, and median widths.
The height and breadth of the oleanders varied throughout the area where the collision occurred.
The oleanders at the collision scene were naturally shorter than they were at other locations in
the area, and would allow viewing of the Volvo as it approached and crossed the median.

Vehicle Factors
Volvo (Vehicle #1)
There were no defects noted in the areas of the mechanical inspections which would have caused
or contributed to the cause of this collision.
The right ball joint separation from the tie rod was most likely due to a severe and abrupt left
turn movement of the steering system as the left-front tire and wheel engaged the C pillar of
the Nissan, which exceeded the turning limitations of the steering system. This condition
allowed the right steer tire to remain in a left turn direction while the left steer tire returned to a
straight forward direction.
The neck of the ball joint, which connected the drag link to the left-upper steering arm, was
broken and remained attached to the upper steering arm. The rough crystalline appearance on
the broken edges on the neck of the ball joint were characteristic of an instantaneous failure
typically associated with a shock load.
The Volvo exhaust system was original and consisted of an exhaust turbo, flexible steel exhaust
pipe, exhaust piping material, a right-side mounted vertical muffler with a turned out extension,
and an aluminum heat shield. There were no particulate filters or aftermarket exhaust
components mounted on the Volvo.
According to the GPS equipment on the Volvo, approximately 6 minutes prior to the collision,
the Volvo was traveling at approximately 59.5 miles per hour, and was approximately 5.5 miles
north of the collision scene. It was indeterminate how fast the Volvo was traveling in the
moments prior to the collision.
The drivers seating position was equipped with an occupant restraint system seatbelt. It was
indeterminate if the occupant restraint system was being utilized by Driver Evans at the time of
the collision since the buckle assembly and latch plate were missing.

Timothy Paul Evans (Driver #1)
Driver Evans was identified as the driver of the Volvo at the time of the collision. He possessed
a
driver license
.
At the time of the collision, Driver Evans had been on-duty for approximately eight hours.
Driver Evans drove south on Interstate 5 at a speed recorded by the GPS system in the Volvo of
approximately 59.5 miles per hour, approximately 6 minutes prior to the collision. Driver Evans
entered a straight section of Interstate 5, south of Rolling Hills Casino. North of the State Route
32 exit in Orland, California, he activated the left turn signal of the Volvo. He began to
gradually change lanes into the #1 lane of Interstate 5 southbound. He maintained this gradual
lane change and continued into the median. Driver Evans crossed the median, traveling
southeasterly, into Interstate 5 northbound traffic without applying the brakes of the Volvo, and
without making any type of evasive steering maneuver.
It was unknown if Driver Evans was wearing his seatbelt, since the buckle assembly and latch
plate were missing from the Volvo and could not be inspected.

However, a safety study conducted by NTSB of commercial vehicle drivers who had been
involved in traffic collisions showed the most important measures in predicting a fatigue-related
collision were the duration of the last sleep period, the total hours of sleep obtained during the 24
hours prior to the collision, and split sleep patterns. 18
Interstate 5 was a predominately straight roadway as Driver Evans drove south from Redding,
California. The Volvo departed the roadway on a long straight section, which was an indicator
that fatigue or sleepiness could have been a contributing factor. Long, undemanding, and
monotonous driving, typified by motorways, facilitates sleepiness. 19 There was a minor curve
to the left for southbound traffic approximately 786 feet north of the location where the Volvo
traveled off the pavement.
The case summaries from NTSBs safety study were also reviewed. We tallied the average
departure angle for fatigue-related collisions and concluded it was between five and six degrees.
The high range of the departure angles was ten degrees. Upon review of the vehicle dynamics
analysis, it was determined the departure angle of the Volvo, when it created tire marks in the
median, was approximately eight degrees. The average departure angle from the study and the
one measured in this collision were consistent, taking into account the departure angle for the
Volvo was measured in the median and not as it departed the #2 lane of southbound Interstate 5.

Other factors typically associated with sleepy or fatigue-related collisions are when the driver is
alone in the vehicle and does not attempt to avoid a collision. 21 Driver Evans was the sole
occupant of the vehicle, and he made no evasive maneuvers as the Volvo traveled across the
southbound #1 lane, southbound east shoulder, median, and into the northbound lanes.
Passenger Lopez was seated in the aisle seat of the third row on the left side of the Setra. Just
prior to the collision, Passenger Lopez related he was attempting to sleep, but couldnt because
he was seated upright. He saw the Volvo traveling toward them and he saw Driver Evans
slumped toward the drivers door.

It was indeterminate why Driver Evans allowed the Volvo to travel off the roadway through the
median and into the northbound traffic lanes. No physical evidence of evasive maneuvers was
observed at the collision scene. No credible witnesses reported evasive maneuvers from Driver
Evans, such as steering input or braking.
For an undetermined reason, Driver Evans allowed the Volvo to travel from the southbound
lanes of Interstate 5, across the median, and into the path of the opposing northbound traffic
lanes, first colliding with the Nissan, followed by the Setra.

Driver Duran entered Interstate 5 northbound. Driver Duran approached the Setra in the #2 lane
and changed lanes to the #1 lane to overtake the Setra. Driver Duran was traveling at
approximately 80 miles per hour, when she observed the Volvo in the median. Driver Duran
steered to the right and applied the brakes of the Nissan in an attempt to avoid a collision.
Although Driver Duran related she was driving at approximately 70 miles per hour as she passed
the Setra, the ACM data showed the Nissan was traveling at approximately 80 miles per hour 5
seconds prior to its collision with the Volvo. Driver Duran was driving approximately 10 miles
per hour above the posted maximum speed limit. Although this condition was undesirable, it
was determined not to have caused or contributed to the cause of the collision. Her speed above
the maximum speed limit did not contribute to the Volvo crossing the median into the
northbound traffic lanes and subsequently colliding with the Nissan.
Driver Duran did not cause or contribute to the cause of this collision.

The Volvo, 2006 Wabash, Hyundai, 2013 Wabash, and Setra were a vehicles regulated by the
California Public Utilities Commission and the Department of California Highway Patrol, and its
operation was subject to the requirements of the California Code of Regulations Title 13, as
required by the following California Statutes:
