Upon arrival, | observed that numerous people were on scene and that CPR was in progress on two individuals approximately 100 feet apart. », Hinesburg Fire, and SCENE: Vermont Route 116 at the crash location is north/south paved State highway with two lanes separated by a double yellow line. The lanes are approximately 11 feet, 5 inches wide and there is an approximate four foot paved shoulder on the southbound side separated by a solid white line. The roadway curves to the right southbound out of the village creating a sight distance of approximately 180 feet from the curve to where the crash occurred. At the time of the crash, the roadway was dry and the weather was cloudy. A scene diagram and measurements completed by the Vermont State Police are contained as Attachment 1. Their related case is number 154102080. INVOLVED PARTY'S: Party # 1 (Marshall) was present at the scene and pronounced deceased at approximately 1128 hours after CPR was unsuccessful. Vehicle # 1 was registered to him and he was also identified by his father and grandfather. Party # 2 (Tom) was present at the scene and pronounced deceased at approximately 1130 hours after CPR was unsuccessful. Tom did not have any identification and the only property were a set of keys, with a key fob. Sgt. Casco, Hinesburg Police, was on scene and possibly recognized Tom as a resident in Lyman Meadows. Sgt. Casco took the keys to Lyman Meadows and was able to enter a residence using one of the keys. Tom's Vermont Operator's License was located in his residence and he was tentatively identified. INVOLVED VEHICLES: Vehicle # 1 (Honda Civic) was found at its uncontrolled point of rest in the field off of the southbound roadway edge. Vehicle # 1 sustained total damage and its location was documented by the State Police as contained in Attachment 1 Bicycle # 4 (TREK, Model X1, Serial Number WL3420294) was found at what is believed to be the uncontrolled point of rest on the southbound roadway shoulder. it was completely damaged and its location was documented by the State Police as contained in Attachment 1. INJURIES: Party #1 (Marshall) sustained fatal injuries. The medical examiner determined the following: Blunt Impact Head and Neck Injuries. Facial abrasions, bilateral subscalpular/subgaleal hemorrhage, multiple skull fractures, thin subdural hemorrhage, cerebral cortical lacerations and Intraventricular hemorrhage. Blunt Impact Torso Injuries: Skin abrasions, fractured left distal clavicle, fractured manubrium, multiple bilateral rib fractures, Pelvic fractures, bilateral hemothoraces, mediastinal hemorshage, pulmonary lacerations and ‘contusions and liver lacerations. Blunt impact Extremity Injuries. ‘Skin abrasions and right distal femur fracture. No Natural Disease. Party # 2 (Tom) sustained fatal injuries. The medical examiner determined the followin: Blunt Impact of Head Injuries. Skin abrasions and scalp lacerations, focal subscalpular hemorrhage, left temple, fracture dislocation atlanto-occipital joint, subdural hemorrhage, subarachnoid hemorrhage, Pontomedullary rent and transected cervical spinal cord. Blunt Impact Torso Injuries. ‘Skin abrasions, bilateral clavicle fractures, fractured sternum, multiple bilateral rib fractures, ‘multiple spine fractures, bilateral hemothoraces, hemoperitoneum and retroperitoneal hemorrhage, right lung laceration, liver lacerations, and spleen laceration Blunt Impact Extremity Injuries. ‘Skin abrasions, fractured left distal tibia/fibula and probable right knee dislocation No Natural Disease. STATEMENTS: Party # 1 (Marshall) — No statement Party # 2 (Tom) ~ No statement ess #1 (Wood, Floyd) ~ Wood is Marshall's grandfather. He identified Joseph Marshall and his vehicle. Witness # 2 (Marshall, Gary) — Marshall is Joseph Marshall's father. He identified Marshall. He stated that Joseph had left the residence angry because of an argument between 0930 hours and 1000 hours. He did not have any additional information. Witness # 3 (Bissonette, Mark) - Bissonette was contacted several days later and stated that he was driving northbound Vermont Route 116 when Vehicle # 1 came around the corner at what seemed to be one hundred miles an hour. He further stated that Vehicle # 1 missed his vehicle by inches and he saw behind him that Vehicle # 1 hit Party #2 sending him flying and then Vehicle # 1 exploded. He did not stop because he knew that they would be dead but did immediately call 911. He said that the bicyclist was on the shoulder of the road. Witness # 4 (Place, Josh) — Place was contacted on April 27, 2015 and related that he had been the passenger in Bissonette's vehicle. He stated that Vehicle # 1 came around the corner at a hundred miles an hour and narrowly missed their vehicle. He did see Vehicle # 1 hit the bicyclist and then the tree. He also stated that the bicyclist was on the shoulder of the road. ‘Trooper McGowan, Vermont State Police was present on scene and talked with several people. He said that Holly started CPR on the injured bicyclist and that he kept traffic back.” “then spoke to Bradley Friesen DOB who said he was walking down Buck Hill Road towards VT RT 116 when he saw the bicycle and vehicle (bearing VT registration GKBI659) down the hill. He said that he saw Holly giving chest compressions. He then said that he gave the injured bicyclist breaths without a mask. He advised that he is a doctor who works at UVM Medical Center at times and that call the the attending doctor in the ER to “call it" on the injured bicyclist. He stated that after the attending ER doctor “called it" he got approval to stop CPR on the = thr apc to scot ss DOME heehee pe caret noth ot VERE Te when he noticed a bicycle in the roadway with a "parking lens" near it. He said that he turned his car around, parked, and went down the bank. He stated that he checked the male laying outside the vehicle (mentioned above) for breathing, but that the male was not breathing.” “I then spoke to Scott Johansen DOB who told me he was travelling north on VT RT 116 when he saw people down the hill. He stated that he grabbed his first aid kit and that Holly/Brad were giving CPR. He told me that the kid laying outside the vehicle (mentioned above) was not breathing, had no pulse, and was very bloody. He then told me that EMS arrived on scene shortly after he did.” End of Trooper McGowan's statements. PHOTOGRAPHS A total of 38 photographs were taken depicting Vehicle # 1, the bicycle, the scene and the roadway. INTOXICATION NARRATIVE Party # 4 (Marshall) ~ Marshall tested positive for Delta-9 THC (cannabis) at a level of 36 Nano grams and Delta-9 Carboxy THC at 30 Nano grams. Vermont establishes a presumptive limit of influence at any measurable amount however for additional reference, both Colorado and. Washington where recreational Marijuana is legal have set a presumptive limit of § Nano grams. Party # 2 (Tom) - Tom did not reveal any positive finding of toxicological significance. OPINIONS AND CONCLUSIONS: ‘Summary: Party # 1 (Marshall) was southbound on Vermont Route 116 and Party # 2 (Tom) was also southbound Vermont Route 116. Based on evidence and analysis by the Vermont State Police, Marshall was at a speed of 83 to 88 miles per hour when he rounded the corner nearly on the center line of the roadway. Vehicle # 1 rotated with the back end swinging out to the left causing the vehicle to continue sideways. Tom, based on witness accounts, was on the paved shoulder of the roadway when he was struck by Vehicle 1. Vehicle # 1 then continued off the road where it stuck a tree and Marshall was thrown from the vehicle. After being struck by Vehicle # 1, Tom struck a tree and then continued approximately another 41 feet. Cause: Based on the toxicology screening, Party # 1 (Marshall) caused the collision by a violation of: § 1201, operating vehicle under the influence of intoxicating liquor or other substance (3) when the person is under the influence of any other drug or under the combined influence of alcohol and any other drug; Based on the investigation and analysis by the Vermont State Police, the associated collision factor is determined to be a violation of: § 1091. Negligent operation; grossly negligent operation (b) Grossly negligent operation, (1) A person who operates a motor vehicle on a public highway in a grossly negligent manner shall be guilty of grossly negligent operation. (2) The standard for a conviction for grossly negligent operation in violation of this subsection shall be gross negligence, examining whether the person engaged in conduct which involved a gross deviation from the care that a reasonable person would have exercised in that situation.
