REQUEST FOR CLERK’S ENTRY OF DEFAULT

COMES NOW the Plaintiff, ACADEMY OF MOTION PICTURES ARTS AND

SCIENCES (“A.M.P.A.S.”), by counsel, and pursuant to Federal Rule of Civil Procedure 55(a),

requests entry of default by the Clerk of this Court against the Defendant, AMPAS.COM (the

“Domain Name”), and in support thereof states as follows:

1. On April 13, 2007, Plaintiff filed a Complaint against the Defendant.

2. On June 18, 2007, the Honorable Judge Leonie M. Brinkema ordered Plaintiff to

publish notice of the lawsuit in The Washington Post pursuant to 15 U.S.C. §

1125(d)(2)(A)(ii)(II)(bb).

3. On June 22, 2007, the Court’s Order to Publish Notice of Action Pursuant to 15

U.S.C. § 1125(d)(2)(A)(ii)(II)(bb) appeared in The Washington Post Legal Notices section. See

Affidavit of Maureen E. Carr, ¶ 2.

4. Pursuant to the Court’s Order and the Federal Rules of Civil Procedure, the

Defendant had twenty (20) days from the date of publication in The Washington Post in which to

respond to the Complaint. That time expired on July 12, 2007.

5. To date, Defendant AMPAS.COM has failed to appear, plead, or otherwise

respond to the Complaint or defend itself in this matter. See Affidavit of Maureen E. Carr, ¶ 3.

6. Upon information and belief, Defendant is neither an infant nor an incompetent

person. See Affidavit of Maureen E. Carr, ¶ 4.

WHEREFORE, Plaintiff ACADEMY OF MOTION PICTURES ARTS AND

SCIENCES respectfully requests that the Clerk of this Court enter default against Defendant

AMPAS.COM.
