1. What are the material facts of the assigned clients case?
Lorna is a child who was a victim of child trafficking when she was 17
years of age. She is a resident of Lanao Del Norte and a practicing Muslim.
Her family lives below the poverty line for the main source of her parents
and siblings income is through farming. After her father died she had
decided to work as a Domestic Helper in Saudi Arabia. Her aspiration to
work Saudi Arabia started from stories and good fortunes that her friends
and neighbors had experience after working on the said country for
several years. Aside from the financial benefit she foresees to gain, her
main intentions on working in Saudi Arabia as a practicing Muslim she
wanted to do a Pilgrimage in Mecca which is considered to be the holiest
city of the Muslim religion. Her plan panned out with the help of their
neighbor who has known an individual named Maisara who recruits
individuals for possible work opportunities in Saudi Arabia for different
work positions. From Lanao Del Norte she went to Cotabato City where the
office of Maisara was located, She and other hopefuls were fetched by a
van arranged by Maisara from their homes to Cotobato City. Upon arrival
to Maisaras office they were informed and given documents that would
serve as their new identities (Name, Age, Address, Personal Information,
etc...). The reason given by Maisara was in order for them to have their
application approved and fast tracked thus their information and identity
needs to be falsified given that she was still a minor. Lorna was shocked
and hesitated initially but eventually agreed to the setup in consideration
of her dream to work in Saudi Arabia and to have a better life for her and
her family. Lorna stayed in Cotobato City from February to May of 2014 in
preparation for her upcoming trip abroad wherein they fixed and prepared
their paper requirements, passport, fees and medical checkup with their

newly assumed identities, thus Lorna was not her real name and the
information provided for on the information sheet of the Nayon ng
Kabataan center are not her real and true information. She does not want
her real identity disclosed thus we shall be calling her Lorna moving
forward. On the first week of May 2014 she was brought in Harisson Street
Pasay City, Manila and had stayed on an apartment managed by Maisara
and his partner Asrap. They stayed in Pasay City for more than a month
and on June 18, 2014 which was 1 day before their flight to Saudi Arabia
the apartment where they were living were raided by the CIDG and
everyone found on the apartment was taken into custody including Lorna.
Lorna was interrogated and was subjected to Dental check up to identify
her real age. After confirming that she was still 17 years of age and was
still a minor, she was brought to the DSWD in the Nayon ng Kabataan in
Madaluyong City which shall serve as her temporary home while the case
against Maisara and Asrap are being litigated in court since her parents
and relatives are all located in Lanao Del Norte.
2. What are the problems/concerns of your client?
Lorna was put under the custody of the DSWD at the Nayon ng
Kabataan in Mandaluyong City since June 2014. She doesnt see herself
as a victim since it was of her own choice, all she wanted is to go
home, be reintegrated back to her family and start a new life by finding
herself a job that would met her and her familys needs. She is
currently

awaiting

help

from

the government

to

shoulder

her

transportation expense to go back home to her hometown.


There is also a great concern of her safety and security given
that currently she serves as one of the witnesses of the prosecution
against her recruiters Maisara and Asrap. They are afraid and doesnt
want to disclose real and true information about herself. She currently

has trust issues against other people mostly strangers and always do
take precautionary measures before revealing any information.
3. What are the legal services which have already been availed of
and/or are still to be availed of or needed by the client?
Lorna is currently put under the security custody and monitoring
of the DSWD while her case is being tried in the court where is being
taken care of in regards to shelter and her daily needs. A Public
prosecutor visit them from time to time to give updates on their case
and to inform them if their presence and testimony is needed by the
court.
4. What other forms of assistance do you think your client needs
at this stage?
In my opinion since Lorna is an essential witness in order to
prove the guilt of the accused (Maisara and Asrap) and that these
persons being accused can be considered as person of financial means
given that they have a wide operation of their business in the province,
then just having Lorna put in under the protective custody of DSWD is
not enough since her posing and testifying against the accused puts
her in a situation that would be of great risk not only to her but also to
her family. I think that she and her family should be put under the
witness protective program if could be found out that there would be
an immediate and present threat or peril against their lives.
She should also be afforded for a speedy disposition of her case
and be immediately reintegrated back to her family in the province in
order for her to move forward with her life and put all of this behind
her.
5. What is the status of the clients case?

She is currently celebrating her one year under DSWD custody


and currently her case is still being tried by the court. She is awaiting
any further instruction from the prosecutors office if she would be
needed to further testify against Maisara and Asrap.
She does have constant communication with her family in Lanao
Del Sur and her mother wants her to go back home and start a new
life.
