EXTRAJUDICIAL SETTLEMENT OF ESTATE

WITH WAIVER OF RIGHTS


KNOW ALL MEN BY THESE PRESENTS:
This
AGREEMENT
made
and
entered
into
this
day
of
__________________, in the Municipality of Quezon, Province of Palawan,
Philippines, by and between:
EDGARDO PAGTANAC PAALAN, of legal age, Filipino, married, and
residing at Barangay Pinaglabanan, Quezon, Palawan;
EDWIN PAGTANAC PAALAN, of legal age, Filipino, married, and
residing at Barangay Riotuba, Bataraza, Palawan;
JOEL PAGTANAC PAALAN, of legal age, Filipino, married, and
residing at Barangay Pinaglabanan, Quezon, Palawan;
EMMANUEL PAGTANAC. PAALAN, of legal age, Filipino, married,
and residing at Barangay Pinaglabanan, Quezon, Palawan;
JOVY PAALAN TABARANGAO, of legal age, Filipino, married, and
residing at Sitio kinurong Barangay Riotuba, Bataraza, Palawan;
JELMA PAALAN. OMIPLE, of legal age, Filipino, married, and residing
at Barangay Pinaglabanan, Quezon, Palawan; and
JOAQUIN SABUYA PAALAN, of legal age, Filipino, widower, and
residing at Barangay Pinaglabanan, Quezon, Palawan;
WITNESSETH, that:
WHEREAS, we are the heirs of the deceased, PAZ PAGTANAC
PAALAN, who died on December 17, 2011, at Barangay Pinaglabanan,
Quezon, Palawan (A copy of her Death Certificate is hereto attached);
WHEREAS, PAZ PAGTANAC PAALAN, died intestate, without Will or
Testament, and without any outstanding debts in favor of any person or
entity;
WHEREAS, PAZ PAGTANAC PAALAN, is the owner and possessor of a
parcel of land, covered by Original Certificate of Title No. E-12260 registered
at the Office of the Register of Deeds for the Province of Palawan, containing
an area of Eight Thousand Four Hundred Forty Eight (8,448) square meters
located at Barangay Pinaglabanan, Quezon, Palawan, and more particularly
describe as follows;
Lot No. 9917, Cad. 798- D
Beginning at a point marked 1 of lot No. 9917, Cad. 798-D
being, S. 66-02 E., 5944.83 m from B.L.L.M. #1, Cad 798- D;
Municipality of Quezon , Palawan, thence.
N. 80-37 E., 127.21 m. to point 2; S.40-03 W., 74.78 m. to point 3;
S. 27-39 W., 87.01 m. to point 4; S. 79-16 W., 27.62 m. to point 5;
N. 04-45 W., 119. 12 m. to point 1; to point of beginning.
Containing an area of Eight Thousand Four Hundred Forty Eight
(8,448 ) Square Meters.

All corners are marked on the ground by P.S. Cyl Conc. Mons.
15 cms. X 60 cms.
Bounded on the N., along line 1-2 by lot No. 9918, Cad. 798 D;
on the SE., along lines 2-3-4 by Barangay Road;
on the S., along line 4-5 by lot No. 9915, Cad.798-B;
and on the W., along line 5-1 by lot No. 10134, Cad 798 D.
Bearing grid.

WHEREAS, pursuant to Rule 74, Sec. 1 of the Revised Rules of Court


of the Philippines, and being with full capacity to contract, we do hereby
adjudicate unto ourselves the parcel of land described above, in equal
shares.
WAIVER OF RIGHTS
We, JOEL PAGTANAC PAALAN, EMMANUEL PAGTANAC PAALAN, JOVY
PAALAN TABARANGAO, JOAQUIN SABUYA. PAALAN, JELMA PAALAN OMIPLE
(whose personal circumstances are mentioned above) have agreed willingly
to CEDE, WAIVE, TRANSFER, and CONVEY unto EDGARDO PAGTANAC.
PAALAN and EDWIN PAGTANAC PAALAN, (whose personal circumstances are
likewise mentioned above), or to their heirs and assigns, as we now hereby
CEDED, WAIVED, TRANSFERRED, and CONVEYED, the full ownership and
possessions of our shares, rights and participations over the above described
property in equal shares.
IN WITNESS WHEREOF, we have hereunto set our hands, this day of
________________________, in the Municipality of Quezon, Province of
Palawan, Philippines.
