Red Stripe Sued Over Misleading


'Jamaican' Beer Claims

class-action suit has been


filed against the manufacturers of Red Stripe beer in the
United States, for allegedly deceiving consumers into thinking
the beverage is made in Jamaica.
Two people represented by
the law firm of Robbins Arroyo
filed the suit last Wednesday in
federal court in California against
Diageo, the makers of Red Stripe,
historically a Jamaican beer.

They claim Diageo committed unfair and deceptive practices


and have been unjustly enriched
by marketing and selling beer in a
way that misleads consumers into
believing that its Red Stripe is still
being imported from Jamaica.
In 2012, Diageo moved its
production of US supplies of Red
Stripe from Kingston, Jamaica to
Latrobe, Pennsylvania.
The label on the bottle of US
supplies states that the beer is produced in Latrobe.
But Arroyos clients say its in
obscure white text and not easily
noticed by consumers.

According to the
court
documents,
Red Stripes packaging claims that
it is a Jamaican Style
Lager
that
contains The
Taste of Jamaica and the
packaging contains the distinctive logo of
Desnoes and
Geddes Limited.

Desnoes and Geddes is a Jamaican brewery.


The plaintiffs further charge
that Red Stripe is sold at substantially higher prices than domestic
beer, despite the fact that it is
brewed in the US with domestic
ingredients.
The lawsuit comes on the
heels of the worlds largest brewer,
Anheuser-Busch InBev reaching a
preliminary settlement with a
group of consumers who said the
company misled them into thinking that Becks beer was German
brewed.

We must embrace #BlackLivesMatter

ome 150 years after Abraham Lincoln's Emancipation


Proclamation freed the slaves
and set the stage for equality and
civil rights for everyone, African
Americans continue to face discrimination and other forms of
injustice.
The Republican Party of
Lincoln promoted individual
freedoms of all men as well as
the right for all to receive a public education. Democrats, at the
time, spoke of social progression, but did not act on it. Some
150 years later, so much has
changed and the Democratic
Party is now regarded as the
party that supports African
Americans.
Nevertheless, we must acknowledge that while we continue to see tangible progress
and achievements for Black
America, they continue to be at
the bottom of the poverty scale
with low income and poor educational attainment.

They also continue to experience overall poor living conditions.


African Americans, for example, account for less than 10
percent of the US population but
represent up to 70 percent of the
nations prison population. And
Blacks appear to be the target of
various agencies of government,
including police and other security personnel at the city, state
and federal levels. It would appear that in too many cases
#BlackLivesDontMatter as they
are being killed, abused and discriminated against without the
perpetuators (cops) facing penalties.
African Americans are very
active in politics, with the majority of the leaders Democrats.
Yet, in several New York City
communities that they dominate,
the agents of the state and city
treat black people with utter contempt.

It would appear that our


elected black leaders are not
doing enough to protect the people who put them in office. Perhaps they are too comfortable
and would not want to disturb

those misguided minority, but


influential racists that always
seek to harass African Americans as #BlackLivesDontMatter.
But there are millions of
Americans, include Whites who
are embracing the hashtag and
slogan #BlackLivesMatter a
grassroots movement of ordinary people such as activist
Shaun King, who claimed for
years that he is biracial but recently uncovered document revealed that he is in fact white,
and ex-NAACP chapter leader
Rachel Dolezal, the white
woman who posed as black for
most of her life and was one of
the most outspoken and aggressive advocates for black people.
The #BlackLivesMatter movement will continue to attract
people of various races and culture and may be the real solution
to bring racism under control.

Understanding Organizational Politics

rganizational politics are actions by individual members


of the organization and in some
cases groups, such as teams, to
obtain, develop, and exercise
power to achieve a desired outcome.
Organizational politics are
the natural outcome of situations
in which members of the organization share power but differ as to
the strategic direction the organization should take, the way strategy should be implemented, and
the resources that should be allocated to the various units in the
organization.
In most situations, organizational politics result in a negotiated settlement to resolve the
differences based on some degree
of compromise among the competing interests. As a result, organizational politics is not
inherently harmful to the organization because it functions as a
means to balance the relationship
between the internal structures
and groups.
The concept of influence exerted by leaders is closely related
to the concept of power. Influence
is the ability to motivate individuals by persuasion and noncoercive techniques. Power is the
ability to motivate individuals
through the use of control, which
can but does not necessarily include coercion.
From this perspective, power
can be considered in terms of the
possibility but not the certainty
that an individual will exercise
control over others.

Leaders in an organization
are more likely to adopt political
behaviors when decision-making
procedures and performance
measures are unclear or complex.
For example, in an organization without specific rules concerning individual accountability
for decisions, a leader may prefer
to achieve some degree of consensus with peers or superiors before making a decision. This
situation could result in the leader
using various forms of power to
influence peers to agree with the
leaders position.
Leaders may also behave politically when resources are
scarce and there is substantial
competition to secure sufficient
resource allocation. In this situation, political behaviors such as
trade-offs and maneuvering to
maintain competitive positioning
among peers are rewarded when
the leader obtains sufficient resources.
The leaders in an organization can also use the performance
appraisal process to foster political behaviors among followers,
which is an example of a negative
form of organizational politics.
The political approach to
performance appraisal occurs
when some criteria other than

performance is the basis for the


appraisal, such as support for the
leaders agenda.
As a result, the employees
performance is no longer con-

Gap Stores To Stop On-Call Scheduling

ttorney General Eric T. Schneiderman
released the following statement on the
decision by Gap, Inc. to end on-call scheduling:
"Today, following discussions with my
office, Gap, Inc. will announce that it will
end on-call shifts at all of its stores. Workers
deserve stable and reliable work schedules,
and I commend Gap for taking an important
step to make their employees schedules
fairer and more predictable. With this news,
following similar decisions by Abercrombie
and Fitch and Victoria's Secret, I am proud
to say that the inquiry by my office into oncall scheduling is delivering results for tens
of thousands of workers."

Pawnbrokers Sentenced
For Stealing Money

rooklyn District Attorney Ken Thompson


on August 7, 2015 announced that a 35year-old Brooklyn man has been sentenced
for stealing $120,000 from a Brownsville
branch of Modell pawn shops, where he
worked as a manager.
The defendant said he took the money to
pay off debts. He was sentenced to six months
of weekends in jail and there was a full order
of restitution filed against him.
District Attorney Thompson said, We intend to make sure that the defendant pays
back every dime that he stole from his employer and also serves jail time for his criminal conduct.
The District Attorney identified the defendant as Timmy Harrison, 35, of Ryder
Street, in Flatlands. The defendant pleaded

guilty before Brooklyn Supreme Court Justice


Danny Chun on May 26, 2015, to one count
of fourth-degree grand larceny. He was sentenced today to six months of weekends in jail
and signed a judgment for a full order of restitution.
The District Attorney said that, according
to the investigation, the defendant had been
employed at the Pitkin Avenue Modell Pawnbrokers since May 2010. As manager of that
location, he was responsible for all cash and
had exclusive access to certain secured areas
of the branch.
In August 2014, owner Eric Modell became aware of financial irregularities in the
Pitkin Avenue location and sent the Director
of Security to investigate.

Empire to pay $6M for Medicaid settlement

Brooklyn:
ttorney General Eric T. Schneiderman
on Monday announced a $6 million
settlement with Empire State Home Care
Services, Inc. (Empire), a home care agency
operating out of Brooklyn.
The settlement resolves claims that
Empire improperly reported its home health
aide hours as well as administrative and
general expenses on cost reports filed between 2002 and 2005. These cost reports
were used to set the reimbursement rates
that Empire received from the state for the
years 2004 through 2007 and resulted in
over $3 million in reimbursements to which
Empire was not entitled.
The audit revealed that Empire reported
the salaries and benefits of administrative
personnel under direct care cost centers,
rather than administrative and general cost
centers. By improperly placing these costs

in direct care cost centers, Empire received


inflated Medicaid reimbursement rates during the audit period. The settlement stipulates that Empire will pay $6 million to the
state, including penalties on top of the just
over $3 million that was improperly reimbursed.
Many New Yorkers count on Medicaid for important health services, and I will
continue to safeguard Medicaid funds to ensure they are being used for their intended
purpose, said Attorney General Schneiderman. When Medicaid reimbursements are
inflated by providers, it causes funds to be
diverted from those most in need.
The audit also found that Empire improperly allocated certain home office costs
to the direct care cost centers, thereby further inflating their reimbursement rate.

owner charged with tax fraud

QUEENS:
n Ozone Park auto body repair shop and
its owner have been charged with criminal tax fraud, grand larceny and other
charges for allegedly stealing more than
$125,000 in collected taxes that were owed to
New York State and local municipalities.
Queens District Attorney Richard A.
Brown identified the defendants as Stephanie
Davino, 31, of Howard Beach, Queens, and
her business, A&W Auto Collision Center,
Inc., located at 104-11 101st Street in Ozone
Park, Queens. Davino was arraigned earlier
last week before Queens Criminal Court
Judge Ernest Hart on a criminal complaint
charging her and the business with second-,
third- and fourth-degree criminal tax fraud,
second- and third-degree grand larceny, firstdegree scheme to defraud and fifth-degree
conspiracy.
Davino, who faces up to 15 years in
prison if convicted, was released on her own
recognizance and ordered to return to court
on September 30, 2015. In the case of a cor-

poration, conviction of a felony is punishable


by a fine of up to $10,000 or double the
amount of the illegal gain.
According to the criminal complaint,
said District Attorney Brown, Davino, who is
listed as the owner and president of A&W
Collision on tax and finance records, failed to
file a single sales tax return between January
26, 2012, and March 3, 2014. However, during that period of time, the auto body shop allegedly
performed
repairs
totaling
approximately $1.4 million and received payment for the repairs from GEICO, State Farm,
Allstate, Progressive and USAA insurance
companies. The total amount of sales tax allegedly due and owing to the city and state
amounts to approximately $125,700 ($61,965
to New York State and $63,735 to local municipalities).
When an auto body shop, or any business, fails to remit sales tax to the state it has
committed a serious crime with serious consequences, said Commissioner Jerry Boone.

BRONX:

Hamilton Smith, a Bronx resident, and
three other people with disabilities filed a
class action lawsuit last week in federal court
to end the illegal administration of a program
designed to transition them to their own
homes with the care and support they need to
live independently.

LLP, the suit alleges that the New York State
Department of Health (DOH), DOH Commissioner Howard Zucker, and Visiting Nurse
Association Health Care, Inc. (VNA) have
administered the Nursing Home Transition
and Diversion Medicaid Waiver Program
(NHTD Program) unconstitutionally and illegally. New Yorks Medicaid Plan trumpets
NHTD as a program that helps senior citizens
and individuals with disabilities avoid unnecessary confinement in nursing home facilities.
Hamiltons story is a common one. He
first applied to the NHTD Program nearly
three years ago and VNA found that he qualified to transition out of a nursing home. He
was unable to complete his application despite his repeated requests to VNA for assistance allegedly due to a lack of program
resources. After two years of trying to complete his application, VNA informed Mr.
Smith during a routine status update that his
eligibility determination had expired and
that he would need to reapply to the NHTD
Program.

US extends temporary
protected status for Haiti

WASHINGTON, USA:

S Secretary of Homeland Security Jeh Johnson has extended


Haitis designation for Temporary Protected Status (TPS) for an additional
18 months. The extended designation
is effective January 23, 2016, through
July 22, 2017.

Current TPS Haiti beneficiaries seeking to extend their TPS status must re-register during a 60-day period that runs from
August 25, 2015, through October 26,
2015. US Citizenship and Immigration

Services (USCIS) encourages beneficiaries


to re-register as soon as possible once the
60-day re-registration period begins.
USCIS will not accept applications before
August 25, 2015.
The 18-month extension also allows
TPS re-registrants to apply for a new employment authorization document (EAD).
Eligible TPS Haiti beneficiaries who reregister during the 60-day period and request a new EAD will receive one with an
expiration date of July 22, 2017. USCIS
recognizes that some re-registrants may not
receive their new EADs until after their

current EADs expire. Therefore, USCIS is


automatically extending current TPS Haiti
EADs bearing a January 22, 2016, expiration date for an additional six months.
These existing EADs are now valid
through July 22, 2016.
Haiti was initially designated for TPS
on January 21, 2010, after a major earthquake devastated the country. Following
consultations with other federal agencies,
the Department of Homeland Security has
determined that current conditions in Haiti
support extending the designation period
for current TPS beneficiaries.

Cayman Islands:

an eleventh hour deal to continue offering
remittance services in the Cayman Islands,
thereby averting a shutdown.
Jamaica National Money Transfer, MoneyGram, and Quik Cash have all made new
arrangements to stay in business.
The money service businesses will remain
under the oversight of the Cayman Islands
Monetary Authority (CIMA).
Uncertainty plagued the money transfer business in the Cayman Islands, following a sudden
closure of Western Union by Fidelity Bank in
early July. The companies had been given a
deadline of August 31 to make new banking
arrangements.
A remittance report released last year by
the CIMA revealed that Jamaicans send home
more money than any other group of foreign
nationals living in the Cayman Islands.

Foreign Affairs Minister Senator A. J.
Nicholson, in announcing the appointment,
said Ambassador Thomas served in China
during
an
important
time
for
Jamaica/China relations, especially in the
area of economic development.
Senator Nicholson said he expects Ambassador Thomas to bring this level of critical thinking and creative energy to the
relationship with the US, one of Jamaica's
major international partners.

Immigrant Children Release from Detention

he American Immigration Lawyers Association (AILA)


and the American Immigration Council (Council) welcome a decision released Friday evening by U.S. District
Judge Dolly Gee in Flores v. Lynch, No. 85-04544 (C.D.Ca.),
which ruled that children should generally be released from
detention within five dayspreferably to a parent, including
a parent with whom they were apprehended. The government
must implement the Courts ruling by October 23, 2015.
There is no denying that the government has breached
the Flores settlement agreement. The status quo is unaccept-

able, and the government must take immediate and dramatic


steps to end family detention, said Victor Nieblas Pradis,
AILA President. Our CARA Project staff and volunteers submitted numerous declarations to the Court showing how the
government is still detaining accompanied minors in secure,
unlicensed facilities. It can no longer hide from the American
people the ugly truth of how it treats children fleeing persecution, said Nieblas. Just as striking is how the Court condemned the deplorable conditions in temporary border jails,
said Nieblas.

Jamaicans win world 100M titles

IAAF World Championships 100m titles being
staged in Beijing, China.
Bolt took the gold medal in the 100 meters, edging out American rival and current title
holder, Justin Gaitlin, snapping his 28 race win
streak. Bolt finished with a 9.79, his fastest of
the year time of the year, but slowest of all his
championship victories. Bolt has been struggling with injuries for most of the season, and
beat Gaitlin by only 0.01 seconds. He said he
wanted this win for himself, and called it a big
deal.
Fraser-Pryce on Sunday retained her number one title in the womens 100 metres, by
winning gold in 10.76 seconds, just .05 seconds
faster then the silver medal winner from the
Netherlands. American Tori Bowie finished
third for the bronze and Fraser-Pryces compatriot, Veronica Campbell-Brown finished
fourth.
Both Bolt and Fraser-Pyrce each hold
three 100-metre world titles. Fraser-Pryce also

The Cayman Islands sports minister has
pulled governments contribution to the Cayman Islands Football Association (CIFA)
after the row over the refusal by the local
football body to accept two challengers to
the long-entrenched members of the executive committee escalated this week.
Bodden said that the government will,
in the current circumstances, redirect the annual payment give to CIFA of $127,775
(US$159,000) from the public purse to other
sport associations in the face of real concerns
that CIFA is failing to clean house and recognise the need for change.
The withdrawal of government funds
follows a statement from CIFA on Tuesday
in which officials made it clear that they
were not going to honour nominations from
two challengers to existing executive mem-

bers, citing alleged infractions, despite accepting the nominations in the first instance.
The challenge to the current leadership
came from Renard Moxam and Sharon Roulstone but the CIFA committee is refusing to
allow the pair to stand during this weekends
annual executive election, which has caused
wide public outcry, as many believe the current leadership of CIFA is not only out of
touch and failing the sport but also tainted by
the wider FIFA probe, in which the suspended president, Jeffrey Webb, is deeply
entrenched and refusing to admit anything is
wrong.
Bodden said on Tuesday that the technicality used to block the bids of those seeking office may be in the rule book but, in
light of all that has happened, it was time to
allow some changes to the CIFA executive.

he Who's Who's within New York's Jamaican Diaspora, turned out in their fineries to celebrate the island's 53rd year of
Independence at the annual Jamaica Independence Grand Ball held on Saturday, August 15th at the New York Hilton hotel in the
heart of New York City.
It was a grand evening of fun and fashion, with lots of food and drinks flowing.
Ladies were looking elegant in their gowns
and the men were quite dapper in their suits.
For the first time, the Jamaican Independence
Celebration Foundation, Inc., (JICFI) under
the leadership of Paulette Willoughby, made
the bold move to recognize "young and gifted
Jamaicans at home and of the diaspora as Future Leaders."

he Caribbean may be missing an important opportunity by not fully tapping into the growing volunteer tourism or
"voluntourism" market, according to veteran community development expert and
nonprofit advisor Kwayera Archer-Cunningham.
With more than 25 years of experience
as a nonprofit leader, Archer-Cunningham,
who travels frequently between her Jamaica
and New York offices, said many tourists
are traveling to the region with a desire to
have a positive impact and make a difference in addition to having fun.
"Unfortunately, too often there are not
enough avenues that are visible for visitors
to figure out how they can help before they
leave and go back home," she lamented.
"Many people have great intentions.
They want to figure out how they can make
the region a home away from home, not
just by enjoying the beach, but also volunteering for an hour or helping a school whether by contributing towards the cost of
a computer or a smart board," said ArcherCunningham, who specializes in community and organizational development,
philanthropy, and social entrepreneurship.
Archer-Cunningham believes that the
hospitality industry, especially hotels,
should be encouraged to establish strategic
partnerships with local and regional media
to increase awareness of the social and philanthropic needs within the destination. "We
need broad communications channels so
that people traveling to the Caribbean - either single or multiple destinations - receive
the information and access they need to
make decisions about how they can contribute their time, dollars and energy," she
commented.

A Trend in Hair Removal

y focus in the past article was hair removal for men. In this article I will
continue on the same thread however the
method of hair removal is Electrolysis for
both men and women.
Electrolysis is the process of removing
one hair at a time. The hair can be removed
from the face or body. The electrolysis device destroys the growth center of the hair.
The hair is destroyed either by chemical
or heat. Note, a probe is inserted into the hair

Dear Divine Diva:


have been dating a divorced man, "Chris,"
for four years. He has a son who is 16. On
the weekends Chris has his son, I become the
"invisible girlfriend."
Sometimes the three of us will go to a
movie or out to eat, but I am never welcome
to spend the night.
Chris and I have talked about living together, but never in depth. Unless I bring it
up, he never says anything about it. When
Valentine's Day came around, Chris asked if
we could celebrate it a few days late because
he was scheduled to have his son that night.
I was heartbroken because even a Valentine dinner for the three of us was out.
I am beginning to think there is no future
with Chris. He seems fine just dating and
seeing me every other weekend as someone
