AFFIDAVIT OF WITNESS

I, Rogelio A. Que, of legal age, Filipino, single and a resident of General

Alvarez Street, Macrohon Drive, Canelar, Zamboanga City, stated under
oath as follows:
That the person examining me is Atty. Foster Kin Sumpiao with office
address at AAA Law Office, Veterans Street, Zamboanga City. The
examination is being held at the same office address. I am answering his
questions fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.
PURPOSE: This affidavit or testimony of Rogelio A Que is being offered to
prove that a check amounting to One Million Two Hundred Ten Thousand
Pesos (P 1,210,000.00) was delivered and paid to Mr. Mohammad Malik E.
Amondi and an acknowledgement receipt was delivered to Mr. Mohammad
Malik E. Amondi and the same was received and signed by Mr. Mohammad
Malik E. Amondi.

Questions were propounded by Atty. Foster Kin Sumpiao, and these

questions are numbered consecutively and each question is followed by the
answer of the witness.
1. Q: Please state your name and personal circumstances for the record.
A: I am Rogelio A. Que, of legal age, Filipino, single and a resident of
General Alvarez Street, Macrohon Drive, Canelar, Zamboanga City
and I am currently employed as Company Driver of Mr. Froilan Chua
under the company of Chuas Incorporated International.
2. Q: How long have youve been working for Mr. Chua?
A: Since 2010.
3. Q: Where were you on the 5th day of January 2014?
A: I accompanied Mr. Froilan Chua at the residence of Mr.
Mohammad Malik E. Amondi at Guiwan Zamboanga City.
4. Q: What was your purpose of going at Mr. Amondis residence?
A: To loan money from Mr. Amondi. Mr. Froilan Chua borrowed the
sum of One Million Pesos (P1, 000,000.00) from Mr. Mohammad
Malik E. Amondi and I personally saw Mr. Mohammad Malik E.
Amondi handed Mr. Froilan Chua One Million Pesos (P1, 000,000.00)
in cold cash.
5. Q: Where were you on the 14th day of August 2014?
A: On the morning of August 14 2014, I drove Mr. Froilan Chua to
AAA Law Office, Veterans Street, Zamboanga City and after leaving
the building I dropped him at the airport for his flight to Manila.
6. Q: What did you after you left the airport?
A: I was tasked by Mr. Froilan Chua to deliver a check and an
acknowledgment receipt to Mr Mohammad Malik

7. Q: And did you do all that was asked of you by your employer?
A: Yes, on the afternoon of August 14 2014, I personally delivered the
check and acknowledgement receipt to Mr. Mohammad Malik E.
Amondi. The same was received by Mr. Amondi and was signed in
my presence and as instructed I returned to our office and gave the
received copy of the acknowledgement receipt bearing the signature
of Mr. Mohammad Malik E. Amondi to Ms. Rachel Ann Daquis
8. Q: Is there anything else you would want to add, correct in your
statement both oral and written?
A: None attorney.
