BPS IS PINCHING

The A.P. High Court cleared the building penalisation scheme (BPS) but still not many
applications pertaining to high-rise buildings have been cleared and issued occupancy
certificate by the Greater Hyderabad Municipal Corporation. Reason: Builders/occupants have
to invest lakhs of rupees for putting in place fire-fighting equipment and secure ‘no objection
certificate’ (NOC) from the fire services department and the Airports Authority of India (AAI).
As far as present BPS cases are concerned - As per the Technical Approval of the
HUDA, the erstwhile MCH and surrounding municipalities have given construction
permissions. The technical approvals a standard format clearly says that, “the municipal
authority shall allow the proposed building/complex to be occupied /used or otherwise let
out etc., only after; completed in accordance with the technically approved building
plans; after ensuring the conditions with regard to water supply and sewerage disposal
systems as mentioned ….are complied to the satisfaction of the municipal authority and
after issuing a “FIT-FOR-OCCUPANCY” certificate by the authority as required in G O
248 MA of 23/5/1996. The applicant is responsible for structural safety and safety
requirements in accordance with the NBC of 1993.”
Before the High Court nobody brought the Technical Approvals. If it would be placed,
there would have some reliefs to all the BPS applicants. Now those High-rise owners find BPS
pinching. The municipal administration and urban development department have decided to
inspect each and every high-rise building. Once inspection is done, the civic officials will ask
builders to get NOC from the fire services and the AAI. The corporation gives one month time
for submitting NOC from fire services and AAI and 15 days for submitting any documents not
submitted earlier.
As such there were no restrictions from the MAUD to inspect all high rises etc all these
days. One fails to understand, why they are taking delayed decisions? The GHMC chief city
planner B Purushottam Reddy: “Those seeking regularsiation of high-rise buildings need not
wait for intimation letter from the GHMC. They can approach fire services and AAI directly.
When most of the builder/developers have been awarded fresh licenses as per the new rules,
why the GHMC is insisting on the individual BPS (Flat Owners) applicants to produce
‘Structural Stability Certificate, NOC from Fire Safety department, etc’?

narrowed down based on area, organization, sex or even vehicle. For safety purposes only
mobile number and email address given during registration is used to slot people into their
respective areas but is not available to searchers.
People who do not own a vehicle can travel with those who do on a cost sharing basis while a
group of people, all of whom own vehicles, can use them on a rotation basis. Also, people
living or working in the same area who travel by two-wheelers can hire a taxi together. There
will be a nominal charge for registration.

Effects of Radiation from Cell Phones Harmless


Allaying fears of ill effects of radiation from cell phones and base towers, the Cellular
Operators Association of India (COAI) and Association of Unified TeleCom Service
Providers of India(AUSPI) assure that there was no scientific evidence that established harmful
affects of cell phone radiation. “ Studies taken up over the years on radiation from mobile
phones and towers have found no harmful effects or any health risks to users,” says
T.V.Ramachandran, Director General of COAI during a workshop on ‘Radiation from Mobile
Phones and Towers- Myth Vs Reality’.
Speakers at the seminar said that the radiation from a mobile phone falls into the non-
ionizing category, which do not cause any genetic damage when compared to radiations of a
much higher frequency. “the emissions from mobile phones and base towers are hundred times
lower and cannot cause health hazards,” said Mr.Ramachandran.
However, the materials used for coating mobile phones have known to cause allergies. “
materials such as nickel, aluminium and chrome used as coating agents on electronic gadgets
can cause allergic rashes,” said Dr.Gnaneshwar Rao, Head of Department of Dermatology,
Gandhi Medical College.

Court Directive to GHMC:


Justice R.Subhash Reddy of the High Court directed the government and the GHMC to protect
the nine open spaces in Mansoorabad area of erstwhile L.B.Nagar Municipality. These orders
were passed on a writ petition filed by residents of Vijayasari Colony.
They complained that the land owner who prepared the layout and sold the plots to them was
selling away the open spaces and no officer was taking any action. Justice Subhash Reddy
declared that the land owner who prepared the layout cannot continue to hold on to the open
spaces.
He directed the GHMC to protect these nine open spaces and develop them for community
purposes.

Dialogue with GHMC:

There were lots of amendments to Hyderabad Building Rules – 2006. Like wise, in
BPS too there are frequent changes. By the time all the BPS cases are disposed off; we will be
facing another general election. In GHMC website we find the BPS status of Circles
1,2,9,11,12 & 14 there is no information about the applications of other circles. Why the data
of other circles not uploaded? This clearly shows the lack of sincerity of the GHMC in
disposing off BPS cases. Before asking the Town Planning department to dispose off the cases
where there are no legal hassles in next 40 days, the C&SO should have asked for updating the
details on non-applicants especially in apartment blocks, the details of penalty to be levied for
those applicants as well as how many cases are being delayed due to legal hassles. It is a
known fact that, the GHMC / Fire Safety / HMDA / MAUD is yet to reply in several BPS
related petitions pending in various courts. Town Planning department dilatory tactics has
spoiled the essence of the scheme and making it a five year plan. I hope that, UFERWAS will
ask for the details from the all department concerned under RTI act on various points raised.

Committees) meetings immediately and to invite other organizations also to join the committee
along with the existing members.

4. Follow up of the Maintenance & Welfare of the Senior Citizens & Parents Act. 2007.

IV. Three documents are approved to be presented to the Hon’ble Minister, Smt. Konda
Surekha, Smt. M. Chaya Ratan, Principal Secretary, Women Development & Child Welfare,
Disabled Welfare & Senior Citizens, Juvenile Welfare, Sri. C.V.S.K. Sarma, Principal
Secretary, MAUD. In the afternoon, three delegations went and discussed the matters with the
Hon’ble Minister, Mrs. Chaya Ratan and Mrs. S. Pushpa Subrahmanyam. They were received
in a very cordial manner. The organsers of elders homes and the senior citizens associations are
encouraged to apply for the Central goverments’ grants based on the new criteria. A document
describing the 16 programmes are supplied in Telugu. The English version could be down-
loaded from the website.

V. A copy of the letters addressed to the Hon’ble Minister and to the Principal Secretary:
Madam,
Our Federation has been functioning as an apex body for various senior citizens
organisations in the State for the past one decade with a wide network in all the districts. We
have the following matters to bring to your attention:

1. There is a State Council for the Implementation of the National Policy on Older
Persons. This needs to be convened every six months to review the actions taken by
various departments.
2. The State Government has notified the Maintenance & Welfare of Senior
Citizens and Parents Act but has not yet framed the Rules & Regulations for
its implementation.
3. Budget allotment is very small for the senior citizens. Funds for observing the
1st October as the World Elders Day are not readily available.
4. Based on the above mentioned Act, last year the State Government announced
that they would facilitate setting up of at least one old age home in each
district. This year’s budget does not seem to envisage that. You may take the
assistance of the NGOs already working in this field.
5. The senior citizens deserve travel concessions in the fares and other facilities
in the transport managed by APSRTC.

Sub: Introducing AASARA in all Municipalities in A.P
The Aasara programme launched by the Greater Hyderabad Municipal Corporation
(GHMC) has completed two years of useful existence. It has created awareness and inspired
strength and security among senior citizens about their role in the society. There are about
hundred senior citizens associations in Hyderabad city under the umbrella of AASARA. Nearly
35, 000 Id cards are obtained by the senior citizens, with a number of benefits accruing to them
in the municipal services. The officials concerned have shown a lot of commitment and
devotion to the cause. Since, it became a best practice, visitors from other parts of the country
are also studying the scheme.
Now, we think, it is necessary to initiate the same programme in other Corporations
and Municipalities as well. We request you to actively take up the programme of AASARA in
cooperation with our District Senior Citizens Committees (DISCs).

Forum for Senior Citizens of Tarnaka


The Forum’s July Meeting was held in Habsiguda, St.no.8 Municipal community hall, along
with the Executive committee meeting a get together of the Forum Members. Special
invitations were extended to the members whose birthday and wedding anniversary was
celebrated during the month. The special highlight of the meeting was a small speech by Sri
.Ram Jaya Ram of Vijayapuri Colony on ----------- The members present were out of their
world when Dr.D.N.Varma and Dr.K.L.Vyas made them laugh with their jokes suited to the
ears of the Senor Citizens

The Day Care Centre of Tarnaka had a special occasion to celebrate when a special computer
table with lovely wooden drawers was presented by Mr.Mrs.K.Maheshwara Rao of Nagarjuna
Nagar, Tarnaka. The gesture was so spontaneous that a word from our members that the table
will b used by the Senior Citizens in the Day Care Centre was enough for the resident to
donate the same.
