JUDICIAL AFFIDAVIT
I, JUAN SANTOS-CONCIO, of legal age, Filipino, single and a
resident of Panabo City, Davao del Norte, Philippines, state under oath as
follows:
PRELIMINARY STATEMENT
The person examining me is Atty. Nylor Jay T. Astronomo, with
office address at Quezon St., Panabo City, Davao del Norte, Philippines.
The examination is being held at the same address. I am answering his
questions fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.
QUESTIONS AND ANSWERS
Q1:

Are you the complainant in this case? (Ikaw ba ang

compalinant aning kasuha?)

A1:

Yes. I am the private complainant representing the Santos

Plastic Manufacturing Corporation, being the Officer-inCharge. (Oo, ako ang private complainat, isip representative
sa Plastic Manufacturing Corporation, bilang Officer-inCharge.)

Q2:

Are you authorized by the said corporation to file the present

case? (Gi-autorisa ka ba sa maong corporation para mo file

A2:

Yes. I was authorized by our corporation to file this case. In

fact, I was authorized through a Special Power of Attorney
and a Board Resolution. (Oo, gi autorisa ko pinaagi sa

I am showing you a Special Power of Attorney (Exhibit A). Is

Q4:

I am showing you another document, paticularly a Board

Resolution (Exhibit B). Is this the one you are referring to?

Q5:

So why did you file the present case against the accused? (So
nganong ni file man ka aning kasuha kontra sa akusado?)

A5:

I filed the present case because the accused issued a check

in favor of Plastic Manufacturing Corporation, to which I am
the representative. The check bounced. (Ni file ko aning
kasuha tungod kay ang akusado ni issue ug cheke para sa

Q6:

Why do you know that the said check issued by the accused
bounced? (Nganong kabalo man ka nga ang maong cheke
nga gi issue sa akusado ni talbog?)

A6:

I know because I was the one who personally received the

check from the accused at our office at Brgy. Cagangohan,
Panabo City. I was likewise the one who personally encashed
the check at Security Bank, Panabo City Branch. When the
said check was presented at the said bank, it bounced.

What was the reason why the said check bounced? (Unsa

Account Closed.

Do you have any evidence to prove it? (Naa ba kay ebidensya

Davao-Magsaysay Branch, dated January 25, 2015, in the

amount of Php 50,000.00, issued to PMC, with a stamp
Account Closed (Exhibit C, C-1). Is this the check you
are referring to? (Ipakita nako sa imo ang Banco de Oro
Check No. 0183812, Davao-Magsaysay Branch, petsa
January 25, 2015, sa kantidad nga Php 50,000.00, gi issue
para sa PMC, ug mat tatak nga Account Closed. Mao ba

Yes, this is the chek. (Oo, mao ni nag cheke.)

Q10: After you learned that the said check was dishonored, what
did you do? (Pagkahuman nimo nahibal-an nga nitalbog ang
mga cheke, unsa imong gihimo?)
A10: I informed the accused about the check. He was even sent a
Notice of Dishonor, but he refused to receive it despite being
served personally with the said Notice of Dishonor at hi
residence at Landmark III, Upper Panacan, Davao City.

because despite the lapse of months after the accused was
informed and was served with Notice of Dishonor, he did not
bother to pay for the value of the said check. (Pagkahuman
ato, ako, isip representative sa Plastic Manufacturing
Corporation, ni file aning kasua sa paglapas sa BP Blg. 22
tungod kay maski nilabay na ang pila ka bulan human
mapahibalo ug matagaan ug Notice of Dishonor ang
akusado, wala man gyud siya nibayad sa kantidad sa
nakasulat sa cheke.)
