WE seek to establish a jus-
tice system whereby it is
the people themselves
who exercise the power to
say who must be arrested
and brought to trial and
who exercise the power to
judge if those brought to
trial are guilty or not.
The power to say who
should be tried in court is
now exercised by the
prosecutors in the Philip-
pines. So that if the one
being accused of rape,
murder or corruption is
influential, which is most
likely, the prosecutors can
easily be intimidated or
bought. BUT if we put this
power in the hands of a
Grand Jury, usually com-
posing 23 persons selected
by raffle from a voters’ list
and whose names and
faces are kept secret, we are
foreclosing any opportu-
nity for the influential crime
doer to use his power,
money and influence. The
role of the fiscal shall be lim-
ited to the presentation of
evidence in court. The
Grand Jury is vested with
the power to compel intimi-
dated or bought witnesses
to speak up or he will be
jailed until they agree to
speak up by the power of
contempt; law enforcers
will be compelled to gather
evidence or they will be
held in jail in contempt un-
til they agree to work as
detectives.
Now, the power to say
whether an accused is guilty
or not is exercised by one
judge in the Philippines;
may be of a regional trial
court or a municipal trial
court. As we know or hear,
the powerful and rich ac-
cused can easily influence
or buy decisions. BUT if we
place this power in the
hands of a Trial Jury, a group
of 12 ordinary persons cho-
sen at random from the vot-
ers’ list and whose faces and
names are kept secret, we
are also foreclosing any op-
portunity for the decision to
be bought or influenced.
Here, ordinary persons are
tasked only to know what is
true and what is false; the
application of laws shall be
the duty of the judge who is
learned in law.
The fact that we are fore-
closing opportunities for
tampering with justice, we
are sure that the abusive
and corrupt shall learn to toe
the line and observe the rule
of law.
The vision here is we see
everybody to be “PATAS
SA BATAS.”
With jury, all laws can
now be implemented. If we
have laws against discrimi-
nation by one tribe against
another, or by Christians
against Muslims, or by the
rich against the poor, we can
say that rebellions (by NPA
and MILF) will die because
the root that is discrimina-
tion is being attacked by
the Jury Systems.
With all corruption
laws assured of implemen-
tation, the usually corrupt
officials will be compelled
to stop stealing people’s
money. The swindlers will
stop because they know
the long arm of the law will
surely reach them.
Businessmen will deal
fairly with the consumers
because the assurance of
implementation of the laws
keeps them at bay.

A: The approval of origi-
nal C-5
First, it is undisputed that
during Marcos time the C-5 road
project was already approved
to connect North Luzon Ex-
pressway to South Luzon Ex-
pressway and to Coastal Road
in Cavite without passing
through Manila City.
This project approved dur-
ing the last year of the presi-
dency of Marcos had long be-
gun its construction.
The portions of C-5 or Cir-
cumferential Road 5 are the fol-
lowing: (1) Gen. T. De Leon
Road in Valenzuela City to con-
nect to North Luzon Express-
way; (2) Tullahan Road in
Valenzuela City; (3) Mindanao
Avenue in Quezon City; (4)
Tandang Sora Avenue in Quezon
City; (5) Congressional Avenue
Extension in Quezon City; (6)
Katipunan Avenue in Quezon
City; (7) Boni Serrano in Libis,
Quezon City; (8) E. Rodriguez
Jr. Avenue in Quezon City and
Pasig City; (9) Carlos P. Garcia
Avenue in Makati City and
Taguig City connecting to South
Luzon Expressway; (10) the
road adjacent to Merville Sub-
division; and (11) Las Piñas-
Parañaque Link Road; and (12)
from the end of the link road to
Coastal Road (C-1).
In the original project, the
road from South Luzon Ex-
pressway to Coastal Road in
Bacoor, Cavite shall be 6.3 kilo-
meters and it was dubbed as
“Manila-Cavite Toll Express-
way Project” (MCTEP).
But in the new C-5 design,
it became 9.7 kilometers because
it had to pass in a zig-zag man-
ner through other Villar proper-
ties in Cavite.
B. The foreign loan worth
1.7 billion pesos
In the approval of MCTEP
or the original C-5 South Exten-
sion project, the government
authorized Public Estates Au-
thority (PEA) to secure foreign
loans for the project, implement
the same in coordination with
the Department of Public Works
and Highways (DPWH) for the
purchase of lots through which
the road should pass through.
When the toll road is com-
pleted, it shall be under the su-
pervision and control of PEA
Tollway Corporation, a subsid-
iary of PEA.
As a consequence, PEA bor-
rowed money in the amount of
$68,564,875.00 in the currency
of the United States of America.
To prove the existence of
this loan, Clause A is hereby
quoted:
“The borrower (PEA) re-
quires loans in an aggregate prin-
cipal amount of up to Sixty-
Eight Million Five Hundred
Sixty Four Thousand Eight
Hundred Seventy Five Dollars
($68,564,875.00) for the pur-
pose of financing the acquisi-
tion of the right of way for the
Manila-Cavite Toll Road
Project (the ‘Tollway Project’).”
At the time of the loan,
which was guaranteed to be paid
by the Republic of the Philip-
pines, the amount of the dollar
was 25 pesos to 1 dollar.
Computing, the loan in pe-
sos amounted to 1,714,121,900
pesos.
This loan was used to pay
for the owners of the lots
through which the MCTEP
road would pass through.
In fact, this loan has already
been consumed to pay all the
owners of the portions of lots
eaten by the MCTEP.
C. Private contractors of
MCTEP
Since this is a toll way
project, it was bid out to pri-
vate contractors willing to pay
for the construction of the road
and run the toll way like in the

In due time, UEM-MARA
started the construction of the
toll road.

UEM-MARA, the project that

quest of Bro. Velarde, Henry Sy
and Rep. Manny Villar for the

ruary of 2008 for every mural
work that he painted on walls
on streets of Sampaloc, Ma-

Pretty-faced, Rep. Bonoan-
David, a lawyer, has been bap-
tized as “congresswoman tar-
paulin” by some of her con-
stituents because tarpaulins can
be found in almost all walls and
C-5 extension project to be
modified.
The same was recommended
for approval by then DPWH
Secretary Gregorio Vigilar.
Momentarily, then President
Joseph Estrada was elected as
the new president and Vigilar
remained as the secretary of the
DPWH.
At the beginning of the new
terms of offices, Villar ran for
Speaker of the House of Repre-
sentatives and then Makati con-
gressman Joker Arroyo deliv-
ered a searing privileged speech
exposing Villar’s irregular and
improper loan transactions with
SSS, GSIS and Pag-Ibig.
But this time, Joker de-
fended Villar on the same ac-
cusations he hurled against
Villar in his 1998 privileged
speech against the Las Piñas
senator.

Details of the complaint
In his complaint, Macaso
said that he has been servic-
ing politicians in Manila as a
graphic artist, where among
his customers was Bonoan-
David of District 4, City of
Manila.
In November of 2007,
Macaso said that he got his
first art job for Bonoan-David
to do a mural on a wall on a
street in Sampaloc, Manila for
a contract of P6,000.00.
After completing the work,
Macaso said he collected pay-
ment from Bonoan-David’s
staffer named Evelyn Cruz.
He said:

center of controversy involving
their live program hosts who give
entertainment especially to chil-
dren, where children are being
guided by their parents and par-
ents who ask for help from teach-
ers how to be good example to
others.
But if the teachers are being
insulted, that is another topic.
The newest controversy in-
volving a controversial actress/
host occurred in the mid-morn-
ing of January 7, on its show
named It’s Showtime.
And the parties who have
been insulted…. are the teach-
ers.
Before the said controversy,
a complaint has been filed before
the office of the Movie and Tele-
vision Review and Clarification
Board (MTRCB) against ABS-
CBN and Florida C. Tan, vice
president for TV program and
entertainment of the network.
A complaint filed by Atty.
Jonathan S. Presquito pertain-
ing to the alleged “vulgar lan-
guages” of Rosanna Roces dur-
ing the live telecast of It’s
Showtime on January 7 wherein
MTCRB cited a probable viola-
tion of Section 3 of Presidential
Decree No. 1986 or violation
against decency of the TV show.
The said complaint was filed
due to remarks made by Ms.
Roces to the show’s permanent
judge Vice Ganda’s comment.
Nevertheless, If the said top-
rating show will be suspended
by Chairman Laguardia, this will
be the second time that the
Lopez-owned network’s show
will be penalized by the said of-
fice.
The first penalty they had
was a three-day suspension or-
dered by the MTRCB against
the noontime show Wowowee,
after a “wardrobe malfunction”
incident worn by a dancer dur-
ing a live telecast dance routine.
The said noontime show host
had also been suspended by the
said office after insulting the cor-
tege of the late President Corazon
Aquino.
This new controversy should
not be ignored, instead sanctions

About an hour later after the
January 7 incident, Dyaryo
Magdalo called the attention of
the Alliance of Concerned Teach-
ers (ACT) informing them about
the said controversy that in-
volves the profession they rep-

Luna High School in Quezon
City also condemned the con-
troversial actress after informing
the said issues.
In an interview with the
former teacher of the said school,
Ms. Dalisay said that the issue
came to her and her former co-
teachers the day after the inci-

She also requested for the
transcripts of the said episode
or even only the part where Ms.
Roces uttered her remarks. She
also asked for the publication of
the incident so that the other
teachers who had missed the said
episode will know the whole

private contractor to stop the
foolishness because their toll
road project will not earn.
Who will pass the toll road
to pay when there is an adja-
cent good road to pass through
for free?
Because the toll road con-
tractor backed out of the old C-
5 project, what will happen to
the road lots bought for P1.7
billion by the government?
It will go to waste because it
can never become a road, after
all.
H. Who will pay the P1.7-
billion foreign loan for old C-
5 extension?
Because the old C-5 route is
no longer viable as a toll road,
there is now nothing from which
the projected payments for loan
can be sourced.
Under the foreign loan agree-
ment, it is the PEA that shall
pay and the Republic of the
Philippines is the guarantor.
This means that the govern-
ment has spent P1.7 billion for
nothing.
Why Villar should propose
that C-5 should be zig-zag
when a shorter straight line
route was already in place in
the old C-5 design and the
owners of the lots to be af-
fected were already paid or
programmed to be paid?

that the C-5 south extension

I. Developing subdivisions
with the government paying for
main roads
In ordinary subdivision
projects, the owners-develop-
ers are required by law to pro-
vide for roads from their own
land and develop the said roads
by spending their own money
so that they are justified to sell
the subdivided lots in higher
prices.
But in the case of the new
C-5 design, it is now the gov-
ernment that paid for the main
roads connecting Villar subdivi-
sions to the mainstream eco-
nomic communities.
What is more, it is also the
government that developed the
said main road named C-5 Ex-
tension Project.
With the very good road
now in place, Villar can sell his
subdivision properties at very
high prices without building ac-
cess roads.
J. Proofs that Villar’s pork
barrels were used

that Senator Manny Villar
used his pork barrels to en-

THERE is this barangay chair-
man in Barrio Obrero, Tondo,
Manila who has been accused
of acts that are reminiscent of a
“Little Ampatuan” in terms of
impunity.
Without offense to the
Ampatuan family, this term is
merely used on the basis of the
popular portrayal by the me-
dia that it is associated with
arrogance to defy laws.
The said barangay chairman
is identified as Joselito “Itoy”
Ejercito, chairman of Brgy. 190
Zone 17 District 2 Bo. Obrero
in Tondo, Manila.
The charges being hurled at
him are: (a) nepotism for caus-
ing the appointment of his in-
law as treasurer of his
barangay despite the evidence
showing that her mother-in-
law is actually a resident of
another barangay; (b) having
in the possession of his
barangay a stolen motorcycle
already mounted with a side
car marked as a barangay ve-
hicle; (c) child abuse; (d) ob-
struction of justice; (e) tres-
passing; (f) grave coercion; and
(g) illegal arrest.
His in-law, Teresita
Punzalan, was named by him
as treasurer in an appointment
paper dated December 22, 2008.
The said appointment was
pushed through despite the re-
quirement of Sec. 395 of Re-
public Act 7160 that the
barangay treasurer shall be of
legal age, a qualified voter, and
an actual resident of the
barangay concerned.
The said law also prohibits
from appointment to treasurer
any kagawad, any government
employee, or any relative of
the punong barangay within the
fourth civil degree of consan-
guinity or affinity.
By affinity, or by marriage,
the mother-in-law is of first
degree and a sister-in-law is
second degree by marriage.

Villar’s properties
In the testimonies of Carlos
Manila Police District Anti-Carnapping and Hijacking Section Chief, C/INSP. Randy
Maluyo together with PO3 Rommel Enrico inspect the recovered Honda XRM
motorcycle. The vehicle was reported stolen last May 12, 2009 and after months of
searching, the search party found the vehicle in the possession of Brgy. 190 Zone 17
District 2 of Manila with a big inscription of Chairman Joey “Itoy” Ejercito on the
hind side of the sidecar. The owner, Darwin Añonuevo, was surprised to find out that
his motorcycle is now fitted with a sidecar and is being used as service vehicle in the
said barangay.
The chairman has also been
accused by his people of arro-
gance. They said that they of-
ten see him brandishing a .45
caliber pistol while on a check-
point area together with a rank-
ing Manila police official.
During checkpoint routines,
chairman Itoy flagged down
motorcycle riders to check pa-
pers. Some who managed to
show registration documents
were allowed to go but after
giving P300 to P500 bribe. The
riders who failed to show docu-
ments and money were appre-
hended and their vehicles im-
pounded.
One particular motorcycle
of a certain Dennis Añonuevo
was reported by the owner to
the MPD Anti Carnapping
Unit as stolen.
The police personnel dis-
patched a team at once to trace
the whereabouts of the stolen

function revolves around inves-
tigation of administrative cases
and road-right-of-way prob-
lems, stated that he was the one
who actually investigated and
determined whether the prices
of the lands to be acquired as

sign, he told the Senate commit-
tee hearing that he based the
prices of Villar’s lands on the
zonal values prepared by the
Bureau of Internal Revenue.
It is noted in the distant past
that Villar argued that there was
no overprice in the lands ac-
quired from him for the new C-
5 road design because it was the
BIR that fixed the prices.
His defenses put up by his
underlings insisted that Villar did
not have any hand in fixing the
prices.
As it showed in the testi-
monies of Bacolod, he indeed
confirmed that he did not see
Villar intervening in his work of
investigating the correctness of
the prices of the lands to be ac-

vehicle. After several months
of search, the vehicle was found
in the possession of Chairman
Ejercito but already mounted
with a side car.
The stolen motorcycle, a
XRM-type, has a sidecar with
the chairman’s name inscribed
on the hind side. The chairman
did not want to let go of this
vehicle because it has been used
as a service vehicle of the
barangay.
“Alam ni Mayor ang
ginagawa ko,” he boastfully
told his detractors, asserting
that the things he has been do-
ing, including the appointment
of the treasurer and the use of a
stolen motorcycle as a barangay
vehicle had the blessings of
Mayor Fred Lim.
The chairman was also re-
ported to have complained to
Mayor Lim that he has been
harassed by his barangay mates.

the said lot. This was also a
raw or undeveloped land.

a total of P24,488.00 for
1,673.83 square-meter part of
the said lot. This was also a
raw or undeveloped land.

the mayor to tell him the com-
plete opposite.
It appears that these com-
plaints have substantial evi-
dence, the minimum amount of
proof required to convict in
administrative cases.
As such, the barangay chair-
man must be guilty of nepo-
tism and grave misconduct for
the use of a stolen motorcycle.
He cannot feign ignorance
for ignorance of the law excuses
no one from compliance there-
with. Ignorantia legis non
excusat.
Actually, the residents have
already filed a complaint be-
fore the Office of the Ombuds-
man concerning the appoint-
ment of his in-law as the trea-
surer of his barangay despite
the express or clear prohibition
by law to appoint a relative as
the treasurer of his village.

by Revenue District Office
Marcelino M. Quito.
Contrary to these ex-
tremely high prices, the City
Assessor of Las Piñas City
issued Tax Declarations of the
Real Property showing that the
lot covered by TCT No. T-
26482 was “agricultural” in
2002 and 2003.
So that if these lands were
“agricultural” or “raw land,”
then the BIR officers who signed
the BIR certifications certify-
ing the P13,300 per square
meter value of Golden Haven
must have no basis in determin-
ing such high zonal values.
And if there was no basis,
then these BIR officials must

if the should not profit from it?
Of course, a person who
does not gain from what he is
doing must have been fair in his
actions.
But if there are pieces of
evidence to show that there is
no basis in the act of certifying
extremely high prices, then
these BIR officials must have
conspired with Villar for these
BIR officials were not owners
of the said lands.
This is clearly the only in-
ference or deduction that can
be taken from these circum-
stances.
Adding to the proof of
conspiracy are the extremely
lower prices of other lots lo-

design and these were priced

located.

Rodriguez lot – TCT No. T-
wins his fourth “Trainer of the
Year” award named in honor of
the late Eddie Futch who at one
time trained Roach and later on
taught him the skills as his as-
sistant trainer. Roach previ-
ously won the award in 2003,
2006 and 2008.

Although the Juan Manuel

that the payments for Masaito
were given to Adelfa.
The total area involved in
Masaito’s lot is 1,606 square
meters and were paid
P48,180,000.00. This zonal
value was certified by the BIR
Certification dated 17 June
2003.
What is a mystery in this
Masaito deal is that the part of
the land involved had not ac-
cess road at that time and was
too far from Real St. where the
price of the lot is P30,000.00.
What proves further the fact
of fraudulent zonal values stated
in the certifications issued by
these BIR officials is the fact
that without the new C-5 road
these properties will still be
nothing but lands without ac-
cess roads.
So that when there were no
access roads, these can never be
priced as high as those located
beside the roads.

photos of the area where the
new C-5 South Extension
project is now located prove that
at the time of the acquisition of
the right-of-way lots the lands
were yet green as in raw lands.
The first shot was taken by
the satellite shoot of
Yahoo.com, showing that the
lands had no structures.
The second shot of
Google.com showed that there
were a few structures already.
The third shot taken by
Microsoft satellite showed that
there were some structures.

So that these photos proved
that during the time of the ac-
quisition of the raw lands, there
was no reason for these lands to
have zonal values at P13,300
per square meter.
The only answer is: these
BIR officials conspired with
Villar to fix the extremely high
prices.
