The President, Kerala State Small Industries Association (KSSIA) had filed
petition before Kerala State Electricity Regulatory Commission (KSERC) regarding
various issues like clarifications in certain conditions of Optional Demand Based
Tariff, modifications in Supply Code and Terms and Conditions of Supply in respect
of KSEB etc. Hon. Commission disposed the petition by issuing order dated
15-03-2011, amending certain clauses of Kerala Electricity Supply Code Regulations,
2005, Terms and Conditions of Supply, 2005 and Annexure E of the schedule of
Tariff and Terms and Conditions for retail supply by KSEB with effect from
01-01-2010.
The Chief Engineer (Commercial & Tariff), while recommending compliance of
the orders of the Commission vide note read above, has informed that KSERC is in
the process of a comprehensive revision of Supply Code, which will necessitate
appropriate revisions in the KSEB Terms and Conditions of Supply, 2005 and
suggested that for implementing the modifications in the transition period, directions
may be issued by the Board for adopting the directions of the Commission while
applying the provisions of these regulations. Having considered the recommendation
of Chief Engineer (Commercial & Tariff), the Board hereby accords sanction to

clarify that penalisation under Clause 51 of the KSEB Terms and Conditions of
Supply, 2005 has to be in accordance with the modification effected to the
definition of Connected load in future for those opting for demand based
tariff.

authorise the Chief Engineer (Commercial & Tariff) to amend Clause I (b) of
the Supplementary Agreement for TOD metering system for LT Industrial
Consumers, LT VII(A) and VII (C) Consumers.

include a new proviso in Annexure E of the schedule of Tariff and Terms and
Conditions for retail supply by KSEB with effect from 01-01-2010 as For
those who opt for maximum demand based tariff, the contract demand shall
be treated as connected load.

accept modification in Supply Code for including 100 kVA as the maximum
contract demand for 415 V in sub clause (5)(a) of Clause 4 of Kerala
Electricity Supply Code Regulations, 2005.

authorize the Chief Engineer (Commercial & Tariff) to conduct study on the
feasibility and ramifications of the introduction of kVAh based tariff and
submit report to the Commission within the time limit.
