AFFIRMATIVE ACTION

The purpose of affirmative action is to prevent unintentional discrimination. Affirmative

action plans require employers to conscientiously monitor the way they hire, promote, reward,
and terminate employees so that they do not discriminate anyone. Many people believe that
affirmative action plans require a quota and preferential treatment in order to achieve race and
gender equality in the workplace but that is not what affirmative action requirements are for.
Complying with affirmative action requirements doesnt mean that the business has to maintain
an imaginary ratio of diversity but instead it has to ensure that there are policies in place to
prohibit discrimination based on race, color, religion, gender, and national origin. This report will
explain which employers are subject to affirmative action plans and why. It will also describe the
plan requirements and what happens to employers who do not meet the goals of an affirmative
action plan.
Affirmative action programs are designed to improve the workplace environment
and free it of discrimination. Affirmative action plans may be voluntary or court ordered, and the
intention of such plans is to give opportunities to a group that has usually been discriminated
against. Most businesses are required to comply with Title VII, and are eligible to participate in
affirmative action programs. Many federal laws concerning discrimination dont cover small
businesses because the percentages can be slanted by the small size but states still set rules that
includes all businesses, regardless of their size. Companies in the private sector are required to
comply with the Executive Order 11246. These regulations state that any constructor that is not
in construction and serves as a depository of government funds must develop an affirmative
action program which would apply to companies like banks.
