Written Statement under Order 7 Rule 1 for Compensation for Damages
The respondent respectfully states as follows:Brief Description of the case:
(1) The case so provided by Republic of Aspirantia herein the plaintiff, is distorted on
many points and neither the Kingdom of Republic herein the respondent is not liable
to pay any kind of damages so claim by the plaintiff nor the charges on Alfons Linke
and Dr. Francois Vienne is lawful and just.
Matters of Inducement:
(2) Plaintiff herein Republic of Aspirantia is a rich and powerful islanded State. It has
one of the worlds largest economies but does not have a significant history or
technical expertise in space exploration. It established a space tourism company
Startours, Inc. and the founders of this Company did so for two reasons:
(a) The favorable tax climate for start-up companies in that country and
(b) It had no national space licensing laws or regulations governing private or
commercial space flights.

Startours developed an experimental passenger spacecraft Starflight-1, a reusable


space vehicle that was designed to take off from a specially-adapted and refurbished

carrier-aircraft flying high above the high seas. Aspirantia adapted and used the
private charter airline owned and controlled by private citizens of neighboring
Zerbica.
Startours offered suborbital flights on Starflight-1 to an altitude of 112 km for three
passengers per flight which cost up to 100,000 Aspirantian pesetas per person and also
promised to provide an Astronaut Certificate to all passengers upon completion of
their flight.
(3) Respondent herein Kingdom of Republica is a continental State and has one of the
largest domestic economies in the world with significant technological capabilities in
space activities. Stationride, which uses the very reliable Stationferry to carry
scientists and supplies to the Republican space station, recently obtained permission
from the Government of Republica to offer unique but expensive rides to wealthy
private individuals. An extra-vehicular spacewalk could be arranged by the Company
on the payment of extra fees.
Facts constituting cause of action:
(4) During the decent of the maiden flight, Starflight-1 herein the plaintiff was struck
by a piece of metal, resulting in a gaping hole in the fuselage, loss of cabin pressure
and the immediate death of the two of the three passengers and the co-pilot onboard
Starflight-1.
(5) On investigation by the Republic of Aspirantia, they found a small, badly-damaged
metal capsule with the inscription father and a serial number. By analyzing data
obtained from a foreign private space object tracking service Space Track, the
experts at Startours concluded that the capsule came from a separate launch a private
company licensed by Republica under its Space Activities Act 2000, crewed
permanently by astronauts trained by the Republican Space Agency as herein the
respondent.

(6) The Republican Space Agency herein the respondent saw no reason to forbid the
one-off launch of the Stationferry along with the cremains and therefore did not
inform other nations about the particular payload and its destination.
(7) Captain Alfons Linke, the captain of the Stationferry was paid a handsome amount
of money, Mr. Ash hid one of the cremains capsules in his spacesuit that contained the
ashes of his father-in-law that, as a token of his and his wifes love for him, he
intended to personally release into space. This capsule that was discreetly released
during his spacewalk shot away at high speed which hit the Starflight spacecraft.
Jurisdiction:
(8) The two countries have agreed to submit their dispute in the International Court of
Justice, which has jurisdiction over the matter.
(9) The respondent claim's that they are not liable to pay any compensation in
reference to Article III of Liability Convention and the arrest of Alfons Linke and Dr.
Francois Viennet.
Relief Claimed:
(10) The respondent prays that the court be pleased to order the plaintiff to nip out the
compensation for the loss of life of the persons on board of the Starflight-1, injury
caused to the remaining persons and also to make good the loss suffered order so
prayed by the plaintiff.
(11) The respondent also prays that they are not liable to pay for the cleanup, recovery
and return costs incurred by Republic of Aspirantia as a result of the emergency
landing by Stationferry.

(12) The respondent also claim unlawful charge on Alfons Linke and Dr. Francois
Viennet and the republic of aspirantia is not entitled to get any compensation for
damages.
