On October 18, 2015 at approximately 0540, Sgt Burkett was inside the main office at 200 Canal Blvd and was
notified by Dty. Chasity Thibodaux that she heard a shot fired in the area of the main office.x Sgt stepped outside
and was met by Dty Thibodaux and Communications Deputy Marissa Dufrene who advised that they heard one shot
in the vicinity. Dty Dufrene then advised that she just observed a black male in a red jacket walking southbound on
LA1 toward Canal Blvd.x Sgt Burkett and Dty Thompson began patrolling the area of Downtown Thibodaux in
reference to the fired shot when Dty Thibodaux received a call from Dty Dufrene.x Dty Thibodaux advised Sgt
Burkett that Dty Dufrene was driving her personal vehicle south on LA1 when the same black male in a red jacket
jumped in front of her vehicle and appeared as though he was pulling something from the right side of his
waistband.x
Dty Thibodaux received a text message from Dty Brittany Peterson who resides in the immediate area which stated
that she heard gunshots in the area. Dty Peterson had just gotten off of working the night shift.
Sgt began responding to the area just south of Canal Blvd where Dty Dufrene last saw the male but Sgt was
stopped by the red light at the intersection of LA1 and Canal Blvd.x Sgt was able to observe a black male in a red
jacket walking on the right shoulder of the southbound lane just north of St. Charles St. Sgt then observed a
southbound truck approaching the male at which time he stepped into the lane of travel and directly into the path of
the truck.x The truck swerved to the left and into the oncoming lane to avoid hitting the male.x Sgt then observed
the male walking between the center of the lane and the shoulder.x Dty Thibodaux responded to the area by way of
Canal Blvd and Sgt responded just behind her.x Sgt observed Dty Thibodaux to activate her emergency lights.x Sgt
briefly lost sight of the subject so she pulled her vehicle to the side of Dty. Thibodaux's to regain sight of him.x It was
at this time that Sgt observed the male walking toward the passenger side of Dty Thibodaux's patrol unit and appear
as though he was trying to enter her vehicle.x Sgt then backed her unit into the southbound lane and placed her
spotlight beam on the male.x The male then raised his hands above his head and Sgt observed a bulge on the right
side of his waistband.x Sgt instructed him to place his hands on her patrol vehicle which he did and Sgt asked him if
he had any weapons on him.x The male responded "yes ma'am."x Sgt asked him again and he responded "yes
ma'am" and pointed to the right side of his waistband.x Sgt placed him at gunpoint and Dty Thibodaux approached,
removing a Ruger 9mm handgun (327-89065) from the waistband of his pants.x Sgt noted that the weapon had
been entirely concealed by his pants and red jacket. Sgt reholstered her weapon and patted down the male, later
identified as Altee Tenpenny, for additional weapons.x Sgt detained him and placed him in the rear of her patrol
unit.x Sgt then cleared the weapon and located a chambered 9mm Luger P&P round.x
Sgt and Dty Thibodaux were approached by a male on LA1 after Mr. Tenpenny was detained who advised that he
heard gunshots in the area.
Sgt Burkett read Mr. Tenpenny his Miranda rights and questioned him in reference to the incident.x Sgt observed
Mr. Tenpenny to be evasive in his method of answering questions and also observed him to have a strong odor of
an alcoholic beverage being emitted on his breath.x He stated several times that he was just trying to get home to
go to bed and that he had done nothing wrong. Sgt asked him where he obtained the weapon.x He stated that he
took it from his Nicholls football teammate.x Sgt asked why and where this occurred and he stated that a younger
teammate, whom he knows as K-dawg, gets into trouble and had possession of the weapon so he took it from him.x
He originally stated that it occurred after they had been drinking downtown and that the male walked up to his
vehicle which is parked on LA1 north of Canal.x He later stated that the exchange occurred on Nicholls campus in
the parking lot of Brady apartments before the Nicholls State football game earlier in the day.x Sgt asked why he

had stepped in front of two vehicles.x Mr. Tenpenny stated that he was walking in the middle of the road because he
was looking for an officer to tell that he had the weapon.x He could not explain why he stepped in front of two
civilian vehicles.x Sgtx then asked him if he shot the weapon and he stated that his specialty is football and he does
not know how to shoot the gun.x Sgt explained to him that there were witnesses to the sound of gunfire in the area.x
He then stated that after he obtained the gun he wanted to make sure there was "one in the head" so he fired the
weapon into the air.x Sgt asked him to clarify and he stated that he did not want to get shot with the gun so he shot
into the air to clear the gun.x Sgt asked him if he knows how to clear a weapon properly without shooting it and he
stated that he does.x Sgt asked him where he shot the weapon and he stated that it was by his vehicle on LA1 near
downtown Thibodaux.x Sgt asked Officer Rebecca Shaver with Thibodaux PD to respond to that area to locate
damage or the spent round.x Officer Shaver returned a short time later with a spent round and advised that it was at
the corner of LA1 and Marange St.x The black Dodge Charger that Mr. Tenpenny claimed as his was parked
approximately 1 block away.x Officer Shaver returned to the arrest location and provided Sgt with the spent casing
which Sgt observed to be a 9mm Luger P&P casing.x The same as the round Sgt cleared from the chamber of the
weapon recovered from Mr. Tenpenny.x
Upon further speaking with Mr. Tenpenny, he advised that the name of the subject who provided him the weapon is
Kaleb Kador (#25) with the Nicholls State football team.x Sgt has notified Nicholls PD in reference to the possession
of the firearm on school campus.x
Mr. Tenpenny was transported to the detention center to be booked on obstruction of a public passage, illegal use
of weapons, and illegal discharge of weapons.x
The weapon is not listed as stolen.x It has been logged into evidence.
