RESUMO

Esta monografia teve como objetivo a realizao de uma abordagem crtica das
Constituies Brasileiras, partindo, portanto, da Constituio Poltica do Imprio
do Brasil de 1824 at o atual texto da Constituio da Repblica Federativa do
Brasil de 1988, verificando, assim, o contexto histrico jurdico nacional e a sua
relao com os modelos de Estado Mnimo e Estado Social. Contudo, tendo
em vista o passado do pas, o ordenamento jurdico por diversas vezes foi
abalado pela centralizao do Poder Poltico atravs de golpes e ditaduras, o
que limitou o avano do direito sobre as liberdades individuais e, com isso,
impediu a concretizao da aplicao do Estado Mnimo. Doutra banda, o
contexto internacional verificado aps a ocorrncia das Grandes Guerras do
sculo XX favoreceram o surgimento e a implantao do Estado Social na
maioria dos pases do mundo, incluindo o Brasil, o que contribuiu para a defesa
e constitucionalizao de direitos sociais como a educao, o trabalho e outros.
Por fim, o prprio Estado Social se aprimorou em diversos pases atravs da
interveno do Estado na economia, e justamente atravs deste
intervencionismo surge a ideia de Estado do Bem Estar Social, o qual no
apenas prev diversos direitos sociais, como tambm os garante e efetiva.

Abstract
This monograph aims to a critical approach of the Brazilian Constitutions,
starting, so, from the Political Constitution of Brazil from 1824 up to the current
text of the Federative Republic of Brazil of 1988, verifying, then, the historical
legal context and its relation with the models of the Minimal State and the Social
State. However, owing to the past from this country, the legal framework for
several times limited the progress of the rights above the individual rights and,
with that, stopped the achievement of the Minimal State's implementation. On
the other hand, the international context verified after the occurrence of the
Great Wars from the XX century promoted the appearance and the
implementation of the Social State in the biggest part of the countries in the
world, including Brazil, that contributed for the maintenance and the
institutionalization of the social rights as the right to education, work and many
others. Lastly, the Social State itself upgraded in many countries through the
State intervention in economy and justifiably trough this intervencionism arises
the idea of the Welfare State, which not only foresees several social rights, but
also assures and make them effective.
