It is impossible to question
the proposition that the
judgment in the present case
was one wholly independent
of the case on trial when the
alleged contempt was
committed, and strictly
criminal in its nature, and,
therefore, one where no
presumptions will be made
that the court had jurisdiction
to inflict the punishment,
because the court may have
had jurisdiction in the case on

trial when the alleged
contempt was committed.
Hence, the jurisdiction of the
court, in this wholly
independent criminal
prosecution for contempt,
must be disclosed by the
record, and will not be
presumed from the fact that
the court may have had
jurisdiction of the case on
trial when the contempt
occurred.
