(Good Faith Justification [NVA History Justification [No OHSA history exists for this Employer { + [CSHO Signature CAs | ~ [Date LD | was dispatched to Hazardville Rd., Longmeadow after receiving a telephone call from the Longmeadow PO informing the Agency of a potentially fatal trench collapse that was currently in progress. ! was immediately dispatched to the location, and when | arrived at the site at 8:21 AM, the site was fairly chaotic, with emergency responders still pumping out the excavation and the workers making sure the water was fully shut off | met with the incident commander, Longmeadow Fire Chief, offered to provide any assistance he might want/need, and then | was directed to the employer, Antonio Martins, who was visibly distraught and drenched from his chest down, and missing his shoes. | spoke with him about the incident, and he was adamant that he did not see whet triggered the event, He told me that he was on site this AM, that the road plates had been removed, the workers were moving about the topside of the excavation, one employee was in the new manhole doing laser set up work, and he was walking down the street to begin to sight where the continuation of the sewer run was to proceed. During my time at the site, | spoke with all of the other employees there, and they all stated that they did not see the victim fall into the excavation, but that Is what they believed had happened, From their various vantage points (some were literally % mile down the street), they did not see him enter the excavation, save for the Mr. Chaves (operating the excavator), who stated that he saw the victim enter the shallow portion of the excavation, and exit that portion prior to the event, but he only made that admission when interviewed with the State Police on September 10, 2045. At the site, everyone said that they did not see anything; they ail just dealt with the post burst water line events and the subsequent rescue attempts, During my time at the site, | met with the Union officials for the covered employees, officials for the Town of Longmeadow, and some of the persons who live adjacent to the site. l/ater met with and spoke to someone who lived at every house on both sides of the street that had a direct line of sight to the excavation, Every person told me something to the effect of that ‘they were inside their homes getting ready for school/work/their day, and they heard a lot of commotion from outside, and when they looked/went outside, people were running all over and they were digging up the street’. Some added that they went outside, they saw men in the water filled excavation, and they saw the emergency responders, remained at the site until the remains were recovered, and conferred with the Town, Police and others as to our plan to conduct our various activities (concurrently as well as jointly) to enable us all to determine what were the actual events that unfolded that morning. In conducting the inspection activities post incident date, which included numerous telephone conversations with the widow, multiple conversations with the employees, water department officials, ete, it was determined that facts are very difficult to establish beyond these; a piece of asphalt roadway broke off the southern edge of the excavation and struck (and broke) the 6 inch water main line causing the excavation to rapidly fill with water. The employer and the other employees took immediate action to remove the victim from the excavation, which included making the excavation much larger to dissipate the rising water. The employer jumped into the excavation and tried to pull the victim out of the water, and that the victim was communicating with his coworkers during these attempts. Beyond those points, what occurred that morning is impossible to prove due to the lack of eyewitnesses, the fact that the excavation was very different post vs, pre incident, and the truncated ‘timeframe in which this all occurred. What I can prove is recommended for citation(s}, and both items were necessary (not to be taken/performed) for the tragic events to have unfolded as they did that morning. ‘Along with the Massachusetts State Police Detectives unit attached to the Hampden County District Attorney's Office, and the Longmeadow Police Department, we conducted joint interviews of the 4 persons (Employer, Operating Engineer and 2 Laborers) who were in the immediate vicinity of the incident, and the video tapes of those interviews are the property of the MA State Police, but copies on DvD are in the case file, The closing conference with the employer, Antonio Martins, was uneventful, and included a review of his rights and responsibilities along with a recommendation that he call the Area Office when he receives the citations, and makes arrangements to participate in an informal conference where the citations can be discussed and, hopefully, a settlement can be reached regarding this matter. There is no history for this employer with the Agency.
