MOST RESPECTFULLY SHOWETH :

That the Appellant is filing the present Appeal against

the impugned order and judgment dated 26.10.2013 in
Suit No. 15/13 by which the Ld. Tribunal was pleased
to direct the Appellant Insurance company to pay an

exorbitant amount Rs. 88,50,000/- along with interest

at the rate of 7.5% per annum.

That the facts and grounds which have been

mentioned in detail in the memo of MAC Appeal may
be treated as a part of the present application and the
contents of the same are not reiterated herein for the
sake of brevity

3.

It is humbly submitted before the Honble Court that

the certified copies of the documents annexed with
this Appeal are not readily available with the Appellant
herein at this stage. Since the matter is urgent and
involves certain questions of law, the Appellant seeks
exemption of this Honble Court from filing the
certified documents.

4.

That the Appellant undertakes to file the original and

certified documents as and when this Honble Court
directs the Appellant.

5.

The Appellant respectfully submit that this Application

has been made bonafide and in the interests of justice.

PRAYER
It is therefore, most respectfully prayed that, in the interests
of justice, this Honble court may be graciously pleased to:
i)

Exempt the Appellant from filing a certified copies of

the annexed documents;

ii)

Allow the Appellant to file dim copies of the annexed

documents; and/or

iii)

Pass any other or further orders as may deem fit and

proper in the circumstances of the case.
