The Menomonee Falls Village Board

reversed course on a change to the conditional use of The Social Haus Nov. 16,
approving the change after rejecting it a several minutes earlier.
The Social Haus is located at N48 W18490
Lisbon Road. The new operator for the bar
and restaurant submitted a request to be
open until 2:30 a.m. while the patio would
be open until 10 p.m. As part of the conditions supported by the Plan Commission, the
hours of indoor operation were limited from
6 a.m. to midnight.
At the start of discussion, Trustee and
Plan Commission member Steve Raymonds
said the commission heard from residents
who were concerned about the previous
business at the site, which was a "biker bar."
Other nearby residents objected to noise
from a bar. The commission also heard from

Germantown to pay DOT for

Donges Bay engineering work
The Germantown Village Board
agreed on a plan Nov. 16 to pay
$216,929.52 to the state Department of
Transportation (DOT) for engineering
work done on Donges Bay Road.
The state agency had sought a
repayment for the work "immediately,"
according to a village staff report.
Village Administrator David Schornack
said "that's quite a bite for us to pay
back in one or two years."
Schornack is suggesting the village

place the item in a 2016 bond issue and
structure it so that portion of the bond
is repaid within the first five years of
the bond issue. He said there would be
some interest with that option, but the
rate "would be very minimal anyway."
Trustee David Baum asked what the
potential penalty would be if the village
didn't pay back the amount. Schornack
said the DOT has threatened to with-
hold highway funds in future years.

"I really think we want to keep our
relationship as good as we can with the
state DOT," Schornack said.
The board approved a motion agreeing to pay the amount within two years
while directing Schornack and Finance
Director Kim Rath to return to the
board with borrowing options.

Raymonds said the midnight hours is a
recommendation from village staff, and
"is a compromise to see if this works
out."
Raymonds also noted the outdoor
hours from March 1 to Nov. 1 will be
between 11 a.m. to 8 p.m. Sunday
through Thursday and 11 a.m. to 9 p.m.
on Friday and Saturday. Raymonds also
cited other conditions stating that the
Architectural Control Board has to
approve landscaping for the site and
conditions such as fencing which were
previously approved.
"It's more of a compromise, let's see
if these people can operate a restaurant
and not cause any problems," Raymonds
said. The request was unanimously supported by the Plan Commission.
Trustee Bonnie Lemmer had concerns about the restaurant hours.
"I don't know how many high class
restaurants open up at 6 a.m. That
makes me think it's going to be more of
a bar," Lemmer said.
She also took issue with televisions

that would be restaurant so customers
could watch sports.
"That to me is not a high class
restaurant. That is more of a bar,"
Lemmer said. She added that restaurants don't stay open until midnight
because the grill closes at 10 p.m.
Trustee Chris Smolik made an
amendment to extend the hours until
2:30 a.m., which was requested by the
owners. Raymonds said a 2:30 a.m.
close was discussed and the commission
chose a midnight closing hour as a compromise. If the business were to work,
they could come back and ask for added
hours.
Trustee David Glasgow said he
resides in the general area and said the
request could be an issue between the
owners and the neighbors.
"I like the concept, by the way,"
Glasgow said. He said he had concerns
about noise and was concerned about
"location, location, location."
"I think a better location would be
more suitable for a place like this,"
Glasgow said.
Village President Joe Helm cited the
proximity of the business to nearby residences as a reason to be opposed to the
added hours. Smolik said there was
"speculation" on what might happen
and said the owners have demonstrated

"We have to look what's in front of
us here," Smolik said.
Trustee Jeremy Walz said a restaurant would be great addition "on Main
Street or Appleton Avenue" and also
had concerns about the location of the
Social Haus. The board rejected the
added hours proposed by Smolik by a 52 vote, then rejected the change in the
conditional use by a 4-3 vote.
"Does everybody realize what
they've just done -- put it back to the
old conditional use permit," Raymonds
said after the change was denied. "Some
of the regulations or the points go
away, it's less restrictive. Just so everybody knows."
The board then approved a liquor
license for the Social Haus by a 4-3

vote.
A short time later, Village Attorney
Michael Morse, responding to a question from Helm, said the board could
reconsider the denial of the changes to
the conditional use request. A reconsideration would have to be made by a
person who voted in the majority, and
the board would have to approve a
request to reconsider by a two-thirds
vote. Walz then made a motion to
reconsider, which was approved by the
board.
Walz said the proposal restricts patio
hours and he could support extending
the indoor hours from 11 p.m. to midnight.
Helm said that by approving the
changes, the board is getting limited
hours in the patio hours and a review of
landscaping by the Architectural
Control Board in exchange for having
the business be open an extra hour.
After additional discussion, the
board approve the changes to the conditional use for the business.

volleyball tournament Nov. 13, as
Brookfield East rallied behind
Matt Szews 29 kills to win 17-25,
26-24, 19-25, 25-21, 15-6.
"Pretty hard to answer for
him," Germantown Coach Brian
Rushmer said of Szews, a Ball
State recruit. "He's a very good
player."
Germantown started the first
game with a 5-1 run and held a
20-9 lead before the Spartans
closed the gap in the latter stages
of the game. In the second game
Germantown held 15-9 lead but
East rallied behind two kills by
Szews and two blocks to reduce
the lead to 17-14, prompting a
Germantown time out. The teams.
Szews finished the game with a
kill.
East then jumped out to 12-7
lead but then Germantown rallied,
as a kill by Jack Thompsen tied
the score at 16-16. With
Germantown leading 17-17, a kill
by Max Keefe started a 3-1 run for
Germantown. East scored one
more point before an attempted
block went out of bounds to give
the game to Germantown.
A five-pint run, which included consecutive kills by Szews,

opened up a 17-13 lead for
Germantown in the fourth game.
After a time out by Germantown,
another kill gave East an 18-13
lead. Germantown rallied and
reduced the deficit to 23-21 following a kill by Thompsen but a
Germantown block went out of
bounds and Nick Watry converted
an ace to send the match to a tie
breaker.
In the tie-break the Spartans
bolted out to a 7-2 lead.
Germantown only scored three
more times as East advanced to a
semifinal the next day, where
they lost to eventual state champion Kaukauna.
Germantown beat East twice
during the regular season.
Rushmer noted that East started a
different rotation from either of
the regular season matches or
what Germantown had seen on
game film between East and other
opponents.
"They played well, they won
that match," Rushmer said.
He later added that East
"played better than our team
overall. There's no one reason why
we lost by any means. They
earned it and they deserved it."
Rushmer noted the team won

more matches and had more
blocks this year that Germantown
team has ever had, had a higher
passer rating and more digs.
"The boys played well all year.
Just to get back here is a privilege
and to play a match like that,
that's why there's 700 people or
however many are out there to
watch it -- they come to see
that," Rushmer said. "The boys
laid it out there, and so did they,
they (Brookfield East) just happened to have come out on top."
Rushmer added he was happy
for the three seniors -- Max Keefe,
Jack Thompsen and Alex Shebesta
who were part of the team that
made it to the state final in 2012.
"For those three to get back
here and play again is just awesome," Rushmer said.
Keefe was named to the allstate team by the Wisconsin Boys
Volleyball Coaches Association.

History of St. Nicholas Day

The true story of Santa Claus begins
with Nicholas, who was born during the
third century in the village of Patara. At
the time the area was Greek and is now
on the southern coast of Turkey. His
wealthy parents, who raised him to be a
devout Christian, died in an epidemic
while Nicholas was still young. Obeying
Jesus' words to "sell what you own and
give the money to the poor," Nicholas
used his whole inheritance to assist the

dedicated his life to serving God and was
made Bishop of Myra while still a young
man. Bishop Nicholas became known
throughout the land for his generosity
to the those in need, his love for children, and his concern for sailors and
ships.
Under the Roman Emperor Diocletian,
who ruthlessly persecuted Christians,
Bishop Nicholas suffered for his faith,
was exiled and imprisoned. The prisons

were so full of bishops, priests, and deacons, there was no room for the real
criminalsmurderers, thieves and robbers. After his release, Nicholas attended
the Council of Nicaea in AD 325. He died
December 6, AD 343 in Myra and was
buried in his cathedral church, where a
unique relic, called manna, formed in his

Falls Village Board approves 2016 budget

The village of Menomonee Falls portion of the tax rate will remain flat for
2016.
The Village Board approved its 2016
budget Nov. 16. According to information from the village, the tax levy will
be $22,604,435, an increase of $200,000
(.9 percent) from last year. Village
Manager Mark Fitzgerald noted that
under the state levy limit, the village
could have increased revenue by 1.35
percent. However, he said the village
opted for a lower increase to maintain a
tax rate of $5.20 per $1,000, which has
been in place since 2012. Fitzgerald
added that the village generated $60
million in new construction growth, the
highest of all 37 communities in
Waukesha County.
Fitzgerald said one change involved
transferring $300,000 from the interceptor sewer levy to the general fund.
According to information from the village, total revenue is increasing by
$685,133, or 2.8 percent. Fitzgerald
said licenses and permits are up 5 percent ($1,300,500). Fitzgerald said that
is attributed with being the highest
growth value community in Waukesha
County.
On the expenditure side, expenditures increased by 2.8 percent to
$85,144. Fitzgerald said moving
$300,000 from the interceptor sewer
fund to the general fund will allow the
village to more rapidly pay down the
revolving loan fund for vehicles and
rolling stock replacement within the
public safety and public service areas,
areas which cover the replacement of
ambulances, fire trucks, plows and
street vehicles. He said the move will
allow the village to pay back internal
loans faster.
Fitzgerald also summarized the transition of fire staff. Last year, the village
started phase one of a plan that went to
going at all 24/7 stations and moving
from paid-on-call staff to a combination
of full-time, part-time and paid-on-call
staff. This is the second year of the transition, and the village will add 16 fulltime equivalent positions filled by parttime staffing.
Among other budget items:
The library budget is $1,868,880, a
$68,773 decrease from this year.
Fitzgerald said fund balance is being
used to fund retirement payouts for a
number of library employees who
intend to retire in 2016. He added the
library fund balance is 50 percent of its
annual operating budget.
"Spending it down on this one-time
only expenditure is deemed appropriate
and in fact probably a wise thing to do
under the level of balance they currently have," Fitzgerald said.
The solid waste fund charges
remains at $100.12.
The water utility "is reasonably
healthy," Fitzgerald said, which has a
net income of $288,7714.
The sanitary sewer utility budget "is
living on earned income from over the

years," Fitzgerald said. The sanitary
sewer utility budget has a loss of
$947,448, and fund balance is being
used to balance this portion of the
budget.
He added that in mid-year 2016
staff would want to bring a recommendation for a "rate process" to the board.
"We are not asking for that tonight
and we would like to leave that as a
future issue," he said.
The storm water utility "is a utility
in name only" and is treading water,
Fitzgerald said. He said the village will
have to do a "deep dive on an analysis"
and either go to a user-based system or
eliminate the utility and absorb it into
other areas.
The village will have $97.2 million of
long term debt, withing it legal general
obligation debt limit of $229 million.
No one spoke on the budget during
a public hearing, and the budget was
unanimously approved by the board.

A vehicle fled Speedway, N87
W17245 Main St., Nov. 1 without paying
for $10.58 worth of gasoline. Two customers followed the vehicle and notified
police. Police located the suspect vehicle at Beacon Street and Lilly Road and
gave chase. The chase entered the city
limits of Milwaukee and was terminated
shortly thereafter.
Fraud
A male complainant reported Oct.
31 that an unknown actor obtained his
Landmark Credit Union card and made
two unauthorized charges of $600 each,
one at Kohls Department Store and the
other at H&M.
Theft
Two bags were removed from a
womans vehicle parked at Tri-County
YMCA, N84 W17501 Menomonee
Avenue, Nov. 2 after an unknown actor
smashed a window.
A womans wallet was stolen from
on top of her purse Nov. 1 as she
shopped at Target, N95 W17707 Shady
Lane.
An unknown actor stole a laptop
computer from Alto Shaam, W164

Warrants
A 34-year-old Milwaukee woman
was taken into custody on a Wauwatosa
warrant at 8:21 p.m. Oct. 28 following a
traffic stop at Appleton Avenue and
Pilgrim Road.
A 19-year-old Sussex man was

taken into custody on a Glendale warrant at 7:52 p.m. Nov. 2.
Vandalism
The rear window was smashed out
of a vehicle parked near Lisbon and
Pilgrim roads Nov. 6. Damage was also
done to the body of the car.
