IntelligenceSurveillanceCourt(FISC)grantingtheNSAaccesstoallVerizon
customersrecords,thenewprogramonlyallowstheNSAtocollectrecords
fromtelecomswhenaspecificselectiontermpertainingtolimiteddatais
outlinedinaFISCwarrant,whichwilllimitinvestigationsofthemetadatato
sixmonths.

tocollecttelephonymetadatarecordsinbulkincludingrecordsofboth
U.S.andnonU.S.personsunderEO12333,inreferencetoanexecutive
orderissuedin1981byPresidentRonaldReagan.
Althoughthebulkmetadatacollectioniscomingtoanend,whatsalready
beencollectedwillnotbeimmediatelydestroyed,asanNSArequesttokeep
themetadatauntiltheendofFebruary2016isunderFISCconsideration.The
WhiteHousetoldReuterstheNSAstillneedslimitedaccesstoit,notfor
analyticalpurposesbutdataintegritypurposes,whilethereliabilityofthe
newfocusorientedprogramismonitored.
Thismonth,afederalcourtfoundthesoontoendprogramunconstitutional,
orderingthatthepastdatabedestroyed.However,anappealscourtstayed
thatrulingoutofnationalsecurityinterests.LarryKlayman,founderofpublic
interestgroupsJudicialWatchandFreedomWatch,hasbeenincourtwith
theNSAsince2013overitsmasssurveillance,andhesayshiscase
dependsonthatdatanotbeingdestroyed.
OnWednesday,FISCfulfilledanotherpartofthenewsurveillancelaw,
addingfiveadviserstoapanel,knownasanamicuscuriaeinlegalspeak,to
offerlegaladvicefromaperspectivepromotingcivillibertieswhenapplicable
toawarrantrequest.Thepanelconsistsoffourlawyersandalawprofessor.
