the year-long 50th celebration. This is just one of many
events and projects that will chronicle the colleges 50
years in the region starting in 2016. To help tell the story,
the college is collecting photographs, mementos and
personal recollections that will help illustrate this vibrant

MONEY GIFT WITH YOUR EX?
Your boss gives you a large financial
gift. Can your spouse get their hands on
it? Normally, no, but you could lose it or a
chunk of it.
Our family law has rules for how your
property (and debts) are to be divided if you
and your spouse split up. For starters, family
property (and debts) are to be shared equally
unless the court decides a split down the
middle would be significantly unfair.
But some things, like property you
each owned before your relationship, and
individual inheritances or gifts you get
before you separate, dont count as family
property theyre excluded property,
which generally isnt shared (though value
increases during the relationship are).
Money or other assets derived from
excluded property (say, money you get
from selling your gift or inheritance) also
typically dont count as family property.
But how you deal with a gift or inheritance
that was initially yours alone may (or may
not) turn it into family property.
In one recent court case, Henry and Trudy
(names changed) started living together in
2003, got married in 2004 and separated
nine years later. They lived in Richmond
and had three children together.
Henry had been with his employer
company since 1997. About two years
before he and Trudy separated, he got a
large $2 million sum as an inheritance gift
from the companys principal when that
wealthy businessman passed away.
Henry was a director of more than 30
companies related to his employer company.
Concerned about his risk as a company

director should things go south with any
of these companies, he put their Richmond
family home in Trudys name alone for
creditor protection. He agreed in court that
this home was family property.
Trudy wanted to move from Richmond
to Vancouver. So late 2011 (while still
together), the couple used the bulk of
Henrys $2 million inheritance to buy land
in Vancouver for a future home. Henry also
put that land in Trudys name alone, and
they started building.
When the couple separated in early
2013, only the new foundation had been
constructed. To avoid a $500,000 loss, they
completed construction although they were
separated. They then sold the Vancouver
house essentially at cost, avoiding a loss.
Henry argued the $2 million hed been
gifted, mostly used for the new Vancouver
property (and the $2 million from its sale)
were excluded property, so shouldnt be
split. But the court decided that when he
put the land in Trudys name, making it her
property for creditor protection, that was
a gift to her. It turned the land into family
property, so the sale money had to be shared.
Several recent cases have come to
different conclusions about what happens
after a separation to excluded property
(or its sale proceeds) transferred between
spouses.
This is a tricky area, so see a good family
lawyer about who gets what after you and
your ex separate.

This year the show runs from January 8 to February 7
in both Langham galleries and features the work of some
fifty North Kootenay Lake artists paintings, photography, sculpture and other works in a variety of media,
including clay, fibre and wood. Everyone is welcome to
attend the opening night reception at 7 pm on Friday, January 8 where we celebrate the vibrant artistic scene that
exists in our corner of Canada.
On Friday, January 22 the annual fundraising auction
and performance night presents local musicians and performers in between some hard-hitting auctioneering.
The money raised supports Arts Council activities such
as ArtWalk, a scholarship for post secondary study in the
arts, history or journalism, the Front Street Banner Project and Arts Advocacy.

In addition to honouring and supporting our veterans

at home and abroad we wish to take this opportunity to
share with you how we contribute, support and function
in our community.
We provide and give to local charities including school
bursaries, special events, Christmas hampers, ongoing
food pantry and head up the Poppy Fund.
The Kaslo Legion also promotes special event dinners,
annual Christmas dinners, monthly birthday celebrations, an annual golf tournament, Halloween and New
Years Eve parties.
In our local branch we offer homemade frozen dinners
(when available), free pool/shuffleboard/darts, Keno/
Pacific Holdem/Lottery, satellite TV, WiFi and Wii.
Come by on Sundays for our crib tournament, Mondays
enjoy a game of Eucre, Wednesday mornings we carpet
bowl, Wednesday nights are Food and Fun Night and Fridays we hold 50/50 and meat draws.

Environmental Education
Columbia Basin children and communities will continue to receive opportunities to learn about, appreciate
and care for the natural world around them, through
Columbia Basin Trusts $1 million commitment to two
environmental education initiatives. These are the Know
Your Watershed program and the Columbia Basin Environmental Education Network.
These initiatives have proven successful and were
pleased we can commit additional funding to help them
become more sustainable, plan into the future and grow,
said Tim Hicks, Columbia Basin Trust Manager, Water
and Environment. Through these initiatives Basin students will continue to have hands on opportunities to
increase their understanding of the natural environment,
which Basin residents have told us is a priority.
The Know Your Watershed program will be receiving
$540,500 over three years. Working with environmental
educators in the Basin, the Trust developed this program in
2010 to help grade eight students understand where their
water comes from, how it is used and where it goes after it
is used. The program is delivered to schools by local educators around the Basin working with Wildsight. Learn

make a big impact on students, but it also strengthens the
community as a whole.
The Columbia Basin Environmental Education Network
(CBEEN) will be receiving $500,000 over three years. Created in partnership with the Trust in 2002, CBEEN supports environmental education in the Basin by offering
professional development for educators and providing
them access to training, resources, opportunities and tools.
It also delivers the Wild Voices for Kids program, which
has local experts deliver curriculum-linked programs to
schools across the Basin. Learn more at cbeen.org
CBEEN is excited to continue to play a key role in

encouraging environmental stewardship and sustainability
in the Canadian Columbia Basin by supporting environmental education, said Duncan Whittick, CBEEN Executive Director. There are so many educators from across
our region who provide excellent learning opportunities

Count Birds?
Do you have birds in your yard? Do you feed birds? Are

you a visiting birder? Every year since 1900, Christmas
Bird Counts have been held across the Western Hemisphere between December 14 and January 5.
The Christmas Bird Count is a citizen science project
where the information collected by volunteer participants
is used to assess population trends and distribution of
birds. The common raven is the most widespread species
on Canadian counts. The Eurasian Collared Dove continues to spread throughout Western Canada, including to
Kaslo. Some years, robins and flocks of winter finches will
show up in our area. A lot depends on the weather!
Kaslo Area Birders invite you to participate in any or all
three local Christmas Bird Counts and its free. You can
help monitor birds by getting involved as a field observer
or feeder watcher anywhere within each 24 km count circle. Participants, old and new to birding, are all welcome.

It is with great sadness that we announce the passing of our father, grandfather, great-grandfather, Bake Poppa,
father-in-law, uncle and friend. Dad
passed away in Kelowna on November
17, with his family at his side.
He was predeceased by his parents
John and Anna Kozun; his loving wife
Beryl; his sisters Annie, Katie, Stephanie and Betty, and brothers Freddie and
Mikie. He is survived by his sister Julia
(Andy) Bosko of Selkirk, Manitoba; and
many nieces and nephews including
niece Barbie Prieston of Calgary, who
he was very close to (he always called
her his little sister); daughters Wendy
(Don) Edwards and their two daughters
Dianna and Anita (Jeff ) and great-granddaughters Sage and Jamie; and Cindy
(Alan) Tarr, their son Tyler (Candice) and
daughter Ashley (Chris) and great-grandson Leo, and
three step-grandchildren Marvin, Courtland and Tracy
Tarr; also his brother-in-law Al (Marg) MacPherson.
Dad came to Kaslo in the early 1950s looking for
work with his longtime friend Joe Onishko. They soon
met up with another prairie dweller, Fred Woods from
Saskatchewan, and the three remained good friends.
Dad started out his career at Browns Bakery in Selkirk where he drove the delivery truck, before moving
to Kaslo. He worked at several mines and mills. He also
worked for Department of Highways, the Village of
Kaslo, Jack Hale Contracting building the Cedar Creek
bridge, the Kaslo Arena and building a few houses
in Kaslo. He worked on the Duncan Dam, Whatshan
power house and the Revelstoke Dam, and when in
between jobs he worked for the BC Forestry with the
youth crew. He and Mom built the Kozy Burger and operated it for several years before selling it and it then
became the Mountain King.
They built a new home on
the airport road; there he had
a garden both vegetables
and flowers some chickens
and turkeys and a dog. Dad
loved the outdoors, he was
always whistling and singing
when he was outside in his
garden or when he was fishing. He loved to pick huckleberries and go prospecting.
After Moms passing, Dad
gave up the yard and that
home, and moved to Abbey
Manor where he made his home for the past 15 years.

He was most happy when he was cooking, and he became famous with everyone at the manor for his cream
puffs.
Dad was a member of the Kaslo Kinsmen club and a
member of the curling club. With Kinsmen he played
Santa for several years, riding on the fire truck in the
parade. He enjoyed Kinsmen and often talked of the
projects they had done.
Dad was a good, honest man of principle who made
many friends along the way. He had many close friends
who would stop in for a visit or take him picking huckleberries, including Sarah Moffatt, Julie Meyer, Lawrence Campbell, Freddie Woods (Jr.) and Ralph Stabler.
He was always so happy when you visited. The staff at
Front Street Market are going to miss him; he always
had to be their first customer of the day. Even in his last
days and hours at the Kelowna Hospital he touched the
hearts of nurses and support staff, with his strong and
cheerful spirit, in a way that very few can.
The family would like to express their heartfelt thanks
to all of Dads friends and family near and far for their
emails, phone calls, visits, cards, food and hugs. We
would like to thank the Kaslo Ambulance staff for their
care, ICU Cardiac in Kelowna for their understanding
and support, Lawrence Campbell for his sincere and
compassionate service, Don for the touching eulogy,
the Legion Ladies for the tea, and Leah and Roy for organizing the candles for Dads service.
Wherever Dad went we could hear him whistling.
Dad, you will be missed but forever in our hearts.
