TASK
You are required to work in a group of SIX (6) students to analysis and answer the following
questions :QUESTION 1 (carries 15 marks)
Adolf and Ida Krueger contracted with a Pisani Construction Inc to erect a metal building as
an addition to an existing structure. The two structures were to share a common wall, and the
frames and panel heights of the new building were to match those of the existing structure.
Shortly before completion of the project however it was apparent that the roof line of the new
building was approximately three inches higher that of the existing structure. Pisani modified
the ridge caps of the buildings to blend the roof lines. The discrepancy had other
consequences, however including misalignment of the gutters and windows of the two
buildings which resulted in an icing problem in the winter.
The Kruegers occupied the new structure but refused to make the last payment under the
contract. Pisani filed a suit in the court to collect the said payment.
Did Pisani substantially performs its obligation?
Should the Kruegers be ordered to pay?
Why or why not
Provide justification of your answer.

QUESTION 2 (carries 15 marks)


Frank Rodziewics was driving a Volvo tractor-trailer on Interstate 90 in Lake County, Indiana
when he struck and became stuck on top of a concrete barrier. The Indiana State Police
contacted Waffco Heavy Duty Towing Inc to assist in the recovery of the truck.
Before beginning work Waffco told Rodziewics that it would cost $275 to tow the truck. There
was no discussion of labor or any other costs. Rodziewics told Waffco to take the truck to
local Volvo dealership.Within a few minutes Waffco pulled the truck off the barrier and towed it
to Waffcos nearby towing yard.
Rodziewics was soon notified that in addition to the $275 towing fee, he would have to pay
$4,070 in labor costs and that Waffco would not release the truck until payment was made.
Rodziewics paid the total amount. Disputing the labor charge however he filed the suit in the
court against Waffco alleging in part breach of contract.
Was the towing contract unconscionable?
Would it make a difference if the party had discussed the labor charge before the tow?
Explain
Provide justification of your answer.

The following is the marks deduction for this group assignment:
Late submission = 5 marks is deducted every day after the due date.
Plagiarism = 0 mark is awarded immediately.
Let others copy your work = 0 mark is awarded immediately.
Off topic work = 0 mark is awarded immediately.
Excessive grammar, punctuation and spelling errors = -5 marks will be given.

marks for this piece of assignment.
