Brief facts leading to the appeal:

The appellant ,a sovereign citizen of India sought information under RTI dated
9.07.2015 ( A1) consisting of 7 points pertaining to,inter alia,vigilance report of
Jaipur . The CPIO sought pretext effectively denying all of the desired
information . The appellant, vide appeal dt.24/08/2015 requested disclosure of
information to FAA .
However, the said Renjeet Gangadharn who
enjoyed air travel*** to CIC on 20th May 2013 instead of attending prescribed
mode of video conference from Mumbai resorted to the fallacies including back
dated order(printed date 30 November 2015 dispatch date 8/1/16) to justify the
denial of information.
***Rs.22710 on account of Air Fare+Halting+Conveyance.
Prayer or Relief sought: 1. The information be disclosed as it pertains to to acts of public
servants on behalf of a PSU insurance company
2. That obstruction to information be viewed seriously and responsible official be penalized under
Section 20 (10) of the Act.
Compensation Sought: The appellant prays for compensation as per Sec 19(8)* of the RTI
Act related to the detriment suffered since long denial of information.
Grounds for the Prayer or Relief:
1.The RTI officials continue to deny information on one pretext or the other.
2. There is no attempt to ensure objective disclosure of information either by CPIO or FAA
3. the desired information is essential for fundamental rights of applicant.

PSU should not indulge in legal jugglery: HC


NEW DELHI: Holding that indulging in "jugglery of legal provision" for depriving

the public of its due is an abuse of law, the Delhi High Court has imposed a cost
on NIACL for resorting to such practice. Justice V B Gupta said the government
undertaking should have a sympathetic view towards the general public. "
The government undertaking must have human approach and should not
indulge in the jugglery of legal provisions as to deprive the unfortunate
victims of their legal due," Justice Gupta said while imposing a cost of Rs 5,000
on New India Assurance Co. Ltd (NIACL)
