Dear Ms. Weismann:

I am writing in response to your September 2, 2008, public records request for all
records relating to the firing of Department of Public Safety Commissioner Walt
Monegan, and all documents that refer, relate to or reference in any way Alaska State
Trooper Wooten.

Enclosed are documents identified to date and reviewed by the Department of Law
that respond in part to your request. You will note that these records are primarily
emails. We were advised today that there are additional hard copy documents that are
being sent to the Department of Law for review to ensure that protected interests of
private or government persons or entities are not infringed. As soon as these additional
documents have been reviewed we will send them to you. I will advise you further when
I know the timeframe for completion ofthe Department of Law's review.

Enclosed also are lists of confidential and privileged records we withheld. The
lists include the date, author, and recipients of each e-mail message withheld, as well as a
description of each withheld message and the basis for withholding it. In some of the
records we are providing, we masked parts of the records to protect confidential or
privileged information. In many instances, the masked information is a personal e-mail
address or telephone number. In those instances, we masked the information to protect
the person's privacy interests, consistent with article I, section 22 of the Alaska
Constitution. Where we masked other information, we included an explanation for the
masking on the record itself.

This response constitutes a partial denial of your records request. Governor Palin
delegated to me the authority to deny public records requests.

If you wish, you may administratively appeal this partial denial of your request by
complying with the procedures of 2 AAC 96.340. Copies of 2 AAC 96.335 - 2 AAC
96.350 are enclosed. You also have the option of obtaining immediate judicial review of
this partial denial by seeking an injunction from the superior court under AS 40.25.125.
Choosing not to pursue an injunction in superior court will have no adverse effect on
your rights in the administrative appeal. An administrative appeal from the denial of a
request for public records requires no appeal bond.
