Land Use Management (LUM)

Purpose
Land use management in Flexible Real Estate Management (RE-FX) integrates your companys internal
view with the public and legal view of land management. You can depict land registers, parcels and other
public registers, link to other master data objects, set up contracts, and run reports.
The land register contains entries about ownership relationships and legal relationships:

Information about owners of real estate

Related rights

Encumbrances and restrictions

Liens and mortgages

The real estate cadaster describes the individual parcels in detail. This includes information on:

Assignments to the different parcel maps

Different addresses

Various views of areas based on overlays and classification types

The accompanying infrastructure

Aspects of site development

Owners

Planned, actual, and contractual usage

Note
Both in the land register and the parcel, you can reference parcels or land registers that are not
entered in the system as master data. You have to make the necessary settings for this in
Customizing.
In addition, you can map all other public registers, such as, development planning, site protection, notices
of assessment, and municipal fee notices.
Land use management can be applied especially for the following business processes:

Depicting land register information:

o
Ownership relationships
o
Rights of third parties
o
Liens and changes

Entering information on parcels and subsequent processes:

o
New land survey
o
Merging of parcels
o
Splitting of parcel

Entering information from other public registers:

Recording notices of assessment and municipal fee notices

Entering contracts that relate to parcels:

o
Land lease contracts

o
o

Purchase and sale contracts

Right of use contracts, such as leases

Integration
To use land use management, you have to install the following components:

Financial Accounting (FI)

You also have the option of using the integration to these components:

Asset Accounting (FI-AA)

Plant Maintenance (PM)

Parcel
Definition
A parcel is a defined section of the earths surface that is administered in the real estate cadaster under
its own description. The parcel with its description is the unit used for recording land in the real estate
cadaster. The real estate cadaster is a public register for parcels of land. It records the location of parcels
of land and their characteristics derived from the land survey.
A local subdistrict is an extensive area of land with boundaries that usually correspond to naturallyoccurring boundaries. Often the local subdistrict shares the same boundaries as a section of the
municipality and has the same name. The local subdistrict is the largest unit in the cadaster and generally
consists of numerous tracts of land.

Use
You can assign the following master data objects to a parcel:

Business entity

Building

Land

Rental object

Business partner

Functional location

Fixed asset
You can assign parcels from within real estate contracts.

Entering Measurements
Use
Parcels are measured by their cadastral area on the one hand, and by areas in parcel maps on the other.
Surveying is performed either by the survey office itself or by another recognized and certified surveyor.
The cadastral area can change after the initial survey due to later surveys or because the parcel is
merged or split. Therefore, you keep track of the surveying status over time.
Areas are distinguishable from one another on the basis of:
Overlay number
The type of cadastral usage/classification
Overlays are used to break down the parcel map into several levels: you can enter areas and
characteristics for each type of cadastral usage or classification. For each federal state, overlay numbers
are created for measuring areas based on the different laws and regulations of the state and federal
governments.
The overlays could be structured using the following hierarchy:

Parcel Update
Definition
The Parcel Update master data object allows you to track the history of parcels as documented by the
survey office. The system also shows the parcels before and after the parcel update.

Use
Changes in the real estate cadaster are made using parcel updates that you record for the parcels.
For more information, see Processing Parcel Updates .

Integration
This information is integrated with the following master data objects:

update category, then choose a parcel update type in the lower part of the screen on the Details tab
page.
Choose at least one parcel on the Parcels Before tab page. Choose at least one parcel on
the Parcels After tab page. You can also create new parcels, for example if you want to merge several
parcels.

Note
The system sets the valid-to date to one day before the valid-from date of the new parcel. When an
existing status is changed, the system ends the old status one day before the new status takes effect.
In this way, the system ensures that the information on areas is consistent on any given key date.
6.
Choose the Measurements tab page, and enter the difference between the measurements of the
parcels in the Surveying Difference group box. This amount must be the same as the difference
between the cadastral areas.

Result
For those parcels that are no longer contained in the list of parcels after the parcel update, the system
sets the cessation date in the list of parcels before the parcel update.

Processing the Todo List

Use
Cadastral changes (such as, splitting of parcels) influence the master data objects that have areas from
the changed parcels assigned to them. For example, site protection relates only to the new parcels that
result from the split. You have to update the affected master data objects to reflect the new, timedependent relationships among the parcels. Otherwise, links to the new parcels for site protection, leases,
and so on, are lost after the parcel update. The todo list displays the master data objects that are
affected.

Prerequisites
You documented a change to parcels.

Procedure
1.

Choose the Todo List tab page.

You see all master data objects that had assignments to the parcels before the parcel update.

2.

Click on one of these master data objects and process it. Then select the row and choose
Confirm with the quick info text Confirm Change Made .
The Mark Entries as Completed screen appears.
3.
Choose Yes .
The entry is now marked as completed
.

Result
You updated the affected master data objects.

Example
Parcel 1211 is split into parcels 1211/1 and 1211/2. Part of parcel 1211 was leased out. You need to make
sure that the parcel update of parcel 1211 is reflected in the Parcels table of the right of use contract.
You need to decide the following:

Do you have to give notice on the contract?

Which of the new parcels, 1211/1 or 1211/2, should become the basis for the lease-out contract?

Has the area changed?

Do the area leased and the lease payment have to be changed in the contract?

Note
You have to update this information manually because the changes are dependent on the specific
circumstances. The system does not update this information automatically.

Land Register
Definition
Land registers are public registers where information about land (parcels) regarding ownership
relationships, relationships based on encumbrances and obligations, and other relevant information is
recorded. In Germany the land register is managed by the land registry at the district court level.
Anyone who can demonstrate a legitimate interest (such as a potential buyer) is permitted to view the
land register.Only notary publics are not required to demonstrate a legitimate interest.
The decrees and official documents submitted to the land registry for the land register are stored in land
register files; a separate land register page is created for each individual parcel. The land register page
receives a sequence number and is stored in a volume together with other land register pages of the
same district.

Structure
Traditionally, land registers were kept in paper form: initially in bound volumes and later in looseleaf
volumes. More and more often, however, land registries are now recording the land register in electronic
form. The traditional structure of the land register nonetheless remains the same:

Creating a Land Register

Use
You create a land register to be able to record information that is managed at a given land registry. The
land register type is dependent on the applicable laws. The following are the possible land register types:

Land register
This is the most common case.

Apartments register
For condominiums as regulated by German law for condominium ownership

Part-ownership land register

For part-ownership as regulated by German law for condominium ownership (example: separate
ownership of non-residential property in condominium building, such as a garage)

Apartment and part-ownership land register

For condominium ownership and part-ownership as regulated by German law for condominium
ownership
Leasehold land register
In section II of the land register, land lease rights of the land lease right holder are recorded with
reference to the real estate register of the landhold lease register. The following registers are created
in accordance with this information:
o
Apartment land lease register
o
Part-ownership land lease
o
Apartment and part-ownership land lease register

Prerequisites
You made the necessary settings in Customizing for Flexible Real Estate Management (RE-FX) .
Choose Country-Specific Settings Germany Land Use Management Land Register.

When you create a land register, the only required entries are the land register type, the land registry,
and a land register page.
You are not allowed to create a land register page for an existing land register page number in the
same land register and volume.

Result
You created a land register.

Processing the Real Estate Register

Purpose
In the real estate register, you enter the parcels belonging to the land register page and the rights related
to the parcel.
In addition, you enter the land register the parcel originates from, and if the parcel was created by splitting
or merging of parcels. You can also record if the parcel, or part of it, is transferred to another land register
page.

Process Flow
You can perform these steps:
1.
Assign parcels
You enter the parcel in the land register.
For more information, see Assigning Parcels .
2.
Change the real estate register
You make changes when a parcel is split, or a parcel is merged with another parcel.
For more information, see Changing the Real Estate Register .
3.
Record related rights
You record a right related to the land. These are rights on another, usually adjacent, parcel.
For more information, see Recording Related Rights .

Assigning Parcels
Use
In the real estate register, you define real estate register numbers for:

Assignment of one or more parcels to a land register page

Notations on related rights, such as, right of way

The real estate register numbers represent the parcels from the point of view of the land register.

Prerequisites

1.

You are processing a land register . Choose the Real Estate Register tab page.
To assign a parcel, choose Add New Entry Parcel/Land .
The system adds a new row to the table.
2.
Enter the required data and save.

Note
A real estate register can appear more than once in the table if you add several parcels for one real
estate register number. In this case, the system generates a row with the same real estate register
number for each of these parcels.

Note
You can also enter related rights. For more information on related rights, see Recording Related
Rights .

Note
If you selected leasehold land register as the land register type, then additional fields are available in
the detail view.
If multiple owners share in the ownership of the parcel, you can enter their co-ownership shares in the
system.

Result
You assigned a parcel to the real estate register of the land register.

Assigning Parcels
Use
In the real estate register, you define real estate register numbers for:

Assignment of one or more parcels to a land register page

Notations on related rights, such as, right of way

The real estate register numbers represent the parcels from the point of view of the land register.

Prerequisites

Choose Country-Specific Settings Germany Land Use Management Parcel of Land.

Procedure

Changing the Real Estate Register

Use
You sometimes need to change entries for parcels in the real estate register, for example, because a
parcel is split. In this case, you first have to remove the original parcel from the land register, then you
enter the new parcels in the land register using the same real estate register number. Each change of this
kind is documented on a separate tab page for each entry in the real estate register. For any given parcel,
only one addition or removal is possible.

Prerequisites
You made the necessary settings in Customizing for Flexible Real Estate Management (RE-FX) .
Choose Country-Specific Settings Germany Land Use Management Land Register Define
Encumbrance Types.

Procedure
You are processing a land register . Choose the Add./Removal in RER tab page. Enter the required data
in the detail view.
If you remove a parcel, the system displays a red symbol and enters the cancellation date.

Note
In the case of a removal, the system checks if there are dependent entries in sections II and III of the land
register that were not yet deleted.

Result
You have an overview of changing ownership relationships on your parcels.

Recording Related Rights

Use
When a parcel benefits from a right related to another parcel, you enter this related right in the real estate
register.
Related rights include:

Restrictions on construction

Rights of way

Rights for rainwater drainage

There are always two parcels affected by the related right:

A dominant tenement (a parcel from the real estate register)

A servient tenement (a parcel from another land register page)

In land use management, you can depict the dominant tenement and possibly also the servient tenement.
For more information on the land register entry, see Managing Encumbrances and Restrictions .

Prerequisites
You made the necessary settings in Customizing for Flexible Real Estate Management (RE-FX) .
Choose Country-Specific Settings Germany Land Use Management Land Register Define
Encumbrance Types. .
You use the same table for related rights as you do for the encumbrances and restrictions in section II of
the land register.

Procedure
1.

You are processing a land register . Choose the Real Estate Register tab page.
You can enter only parcels and related rights in the real estate register.
Choose
with the quick info text Add New Entry Related Right .
The system adds a new row to the table. The system sets an indicator in the Rel. Right column.
2.
Make the required entries on the tab pages in the lower part of the screen and save.
The system establishes the link from this parcel to one or more parcels by means of the Related
Rightindicator.

Note
The parcel and land register page of the servient tenement are not always entered as master data
objects in Flexible Real Estate Management . However, you can still enter this information. In this way,
you can avoid having to enter all land registers in the system that have to dowith your parcels in some
way.

Result
You entered the related right.

Entering Ownership Relationships

Use
In this section of the land register, you record the owner or owners of parcels entered in the real estate
register, along with the basis for the entry.
The basis for the entry could be, for example, conveyance, inheritance, or certification as auction winner.
The following forms of ownership are possible:

Sole ownership
The owner does not share any rights on the land.

Tenancy in common
Multiple owners share ownership in a piece of land, with each possessing a fractional share that is
allowed to be sold separately.

Joint ownership
Multiple owners share ownership in the land as a whole. None of the owners has the right to sell his
share separately.

Procedure
You are processing a land register . Choose the Section I , tab page. Enter the necessary data and save.

Note
The entry date and cancellation date define how long the entry is valid. In time slot management, the
system displays the time slot valid on the current key date.

Result
You defined ownership relationships.

Processing Encumbrances and

Restrictions
Use
Encumbrances and restrictions on the land are recorded in section II of the land register.
Encumbrances and restrictions can relate either to the owner of the dominant tenement (easement in
gross) or to the dominant tenement itself (appurtenant easement). Owners are represented in the system
as legal or natural persons. Dominant tenements can be entered as separate land register pages.
You can record the related right in the dominant tenement. For more information on related rights,
see Recording Related Rights .
You can enter a reference to the dominant tenement even without entering a master data object for it.
You can define encumbrances and restrictions such as the following in Customizing. You can then assign
them to parcels when processing the land register.

The system automatically determines the rank of an entry using the entry date. In doing so, the
system considers the entries in both section II and section III. If you want to change the rankingof an
entry, then choose the Rank tab page in the lower part of the detail view.
For more information on ranking, see Changing a Ranking .
If you want to enter a joint liability, then choose the Lien tab page in the lower part of the detail view.
For more information, see Joint Liability and Creating Joint Liability .

Result
You entered mortgages and liens.

Changing a Ranking
Use
The restrictions in section II and section III are ranked.
The system determines the ranking within a section and among groups using the date of the entry. The
earlier the date of entry is, the higher the ranking. If rankings are changed later, then the two rights
involved exchange their rankings. Any other rankings are not affected by the change. A subsequent
change in ranking remains in effect, even if the change to the right involved is cancelled. If rights have the
same date of entry, or are changed in a subsequent ranking change so that they have the same ranking,
then these rights have equal ranking.
You can change rankings in section II and section III manually.

Procedure
1.

You can change the ranking of entries on the Section II and Section III tab pages. Select an
object and choose the Rank tab page in the lower part of the detail view.
2.
Change the ranking in the Rank group box. The system calculates the ranking using both
sections that is, the entries in both section II and section III are considered in determining the rank.
You can make the following changes:

Before Seq.No.Sect.
To place an encumbrance in the ranking before the selected encumbrance, enter the
encumbrance in this field.

Add to Section No.

To assign an encumbrance to an existing ranking number, enter the encumbrance in this field.

3.

Save your entries.

On the Ranking Overview tab page, the system provides an overview of the ranking numbers of both
sections II and III.

Result
You changed the ranking of an encumbrance.

Joint Liability
Definition
Using a joint liability, you can assign parcels from different land register pages to a common ID. This also
applies for parcels for which you did not create a land register page in the system.

Use
After you enter into a loan contract, you enter the encumbrance of the parcel. Different parcelsthat serve
jointly as collateral for a debt (joint liability) can be assigned to different land registers. When this is the
case, you can enter these parcels under a common name (of your choice) in a joint liability. As a result of
this entry, the system records this encumbrance in each of the parcels with an entry in section III of the
different land registers. In the joint liability, you can reference all these entries in section III of the various
land registers that contain parcels serving as joint collateral.
The joint liability contains the following information:

An ID

A descriptive text

A list of the land registers affected

You can use the number of the joint liability to identify parcels that jointly act as collateral, although they
may be entered in other land registers.
You can run a report showing the land registers that contain parcels affected by joint liability. In the
Information System of Flexible Real Estate Management, choose Country Specifics Germany Land
Use Management Land Registers Joint Liability .
To display the joint liabilities, choose Country Specifics Germany Land Use Management Joint
Liability.

Integration
The Joint Liability object is integrated with the Land Register object. All joint liabilities you enter appear on
theSection III tab page of the land register. You can also enter the joint liability directly in the land register.

Creating Joint Liability

Use
You record joint liability in order to identify parcels that serve jointly as collateral for a debt.

Prerequisites

Notice of Assessment
Definition
Using this object, you can enter notices of assessmentin the system.

In order to determine and set taxes, such as property tax and inheritance tax, the tax office uses the
assessed value of the land, rather than the market value. The tax office calculates the assessed valuefor
tax purposes. This calculation is defined by the regulations set out in German valuation law.
The tax authorities set new assessment rates for all properties from time to time. This is called principal
assessment.
If the tax office updates the assessed value and also sets a new assessment rate (per 7 of the property
tax law) at the same time, that is called reassessment.

Use
The land register pagedoes not contain any information regarding the assessed value. Therefore, the
assignment to real estate register numbers is recorded in the notice of assessment. At least one owner
belonging to the assigned real estate register numbers is adopted as a default value in the assessed
value. You record owners on the assessed value, for example because they might differ from the owner of
the land recorded in the land register if the land is sold.
You can enter assessed values even if you have not created a land register in the system.
For more information, see Processing a Notice of Assessment .

Integration
The notice of assessment is integrated with the master data object Parcel .
