Matt and I worked up a couple layout ideas. We do not profess to be the Costco experts, but we searched Google Earth
and found numerous sites that resemble the layouts in the attached drawings. These drawings are obviously very
conceptual, but they should give you a general idea of how the store could easily fit and enjoy very wide open visibility
from the interstate. Both drawings keep the building and parking areas out of the Flood Way.

Another likely important point is that you can apply for an additional curb-cut on Highland Colony Parkway that would
act as a right-in/right-out. This curb cut is not shown on either plan, but it is an option for both to improve
ingress/egress.

Following up from our meeting last week. Here are a few items we wanted to address:
1. Sale of Light Wine and Beer: Regulated by the City of Ridgeland. Distance is measured 400 feet front door to
front door. Your site plan adequately addresses this issue. The front door from the church is appx. 381 feet
from their property line. As long as the front door of Costco is appx. 19 feet from the property line, there will be
no issue with the sale of light wine or beer.
2. Sale of Wine and Liquor: Regulated by the Alcoholic Beverage Control Division of the Mississippi Department of
Revenue. The agent that I spoke with at ABC, confirmed that they measure from the nearest point of building to
the nearest poi"nt of building. The buffer distance required is 400' by State Law (Title 27 Chapter 71 Regulation
No. 7). The church building is appx. 326 feet from the property line. Another 74 feet would be required to be
100% clear of any point of the Costco Building; however, the location of the separate attached alcohol sales
facility appears to well beyond the nearest point of the Building. It is advisable that you verify with ABC if they
will measure from the edge of the Costco Building or from the edge of the attached Alcohol Sales building
before completing the site plan. If this becomes an issue either way, the Church can waive any objections. One
of our Aldermen attends Church their and could likely help us.
3. Zoning: We believe that the sale of all goods except the fuel center complies with the current zoning
regulations. We also believe that we can appropriately amend the language of the zoning ordinance to
accommodate the accessory detached fuel facility. That process would take less than 60 days and could be done
in as few as 30 days.
4. Access to Highland Colony Parkway: I have ilttached the HCP Access Control Policy. It appears to me that the
minimum distance between crossovers is 600 feet. The distance between crossovers at the north side of the
property is 765 feet; therefore, I believe a request to move the northern crossover north for better efficiencies
could be accomplished. The right-in I right-out could be added between crossovers as long as they have a 300foot buffer from the crossover. When you develop the site plan further and can send it to me without any
reference to Costco, send it to me, and I can get preliminary reviews accomplished with the City Engineer and
Public Works Director.

SECriON NINE
EXPIRATION OF EXTENSIQN
Any approval of a Development Review shall expire within six (6) months of such approval
except where construction or use of the property in reliance on such Development Review
approval has commenced prior to its expiration. If construction and use of the property in
reliance on a Development Review approval has not commenced within a six (6) month period,
said period may be extended by the Mayor and Board of Aldermen for a period not exceeding
six (6) months for each application up to a maximum of two (2) years from the date of original
approval.
SECTION TEN
ENALT1PS
Violation of this ordinance shall be a misdemeanor punishable by a fine of not more than
$1,000.00 and/or imprisonment for not more than ninety (90) days.
SECTION ELEVEN
EFFECTIVE DATE
This ordinance shall be effective thirty (30) days from and after passage.

Safety Criteria
The Highland Colony Parkway was designed
utilizing a Design Speed of 40 MPH.
Median
Opening (Crossover) Spacing is 600 feet minimum
with some spacing being in excess of 900 feet.
Any proposed access points to the Parkway shall
be so located to provide safe stopping sight
distance for vehicular traffic on the Parkway
based on the design speed of the Parkway and to
provide adequate intersection sight distance
for vehicular traffic entering the Parkway.
Location of signs, landscaping, retaining walls
and other related items shall also be
considered for compliance with the intent of
this Policy.
Proposed Access Points shall also be located so
as not to interfere with existing accesses to
the Parkway.

SECTION ONE

The Mayor and Board of Aldermen find that a development review process supports the
implementation of the Building Codes, Zoning Ordinance, Sign Ordinance, Subdivision
Ordinance and Development Ordinance of The City of Ridgeland. The Mayor and Board further
find that the quality of residential, commercial, industrial and public/quasi uses has a substantial
impact or visual appeal, environmental soundness, ~nomic stability, and property values of
the City. This ordinance is not intended to restrict imagination, innovation or variety, but rather
to focus on design principals which can result in creative imaginative solutions for the project
and quality design for the City. It is, therefore, the purpose of this ordinance to:

Recognize the interdependence of land values and aesthetics and provide a method
by which the City may implement this interdependence to its benefits.

Maintain the public health, safety and general welfare, and property throughout
the City.

Ensure that the proposed development complies with all other provisions or the
Zoning Ordinance and the comprehensive land use plan.
SECTION TWO

In order to safeguard and enhance the appearance and quality of development of the City of
Ridgeland, Development Review approval shall be required prior to the issuance of any builqing
permit for single-family subdivision developments; multi-family developments; mobile-home
parks; commercial or industrial establishments, and public/quasi-public uses, including exterior
additions, alterations and redevelopment thereof.

Mark -- I just finished meeting with Dan and Jeff and there are some items we need from the Seller. I gather
that they've discussed all of these with Andrew before but to date the information has not been provided. We
need this information to complete our analysis and to proceed with the estimating exercise to prepare the
required budgets. Dan and Jeff shared with me that the delay in receiving these materials has likely made it
impossible for us to obtain internal approvals in July and there are no meetings set for August.
Materials Needed (in order of priority):
1. All materials prepared for filing with FEMA and/or the Army Corps to address new floodplain/floodway and
wetlands matters. [NOTE: WE NEED THIS BEFORE WE CAN EFFECTIVELY RESPOND TO THE
REVISED LOI AS WELL.]
2. Boundary survey with topo.
3. Agreed upon site plan for the Costco Property, including a resolution of the "southern" access point and how
the church access and the Costco access will interface/co-exist.
4. Copy of approved ZTA modifying the C-2 zone, which, among other things, permits fueling station "by
right". We have the draft version but not the final.
Any help you can provide in getting these materials to us would be appreciated.

The Mayor opened the first regular June 2015 meeting of the Mayor and Board of Aldermen to order.
Present were Mayor Gene F. McGee, Alderman D. 1. Smith, Alderman Brian Ramsey, Alderman Ken
Heard, Alderman Kevin Holder, Alderman Scott Jones, Aldennan Chuck Gautier, Alderman Wes
Hamlin, City Attorney Jerry Mills, City Attorney James Gabriel, and City Clerk Paula Tierce. The
meeting wa< opened with an invocation by Mayor Gene McGee followed by the Pledge of Allegiance .
Next came the recognition of Colonel John M. McCollum for receiving the Legion of Merit medallrom
the United Stutes of America. Paula Tierce, City Clerk, called the Orders to attention and read the
following from the ccnilicate awarded, ''For exceptionally meritorious service in positions of increasing
responsibility, culminating a 31-ycar career as the Executive Officer ofthe 4010 United States Army
Hospital. Colonel McCollum served with distinction in positions at various locations throughout the
world. His noteworthy services have been at all levels or command and in a myriad of positions. His
outstanding leadership, technical competence and distinctive accomplishments contributed immeasurably
to the Army. Upun rotirornent, Colonel McCollum is recognized tor distinguished performance of duty
that represents exemplary service in tinest tradition of the United States Army." Mayor McGee then
presented the Legion of Merit medal to Colonel McCollum and thanked him for his service and sacri flee

and Board of Aldermen for their strong support to the Mississippi National Guard and also thanked his

Next came the public hearing for the proposed amended Section 21 and 410 of the Official Zoning
Ordinance of the City of Ridgeland, Mississippi. Mayor McGee opened the public hearing and the City
Clerk adjudicated that proper and timely notice was advertised as required by state law. A copy of the
notice is attached hereto as Exhibit "A"
Alan Hart, Director of Community Development, advised the Mayor and Board of Aldermen that the
following changes were being proposed:

area of land, including the structure thereon, which is used primarily for the retail sale qf gasoline, diesel

OF THE OFFICIAL ZONING ORDINANCE
OF THE CITY OF RIDGELAND, MISSISSIPPI
WHEREAS, the Mayor and Board of Aldermen of the City of Ridgeland, Mississippi
did lawfully adopt a Zoning Ordinance on February 4, 2014 after proper notice and a public
hearing; and
WHEREAS, the Mayor and Board of Aldermen of the City of Ridgeland, Mississippi
did lawfully adopt a Zoning Ordinance Amendment on February 3, 2015 after proper notice and
a public hearing; and
WHEREAS, additional development trends of a certain commercial use has resulted in
the need to consider appropriate regulations and restrictions; and
NOW THEREFORE BE IT RESOLVED, the Mayor and Board of Aldermen adopt the
following sections as amendments to the Official Zoning Ordinance of the City of Ridgeland,
Mississippi by amending the following sections:
Section 1
Replace the Section 21 "Service Station" Definition with the following language: Service
Station: Any area of land, including the structure thereon, which is used primarily for the retail
sale of gasoline, diesel fuel, ethanol, oil, propane, other fuels, and/or the sale or installation of
automobile accessories and may also include incidental services such as facilities for lubricating,
washing (either automatic or by hand), and cleaning, or otherwise servicing automobiles and
light trucks. This term does not include the painting or major repair of vehicles.
Add to Section 21 Definitions the following definition: Large Master Planned Commercial
Development: Any large commercial development consisting of a group of one (1) or more
contiguous separately owned or ground leased tracts or parcels that contain, among the group of
tracts or parcels, at least one building for occupancy for retail/wholesale purposes exceeding
I 00,000 square feet of heated and cooled space for the indoor display and sale of goods, a site
with a minimum of 15 contiguous acres, access to an Arterial Street, and approved by the Mayor
and Board of Aldermen which may or may not include conditions. Large Master Planned
Commercial Developments may include any of the uses permitted in the underlying Zoning
District as well as Service Stations; Banks, branch banks, drive-thru ATM's, and other banking
facilities; Food product and carry-out and delivery stores, laundry and dry cleaning pickup
stations; Fast Food Restaurant with drive-thru; Fast Casual Restaurant with drive-thru; Pharmacy
with a drive-thru; and outdoor display of goods in designated areas approved by the Mayor and
Board of Aldermen in one (1) or more locations not exceeding an aggregate of 15,000 square
feet.

Daniell am going to be out of the office Monday and Tuesday having a medical procedure and will be in
deposition preparing on Wednesday, so I wanted to go ahead and send you information today and get
you more information at the end of the week. First of all right of way acquisition is going very well and in
fact should be completed in 30 to 60 days. Plans are complete for the most part except for a few
changes at the railroad which should be done within a week or two. Financing is complete so that is not
a problem. Some utilities have to be relocated and will be completed as soon as the ROW is finished. I
expect to have the project ready to bid by the end of 2015 or early 2016. As you know the total
construction to completion is 18 months, I expect to cut a ribbon on the road by mid-2017.
As you know the city of Ridgeland is committed to getting this project done and is investing a large
amount of capital to do so. We have a reputation for getting the job done and this case is no different.
Thanks for working with us. We look forward to the completion of our project as well as yours.

management. Can you provide me with an update on the status of the Lake Harbour Drive extension
over to Highland Colony Road?
Clearly, the completion of this road project is important in our decision making to move forward on this
transaction. Specifically, I am looking for something that resembles a project schedule that lists all of
the major milestones including: financing, completion of engineering plans, acquisition of all rights-ofway, ground-break, various construction milestones and completion date.

2 conceptual options attached. These ideas would have to be engineered by a PE.
We prefer that Santa Claus get a primary-looking full access arrangement to Highland Colony Parkway. We prefer that
the Church access appear secondary so that shoppers don't confuse the entrances and burden the church property with
U-turns in their parking lot. Option #2 would be available after all other options fail to pass the reasonable test. Option
2 is not preferred, but we think it can be Engineered to work.

toward your administration and we will actively field and support a viable candidate against

RIDGELAND- City officials have for the third week in a row reiterated that they are
aware of no plans at the moment for a Costco to be built off Highland Colony Parkway,
although a site for Renaissance Phase Ill will bring about some type of large
commercial development.
Residents of nearby neighborhoods such as Dinsmor and Greenwood Plantation
continue to raise concerns over a Costco being built near their homes.
The site for Renaissance Phase Ill is located south of the Natchez Trace Parkway
between Highland Colony Parkway and 1-55. There is other property ripe for commercial
development along Highland Colony, as well as property on the east side of 1-55.
Mayor Gene McGee said the city has been working to ensure that the illegally
subdivided land where Renaissance Phase Ill sits, which was originally part of an $80
million mortgage fraud case involving Chris and Charles Evans, is developed in-line with
the city master plan.
"We're cleaning up a mess, particularly the mess to do with what the Evans brothers did
with all the different properties they had," McGee said.
The brothers were sentenced to 14 and 20 years in prison in 2011 for defrauding over
50 banks on mortgage loans on land where deeds were not even being recorded.
"It put us in a situation where we had a bunch of subdivided properties," McGee said.
McGee said banks wanted to sell the property off to anybody who would take it and
fought against call centers and an apartment complex apartments from locating there
based on the subdivision violations.
"We had a realtor threaten to sue us for putting our foot down," he said. "They got
serious with us."
He said that's why the property in question fits with the Large Master Planned
Commercial Development definition.
"That was done to try to master plan that," McGee explained. "To have a quality
development instead of piece-milling a development. We're always trying to think ahead
as to what would be the best for the City of Ridgeland."
He added, "We strongly believe in master planning that area on both sides of Highland
Colony Parkway. We have worked hard to protect that area."
McGee pointed to the piece-milling developments along County Line Road and the
troubles that arose, including traffic and parking.
Highland Colony Parkway was byilt'~~lithorized by special state legislation in 1989 that

allowed the county and cities to build the $10 million public/private joint venture
roadway. That opened the Parkway up to commercial development.
Prior to 2014, some of the property along the parkway was zoned C-4, which would
have allowed for anything from bail bond companies to tattoo parlors and gold buying
shops.
Planning by the city changed that land to C-2, allowing for only a certain kind of
development, including office, retail, hotels, and restaurants.
Between the residential areas and the C-2 property are parcels zoned C-1 that would
allow for commercial office space.
Alan Hart, director of community development, said the city has been diligent in
ensuring that proper development occurs in that area.
"Half of it was zoned C-2, the other half zoned C-4," he said at a meeting in city hall last
week. "Between those two districts, what used to be allowed were automobile
dealerships, apartments, convenience stores ... "
Hart said they cannot legally tell property owners what they can do with property if
zoning allows for it, but they are able to control the development with different
ordinances.
He said there is architectural review, a landscape ordinance, and even a tree ordinance
to shape developments.
"When you demand the best quality, you're gonna have a lot better chance of cutting
out the lower quality businesses," he said. "The city doesn't pick the tenants, the city
doesn't pick the sites. We regulate through zoning and other land-use controls."
Both McGee and Hart say whatever businesses come to Renaissance Phase Ill will fit
right in line with what the developers did with the first phase of Renaissance in terms of
quality. While Costco has not given any indication whether or not they plan to put a
store in Mississippi, Hart verified that such a store meets the land use requirements of
the Zoning Ordinance.
The timing of such development, however, is yet to be known.
McGee said the third phase could be constructed to coincide with two major road
projects in 2016 or could come later.
"We haven't had anything brought to us yet," he said, saying they haven't seen a master
plan.
The city has almost acquired all the right of way needed to construct the $22 million

Lake Harbour extension, which will connect with Highland Colony Parkway. Subject to
Mississippi Department of Transportation approval, McGee hopes to bid the project in
2016.
One piece of property is left to be obtained before the city can begin on the Colony Park
Boulevard tie-in.
McGee said the city will have to use eminent domain and a hearing is set for
September. Once all the right of way is obtained MOOT can finish that project.

Locating this Big Box store where it is being proposed would greatly affect our quality of life in
Ridgeland. Please, Mayor, do not let this happen!
I do NOT want Costco to locate in the proposed location, south of the Natchez Trace Parkway,
between 1-55 and Highland Colony. The tremendous amount of traffic that will be generated by this
big box store is completely UNWANTED. Additionally, Highland Colony CANNOT handle all of the
traffic that will result.
Costco needs to know that if it does locate in this location, the neighborhoods affected will NOT
become patrons of Costco. We have no desire to support this store in the proposed location.
Costco should be encouraged to find an alternate location in the Jackson Metro area or Flowood. We

Ridgeland. Being a big advocate of healthy living, I love how pro health the entire city is. Being
in real estate development business, I can really appreciate the quality of the developments on

big box store. A discount gas station will also be part of the development. More importantly, there will be several
hundred more folks in our neighborhood every day that we ever anticipated when we moved here ..
We need to fight this project with all the might we may have. Neighborhoods surrounding us, including Bridgewate
Greenwood Plantation, Dinsmoor, Canterbury and others have joined the opposition to the project.
There will be a city hall type meeting next Wednesday night at Ridgeland High School 6 pm that we all need to
attend because this project will be on the agenda. The more the merrier.

The truthful statement is that we do not know at this point. These are all great questions that we will ask of any applicant when a site
plan is submitted. The developer has not made a site plan submittal. We will have to consult with MDOT regarding the performance
capacity of the roundabout. It is clear to me that a traffic is of great concern and a traffic impact analysis may need to be considered
before making a decision about what should be allowed to locate within this area and surrounding areas, but we cannot make any
decisions about traffic in the absence of useful information from a developer and specific tenants. Right now, all we have to go on are
assumptions and the ITE Traffic Generation Manual that MDOT uses. We will continue to work towards answers.

box/gas station is a material divergence from the intended character of our area. I feel that a location further
south on Highland Colony Pkwy is more appropriate. I understand the complications this may cause with
interested parties, but as far as the existing neighborhoods are concerned, a move further south would allow us
to maintain the quality of life that drew us to Ridgeland in the first place.

I'm willing to bet two hundred bucks against a donut that all you will hear at this meeting
is the phrase "I can assure you that the city ... " at least thirteen times. Industrial
development always has and always will involve secrecy. You canNOT expect to hear
any mention of specific businesses considering location here. That's a fact. The
intention of this meeting is to see that you go home assuaged, calmed-down, noncombative and with wool over your eyes. Don't let it happen.
If Mayor McGee shows up at all (after showering following a bike ride) his comments will
be nebulous, non-specific and intended to make you feel good about his stewardship.
And whether or not McGee shows up, Alan Hart will 'assure you' that they have your
best interest at heart and are 'looking into ways to improve traffic flow throughout the
Ridgeland community'.
Highway 51 already resembles Pearl in many ways. Ridgeland leads the state in the
number of apartment units per capita. The city has done NOTHING to develop the
reservoir market potential. Weeds are eight feet tall on vacant property on the main drag
through town (across from and just to the west of Shapley's). Pawn Shops, Resale Junk
Stores, Nail Salons and Payday Loan Sharks are welcomed by the city administration.
Goodyear at the mall has been vacant for five years. If your specialty is building bike
trails, they'll fly you in and host your stay for a week of fine dining.
I no longer live in Ridgeland but do own a house in your neighborhood that I'm
preparing for sale. I hope I am wrong about the direction Ridgeland is taking, but
nothing leads me to that conclusion. I agree with Eddie in hopes that you can attend this

property gets to decide who he sells or leases the land to... not the city of Ridgeland. I
am under the impression that the townhall meeting will be just a response from the
city of how they propose to make it look nice and fit into the city plan. I think we all
understand that Highland Colony is zoned for business development, but I don't
believe having a Costco is the same as having a Renaissance so close to our
homes... that there will be more transient traffic, more congestion, and our property
values will decline.. Just like County Line. While I appreciate Mayor McGee's
leadership of Ridgeland in many ways, I think if there was a choice to be made
between business or residents, he would choose infavor ofbusiness... as he did when

Renaissance Phase III is a 45-acre site, located south of the Natchez Trace Parkway on the east side of
Highland Colony Parkway in Ridgeland. Highland Colony Parkway is a corridor designed for high
quality commercial development. Being located near Interstate-55 positions the site to be attractive to
retail uses that would bring revenue to the city, helping to maintain the public services and amenities
to which citizens are accustomed.

that outlines the future of Ridgeland's land uses.
The City uses the process of developing these maps and following the master plan to guide our
community's development. Any development along Highland Colony Parkway will follow the Master
Plan and the Zoning Ordinance of the City of Ridgeland, which seek to ensure a balance of land uses
and development that helps maintain a high quality of life for residents.
The site is zoned C-2 for certain commercial uses including a master planned development for
developments over 1oo,ooo square feet. Commercial zoning is essential for the growth of taxproducing properties. What type of property is built is controlled by the zoning ordinance.
Commercial development is essential in order to maintain low taxes, public services and
infrastructure. Property values increase in communities where development is planned.
Travel
Highland Colony Parkway is designed to carry more than 27,000 vehicles per day. This roadway in
the immediate area of the site, south of the Natchez Trace Parkway, currently carries 8,ooo vehicles
per day. It is considered to have a Level of Service A, which is defined in the Ridgeland Transportation
Plan Update as "relatively free traffic flow with traffic volumes that are between o% and 35% of
capacity."

Renaissance Phase III, when developed as retail use, would g~nerate 1,020 vehicles per day
according to the ITE Trip Generation Manual that the Mississippi Department of
Transportation uses. This number of additional vehicles will not significantly alter the Level of
Service. It is possible that certain uses can carry a higher traffic demand than averages
supported by the ITE Manual. City officials will require a full-blown traffic analysis for
Renaissance Phase III to provide assurances that the existing infrastructure can support the
project.
The roundabout is currently handling the number of vehicles that travel through it from all directions.
It flows at a Level of Service A with one exception; the west-bound Old Agency Road entrance during
the morning peak sustains a Level of Service C.
An additional1,020 vehicles will not substantially change the ability of the roundabout to
handle traffic. The required traffic study vvill also analyze the impacts to the traffic circle.
Retail development does not typically affect morning peak traffic since retail hours of operation
are later than office hours.
There are no plans to remove the roundabout.
Delivery trucks for any retail businesses at the site will not be allowed to use the roundabout. It is
marked as a No Truck Zone and this will be enforced.
Delivery trucks will be limited to travelling from the south in order to access the site. Truck
routes will be enforced by the City of Ridgeland and the managers of the property.
The traffic study will need to reveal the bearing capacity of the streets and may result in load
restrictions.
The planned Lake Harbour Drive extension will provide an additional route for travel to and from
Renaissance Phase III. Lake Harbour Drive extension has been included in ever.y Comprehensive Plan
and Transportation Plan since 1988. City leaders are working to move this project forward for an
additional east-west connector in Ridgeland.
Quality
The opportunity to plan the development for this site will enrich the look and feel of that
development. High standards of architecture, lighting, and landscaping will be implemented.
Renaissance Phase III will provide visitors with an environment of similar design to Renaissance at
Colony Park. It will be a very attractive development.
With high quality developments, security can be expected through lighting, cameras, and site design.
An area such as this is unappealing to criminals. The Ridgeland Police Department will conduct
patrols and maintain a police presence in the area. It is anticipated that this development will provide
for private security to further enhance safety.
The Master Plan reveals that the portion of Highland Colony Parkway adjacent to the proposed site
should include General Commercial, which allows for retail, restaurant, hotels, etc. Low-Intensity

Commercial such as office buildings are planned between the residential areas and C-2 districts. A
gradual reduction in intensity of uses helps to provide a buffer for residential areas. This helps to
ensure a quieter environment for residential areas and protect property values.
High quality commercial uses will result in tax revenue increases for Ridgeland to better provide for
its citizens and helping to keep citizens' taxes low.
The city does not have any confirmation of the tenants for the development of Renaissance Phase III.
But, knowing that the developers desire businesses that are complementary to Renaissance at Colony
Park, city leaders feel assured that tenants will not harm the success of the existing retail businesses at
Renaissance at Colony Park.

look at all information before we do anything.

Here's a question, esp for someone saying "OK for Jackson ... but
not R'land". So it's OK for we in R'land & folks from Jackson to go
up to Madison, spend money AND benefit their sales & property tax
base, but NOT A FAIR idea to have a Costco (anywhere?) in
Ridgeland? How does that help the development of R'land? and
support budget for police, fire & enhanced roads. Highland Colony
IS in desperate need of re-surfacing and I suspect that will come
with other infrastructure aspects of such a project. I still have trust
in the City leaders to study the pros & cons, tho they may "cave in
to the froth of community organizing AGAINST this project". I
hope folks at least wait for the 20th meeting- unless they plan to
bring baseball bats & sticks. Be like grown-ups people. Remember
this will further & speed up an important addition to connector
roads; the west bound extension of Lake Harbor from Hwy 51,
UNDER the railroad right there, over to a new interchange with I55 & continue to HCP. That's a game changer since nowhere else
does R'land have other than a 'grade level' crossing for the
railroad. Hope I never need certain access to interstate or hospital

I just wanted to drop you a few lines to tell you how incredibly impressed I was with how cool you were last night
in the midst of all of the angry words and childish behavior that was being shown by the residents. I feel like you
handled yourself well, because I promise I would not have been able to- in fact, I lost it when everyone was
yelling out at Susan Haltom, and was the one that told everyone to hush and let her speak. I felt like everyone had
the right to speak in an orderly fashion, and for those that didn't, then they didn't need to be heard.
I made a few friends last night with my suggestion, but also gained several enemies with it, but my opinion is my
opinion. I am sure you can ask Jane, as she and I have done several mock interview sessions together- the first
thing I try to teach young ladies in interview is to have just that- an opinion, and to have solid reasons for the
opinion. Without an opinion and reasons for it, we are all just robots or puppets with someone else controlling
us. I just feel that no matter what, that area is a development area and it will be just that- developed. My stance
is that we should give positive feedback with ways to possibly keep the integrity of the parkway intact. I feel like
my suggestion would do just that.

Hi! I will certainly see you tonight, but wanted to send a quick suggestion or at least my thoughts on this whole
Renaissance Ill that everyone seems to have blown a bit out of proportion.
You know that I will always support your efforts- you have been an excellent Mayor and an asset to
Ridgeland. After listening to countless complaints and concerns, it hit me that everyone has lost sight of a very
easy solution to this entire issue.
No matter what stores or development is decided upon to go into the location in question, the real main concern
is the sight and traffic that would certainly occur from the round-a-bout to the development.
I understand that we have to take the Natchez Trace development constraints into consideration for frontage road
access, but everyone seems to have forgotten there is the ability to create an exit from 1-220 that could be an "exit
only" to a frontage road to lead directly to the site from the south side. You would, then, not impede upon the
Natchez Trace and have an outlet to keep so much traffic from coming through the round-a-bout. You would still
have the access from the Lake Harbour Ext. flyover and from South Highland Colony Pkwy. leading from 1-220
coming from Jackson. I would say that the development would surely need to face 1-55, and there really be only a
small entrance to lead from HCP to the front of the development. All parking would be on the 1-55 side. The back
of the site on the HCP side should be "hidden" with trees and landscaping, so as not to diminish the "look" of a
tranquil residential area.
When speaking to a Mattice employee this weekend that has a little bit to do with all of this, I brought this idea
up. He looked shocked .... and then after a few seconds, said "Wow- not one person has thought of that! What a
great idea!".

portraying that they speak for all the residents of our great city. I can tell you emphatically that they are
a very small minority and DO NOT represent me nor the thousands of other residents and business
leaders that welcome development to our community.
Let me share some interesting things that have occurred by many of these same people that oppose
Costco coming to Ridgeland (or should I say to "their" part of Ridgeland).
1. They opposed the building of St. Andrews school - some sent their kids to school there after it was
built.
2. They opposed the Township development- they now frequent its shops, tennis and fitness center and
restaurants.
3. They opposed the Renaissance Shopping mall - they now tell of how Costco will put those poor little
retailers out of business.
4. They opposed the building of the 13 story Butler Snow building - no complaints about the tax revenue
from it now.
I attend Christ Life Church which will be your neighbor to the south. Many of our members are excited

From my research and comments made to me from others:
Costco is a great community supporter! Awesome!! I coach in the Madison Ridgeland Youth Softball Club
and my three daughters play in the league. Community minded businesses matter to the 500 families in
our league.
Costco will bring jobs to the community. That is HUGE in this economy.
Costco will bring consumers from other areas of the state and support our tax base by not only shopping
at your store but at the restaurants, other stores, etc ...
Costco being here will attract other fine retail for our community.
Please do not allow a VERY SMALL number of people impact your decision to locate in Ridgeland. I am
confident that many of the nay-sayers will have Costco cards in their wallets in the near future if they
follow their pattern I shared earlier in the email.
If you need others to provide their support in emails please let me know and I will ask them to send them
to you.
Please bring Costco to Ridgeland.

Here's a question, esp for someone saying "OK for Jackson ... but
not R'land". So it's OK for we in R'land & folks from Jackson to go
up to Madison, spend money AND benefit their sales & property tax
base, but NOT A FAIR idea to have a Costco (anywhere?) in
Ridgeland? How does that help the development of R'land? and
support budget for police, fire & enhanced roads. Highland Colony
IS in desperate need of re-surfacing and I suspect that will come
with other infrastructure aspects of such a project. I still have trust
in the City leaders to study the pros & cons, tho they may "cave in
to the froth of community organizing AGAINST this project". I
hope folks at least wait for the 20th meeting- unless they plan to
bring baseball bats & sticks. Be like grown-ups people. Remember

Message already delivered again today, and I will continue to share with them these very options you have mentioned. We've had
conversations with land owners within each of the 3 sites you mentioned. I certainly appreciate your confidence in me to rectify, but
aside from trying, I'm not sure there is much that I can do to lure them to another site. It is a very real possibility that Costco will not
come to this site. I have my doubts that they will come to any other site in Ridgeland, but let's remain positive. I only hope that they
do not decide to build in another surrounding community, which would only drag more shoppers and synergy away from
Ridgeland. My belief is that this site will develop one day, and I hope the individuals that get to make those decisions do their best to
make it great for Ridgeland.
I will continue to press for information and offer suggestions that make whatever lands there better. I believe the three meetings have
brought to light the issues, and I believe those issues have been heard loud and clear. I certainly appreciate your approach,
professionalism, and knowledge. There are several individuals that have been very professional in their delivery and demeanor, which
I have observed as being more productive to their cause.
People often ask me why businesses leave Jackson or Ridgeland and head north. I always explain that they are merely chasing
YOU. If people will quit running from them, they will quit chasing. I normally buy everything I need in Ridgeland. It doesn't always
work out that way, but I give it a good try anyway. I do this so that I can pay the sales tax that is returned to the city to ensure that the
police and fire services among all other city services (especially paving streets) is better than the rest. I do this even at the
Renaissance where there is a TIF in place. It doesn't cost me more; it gives me a good place to shop and enjoy quality oflife ... a place
that wouldn't have been there in the absence of a TIF.
If not Costco at this location, I would love to hear only your thoughts about what could go on this site that you think fits. There is no
reason for us to "sit on our laurels" and not be proactive at bringing to this site a development that meets the desires of 100% ofthe
neighbors. (You may recall "sit on our laurels" from the teachings of Patrick Moore.) Although it could take years to materialize, I'm
not at all against starting to make calls to other businesses that can add value to our community.
Again, I really appreciate your kind words and value your input. We may not always agree, but you have always been more than kind
to me, and I thank you.

Sir ... I served my country for over 26 years on active duty (I notice you have never served) and fully understand the meaning of
trust, service, duty and honor. It is clear to me that you have none of those values inculcated into your character, very sad to see that

I have been absent from some of the proceedings these last few weeks because I was at a leadership conference at West Point.
honestly wish you could have attended the conference and learn a little about selfless service and true leadership. However, I still
think you were smart enough to know that this was not in the best interest of your constituents (a cursory check (i.e. Google search) on
your own time would have highlighted in the incongruencey of this operation at the "secret" location) and should have done the
honorable thing and refused to facilitate any enabling efforts
(i.e. zoning amendments) to make it happen from the get go.
Your actions have severely impacted the trust you assured us to have in you. You have compromised your personal
character. And to answer your question you posed to me in front of everyone .... "can you trust me?". Sir, I have been trusted to
maintain national security secrets and now you can trust me to fight against your less-than-honorable efforts. And you can trust me to
be a vocal supporter of just about anyone who runs against you in future elections.
I would welcome any professional (that means no yelling at me) discussion on leadership, morals, ethical behavior, trust, and
honorable living with you in the future. Additionally I am still requesting your analysis of the projected traffic safety ratings on Old
Agency Road between the I-55 exit and the roundabout and its impact on the St. Andrew's school traffic as well as foot traffic on the
Natchez Trace walking trail where it crosses Highland Colony Parkway.

My specific question is regarding the current MDOT official rating of an "F" for the Old Agency Exit/Roundabout/Renaissance
Entrance area. I understand this is based on weave space, vehicle count, and other safety factors.
What is the projected vehicle count (not just delivery trucks) with the projected development and how does it affect the MDOT
safety/"funtionalbility" rating for that already "F" rated exit area? I clearly understand the capacity of the Highland Colony Parkway,
however it is the exits and interchanges that I am requesting dissemination of your staffs and the developers' feasibility analysis with
respect to MDOT Design Guide Criteria and ratings.

I DO have confidence in you, since I believe you know the city and the Master Plan better than anyone. It takes
broad vision and a constant ability and readiness to juggle in the job you hold. I think you can influence some
important people if you hold true to what is best long term.
Ridgeland is different from all other nearby cities, and we have many special assets we must protect, even if it
means to tum things down which are promoted in a big way and which might seem good now but are risky later
on.

There is a lot to be worried about with Mayor Hawkins and Mattiace announcing Grandview East, with all the
stores they will suck away from County Line Road. I'm sure you saw her little dig about her spot being tailor
made for big box stores; she is right, it is. I'm not saying that sort of big retail conglomeration is good,

I have read comments online about the elite group of citizens in the west area who are unhappy with the
proposal. Yes, many are professionals who spent years in training, but why should they be condemned for that?
While some of their homes are grand, those homes represent their own biggest personal investment akin to that
of more moderate homes and their owners. As you may remember, we moved here in 1989 when our sons were
7, 4 and 1. We purchased a home built in 197 5, and we were still in rural Madison County at the time. I was not
aware of HCP until construction began. If I had had time and the knowledge that I now have, I would have
lobbied for a deeper C-1 area to separate residential from commercial. Citizens don't like being caught by
surprise; they feel the city is supposed to protect them from bad surprises down the road.

Here are my thoughts about the property in discussion:
Because this area was proposed in RAMP as a civic complex and a possible overlay district, that should indicate
the care with which it should be developed. For long term, it would seem to me that something like The
Township is good. I have come to appreciate its brick facades (not stucco) and its considered build out. People
feel comfortable there.
Incremental scale, multiple uses, integration of uses, density, a longer build-out, no island buildings in a
sea of parking-all of these seem important to me. Human scale.
What is not appropriate in this location (and others nearby) for long term is monolithic scale and single
use.
Might it be important to link Freedom Ridge in some way with greenspace across the bridge, on the west side?
A Greenwood Park? I see that Freedom Ridge will expand south of the new road, giving a nice drive-through
vista. But once you land on the west side, you have "flown over" small businesses (the engineers and Sikh
temple etc.) and then whatever will be built across the street on Luckett land? This all seems very important to
me, in aJJitiun to the Cush.:u property.

for Costco or any singled out piece of property. It clearly benefits the city of Ridgeland by making ourselves

constructed in the early 90's.

The site of Renaissance Phase Ill was never zoned residential. it was zoned commercial
for as long as Highland Colony Parkway has been in existence. Our earliest zoning
maps for the area reveal commercial zoning.

Leah, I was legally restricted from giving any indication that we were having any
discussions with Costco until such time as they consented to a release of our
confidentiality agreement. These confidentiality agreements are commonplace when
a competitive business shows interest in a property. The vast majority of
conversations were taking place between Costco and the developer, not the City. I
admit that my choice of the word "rumor" may have given the wrong impression, but
at the time (and this is still the case), there was no lease or purchase completed so any
conversations about Costco locating there were not substantiated with a signed
contract for the land or a building.

Below is an email notice about the upcoming meeting at City Hall. The meeting agenda includes a proposal to
refinance the 'shortfall' for the difference between the sales taxes generated by the Ridgeland Lowe's near
County Line Rd and the debt owed bondholders for the TIF bonds issued to finance the development.
This is an !mportant agenda item for the City because the shortfall was guaranteed by L.R. Company, LLC- a
company owned and managed by the Lowe's developer, Andrew Mattiace. Our Mayor and city aldermen
(except for Ken Heard) voted in 2013 to release L.R.Company, LLC and Mattiace from any further debt
obligation related to the TIF bond debt. The city has apparently been paying the debt shortfall out of general
funds, which is a highly questionable action and likely prohibited. The city apparently sought an attorney
general opinion on the matter in about April 2015, then quietly withdrew the request in June 2015.

This Tuesday, September 1, 2015, 6 p.m., the Mayor and Board of Aldermen will meet
at City Hall to discuss and act on the refinancing of the Lowe's TIF (Tax Increment
Financing) bond debt.
TIF Bond financing is a public financing method that is used to subsidize a development
project in a community. It allows municipalities to dedicate future tax revenues from the
development to repay the principal and interest on the bond (sales and ad valorem
taxes that SHOULD go into the general fund). These bonds are issued by the
municipality (the City of Ridgeland) to subsidize the developer (LR Company LLC,
Andrew Mattiace managing member) in building the project (Lowe's).
As you may recall, Andrew Mattiace was the developer of Lowe's off County Line Road
in Ridgeland, and at the time that he proposed the Lowe's development, the city issued
a TIF bond to finance the construction of Lowe's. Mattiace, at the time that the bond
was issued (serving as the Manager of LR Company, LLC) signed a guaranty in
which the LLC committed to make up any shortfall (the difference between the taxes
collected and the amount needed to satisfy the bond debt). He, of course, was
anticipating that the tax revenue would service the debt entirely.
Subsequent to its opening, the sales and ad valorem taxes collected on the Lowe's
development have been insufficient to repay the principal and interest on the bond. LR
Company LLC (as required by the guaranty) made up the difference for 3 years, and
then Mattiace informed the city that the LLC would no longer make up the
shortfall. Matti ace and his company were released by the City from the deficit
obligation.
NOW, the city is proposing to refinance the Lowe's TIF bond debt ($1 ,905,000) and the
City (you and I) will be repaying the TIF Bond debt out of the general fund instead
of requiring Mattiace's LLC to honor the guaranty and what should be his LLC's

obligation. The City of Ridgeland should not be making up the shortfall; Mr. Mattiace 's
defunct LLC should be!
This is the same Andrew Mattiace that is proposing to serve as the master developer of
Renaissance 2 (north of Renaissance 1) and Renaissance 3 (Costco and others located
south of the Natchez Trace Pkwy. between 1-55 & Highland Colony Pkwy.) and will be
using a Mississippi Development Authority (MDA) Sales and Use Tax Rebate Program
for TOURISM PROJECTS to help build it ($29.6 million of OUR tax dollars)!
If you are concerned that the City is using YOUR tax dollars to pay the debt obligation
of Andrew Mattiace's LLC, you and your neighbors may want to go to the meeting at
City Hall on Tuesday, September 1, 2015, at 6 p.m. and voice your opposition.
Attached is the Resolution of the Mayor and Board of Alderman to refinance the Lowe's
TIF Bond debt.

There is no need to put Kimberly in the center of the debate. I prefer that you not forward this because I'm not the
authority on this subject. I can only offer you my understanding. There's not much that can be said that these
individuals are willing to listen to anyway.
I understand that a refinance is necessary in order to avoid default on a loan the City made or use the general fund to
pay the difference. Default would result into damaged credit. Most of us can apply the same logic to our personal
finances. Damaged credit simply means we pay more for financing road projects, etc. Refinancing is one of the big
ticket items that makes it possible for us to balance the budget and avoid a tax increase this year!
It is true that LR Company, LLC failed to fully honor a personal guarantee, and a lawsuit was filed. The Board decided to
settle the lawsuit instead of throwing more good money after bad. It is worth noting that LR Company has no
assets. Regardless, the redevelopment of the Lowe's area was an important development to us all by arresting the rapid
decline we were experiencing 10 years ago. We are still trying to stop the decline. LR Company, LLC didn't default on
the personal guarantee until after giving the City of Ridgeland the idea of refinancing the debt. This option was not
chosen immediately by the Board of Aldermen, but it will be considered now.
The City of Ridgeland pledged its share of the ad valorem tax (property tax) and 50% of the sales tax to pay for the TIF
incentive offered to the developer of Lowe's. I'm not sure of the length of time was required for us to make payments.
was not employed at the time, so I don't know all the particulars, but I understand that the primary use of the funds
collected by the developer were used to build the massive retaining wall and bring in huge amounts of dirt. In the
absence of these two items, there would be no Lowe's because it would have been too expensive to redevelop. The
dilapidated buildings that once stood there would probably still be there. The effects of the decline would have further
extended to adjacent properties.
Today, we have a Lowe's. We've been getting 50% of the sales tax to pay the debt service on the loan. The other 50% of
sales tax collections goes into the general fund where we pay for things like roads, police protection, fire protections,
trails, etc. Default or not, this was a good project for Ridgeland.

Mr. Heard continued pressing Mr. Jerry Mills about the withdrawal of
the AG opinion request. Mr. Heard cited the name of the person on record that
made the request for the withdrawal, a partner in Mills' law firm, as well as the
date the withdrawal request was made- June, 2015. Prior to June, no one
believed the AG opinion request was withdrawn. Heard revealed the specifics.
Mr. Mills then remembered the truth. Previously, Mills denied any knowledge
of the AG opinion request being withdrawn. Finally, this past Monday night,
and after repeatedly denying any personal knowledge, Mr. Mills admitted that
Jim Hood personally said that using general tax revenue to pay for private TIF
bond debt was illegal.
Dow Yoder, a former Madison County Assistant District Attorney and
Special Assistant U.S. Attorney, said public officials are routinely investigated,
indicted, and prosecuted for much less in the way of public corruption. A
Ridgeland resident since 1999, Yoder continued, "Private use of public money
is the most common criminal violation of our public trust. Concerning the
Mattaice default on the TIF bonds, the Ridgeland Board of Aldermen can't
legally pay the private debt of Andrew Mattice with public taxpayer funds ---any more than a state employee may lawfully purchase liquor, or tobacco with
a government credit card."
When the television cameras and reporters left, Yoder explained that the
Ridgeland mayor and aldermen had the legal authority to vote, and to make
poor public policy decisions. "Making poor, illogical decisions is not illegal,
but arbitrary and capricious actions may be attacked under constitutional due
process arguments. We have no idea whether any quid pro quos, or agreed
exchanges of consideration, attended any of these unusual decisions. Our
officials may not understand that Jerry Mills does not personally represent
them, and that facts may suggest exposure to criminal and/or civil liability
under Miss. Code Sections 99-7-31 and 99-19-18 for fraud and embezzlement
of public funds. Mayor McGee should read Miss. Code Section 25-4-105, which
addresses prohibited conflicts of interest with public officials in private
business dealings."
Yoder continued, "The Mayor of Terry, Roderick Nicholson, was arrested
in March for five counts of embezzlement of public funds, totaling less than
$3000, for repairs allegedly made on his private vehicle. Why have Ridgeland
officials and others not violated the spirit of the same laws by using taxpayer
funds to pay the private debt of their political crony, Andrew Mattaice?"

sort of guilt, of which I have none. However, I do not like Laura and Rhett being
attacked! I can handle it, but I don't wish to see them dragged through the mud on

In relation to the comments below, I don't recall any other issues that have come before

"I'm quoted in the above article, so let me explain my concern. For the Costco
development location to meet Rldgetand zoning requirements, the subject
property had to be re-zoned. This would usually be handled by providing
Ridgeland residents vvith a publ'ic notice that a zoning variance request would be
considered by the Cit'j, and we wou,ld learn ofthe reason for a variance.
However, the Crty skirted the usual procedure for a zoning variance requirernent,
and instead re-defined 'C-2' zoning for ALL C-2 Ridgeland property so that Costco
coufd locate on this parcel of land. The mayor, the aldermen, and the Costco
developer knevv the property' was being re-zoned for Costco. Ridgeland residents
cfid not know that- it vvas purposefully a secret and the mayor has since admitted
it
So, Ridgeland alderman Scott Jones voted to re-zone the property and has also
votetj to approve other matters brought before the City w'hlcll needed approval to
accommodate the proposed Gostco development. His son-in-law, Rhett
Stubblefield, ser\les in a paid position on the Ridgeland Zotl!ing Board. Perhaps
this is not an issue if it stopped here, although it is still a slippery slope for
alderman Jones vvhen he votes on zoning matters brought before the City.
In August, as the Dinsmor Property OWners Associiation president, 'I received an
email from Laura Stubblefield and d:idn't recognize the name. She was promoting
Costco, but denied it in the email and stated emphatically that she had no
connection to the City of Ridgeland. She wanted me to send :by emai'l Costco
information and a survey to al! Dlnsmor homeowners. She said she worked with
two individua'ls and named them. I found out recently the two individuals own the
property (which had also been re-zoned) across the parkway from the subject
Costco property. She is Scott Jones daughter, Rhett Stubblefield's wife, and is
vvork!ng with property owners who stand to benefit financially from the re-zoning
and proximity to the Costco development This certainly indicates a conflict for
Alderman Jones, and should be questioned further. His association, via his
daughter and son-in-law, with the referenced landowners needs to be disclosed.
