CIRCULAR
Sub:-

Policy for dealing proposals for permissions to the erection of full height light weight
partition walls except B.B. masonry wall/R.C.C. walls/Siporex walls in the authorized &
authentic commercial structures through concerned Ward Offices.

Following procedure is proposed to be adopted to deal with the proposals of cabins & cubicles.
A]
The proposal for full height partition in B.B./R.C.C./Siporex wall in authorised and
authentic commercial structure shall be dealt with by concerned Ex. Engineer (Building
Proposal).
B]
1)
For light weight partitions upto 5'-0" (5 ft.) height except brick masonary
wall/R,C.C. walls/Siporex wall in the authorised and authentic commercial
structure, permission from Ward office or Building Proposal Deptt. will not be
required.
2)
For tenantable repairs such as raising/lowering of kitchen platform, changing tiles
of kitchen platform and/or floors, plastering when no structural change is
proposed, permission from Building Proposal/Ward Office will not be required.
C]
Partitions of full height (up to upper floor slab or falls ceiling).
The proposals for the erection of full height light weight partition walls except B.B.
masonry wall / R.C.C. wall / Siporex wall in the authorized & authentic commercial
structures shall be dealt by Ex. Engineer of concerned Ward subject to following
conditions.
i)
The owner/occupier shall submit the application along with Plan/s showing the
proposed work for permission/ approval to erect light weight partition walls except
B.B. masonry wall / R.C.C. wall / Siporex wall to the Executive Engineer of
concerned Ward office through an Architect/Licensed Surveyor only. The plans
shall be signed by the Architect/Licensed Surveyor and owner/Licensee/ lessee
of the premises/occupier.
ii)
The said proposal shall be submitted alongwith a) appointment letter of the
Architect/Licensed Surveyor appointed by owner/occupier, b)certified
photocopies of the Occupation Certificate issued by the appropriate authority for
the property or any other document showing authenticity of the property,
c)remarks issued by the Survey Department of MCGM, d)structural stability
certificate.
iii)
The permission to be granted is only for erection of the light weight partitions,
except B. B. masonry wall / R.C.C. wall/Siporex wall, upto upper floor slab or falls
ceiling (i.e. full height) in the authorized Commercial/Office /I.T. Buildings for the
Commercial/Office/I.T user. Walls of 4.5 inches (i.e. 116 m.m. thickness can be
allowed for toilet blocks, if required.
iv)
For scrutiny of the proposals scrutiny fee of Rs. 6600/- per proposal is recovered.
Similarly, debris removal deposit of Rs. 5,000/- per proposal shall also be
recovered. The fees and the deposit shall corresponding with fees/deposits
decided by the Building Proposal Department for the miscellaneous proposals
and hence shall be revised as and when Building Proposal Department revise
the same.
v)
N.O.C. from the Society/owner shall be insisted.
vi)
In case of the buildings included in the HERTAGE LIST as declare by the State
Govt., such proposals should not be permitted unless the Mumbai Heritage

Conservation Committee's specific N.O.C. for the work is obtained. However, for
GRADE-III Heritage buildings and/or in precincts, N.O.C. of MHCC is not
required for erection of internal light weight partitions. The list may be obtained
from the Dy. Municipal Architect (D.P.)/Mumbai Heritage Conservation
Committee, Municipal Head office.
Such proposals for the buildings situated in C.R.Z. may also be permitted as it is
only about the permitting internal light weight partitions. However, indemnity bond
from the owner/architect shall be insisted stating that, under the circumstances or
due t amendments in the CRZ notification, if made mandatory, requisite
permission will be obtained by the owner/architect froce the concerned office
from CRZ point of view separately.
N.O.C. from C.F.O. shall be insisted only if, the clear height of the partitions
proposed is more than the 5 feet.
Certificate from the Registered Structural Engineer stating that the proposed
work does not involve any addition or alteration & removal of any structural
members and does not affect the structural stability of the building" shall be
insisted.
Tax clearance certificate/latest tax paid bill/his latest tax clearance for the
Building shall be insisted.
Any type of additions/alterations or demolition of existing walls and/or
amalgamation of galas etc. shall not be permitted.
The plans submitted shall be scrutinized by Executive Engineer of the Ward with
respect to all other requirements as above and the permission shall be issued
within 15 days, if application is submitted with all the above required documents,
fees a d deposit.
In case of Municipal Lease Hold Properties NOC from the Estate Dept. shall be
insisted to lessee before approval of such proposals.
The powers for approval of such proposal are to be delegated to, the Executive
Engineer (Ward) and who will Issue the permission duly signed with
endorsement that 'Existing user/Activity not changed' on plan. The permissions
will be issued in the form of permission letter and plans, by incorporating various
applicable conditions as per prevailing policies and guidelines followed in
Building Proposal Dept. alongwith the plans under stamp of concerned Executive
Engineer (Ward). Copies of the same will be issued to the Architect/Licensed
Surveyor/owner/ Dy. A.A. & C.
Regularization of the interior works already commenced without approval will be
dealt with on similar guidelines for recovery of regularization charges being
followed in concerned B.P. Dept. The approval for such regularization will be
obtained from the Zonal Dy. Ch.Eng./Zonal DMC'.
Completion certificate for the work will be issued to the Architect/Licensed
Surveyor by the Executive Engineer of concerned ward. Before issuing the
completion certificate, the site will be visited by the Jr.Eng./Sub Eng.(B&F) with
the Architect/Licensed Surveyor and after verification on site submit a report to
Asstt. Eng.(B&F)/Ex.Eng.(Ward) certifying that the' carried out is as per plans
and conditions of permission given by Ward or otherwise.
The validity of such permission given will be only for Twelve months from the
date of issue of permission. The intimation of start of work will be insisted from
Architect/ Licensed Surveyor. If the work could not be started within stipulated
time period, the architect/licensed surveyor shall make an application to the Ex.
Eng.(Ward) for allowing the revalidation by paying twice the scrutiny fees to
M.C.G.M. Such revalidation of the proposal will be for further twelve months only.
If any compliance is not made or the work remained unfinished within prescribed

time period, the permission shall be revoked after 24-months from the date of
issue of permission.
In case of any amendments/modifications in prevailing policies, guidelines,
regulations BY THE M.C.G.M./State Govt. the same shall be made applicable to
this policy.
For the various prerequisites such as procedural guide lines, proformas & formats
of application /scrutiny fees/further particular letters to architect etc. involved in
the actual implementation of said policy may be finalized by the Ex. Eng.(Ward)
in consultation with the concerned B.P. section with competent sanction of Zonal
Dy. Ch.Eng./Zonal D.M.C.
Separate provision shall be made in the Ward Office for recording and preserving
the file papers and permissions issued for such proposals as per the procedure
being followed while granting repair permissions.
Permission shall be issued generally with the following conditions and the
Executive Engineer (Ward) may impose any additional necessary condition, if
required.
a)
That the work shall be carried out as per approved plan and terms and
conditions.
b)
That the conditions as stipulated in N.O.C. of C.F.O. dt. .. u/No.
shall be complied with.
c)
That the debris and construction material shall not be dumped on road
and the same shall be carted away promptly, so that no nuisance is
caused to the occupants of the Buildings.
d)
That the Indemnity Bond indemnifying M.C.G.M. against any accidents,
damages, risks claims, litigations, disputes etc. that may arise out of this
approval shall be submitted at this office.
e)
The permission is valid for a period of 12 months. After 12 months, only
one revalidation of the proposal shall be done by recovering revalidation
charges of twice the scrutiny fees. If any compliance is not made or the
work is not completed within 24-months, the permission shall be
revoked.
f)
That the date of starting and completion of the work shall be intimated to
Ward office and along with the intimation of the date of completion, the
Certificate from the Registered Structural Engineer stating that "while
carrying out the work, no structural members have been damaged" shall
be submitted.

Last para of the permission letter shall read as follows:


Please note that this permission does not empower you to carry out the work in an unauthorized
premises portion nor it construes authorization of the premises in which interior work is carried out.
In the plan to be approved and issued, the following condition shall be stamped.
"Permission is granted only for and does not express the authenticity of the
Building, legality of occupancy and the user thereof. It is without prejudice to the right of M.C.G.M.
to take action and/or to continue the action against any unauthorized construction, unauthorized
user on the same plot, Building. "This permission shall not be construed as a proof of authenticity/
legality of occupancy of premises under reference.
