Enclosed please find draft copies of both the Zoning Ordinance and SALDO amendments for
Eldred Township. As per the Financial Assistance Program II (FAP II) guidelines, the Township
is requesting that a technical review be completed. The Township is also requesting a MPC
review.
Please note that these amendments are on the Eldred Township Planning Commission agenda for
their recommendation on April 17, 2014.

The Township of Eldred is proposing a comprehensive list of amendments to its zoning ordinance.
The Township has applied for reimbursement for these ordinance amendments through the Financial
Assistance Program II (FAP II). This review should be considered the technical review required by
the FAP II as well as the review required by the Pennsylvania Municipalities Planning Code
(PMPC).
The above mentioned zoning ordinance amendments have been reviewed on the basis of generally
accepted plaIUling principles and the provisions set forth by the PMPC, as amended. The following
comments are offered:
Technical Comments
1. The proposed ordinance amendments are generally consistent with the PMPC, Act 247 of 1968,
as amended, ill terms of following required procedures.
2. The proposed amendments \vere previously reviewed by this office (MCPC I'evie\v #36-14) on
March 26, 2014. Previous comments have been satisfactorily addressed.

4. This office has worked closely with the To\vnship developing the proposed amendments in order
to better promote the goals of the Chestnuthill, Jackson, Eldred, Ross and Polk Townships
(CJERP) Regional Plmming group and support ordinance consistency within the region. The
Township should be commended for taking an active role in this process.
General Comments
5. If any revisions are made to the proposed zoning ordinance amendments, they must be
resubmitted to the MCPC for review prior to adoption. TIlis requirement was recently affirmed
by the Pennsylvania Commonwealth Court in Hanover Healthcal'e Plus, Inc. v. Zoning Hearing
Board of Penn Townsllip 875 A.2d 1255 (Pa. Cmwlth 2005). It is recommended that the
TO\vnsllip discuss this with their solicitor.
6. The StaiY has reviewed the proposed amendments and recommends that they be adopted, subject
to the above noted conunents being addressed.
In an attempt to maintain a library of municipal ordinances, we request that any adopted ordinance
amendments (Zoning, Zoning Map and SALDO) be sent to the MCPC within 30 days of enactment
as specified in the PMPC.
This review is subject to the approval of the Monroe County Planning COllunission atits next
regqlarly scheduled meeting.
