Rafizi arrested at Parliament gates for

exposing OSA document

PKR secretary-general Rafizi Ramli has been detained by the police as he exited the
Parliament building gates this evening.
Inspector-general of police Khalid Abu Bakar confirmed he was arrested under Section
8 of the Official Secrets Act, which relates to wrongful communication of an official
secret.
The Pandan lawmaker had last month exposed what he claimed is a classified
document showing links between the Lembaga Tabung Angkatan Tentera and 1MDB.
He also gave a statement on the matter to the commercial crime investigations
department.
Tweeting on the arrest, PKRs Subang MP R Siavarasa said: "Will the IGP explain to the
rakyat why PDRM cannot just request Rafizi to surrender himself?
He likened it to a "kidnapping" by the police.
However, Khalid immediately reminded Sivarasa not to use words he does not
understand.
PKR's Kuantan MP Fuziah Salleh said Rafizi would be taken to the Bukit Aman police
headquarters.
PKR Youth strategic director Akmal Nasir told Malaysiakini that Rafizi was on the way to
pick up his two-year-old son from the babysitter when the arrest took place.
"Rafizi had asked if he could come to Bukit Aman at 7.30pm after fetching his son but
the police did not allow him to do so," he said.
Amanah's Kuala Terengganu MP Raja Kamarul Bahrin Shah Raja Ahmad who
witnessed the arrest said he tried to speak to Rafizi, but police did not allow it.

1MDB denies causing late gratuity payments

A candlelight vigil is planned for Rafizi at Bukit Aman tonight.
Rafizi had disclosed the alleged classified document at a press conference at the
Parliament lobby, however, he did not distribute the document to the media.
Malaysiakini could not report the contents of the press conference due to constraints
under the OSA.
Anyone found guilty of having unauthoritised access to or disseminating classified
information will be jailed for a mandatory one year or a maximum of seven years.
Responding to the disclosure, 1MDB denied it was the cause for late gratuity payments
by LTAT to retired armed personnel.
It also said the document was part of the auditor-general's report on 1MDB, which was
presented to the Public Accounts Committee.
The PAC is expected to conclude its probe on 1MDB this week, after which the report
will be tabled in the Dewan Rakyat.
LTAT said it has made gratuity payments to most armed forces personnel in Rafizi's
list, and will take the MP to court.
ETHICAL : Rafizi exited the Parliament building gates to show the document links between
the Lembaga Tabung Angkatan Tentera and 1MDB.
ILLEGAL: it is illegal and arrested under Section 8 of the Official Secrets Act, which relates to
wrongful communication of an official secret.

individuals entitlement .He is entitled to act and be treated in a certain way. The legal right of an
entitlement that derives a legal system that permits or empowers a person to act in a specified
way or that requires others to act in a certain ways toward that person .Limited to when the legal

Entitlement can also derive from a system of moral standards independents of any
particular system. The right to work is not in the constitution .But it is something that all human
must posses .Such rights are called morals rights and human rights . They are based on moral
norms and principles that specify that all human being are permitted or empowered to do
something or are entitled to have something done for them. Rights of a human being. No limit
like legal and everyone have it regardless of the legal system under which they live.
According to the concept of contractual rights and duties. They are limited rights and
correlative duties that arise when one person enters an agreement with another person. It also
provide a basis for the special duties or legitimate social institution or organization.
Refer to the case above, Rafizi is a secretary of PKR. He is willing to spread the actual
evidence about 1MDB and LEMBAGA TABUNG ANGKATAN TENTERA. He has the right to
spread the document because he is a politician and know the actual story about the document
.But it is wrong because the document was confidential under parliament.

The suggestion ways

The ways to settle the problem are investigate the case according to the law that stated at
law act. The case was arrested under section 8 of the Official Secrets Act. The section is
an Act of the Parliament of the United Kingdom that repeals and replaces section 2 of the
Official Secrets Act 1911, thereby removing the public interest defence created by that section.
The offences under the Act, that can be committed only by persons who, as the case may
be, are or have been crown servants, government contractors, or members of the security and
intelligence services, can be committed only where the information, document or other article in
question is or has been in the possession of the person in question by virtue of their position as
such.
Rafizi also can defence himself from the case if he stated the reason and show the strong
evidence about the document.He can protect himself by using law act because he has right to
prove the connection between 1MDB and LEMBAGA TABUNG ANGKATAN TENTERA.
