meansthejudgesofHighCourtcanberemovedbythePresidentonlyinthemannerand
onthegroundsmentionedintheConstitution.
TheJudgesoftheHighCourtdonotholdtheofficeduringthepleasureofthePresident.
SofarhowmanyjudgesofHighCourthavebeenremoved?
NoHighCourtjudgewasremovedsofarinindependentIndia.
The salaries, allowances and pensions of the High Court judges are determined from
timetotimebytheParliament.

TheChiefJustice(CJ)isappointedbythePresidentafterconsultationwiththeCJIand
theGovernoroftheconcernedstate.
IncaseofcommonHighCourtfor2ormorestatestheGovernorsofallthestatesare
concernedbythePresident.
OATH:
OathofofficeisadministeredbytheGovernoroftheconcernedstate.
In the absence of the Governor some other person appointed by the President would
performthesame.

TENURE(TERM):
AjudgeofHighCourtholdstheofficetillhe/sheattainstheageof62years.
Note: Through 15th Amendment Act of 1963 the retirement age of the High Court
judgeshasbeenincreasedfrom60to62years.
SALARY:
DeterminedbytheParliamentfromtimetotime.
At present the salary of the Chief Justice of High Court Rs. 90,000/ (Ninety
Thousands).
TheSalaryofotherJudgeoftheHighCourtis80,000/(EightyThousands).

IntheabsenceoftheCJthePresidentcanappointajudgeofaHighCourtasanacting
ChiefJusticeoftheHighCourt.
TheCJcanrequestaretiredjudgeofthatHighCourtoranyHighCourttoactasajudge
oftheHighCourtforatemporaryperiodoftime.
The High Court is also a court of records. The judgments of the High Court are
admittedtobeofevidentiaryvalueandcannotbequestionedwhenproducedbeforeany
subordinate court. Secondly, the High Court has also got the power to punish for the
contemptofcourt.
TheJudicialreviewisthepoweroftheHighCourttoexaminetheconstitutionalityof
legislativeenactmentsandexecutiveordersofboththecentralandstategovernments.
The judicial review is needed to uphold the principle of the supremacy of the
Constitution,tomaintaintheconceptoffederalism(balancebetweenthecentralandstate
governments)andalsotoprotectthefundamentalrightsofthecitizens.
TheHighCourthasthepowertoreviewitsownjudgmentororder.

ThenamesofBombay,CalcuttaandMadrasarechangedtoMumbai,KolkataandChennai
respectively,thenamesoftherespectiveHighCourtsarenotchanged).

JANUARY29,2013:VISHWAROOPAM:AmoviethatstarsKamalHasanwasbannedin
Tamil Nadu by the Government on the account of threat of demonstrations and processions
andthreatsofviolence.MadrasHighCourtliftsbanonJanuary29,2013andpermittedthe
screeningofthemovie.
Controversy:Thecourtsexistprincipallytodispensejustice,nottohandoutadvicewhichin
thecaseofVishwaroopamseemsentirelygratuitous(unwarranted)(AdaybeforetheMadras
HCadvisedKamalHasantosettletheissuewiththeGovernment).Intheyear2011theSC
setasidethe2monthbanontheHindifilmAarakshanonthegroundthatthestatescannot
proscribefilmsthathavebeenclearedbytheCBFC(CentralBoardofFilmCertification)on
themereapprehensionsthatscreeningthemmaycausealawandorderproblem.SCheldthat
thefreedomofexpressioncannotbesuppressedonaccountofthreatofdemonstrationsand
