Facts:
Regarding a contract of sale with a construction firm, the owner wrote the
firm that he intended to cancel the contract, whereupon the firm stopped
construction work for alleged non-payment of fees at the proper time.
Issue:
Is the firm liable?
Held:
No. For after all, the adverse party had already informed the firm of the
formers intention to cancel or rescind the contract.
