BaranesvStateofIsraelisalandmarkcaseforanumberofreasons:Itisoneofonlya
handfulinthehistoryoftheStateofIsrael,wherearequestforanewtrialwas
granted.Itisacasethatstirredthepublicformorethanacoupleofdecades.Itis
alsoacasewherewidespreadcorruptionoflawenforcementwaseventually
documented,butnobodywasheldaccountable.
Itisalsoacase,wheretheRightforDueProcesswasexplicitlydeclaredandinvoked.
Regardless,dataminingofSupremeCourtdecisionrecordsprovidedevidencethat
electronicdecisionrecordsinthiscourtfilewerefalsified.
Therefore,requestwasfiledtoinspecttheoriginaldecisionrecordsintheSupreme
Courtpapercourtfile.Inthiscase,accesswasgained,anditturnedoutthatthe
suspectrecordsweremissingfromthepapercourtfile.
Therefore,NoticeandRequestforcorrectiveactionswasfiledwithSupremeCourt
PresidingJusticeMiriamNaoronOctober07,2015.Therequestdocumentedthat
certaindecisions,whichappearintheSupremeCourtITsystem,andweresuspected
asfalserecords,weremissingfromthepapercourtfile,andrequestedtheirremoval
fromtheSupremeCourtITsystem,asrecordsthathavenofoundation,andtherefore
misleading.
NodecisionhasbeenrenderedbySupremeCourtPresidingJusticeMiriamNaoron
therequest,regardlessofafollowupRequestforRenderingaDecision.
Needlesstosayacourt,wheredecisionrecordsdisappearand/orarefalsified,isof
dubiouscompetence,evenmoresoacourtthatrefusestocorrectfalserecordseven
afternoticeandrequest.

InitiatingCorrectiveMeasures.
A.Noticeofseriousperversionofrecordsininstantcourtfile
1. OnMarch23,2015,IfiledaRequesttoInspectininstantcourtfile.TheRequest
wasfiledaspartofanongoingsurvey,regardingexercisingpublicaccesstocourt
recordsintheIsraelicourts,followingthepromulgationoftheRegulationsofthe
CourtsOfficeoftheClerkInspectionofCourtFiles(2003)andthe2009
JudgmentintheHighCourtofJusticepetitionAssociationforCivilRightsinIsrael
vMinisterofJusticeetal(5917/97).
2. Additionally,therewasconcernofperversionand/orforgeryofdecisionrecordsin
instantcourtfile,evenpriortoinspection,basedonreviewoftheelectronic
decisionrecordsintheCourt'spublicaccesssystem,andalargescalestudy
regardingintegrity,orlackthereof,inelectronicrecordsoftheSupremeCourt.The
studywasfiledwiththeHumanRightsCounciloftheUNaspartoftheUniversal
PeriodicReview(2013),asoutlinedbelow:
a.Processininstantcourtfilewasconductedaroundthetimeofthedeathof
SupremeCourtChiefClerkShmaryahuCoheninMarch2002.Theabove
referencedreportshowedwidespreadperversionofrecordsduringthesame
period.
b.Duringthesameperiod,materialandunusualchangeswereintroducedinthe
templateofalldecisionrecordsoftheSupremeCourt:ThecertificationTrue
CopyoftheOriginal,undertheauthorityoftheChiefClerkandreferencetoa
uniqueelectronicfile(presumablysecured)weredeleted.Instead,adisclaimer
wasadded...susbjecttoeditingandphrasingchanges,andaWordfile
reference(presumablynotsecured).PresidingJusticeAsherGrunisrefusedto
answeronaninquiry,andtheAdministrationofCourtsrefusedtoanswerona
FreedomofInformationRequest:Underwhoseauthority,andonwaslegal
foundationsuchprofoundchangesinthetemplateofSupremeCourtdecisions
wereintroduced?

standardcertificationTrueCopyoftheOriginalwasremovedfromthetemplateofalldecision
records.Instead,adisclaimerwasadded...subjecttoeditingandphrasingchange.(FromHuman

RightsinIsrael,2013).

c.Separately,dozensofdecisionrecords,datedtotheyearssurroundingthedeath
ofChiefClerkShmaryahuCohenwerediscovered(however,suchdatesare
unreliable),whichshouldbedeemedforgeries.Inmanyofsuchrecords,the
referencetotheelectronicfilewasdeleted,orreplacedbyareferencetoan
electronicfileofaninvalidfilename(seeFigure2).Similarfindingswere
detectedintheelectronicrecordsininstantcourtfile(seebelow).

thedecisionwaspurportedlyrenderedbyMagistrateBoazOkonandcertifiedbyChiefClerk
ShmaryahuCohen.Bythatdate,OkonwasnolongerMagisrateoftheSupremeCourtforseveral
years,andCohnewasnolongerwiththelivingforsome5years...Therecordalsofailstoinclude
anyreferencetoanelectronicfile.(FromHumanRightsAlertNGOsubmissionfortheUNHuman
RightsCouncilUniversalPeriodicReviewofHumanRightsinIsrael,2013).

3. OnAugust17,2015,MagistrateGileadLubinsky'sdecisionwaspublished,
permittingpartialinspectionofinstantcourtfile,underspecificrestrictions.On
August19,2015,Iexercisedtheinspectionininstantcourtfile,andIreceived
someofthedecisionrecords,asdetailedbelow.
4. Reviewraisedseriousconcernsregardingintegrityoftherecordsininstantcourt
file.
5. Therefore,theRequesterofInspectionisperforminghiscivicduty,informingthe
PresidingJusticeoftheperversionofcourtrecords,andrequestingappropriate
correctiveactions.

Ten(10)ofthedecisionrecords,whichappearintheelectronicsystemofthe
courtaremissingfromthepapercourtfile,mostofthemaresuspected
perversionand/orforgery(seeTableNo1).
6. Ten(10)decisionrecordsaremissingfromthepapercourtfile,andtheyarethe
records,listedintheelectronicpublicaccesssystemunderthefollowingdates
(dd/mm/yyyy):01/02/2000;01/02/2000;01/02/2000;06/02/2000;
16/02/2000;29/03/2000;27/06/2000;24/07/2000;05/09/2000;25/09/2000.

7. IntheSupremeCourtthepaperrecordsaretheauthorizedrecord,andnotthe
electronicrecords.Therefore,intheabsenceofthecorrespondingpaperdecision
records,listedabove,thereisnofoundationforsuchelectronicrecords,andthey
shouldbeheldinvalid.
8. Moreover,seven(7)ofthemissingpaperrecordsincludenoreferencetoavalid,
uniqueelectronicfileintheirelectroniccounterparts.Theinvalidelectronicfile
name,COURT,islisted,insteadofavalidelectronicreferencefile.Suchrecords
shouldbedeemedpervertedand/orforgery,andtheiroriginalcontentcannotbe
ascertained.
Two(2)ofthedecisionrecords,whichwerefoundinthepapercourtfile,
includereferencetoaninvalidelectronicfile(COURT),andthereisroom
forsuspicionthatJudgeDorner'shandsignatureonthemisforgeryaswell.

9. Ofsix(6)decisionrecords,whichwerediscoveredinthepapercourtfileduring
theinspection,two(2)decisionrecords,dated22/08/1999and22/08/1999,also
includeinvalidelectroniccourtfilereference(COURT),andarelikelytobe
pervertedand/orforgeries.[2]
10.Moreover,thehandsignaturesofJusticeDornerontheabovereferencedtwo(2)
decisionrecordsappeardifferentfromherhandsignatureonotherrecords,and
thereisconcernthatthesetwosignaturesareforgeriesaswell.
B.RequestforaDeclarativeJudgment,sayingthattherecordsininstantcourt
file,listedabove,aremissingand/orpervertedrecords,andaredeletedfrom
boththepaperandtheelectronicsystem.
11.Givenalltheabove,andoutofdesiretomaintainpublictrustinthecourtsin
general,andintheSupremeCourtinparticular,PresidingJusticeNaoris
requestedtograntaDeclarativeJudgment,statingthatdecisionrecordsininstant
courtfile,listedinparagraphs6and9,above,aremissingand/orperverted,and
aredeletethemthepaperandfromtheelectronicrecordsystem.

C.RequestforinitiatingcorrectivemeasuresbyPresidingJusticeNaorregarding
integrityoftheofficesoftheclerksandtherecordsinthecourtsoftheState
ofIsrael.
12. Fromtheperspectiveoftheyears,thefindingsininstantcourtfilemustbeseen
veryserious.Instantcourtfilepresentsevidenceofwrongfulconductbylaw
enforcement,internalsecurityandjusticeofficers,whoengagedinfalsificationof
evidence,providingfalsetestimonies,andhidingthetruthinthecourts.Thegoal
ofsuchconductwastopervertjusticeandconvictaninnocentpersonofmurder.
Giventhenumberofpersonsinvolved,thecoordinationamongthem,theduration
ofsuchconductinyears,andthenumberofcourtprocessesinvolved,suchconduct
shouldbedeemedorganizedcrimeinthecourts.
13. Thefindingsininstantcourtfilearenotunique.Similarconductwasdocumented
invariouscourtsoftheStateofIsrael,inspectedbythefilerinrecentyears.
14. Suchstateofaffairsisnotaccidental.Itoriginatesinsystematicunderminingof
integrityofthecourtsoftheStateofIsraeloverthelastdecade,inpartthroughthe
actions,listedbelow:
a.Falseappearanceofpersons,whoholdnolawfulappointment,as"ChiefClerks"
intheSupremeCourtandothercourts.
b.AbolishingthedutiesoftheChiefClerk,relativetothe"excellentmaintenanceof
therecordsandregistrationsofthecourt",whichwereexplicitlyprescribedin
theRegulationsoftheCourt(RegistrationOffice)1936fromtheBritishMandate
period,withtheirreplacementwiththeRegulationsoftheCourts(Officeofthe
Clerk)2004.
c.AbolishingthedutiesoftheChiefClerk,relativetotheentryofjudgments,
whichwereexplicitlyprescribedintheRegulationsoftheCourt(Registration
Office)1936fromtheBritishMandateperiod,withtheirreplacementwiththe
RegulationsoftheCourts(OfficeoftheClerk)2004.
15. Thereisnodoubt,thatacourt,whereitisimpossibletounequivocally
distinguish,whatisavalidandeffectual,authentic"Judgment"record,wouldbe
consideredanincompetentcourt,anditsconductseriousviolationofHuman
Rights.
16. Moreover,thereisnodoubtthatconductoftheIsraelicourtstoday,relativeto
ambiguityof"Judgment"records,andfailuretolawfullyappoint"ChiefClerks"
standsinviolationoftheHagueApostilleConvention(1961),towhichIsraelisa
party.
17. Suchcircumstancesshouldbeconsideredparticularlyserious,sincetheywere
formedoveradecadethroughthedeliberateandcoordinatedconductofsenior
Stateofficerinthecourts,intheMinistryofJustice,andintheKnessetalmostall
ofthemIsraeliattorneysbyprofession.
18. Undersuchcircumstances,itisquestionable,whethertheIsraelicourtstodaycan
bedeemedCourtsofRecordsanylonger.Otherwisestated:TheIsraelicourts
todayshowdistinctlymedievaltraits.

19. Therefore,SupremeCourtPresidingJusticeMiriamNaorishereinaskedto
initiatecorrectivemeasures,relativetointegrityoftheofficesofChiefClerksand
integrityofrecordsintheIsraelicourtsingeneral,andinparticularinthe
SupremeCourt.

D.Noticeregardingserviceonparties,andrequestfordueserviceofthe
parties'responsesoninstantrequest.
ImmediatelyfollowingthefilingofinstantRequest,thefilerwoulddulyserveiton
