a) Before resorting and enabling this Alternative Dispute Resolution (ADR) clause all members shall attempt to settle all disputes or differences in good faith arise between them, or in connection with the team to which they are associated with. b) Continued enrollment at the University of Phoenix will constitute agreement to this clause. c) . The dispute must be in reference to a member or members within a team involving alleged harassment, either written or spoken to another team member, failure to meet goals, objectives, deadlines, or expectations pertaining to quality of work, level of contribution, participation, attendance, adherence to the Team Charter, University of Phoenix Online Campus Learning Team Handbook or Academic Policies or any breach thereof, and if the dispute cannot be settled by and between the parties. Personal conflicts between team members will not initially be subjected to be resolved through ADR, but rather through rational adult discussions. d) When a dispute within the learning team causes a loss of productivity and efficiency this will enable the ADR process. T 2. The Peer Review Procedure a) The parties agree first to settle the dispute by Peer Review administered by the Learning Team members, before resorting to some other dispute resolution procedure. b) Each team member with a dispute will notify all members by notice in the team folder within 24 hours of an incident. c) The claimant will provide a detailed summary including the nature of dispute, supporting materials, and a proposed resolution for team review within 48 hours of claiming a dispute. d) All team members will review all the dispute materials after review material deadline.Peer Review role is to evaluate submitted material, ask clarifying questions, and provide procedural or substantive solutions in the team folder within 48 hours.
3. Termination of the Peer Review Process
a) If Peer Review is an majority agreement, the suggested solution is considered a rendered decision. Decisions are not binding. Individuals can seek relief in traditional forums for dispute resolution if dissatified with the decision under Peer Review.
