2016 Louisiana Legislative Session Review

Message from Rep. John Doe...


When we entered the 2016 legislative season, we faced a total deficit of
$2.9 billion - $2 billion for the current fiscal year and $900 million for the last
fiscal year. While we didnt close the deficit entirely, we were successful in
funding critical services through revenue raisers and spending cuts.
Most of the revenue raised is only temporary and will expire in 2018. In
total, we raised $1.52 billion for the current year that started July 1 and closed
the remaining hole for the year that ended June 30.

Spending Cuts
Act 27 (Executive Appropriation) - Cut $42,891,482
million from the total budget of $24.5 billion.

We raised enough revenue to adequately fund higher education, medical


schools in Shreveport and New Orleans, safety-net hospitals and Medicaid.
The TOPS scholarship program will cover most expenses for the fall semester;
however, students will receive only 42% of their annual scholarship for the
spring semester unless more money is generated through the revenue raisers.

Act 19 (Judicial Appropriation) - Cut $3,991,120


million from the total budget of $180 million.

This document includes acts related to the budget from all three
sessions as well as other acts of importance from the Regular Session. This
document does not personally reflect a legislators viewpoint; however, it
provides information on bills passed by the legislature as a whole. I hope
this document will be helpful in understanding the hard work done in Baton
Rouge over the last six months.

HCR 2 - Directs state officials to review state contracts


and identify contracts that can be terminated,
determine potential savings from termination, and
identify contracts that have already been terminated.

Act 20 (Legislative Appropriation) - Cut $2,033,243


million from the total budget of $73 million.

Immediate Revenue Raising


Act 26 - Imposes a one percent state sales and use tax,
beginning April 1, 2016, and ending September 30,
2017.

Act 25 - Cleans 1 of 4 existing pennies of state sales


and use tax.

2016 Session Highlights

1st Extraordinary Session Continued


Act 7 - Reduces the amount of the discount for accurately
reporting and remitting excise taxes on alcoholic beverages
and beer.
Future Revenue Raising
Act 10 - Reduces insurance premium tax credits by 5%
for 2 years
Act 16 - Requires that certain deductible items be addedback on certain corporate income tax returns.
Act 17 - Extends hotel-motel tax to include online
bookings (Airbnb).
Act 18 - Reduces the Enterprise Zone tax credit.
Act 30 - Repeals state deduction of federal income taxes
for corporations.
Act 8 - Establishes a flat rate for purposes of calculating
corporation income tax liability.
Act 22 - Collects sales tax from internet sales.
HCR 11 - Creates the Task Force on Structural Change in
Budget and Tax Policy.
SCR 6 - Establishes a task force to study ad valorem taxes
that are offset by state tax credits.

2016 Constitutional Amendments

Election Date : Nov. 8, 2016


*Act 31 (1st Extraordinary) - Would remove a
deduction allowing corporations to reduce their state
tax liability by the amount of federal income taxes
they pay.
*Act 677 - Provides for the appointment and
qualifications of registrars of voters.
*Act 678 - Establishes a total ad valorem property tax
exemption for the surviving spouse of a member of
the Armed Forces of the Unites States, the La. National
Guard, the La. State Police or a law enforcement or fire
protection officer killed in the line of duty.
*Act 679 - Creates the Revenue Stabilization Trust
Fund.
*Act 680 - Allows postsecondary education boards to
set their tuition and fees.
*Act 681 - Revises the circumstances that would
allow the reduction of constitutionally protected
expenditures and dedications to eliminate a projected
deficit in an ensuing fiscal year.

Fiscal
Act 600 - Limits the amount of state dollars to be spent under the
Percent for Art Program per construction or renovation project to
the lesser of $450,000 or 1% of the state money to be expended
on the project.
Act 408 - Changes the criteria of professional, personal,
consulting, and social services contracts that are required to
be reported, reviewed and approved by the Joint Legislative
Committee on the Budget for Fiscal Year 2015-2016 through
Fiscal Year 2017-2018.
Act 66 - Requires agencies to use existing state office space before
leasing outside space.
Act 569 - Requires annual notifications to purchasers and the
Dept. of Revenue by remote retailers who make sales in La. in
excess of $50,000 per year.
Education
Act 497 - Eliminates local charter authorizers and Type 1B charter
schools.
Act 523 - Creates the Louisiana Expectant and Parenting Students
Act to provide support to expectant and parenting students in
regard to attendance policies and academic success.
Act 404 - Creates the Farm to School Program getting farmers
and school lunch programs together to get the freshest, most
minimally processed foods to local schools.

Act 304 - Prohibits entities that perform abortions from receiving


public funding for any purpose from institutions, boards,
commissions, departments, agencies, officials or employees of
the state or its political subdivisions.
Act 563 - Prohibits the performance of an abortion and any
attempt to perform an abortion when a pregnant woman seeks
the abortion because of a genetic abnormality of the unborn
child.
Act 264 - Enacts the Unborn Child Protection from
Dismemberment Abortion Act to define and prohibit
dismemberment abortions.
Act 196 - Prohibits the sale or transport of organs or body parts
of aborted babies.
Health and Health Insurance
Act 252 - Allows telemedicine physicians to prescribe controlled
substances.
Act 630 - Removes the requirement that a physician practicing
telemedicine maintain an office or have an arrangement with
another physician who maintains an office in this state.

TOPS

Family Matters

Act 18 - Locks in the current rate of the TOPS award and requires
legislative approval for future increases.

Act 494 - Provides a regulatory framework for contracts between


parents and gestational carriers, ensuring that the gestational
carrier cannot later make a legal claim to the child.

Act 388 - Increases the minimum GPA required for the


Performance and Honors Awards to 3.5.

Act 110 - Provides for the removal of guardians who prevent


communication & interaction with others without a court order
in an effort to prevent the isolation of adults from their family
and friends.

Medical Marijuana

REAL ID

Act 97 - With limited exceptions, extends the mandatory waiting


period between certain required pre-abortion procedures and the
performance of an abortion from 24 hours to 72 hours.
Act 593 - Prohibits buying, selling, and any other transfer of the
intact body of a human embryo or fetus whose death was caused
by an induced abortion.

Firearms
Act 124 - Requires the reporting of certain information to the La.
Supreme Court regarding the possession or carrying of firearms
and procedures for the restoration of firearms rights.
Act 426 - Requires the Dept. of Health and Hospitals and the
office of elderly affairs to report to the La. Supreme Court any
information in its possession on any adult who may be prohibited
from possessing a firearm.

Criminal Justice Reform

Act 145 - Requires insurance companies to cover reconstructive


surgeries following mastectomies.

Abortion

Act 25 - Provides additional time to pay sales and use taxes on


motor vehicles owned by or registered to military service persons
or spouses following separation from active duty from any branch
of the Armed Forces of the U.S.

Act 370 - Allows naloxone to be dispensed without a prescription


to combat opioid overdoses.

Act 149 - Requires one coach per sport to be certified in CPR, first
aid, & AED.

Act 343 - Provides an exemption from criminal possession laws


for patients and parents of patients with prescriptions or doctor
recommendations for medical marijuana.

Act 44 - Exempts veterans of the armed forces from concealed


handgun permit fees.

Act 212 - Provides that a person who obtained a gubernatorial


pardon or has had his record expunged shall not be considered
ineligible from obtaining a concealed handgun permit.

Act 311 - Requires healthcare services providers to conduct


background checks on prospective employees.

Act 96 - Expands the medical conditions for which marijuana


may be recommended by a physician.

Act 154 - Allows that fees for state veterans cemeteries may now
be waived.

Act 396 - Allows patients access to physical therapists without a


physician prescription or referral.

Act 425 - Requires high schools to keep automated external


defibrillators on their premises.

Act 503 - Will require a pro-rata reduction of all award amounts


other than TOPS-Tech Early Start in the event TOPS is not fully
funded.

Act 670 - Requires 10% of the total evalutaion points in a request


for proposal to be awarded to a certified veteran/service-connected
disabled veteran-owned small business entrepreneurship.

Act 505 - Provides for the issuance of REAL ID special identification


cards.
Act 496 - Requires the Department of Public Safety and
Corrections (DPSC) to provide all applicants for a Louisiana drivers
license the option of receiving a drivers license that is REAL ID
compliant.
Military and Veterans
Act 463 - Provides for unemployment compensation for military
spouses who resign employment to relocate pursuant to a
permanent change of station order.

Act 501 - Raises the age of juvenile court jurisdiction to include


17 year olds.
Act 509 - Creates a procedure for designating crimes of violence in
court minutes for the purpose of determining a persons eligibility
for suspension of sentence and participation in a drug division
probation program.

2nd Extraordinary Session


Act 375 - Authorizes limited disclosure of telephone numbers,
e-mail addresses, online screen names, static internet protocol
addresses and other online identities associated with a person who
is required to register as a sex offender.
Act 269 - Amends the crime of human trafficking so that a
prosecutor doesnt have to prove that the offender used fraud,
force or coercion to recruit, harbor, transport, provide, solicit, sell,
purchase, receive, isolate, entice, obtain or maintain the use of a
victim who is under 21.
Act 82 - Places strict limitations on who may access & view
materials that are collected as evidence of the crimes obscenity,
video voyeurism and pornography involving juveniles.
Act 629 - Extends the time limit to file civil suits for sexual assault
from 2 to 3 years.
Act 357 - Provides that a victims past sexual behavior and attire
will not be admissible as evidence that the victim consented to the
offense or encouraged it.
Law Enforcement and First Responders
Act 225 - Expands how the state defines offenses and crimes of
violence against peace officers.
Act 184 - Expands the definition of hate crime as it applies to
first responders, specifically those employed as law enforcement
officers, firefighters or emergency medical services personnel.
HCR 59 - Creates the Louisiana Law Enforcement Body Camera
Implementation Task Force, whose purpose will be to study and
make recommendations for the implementation of body cameras
and the development of best practices for their use.
Transportation

Act 421 - Allows a minimum sentencing to be made discretionary


for non-violent offenders.

Act 397 - Allows motorists with lapsed auto insurance to pay their
debts in installments and maintain their drivers license during
repayment.

Assistance for Domestic Violence Victims

Elections

Act 387 - Requires courts to provide, where possible, designated


seating separate and away from the defendant upon the request
of any victim of crime.

Act 83 - Adds an additional day to the early voting period when it


is interrupted by a state holiday.

Act 399 - Allows victims of domestic abuse and cruelty against


juveniles to offer evidence of the accuseds past abusive behavior
and similar acts if otherwise appropriate under the rules of
evidence.
Act 465 - Allows a person with a protective order for abuse to
obtain a temporary concealed handgun permit, which can be
issued without required training for 45 days.
Act 119 - Provides that, in a multi-parish judicial district, expedited
hearings to address abuse may be held in any parish within the
district if necessary.
Sex Offenses
Act 267 - Prohibits sex offenders from soliciting business door to
door.

Act 508 - Allows disabled voters to request an electronic


transmittal of their absentee ballots.
Act 183 - Extends the voter registration deadline when submitting
electronically.
Employment
Act 517 - Requires the Joint Legislative Committee on the Budget
to approve salary increases in the executive branch in the last 90
days of an administration.
Act 398 - Bans criminal record inquiries on initial applications for
state and local government jobs.
Act 93 - Grants a COLA for retirees of the state systems. This
includes teachers, school and state employees, as well as state
police.

Immediate Revenue Raising


Act 9 - Reduces the amount of the La. Citizens Property
Insurance Corporation Assessment income tax credit from
72% to 25% of the amount of the surcharges and makes
the reduction permanent.
Act 10 - Limits the amount of interest people and
businesses get back if they overpay their taxes.
Act 1 - Increases the annual tax on HMOs to 5.5%.
Act 11 - Requires a business be domiciled in La. for a
minimum of five years prior to the sale of the business to be
eligible for the net capital gains deduction and provides a
tiered individual income tax deduction for net capital gains.
Act 4 - Limits the refund of the tax credit for ad valorem
taxes paid on certain inventory.
Act 5 - Limits the inventory tax credit given to businesses
that also get an exemption from paying local property
taxes.

Athletic & entertainment events for K-12 schools.
Entertainment events by Little Theater organizations.
Entertainment events, musical performances & fairs &
festivals by non-profit organizations.
Sales to:
Boys State of Louisiana, Inc. & Girls State of Louisiana, Inc.
Food banks.
Hospitals that provide free care to all patients.
Volunteer fire departments.
Sales by:
Certain non-profit entities.
Certain youth-serving organizations.
Parochial & private elementary & secondary schools.
Sales of:
Boats, supplies, fuels & repairs for licensed commercial
fishermen.
Butane & liquefied petroleum gas for private and
residential use.
Certain goods & services at domed stadiums & publiclyowned facilities.
Certain medical & adaptive equipment.
Educational materials & equipment used for classrooms.
Meals by educational, medical & mental facilities /
institutions.
Membership fees or dues of non-profit, civic associations.
Room rentals at non-profit camp facilities & homeless
shelters.
