resignationfromtheArbelCommittee
DearProfKasher:
Iamwritingtoyouagain,requestingyourpublicopinionpertainingtomounting
evidenceofwidespreadincompetenceand/orcorruptionofthejusticesystem.Iam
writingtoyouasanexpertonprofessionalethics,asonewhowasinvolvedinthe
writingofover40ethicscodesofsignificantbodiesinIsraeli,andasonewhoholds
advancedtraininginAppliedMathematicsauniquecombinationofqualifications
forthematterathand.
Irequestyouropinionregardingthefollowingmatters:
a. EvidenceofseriousfraudbyjudgesincollusionwithseniorstaffoftheState
ProsecutioninRomanZadorov'strial.Thematterispresentedinashortformin
myattachedpublication,datedJuly22,titled:JudgeJoubranisagainaskedto
ruleonthe'jumble'intheRomanZadorovcourtfile,[1]andinanextensiveform
intheComplaint,whichwasjointlyfiledwithRomanZadorov'swifeMsOlga
GrishaevwiththeUNHumanRightsCouncilWorkingGrouponArbitrary
Detention.[2]
AlonglistofpublicfigureshasopinedonvariousaspectsoftheRomanZadorov
affair,manyofthemarequotedintheComplaint.Perhapstheopinion,which
sumsthemattermostclearlyisthatofProfMotaKremnitzerwhowrote:
Conductoftheprosecutionisscary.Itisnottheconductofprosecution,
whichistryingtoknowthetruth...Whenyouaddtoitthestanceofthe
SupremeCourtandconductoftheAttorneyGeneralinrecentyears,we
areleftwithajusticesystem,whichisprimarilyprotectingitself.
Youropinioninthisimportantaffairisconspicuouslymissing.Ihavenodoubt
thatwiththepassageoftheyears,theRomanZadorovaffair,pertainingtoa
UkrainianinIsraeltoday,wouldberememberedasamirrorimageoftheMendel
BeilisaffairintheUkraineacenturyago.Thelistofthosewhostoodupand
opinedonthematterandthosewhochosetoremainsilentwouldbe
rememberedasintegralpartoftheaffair.
b. EvidenceoffraudbyJudgeDavidRosenincollusionwiththeAdministrationof
CourtsinHolylandcorruptiontrial,theessenceofwhichisthefailuretoduly
enterlawfullymadejudgmentrecordsinthecourtfile,thepublicationof
fabricated'/sham/simulatedjudgmentrecordsinstead,andresponsesofJudge
DavidRosenonmyrequeststoinspectlawfullymadejudgmentrecordsinthe
courtfile.Wehavediscussedthismatterinthepast,anditisagainbriefly
summarizedintheattachedJuly14publication,titled:LoriShemTovandthe
AdministrationofCourtsFraudCentralofthejudiciary.[3]
c. EvidenceoffraudinconductoftheAdministrationofCourtsinattempttosilence
anantifamilycourtscorruptionactivist.Thismatterdirectlypertainstothework
oftheArbelCommittee,ofwhichyouareamember,andalsoisoutlinedinthe
theabovereferencedpublication.[3]

d. EvidenceofotherfraudincidentsinvolvingtheAdministrationofCourts,asmall
selectionofwhichisprovidedintheabovereferencedpublication,partofamuch
largercollection.[3]
e. ConductoftheArbelCommitteerelativetomypreviousrequestforyouropinion:
TheJuly14publicationwasfirstforwardedtoyouabout10daysago.You
immediatelyrespondedthatyouwouldn'trespond,andforwardeditinsteadfor
reviewbythefullCommittee.Immediatelyafterwards,AttorneyGaelAzriel,who
isnotanofficialmemberoftheCommittee,decidedtoremoveitfromthe
Committee'sagendaandhandleitherself...Herauthoritytodosoisdubiousat
best,andtheentireepisodeappearsasarepeatoftheincidents,whichare
describedinthepublicationitself.
Thecommonthemeinmanyofthemattersaboveisthegenerationoffabricated/
sham/simulatedelectronicrecords.Thismatterisparticularlynotableinthefailure
todulyenterlawfullymadedecisionandjudgmentrecords,andthepublicationof
fabricatedelectronicrecordsofdecisionsandjudgmentsinstead.Suchcircumstances
arebasedinsystemwidechangesinthecourtsoverthepastdecade,includingin
particularthedevelopmentandimplementationofnewITsystems.Inmyopinionit
transformedtheIsraelicourtintopatentlyincompetentcourts.Theattached
publication,publishedintheEuropeanConferenceonEgovernment,describessuch
transformationasunannouncedregimechange(Attachment9.3,below[2])
Thetwoofushavecommunicatedregardingthesemattersovermanymonths,
particularlyregardingthenatureofITsystemsofthecourts.Youhavealso
previouslywrittenthatyouintendtointensivelylookintothematter.
However,inthemeanwhile:
Youhaveinformedmeofyourrefusaltopubliclydiscussanymatters,pertaining
tointegrity,orlackthereof,ofthejusticesystem.
YouhavejoinedtheArbelCommittee.BorrowingthewordsofformerJustice
Minister,ProfDanielFriedmanonarelatedmatter,theCommitteeappearsan
attempttogaganentirenation...
YouexpressedyoustrongdismayregardingmyfilingtheComplaint,pertainingto
theRomanZadorov'sarbitrarydetentionandwidespreadincompetenceand/or
corruptionofthejusticesystemwiththeUNHumanRightsCouncil.
ThereisclearandseriousconcernthattheJustice(ret)ArbelCommitteeon
EstablishingProtectionforthePublicandPublicServiceEmployeesagainstActivity
andHarmfulPublicationsaswellasHooliganismontheInternet,ofwhichyouarea
member,actsaspartofwhatProfKremnitzerdescribedajusticesystem,whichis
primarilyprotectingitself.TheclearandseriousconcernisthattheCommitteeis
intendedtodeprivethepublicofinformationregardingthefailingjusticesystem,and
preventthepublicfromexpressingitsprotestagainstit.
Iyou choosetomaintainyoursilenceandrefusetoopineregardingthemounting
evidenceofwidespreadincompetenceand/orcorruptionofthejusticesystem,you
shouldresignfromtheArbelCommittee.
