CONSTITUTION

of
ASEAN Scout Association for Regional Co-
operation
(ASARC)

PREAMBLE

“We, The Scout Associations in the ASEAN countries,


desirous of promoting peace, stability and progress in
the region through strict adherence to the principles of
the UNITED NATIONS CHARTER and respect the
principles of sovereign equality, territorial integrity,
national independence and others. Conscious that in an
increasingly interdependent world, the objectives of
peace, freedom, social justice and economic prosperity
is best achieved in the ASEAN region by fostering
mutual understanding, good neighborly relations and
meaningful cooperation among the Scout associations;

AWARE of the common problems, interests and


aspirations of ASEAN and the need for joint action and
enhanced cooperation within their respective political
and economic system and cultural traditions;
CONVINCED that regional cooperation among the
countries of ASEAN is mutually beneficial, desirable and
necessary for promoting the welfare and improving the
quality of life of our Scouts;

RECOGNIZING that increased cooperation, contacts, and


exchanges among the countries of the region will
contribute to the promotion of friendship and
understanding amongst Scouts;

Do hereby agree to establish an association to be known


as ASEAN SCOUT ASSOCIATION FOR REGIONAL CO-
OPERATION hereinafter referred to as the
“ASSOCIATION.”

Article 1
Title and Office

1.1 The name of the Association shall be the ASEAN


Scout Association for Regional Co-operation
hereinafter called the “Association”.

1.2 The office of the Association shall be located at the


National Organization of the elected Chairman and
in the office of the NSO of the appointed Secretary
General.
Article 2
Membership

1.1 Full-fledged member NSOs of Brunei Darussalam,


the Kingdom of Cambodia, the Republic of
Indonesia, Malaysia, the Republic of the Philippines,
the Republic of Singapore, and the Kingdom of
Thailand

2.2. Accreditation of Non-WOSM Member Association

2.2.1 Scout Associations not registered with WOSM can


be affiliated to ASARC. The procedure for affiliation
and approval shall be prescribed by the ASARC
Board.

1.2 Admission of New Member Associations

2.3.1 The procedure for application and admission to


ASARC shall be prescribed by the ASARC Board
based on the following :
2.3.1.1 In a recognized geographical region of
Southeast Asia;
2.3.1.2 Recognition by all ASEAN Member States;
2.3.1.3 Agreement to be bound and to abide by the
Charter; and
2.3.1.4 Ability and willingness to carry out the
obligations of a member Association

2.3.2 Admission shall be decided by consensus of the


Conference, upon recommendation of the ASARC
Board.
2.3.3 The National Scout Organization shall be admitted
to ASARC upon signing an instrument of accession
to the Charter.

Article 3
Aims/Objectives

3.1 The aim of the Association is to encourage mutual


co-operation and coordinate support from outside
organizations.
3.2 The objectives of the Association are to help the
development and promotion of Scouting in ASEAN
and to address other Scouting issues as need
arises.
3.3 The cooperation of the ASARC is based on the
principles of Scouting and the ASEAN Charter.

Article 4
Organ of the Association

4.1. The Association will have simple organization, the


Conference; the Association itself, and the
Secretariat.
4.1.1 The Association – refers to the member NSO in the
ASEAN.
4.1.2 The Conference – is the forum of all members of
the Association.
4.1.3 The Secretariat – is the implementing organ of the
Association. The Secretariat shall be headed by a
Secretary General, and two Deputy Secretary
Generals. One Deputy Secretary General should
come from the NSO of the Chairman.

Article 5
Appointments/ Term of Office

5.1 The Chairman shall be rotated among ASARC


members every 3 years during ASARC Conference
from any National Chief Commissioner or equivalent
in the ASEAN NSO. The rotation will be based on the
name of the countries in alphabetical order.
5.2 All NSO National Chief Commissioners or
equivalents who are not the chairman shall be the
vice-chairmen for a term of 3 years.
5.3 The Treasurer will be elected during the ASRAC
Conference for a term of 3 years.
5.4 The Chairman, Vice-Chairmen and the Treasurer
shall constitute the ASARC Board.
5.5 The Chairman shall appoint a Secretary General in
consultation and approval from the NSO. Other staff
of the secretariat shall likewise be appointed by the
Chairman. Should the Secretary General
resign/retire, his NSO should recommend a
replacement to serve the unexpired term in the
ASARC.

Article 6
Conference/Official Delegates

6.1 Official Delegates to the Conference shall comprise


two representatives from each member NSO.
6.2 The conference of the ASRAC shall be held at least
once in three years, the date and venue shall be
decided upon by the ASRAC Board.
6.3 The Conference shall have at least two thirds of its
members present to constitute a quorum.

Article 7
Board Meetings
7.1 Regular meetings shall be held at least twice in
three years.
7.2 Quorum for the meeting of the Board shall comprise
at least 50% of its members.
7.3 Special meetings may be called by the Chairman on
request of two thirds of the members of the Board
by giving two months’ notice.

Article 8
Functions of the Association

The Association shall:


8.1 Discuss the progress of the Associations in each
meeting and do all things necessary towards
achieving the aim of the Association as mentioned
under article 2.
8.2 Hold appointment and elections of officers as
provided in this Terms of Reference
8.3 Consider recommendations and reports from WOSM
and Regional Scout Conference and make
recommendations thereon.
8.4 Consider recommendations brought forward by
members and make decisions thereon.
8.5 Consider and, in accordance to this Terms of
Reference, adopt proposed amendments to this
Terms of Reference.
Article 9
Function of the Chairman
9.1 To chair all meetings and conferences of the
Association
9.2 To encourage /coordinate and support the
Secretariat and member NSOs to take actions as
per the association decisions.
9.3 To carry out any special actions as decided by the
Association

Article 10
Functions of the Vice-Chairman

10.1 In the absence of Chairman, one of the vice-


chairmen appointed by the chairman shall execute
his duties and responsibilities.
10.2 Carry out the functions as may be designated by
the Chairman or the Association

Article 11
Functions of the Secretary

11.1 Act as Secretary at all meetings and conference of


the association
11.2 All documents and registry shall be kept by the
Secretary General
11.3 Manage the communication and correspondence
of the Association
11.4 Implement the decisions made by the association
in its meetings.
11.5 Support member NSOs in carrying out the
decisions of association meetings.
11.6 promote cooperation and mutual assistance
amongst the member NSOs
11.7 Perform such other duties as the association may
determine

Article 12
Votes
12.1 Each member NSO is entitled for one vote
12.2 Voting shall be by show of hands, or such means
as the meeting may decide.
12.3 Delegates representing organizations with an
affiliation or observer status shall have the right to
take part in meetings, discussions and debate but
shall not have the right to vote or be voted upon
and to make or second any nominations or
resolutions.

Article 13
Amendments

13.1 Any amendment to this Terms of Reference may


be made at the conference by at least two third
votes of its members.
