FACTUAL STIPULATION

JEFF WAYNE BANTA,

Defendant.
The United States of America, by Billy J. Williams, United States Attorney for the
District of Oregon, and through Ethan D. Knight, Geoffrey A. Barrow, and Craig J. Gabriel,
Assistant United States Attorneys, and defendant Banta through his counsel, Robert L. Salisbury,
have reached the following factual stipulation with respect to defendant Banta.
Stipulation
Jeff Banta drove from his home in Elko, Nevada, to the Malheur National Wildlife
Refuge (Refuge) on two separate occasions:

He first arrived at the Malheur National Wildlife Refuge on Saturday, January 9,

Mr. Banta visited the headquarters area of the Refuge on January 9th and then stayed the

night at a motel in Burns, Oregon. Mr. Banta returned to the Refuge headquarters area on
Sunday, January 10th, and spent the morning of that day on the Refuge before returning home.

Mr. Banta again drove from his home to the Refuge and arrived on Monday,

January 25, 2016.

He stayed on or near the Refuge until he was arrested on Thursday,

February 11, 2016.

During this second trip to the Refuge, Mr. Banta brought with him his

firearm, a 12-gauge Remington 870 shotgun. That shotgun was later recovered by the FBI from
the Refuge and is marked as Exhibit 442.
