AFFIDAVIT OF EXPLANATION
I, CPL. M, Filipino, of legal age and a resident of Tagulo, Tukuran,
Zamboanga del Sur, after having been duly sworn in accordance with law,
hereby depose and state:
1. I am a member of the Armed Forces of the Philippines (AFP)
presently assigned at Camp Buddatu, Indan, Jolo, Sulu under the 15
SRC Mandirigma Company;
2. On 7 July 2016, I went home to get some relaxation with my family
as I was off-duty during that time. I was supposed to report back for
duty on 12 July 2016;
3. As I was about to travel back to my place of assignment, my
brother-in-law, JONATHAN YAON approached me and told me that he
was in dire need of my help in the negotiation with a private
complainant for the dismissal of the criminal case filed against him
pending before Branch 21 of Regional Trial Court, Pagadian City with
docket no. 12774-2K16;
4. Feeling a sense of duty to the family, I gladly obliged to help my
brother-in-law. Our meeting with the private complainant, which
happened on 12 July 2016, yielded positive results as the latter
eventually decided to cease and desist from further prosecuting the
above criminal case;
5. Thereafter, my brother-in-law requested me to help him look for a
lawyer who will represent him in asking the court to officially
dismiss the same case. Unfortunately, I was able to secure the
services of a legal counsel for my brother-in-law only on the next
day;
6. These circumstances forced me to be absent from my work for two
days, that is, from July 12 to 13, 2016. Truth be told, I did not have
any malicious intent to abandon or reneged on my duty to the AFP
nor did I have the temerity to go AWOL;
7. I am executing this affidavit in order to attest to the truth and
veracity of the foregoing facts;
