RESOLUTION NO. 15-1007


WHEREAS, with the closure of the much maligned Santiago Open
Dumpsite, the city wastes are now dumped and segregated by the personnel
of the City Environment Management Office (CEMO), at the Central
Materials Recovery and Composting Facility (CMRCF) at Sitio Bangko,
Barangay Bonbonon;
WHEREAS, the CMRCF is design not only for the proper disposal of
solid waste in accordance with R.A. 9003, The Ecological Solid Waste
Management Act of 2000, and City Ordinance No. 09-5488, The Iligan
City Solid Waste Management Code, but also to generate income to help
sustain the Solid Waste Management Project/Program;
WHEREAS, years of segregating the biodegradable and nonbiodegradable waste resulted to the accumulation of recyclable saleable
wastes in the warehouses of the CMRCF. Moreover, the Demo Farms and
Nursery has also produced agricultural products;
WHEREAS, if these marketable items are sold and it should be, it
could generate substantial income to help defray the miscellaneous
expenditures for the sustained efficient operation of the CMRCF and
development of the government-owned CMRCF vicinity;

WHEREAS, Section 7 (d), Article III of City Ordinance No. 09-5488
states:

Adopts revenue-generating measures to promote the
viability of the solid waste management plan
WHEREAS, additionally, Section 20 (c), Article V of City Ordinance No.
09-5488 states:

Re-cycle - There are waste materials that can be processed


to
produce new products. This type of waste materials
shall be identified and separated from the waste stream.
There is a growing market for recyclable materials; thus,
waste generators can dispose this type of waste by selling
to recyclers;

WHEREAS, there is a need to fix the reasonable market value of


saleable segregated items and the Demo Farm and Nursery products so that
the Iligan City Government could earned money out of it;
WHEREFORE, on joint motion of Members Ariel P. Anghay, Simplicio
N. Larrazabal, III and Samuel P. Huertas, duly seconded by Members
Usafeno F. Obial
BE IT RESOLVED, AS IT IS HEREBY RESOLVED, By the Sangguniang
Panlungsod of Iligan, that the following City Ordinance is hereby ADOPTED
and APPROVED:
CITY ORDINANCE NO. 156383
AN ORDINANCE FIXING THE PREVAILING MARKET
PRICES OF SEALABLE SEGREGATED ITEMS AND
COMPOST RESULTING FROM THE CENTRAL MATERIALS
AND COMPOSTING FACILITY (CMRCF) OPERATION AND
AGRICULTURAL PRODUCTS OF THE DEMO FARM AND

NURSERY
IN
THE
COMPOUND VICINITY.

SECTION 1. Coverage- All items that are sold at the CMRCF


compound and government- owned CMRCF vicinity, except coconut
products, shall be covered by the ordinance.
SECTION 2. Definition of Terms The following terms shall be
construed as follows:
African Night Crawler - refers to the specie of worms being
used for vermi-cast production

Agricultural products - refers to vegetables grown at the
demo farm to show the effectivity of compost, vermincast & compost-vermi mix as a much better organic
substitute to inorganic fertilizers like urea; seedlings
mainly grown to support the LGU greening program, but
also for sale to private individuals/ entities; and flowers
for sale
Compost - is the product of processing of biodegradable
materials at the CMRCF with an NPK of less than 5,
thus categorized as soil enhancer.
Compost-vermi mix is a mixture of vermin-cast and compost
with an NPK higher than plain compost, but lower than
vermin-cast
Saleable non-biodegradable items - refers to materials
which are segregated at the CMRCF for sale to any
person, group of persons or entity.
Vermi-cast - refers to the waste product of worms being fed
with appropriate substrate & with an NPK more than
five (5), thus categorized as fertilizer grade
SECTION 3. Prices of Products of the CMRCF and GovernmentOwned Vicinity-The following are the prices of segregated items and

products of the CMRCF operation and other agricultural products ( in the


government-owned CMRCF compound vicinity ) as defined above:

SECTION 4. Periodic Price Adjustment- The prices of the items in


Section 3 are subject to periodic change because of the fluctuating market
prices, upon due notification of the City Treasurers Office who shall issue a
permit for such adjustment.
SECTION 5. Conditions of Sale- The items/products are to be sold to
any individual/groups of individuals/entity who buys it at the prescribed
original or adjusted price on a first come, first serve basis.
SECTION 6. Proper issuance of Receipts- All purchase shall properly
receipted using the Official Receipt of the City Government and issued onsite by a person duly authorized by the City Treasurer to issue such receipt.
SECTION 7. Category of Deposit of CMRCF Income- The income
from the sale of CMRCF items, enumerated in Section 3, shall be deposited
as Special Account under the General Fund for use in Solid Waste
Management expenditures.

SECTION 8. Penal Provision Violation of this ordinance shall


subject the violator to the standard fines/ penalties as imposed in the Local
Government Code and applicable national legislation.
SECTION 9. Separability Clause. - If for any reason any section of
provision of this ordinance shall be declared unconstitutional and invalid the
other sections or provisions which are not affected thereby shall continue in
full force and effect.
SECTION 10. Repealing Clause. All previous ordinances, executive
orders, rules and regulations or parts thereof which are inconsistent with
this ordinance are hereby repealed and modified accordingly.
SECTION 11.
Effectivity - This Ordinance shall take effect ten
days (10) after the publication of a local newspaper, as set forth by law.
