 1 I, Ori Katz, declare:
2 1. I am an attorney licensed to practice law in the State of California and am
3 admitted before this Court. I am a partner with the law firm of Sheppard, Mullin, Richter
4 & Hampton LLP ("Sheppard Mullin"), counsel for creditors Sigma Connectivity Inc.,
5 Stephen Gould Corp., DUCO Technologies Inc., Colony, Inc. and Volume & Tone LLC in
6 the above-captioned case (collectively, the "Petitioning Creditors"). I make this
7 declaration in that capacity. Except for those statements made upon information and
8 belief, the following facts are based upon my personal knowledge and if called to testify, I
9 could and would competently testify to such facts. As to those statements made upon
10 information and belief, I believe them to be true.
11 2. This declaration is made regarding the Request for Entry of Order for Relief
12 By Default, filed concurrently with this declaration (the "Default Request"). I give
13 capitalized terms not otherwise defined in this declaration the same meanings given to
14 them in the Default Request.
15 3. On March 14, 2016, the Petitioning Creditors filed in this district the
16 Involuntary Petition against the Debtor. A true and correct copy of the Involuntary
17 Petition is attached to this declaration as Exhibit A. Thereafter, on March 16, 2016 the
18 clerk of the Court issued the Summons. A true and correct copy of the Summons is
19 attached to this declaration as Exhibit B. Also on March 16, 2016, Sheppard Mullin served
20 the Summons and the Involuntary Petition on the Debtor. A true and correct copy of the
21 certificate of service is attached to this declaration as Exhibit C.
22 4. As of the date of this notice, Sheppard Mullin has not received an objection
23 with respect to the Involuntary Petition. A review of the Docket in this case reveals that no
24 such pleading or other defense to the Involuntary Petition have been filed to date.
