Dec 09, 2011 - A worker was observed picking mushrooms over 10 feet in barn 16 without
guard rails. Upon questioning the worker he stated that he was told by
another worker "he only had to use the guard rails if he felt scared".
In discussion with the quality assurance manager no additional training
has been conducted on training of how to use or install the guard rails,
and a discipline system for when the workers do not use them. This order
has been date extended to December 23, 2011.
Initiating order:
Mushroom picking ladder system was observed without adequate guard rail
system with workers working over 4 feet. Upon the request of this Officer
guard rails where installed at the time of inspection. It was observed
that the workers where unfamiliar with installing the guard rails.
This is in contravention of the Occupational Health and Safety Regulation
Section 4.55(a).
An area accessible to workers must have guards or guardrails installed if
a raised floor, open-sided floor, mezzanine, gallery, balcony, work
platform, ramp, walkway, or runway is 122 cm (4 ft) or more above the
adjacent floor or grade level.
The employer shall provide and ensure that all worker are protected by a
guard rail system when picking mushroom. The employer will also ensure
that workers are instructed on how to use the mushroom ladder picking
system.

plan. The employer has been provided with another copy of the sample of
WorkSafe BC Exposure Control Plan at the time of the follow up inspection
report delivered. This order has been date extended to December 23, 2011.
An exposure control plan has not been implemented indicated that a worker
might be exposed to an carbon monoxide levels that may in excess of 50% of
its exposure limit. Carbon monoxide levels have a TWA of 25 ppm during the
casing stage of mushroom production this TWA level may be exceeded. Oxygen
levels less than 21.5% indicate that a hazards to the workers may exist
resulting in worker injury.

INFORMATION ABOUT ADMINISTRATIVE PENALTIES
Section 196(1) of the Workers Compensation Act sets out the criteria for
imposing an administrative penalty. An administrative penalty must not be
imposed if the employer exercised due diligence to prevent the failure,
non-compliance or conditions to which the penalty relates.
Section 196(1):
The Board may, by order, impose an administrative penalty on an employer
under this section if it considers that
(a) the employer has failed to take sufficient precautions for the
prevention of work related injuries or illnesses,
(b) the employer has not complied with this Part, the regulations or an
applicable order, or
(c) the employer's workplace or working conditions are not safe.
Board Policy
The main purpose of administrative penalties and similar levies is to
motivate the employer receiving the penalty and other employers to comply
with the Act and regulations.
The Board will consider imposing an administrative penalty when:
- an employer is found to have committed a violation resulting in high
risk of serious injury, serious illness or death;
- an employer is found in violation of the same section of Part 3 or the
regulations on more than one occasion;

WorkSafe BC Exposure Control Plan at the time of the follow up inspection
report delivered. This order has been date extended to December 23, 2011.
An exposure control plan has not been implemented indicated that a worker
might be exposed to an carbon monoxide levels that may in excess of 50% of
its exposure limit. Carbon monoxide levels have a TWA of 25 ppm during the
casing stage of mushroom production this TWA level may be exceeded. Oxygen
levels less than 21.5% indicate that a hazards to the workers may exist
resulting in worker injury.

(SRO). The following deficiencies are:
- The ECP provide is for two operations and the employer has failed to
provide separate ECPs for each operation.
- Missing the address
- Missing contact information for ECP
- Missing some of the worker responsibilities, for example know how to
report exposure incidents.
- Inaccuracies have been identified in the document for example the
document states 20.5 % oxygen is normal, when in fact 20.9 % is normal.
- Additional points: There is no reference to Training topics, monitoring
equipment, health surveillance, no reference to cleanup and
decontamination.
- Risk assessment table is not acceptable (incomplete and inaccurate). For
example they state low levels of C02, CO (under 2000PPM)This is incorrect
for CO. I am not sure how they arrive at the low, moderate and high risk
levels

the boilers and suggests that another boiler operator is in close
proximity of the farm if assistance is need when the farm boiler operator
is away.
To ensure that the employer suggestion is in scope I have contacted the
Boiler, Pressure Vessel Section of the BC Safety Authority for
clarification. Instruction, with respect to the employer's suggestion,
will be provided by this officer when that opinion is received.

Each electrical distribution switch, circuit breaker and control must be

inspection for the Agriculture Industry Strategy, hence a work site
inspection occurred on June 19, 2013 by Officer Anna Billingsley
Prior to arriving at the site the Officer took the following bio-security
measures:

WorkSafeBC has initiated a Province wide Agriculture Industry Strategy
that will focus on reducing fatalities, the serious injury rate and the
injury rate in the top exposure categories in the agriculture sectors,
specifically, falls on same levels, falls from heights and struck by
injuries. The Strategy will also raise awareness of health & safety
rights and responsibilities within the agriculture sector.
In addition to the above goals, the Strategy will continue to develop and
implement an industry outreach and communication program in support of the
focused enforcement activities.
In response to the Mushroom Farm Coroner Inquest and the Jury
recommendations, WorkSafeBC will be working with the Farm and Ranch Safety
and Health Association (FARSHA) to develop and implement a Centre of
Excellence for Confined Space Entry.
The Strategy involves a standard inspection process that will focus on
high hazard areas in the specific agriculture operations including the
requirements for formal and informal Occupational Health & Safety
programs. Employers who have a higher injury rate than the industry
average will be inspected as part of this strategy as well as those
employer operations which have a high risk of injury.
Issues discussed with the employer during this inspection revolved around
the deficiencies at this workplace which result in corrective orders
outlined and detailed on the following page(s).

Records and statistics are important components of occupational health and
safety programs for the prevention of injuries and illnesses. They help

Section 3.3(f) of the Regulation requires that the occupational health and

c) Workplace Inspections
A key activity in the prevention of workplace incidents is the
identification of hazards to which workers may be exposed and contact.
The intent being to identify such hazards and take appropriate action to
prevent contact. To this regard the Occupational Health and Safety
Regulation requires that the employer ensure regular workplace inspections
are conducted.

A confined space is an enclosed or partially enclosed area that is big
enough for a worker to enter. It is not designed for someone to work in
regularly, but workers may need to enter the confined space for tasks such

layout with obstructions can make entry and exit difficult and can
complicate rescue procedures.
It is vital to identify all confined spaces in any workplace. Examples of
confined spaces include tanks, silos, storage bins, process vessels,
pipelines, sewers, underground utility vaults, and vats in short, any
area that can have a confined atmosphere. (see order #5)
----------------------------------------------------------------------3. Working from heights requirement:
The employer must ensure that workers required to work from heights be
protected from a fall.
The hierarchy of fall protection consists of:
- guardrails
- fall restraint
- fall arrest
- procedures
Occupational Health & Safety Regulation 4.54 defines working from a height
as being an opening in a floor or along the open sides of stairs or a
ramp, landing, work platform, balcony, mezzanine, raised walkway or any
other area that a fall to a lower level could happen.
The employer is to ensure that the above mentioned areas accessible to
workers must have a guard or a guardrail installed.
A guard is described as a barrier and a guardrail consists of a top rail
102 cm to 112 cm (40 in to 44 in) above the work surface, and a midrail
located approximately midway between top rail and the work surface.
Occupational Health & Safety Regulation Section 4.55 identifies that a
guardrail must be installed if a raised floor is 122 cm (4 ft) or more
above the adjacent floor or grade level. (see order 1)
----------------------------------------------------------------------4. Machine Safeguarding requirements:
Occupational Health & Safety Regulation Section 12.2 requires the employer
to ensure that machinery and equipment is fitted with adequate safeguards
to protect workers from contact with hazardous power transmission parts
and to ensure that a worker cannot access a hazardous point of operation.
Occupational Health & Safety Regulation Section 12.3 requires the employer
to meet the CSA Standard Z432-94 for Safeguarding of Machinery.

On July 10, 2013 a meeting was held at the WorkSafeBC Abbotsford office
with the mushroom farm employers to review the three serious incidents
that occurred over the last several months in the mushroom growing
industry. Two of the incidents involved workers falling from height due
to the mushroom picking ladder system detaching from the railing system.
The third incident involved cable damage or wear.
Inspections of the picking ladder system involved in the three incidents
has determined that the employers do not have manufacturer instructions
and any standard the equipment is required to meet for the installation,
testing, repair and maintenance for the picking platform equipment and
therefore, are required to be specified by a professional engineer. In
addition, the picking platform does not meet the requirements of a
professional engineer.
FARSHA has carried out research to assist the mushroom farmers with
respect to the options that are available to achieve compliance with the
orders issued in this report.
With respect to the design of the picking ladder system the following
recommendations and comments are provided:
1. The employer is required to secure the platform with pins, otherwise
the platform is considered to be a suspended work platform and
Occupational Health & Safety (OH&S) regulation 13.33 applies with respect
to the use of a personal fall protection system.
2. The employer may be required to consider alternatives to the platform
such as equipment already available on the market, such as a scissor lift.
3. The support system of the platform frame should restrict vertical
movement of frame (rollers) from rails attached to bed, prevent horizontal
movement of bottom of frame (outwards and away from beds), ensure fail
safe connection of frame to rail attached to mushroom beds, ensure
connections of rails to mushroom bed are rated for maximum load.
4. Design considerations for winch and wire rope system for a manually
moving platform should include winch rated and designed to support
personnel or the platform to be dogged in place and correctly sized wire
rope for winch and sheaves. In addition, determine maximum load for
platforms, guardrails and fixed ladder connections and ensure system is
designed for this load. Determine maximum platform load that can be
safely raised with the winch.

workers to pick mushrooms during the harvesting stage in the mushroom
growing barns. The work platform is a system of several components, for

growing barns. The work platform is a system of several components, for
example, ladder, winch, frame, wire rope, wire rope clips, track system,
guard rails and work platform that attach to the mushroom growing beds by
a system of rollers and rails. There is no applicable standard under
Occupation Health & Safety regulation 13.2 (1)(a) or (b) for this work
platform and the employer has not ensured that the platform meets the
requirements of a professional engineer.
This is in contravention of the Occupational Health and Safety Regulation
Section 13.2(1)(c).
A ladder, window cleaner's belt or work platform must meet and be used in
accordance with (c) if there is no applicable standard under paragraphs
(a) or (b), the requirements of a professional engineer.

Jan 21, 2014 - The employer has engaged a consulting engineering firm (Roos Engineering)
to provide engineering opinion on the design and repair of the mushroom
picking ladder and cart assembly. Currently the engineering firm has
provided information to the employer that should enable the employer to
completed repairs to the equipment. The locking mechanism is required for
the platform and has been ordered from the supplier and it is expected
that this will be received at the end of January, 2014. It is expected
that the engineering firm will inspect both parts of the equipment and
issue a signed and sealed professional engineering certificate that the
equipment is safe to operate. The engineering firm expect that this
certificate will be completed mid February 2014.

provided information to the employer that should enable the employer to
completed repairs to the equipment. The locking mechanism is required for
the platform and has been ordered from the supplier and it is expected
that this will be received at the end of January, 2014. It is expected

issue a signed and sealed professional engineering certificate that the
equipment is safe to operate. The engineering firm expect that this

This was a follow-up inspection to authenticate appropriate compliance with the order(s) noted.
At the time of this inspection there was work activity observed in the mushroom growing barn. There was mushroom harvesting
and multiple workers were using the mushroom ladder picking systems (work platforms) at the time of this inspection.
In room 13 - I observed eight (8) ladder frames, all attached to the rail system of the mushroom beds and 6 ladder systems where
observed without the required locking mechanism to secure the work platform to the ladder frame to prevent a worker falling from
height as identified in the engineers structural review report No 1.
In room 10 - I observed nine (9) ladder frames, all attached to the rail system of the mushroom beds and 5 ladder systems where
observed without the required locking mechanism to secure the work platform to the ladder frame to prevent a worker falling from
height as identified in the engineers structural review report No 1.
In room 5 - I observed thirteen (13) ladder frames, all attached to the rail system of the mushroom beds and 10 ladder systems
where observed without the required locking mechanism to secure the work platform to the ladder frame to prevent a worker falling
from height as identified in the engineers structural review report No 1.
In room 4 - I observed nine (9) ladder frames, all attached to the rail system of the mushroom beds and 7 ladder systems where
observed without the required locking mechanism to secure the work platform to the ladder frame to prevent a worker falling from
height as identified in the engineers structural review report No 1.
The worker representatives conducting the inspection with Officer Anna Billingsley and SRO Carol-Anne Boufford was asked if the
locking mechanism would be installed prior to the next mushroom harvesting shift, they answered, they could.
Based on the evidence gathered during this site inspection, this officer directed the worker representative and the employer not to
allow workers to use the work platforms until the employers engineer can inspect them to ensure they are safe to use by workers.
The worker and employer representative acknowledged this.
A meeting was held with the owner at approximately 12:30 pm where I stated that the platforms at this site could not be used until
the employers engineer could inspect them to determine if they are safe to use. This direction was also give to the Human
Resources Manager and that a Stop Use Order would be issued on this site as well with respect to the work platforms.
Prior to conducting this inspection the following precautions were undertaken; by Officer Anna Billingsley and SRO Carol-Anne
Boufford:
- Application of 2% Virkon solution to safety boots prior to entering work site.
- Followed the required bio-security precautions as set out by this mushroom farming operation and the request of the employer.

Section 196, Workers Compensation Act (the Act)
On July 25, 2013, an inspection of a workplace at 28265 58 Avenue, Abbotsford, BC determined there was a violation of section
4.3(2)(b) of the Occupational Health and Safety Regulation (the Regulation). Inspection Report 2013163210194 was issued to
the employer, H.Q. Mushroom Farm Ltd. (the Employer) which described the violation.
Upon consideration of all available evidence, and in accordance with section 196 of the Act and applicable Prevention Policy,
WorkSafeBC is imposing an administrative penalty because the Employer:
1. has failed to take sufficient precautions for the prevention of work related injuries or illnesses;
2. has not complied with section 4.3(2)(b) of the Regulation;
3. has not maintained a safe workplace or safe working conditions; and
4. did not exercise due diligence to prevent these circumstances.
The amount of the penalty is $8,380.80 and was determined in accordance with Prevention Policy D12-196-6 based on the
following:
1. the Employers payroll; and
2. the nature of the violation (determined as Category B).
The Employer, a worker, a union, or other person identified under section 96.3 of the Act who is directly affected by this decision
may request a review of the decision by the Review Division of WorkSafeBC.

This is in contravention of the Occupational Health and Safety Regulation Section 9.2.
The employer must:
(a) ensure that each confined space in the workplace is identified, and
(b) determine whether any such space will require entry by a worker, either in scheduled work activities or as a result of
foreseeable system failures or other emergencies.
Measures to Ensure Compliance:
The employer must identify and document all of the confined spaces in its workplace. Once identified a determination must made
regarding whether or not workers are required to enter an confined space area.

This is in contravention of the Occupational Health and Safety Regulation Section 10.4(1).
When lockout of energy isolating devices is required, the devices must be secured in the safe position using locks in accordance
with procedures that are made available to all workers who are required to work on the machinery or equipment.

The employer must develop and implement lock out procedures for their energized equipment.

I attended this workplace as a result of an incident that presented a high risk of serious injury, or involved the serious injury or
death of a worker.
This incident inspection was completed on November 23, 2015. The following comments are noted with regard to: scope of
incident inspection, deficiencies and discussions at the workplace.
SCOPE OF INCIDENT INSPECTION
The manager aided in an incident inspection with Officer Anna Billingsley (OSO) at 2:00 pm for an incident of a mushroom picking
platform partially de-railing causing a worker to fall striking floor and receiving injuries.

A worker had an incident where the mushroom picking platform partially de-railed from the top rail. The worker fell through the
guard rail striking their head and wrist on the floor. The picking platform locking mechanism appears to be striking the bolts that
support the top rail.
If the Board has reasonable grounds for believing that a thing that is being used or that may be used by a worker is not in safe
operating condition the Board may order that the thing is not to be used until the order is cancelled by the Board.
Measures to Ensure Compliance:
Stop use of the picking platform on the top rail until inspected by a professional engineer.

The employer transported the injured worker by private vehicle without adequate medical supplies or first aid attendants. .
This is in contravention of the Occupational Health and Safety Regulation Section 3.17(1)(e).
The employer must keep up-to-date written procedures for providing first aid at the worksite including who is to call for
transportation for the injured worker, and the method of transportation and calling.

The employer must develop written procedures on transportation of injured workers.

support structure, resulting in an injury to worker.
This is in contravention of the Occupational Health and Safety Regulation Section 4.3(1)(a).
The employer must ensure that each tool, machine and piece of equipment in the workplace is capable of safely performing the
functions for which it is used.
Measures to Ensure Compliance:
Due to the level of the risk associated with the use of the mushroom picking platforms the employer is required to stop use of the
mushroom bed and picking equipment in room 21 (C & D). Until the following items have been completed:
- Structure of mushroom beds, top rail, guard rail, and ladder system have been assessed for structural integrity by a professional
engineer.
- Any deficiency noted by the professional engineer need to be corrected and a final inspection conducted, of which a copy will
be submitted to this Officer for final review before cancellation will occur.

INSPECTION NOTES
WorkSafeBC has initiated a Province wide Agriculture Industry Strategy that will focus on reducing fatalities, the serious injury rate
and the injury rate in the top exposure categories in the agriculture sectors, specifically, falls on same levels, falls from heights
and struck by injuries. The Strategy will also raise awareness of health & safety; safety rights and responsibilities within the
agriculture sector.
In addition to the above goals, the Strategy will continue to develop and implement an industry outreach and communication
program in support of the focused enforcement activities..
The Strategy involves a standard inspection process that will focus on high hazard areas in the specific agriculture operations.
Discussion held with the employer, included the requirements of the agriculture industry strategy as it relates to identified hazards:
1. Struck by (animals, product, equipment, machinery, etc)
2. Falls from elevation
3. Falls from same elevation
4. Confined Space identification and requirements
5. Informal and formal health and safety program
6. Tractor safety
7. Equipment and machine safeguarding and lock out
8. Documented new and young worker training
9. Pesticide / chemical storage and use.
An inspection was conducted on February 3, 2016 in accordance with the WorkSafe BC agricultural strategy. The following
comments are noted with regard to: scope of inspection, deficiencies and discussions at the workplace.

The supervisors aided in an inspection with Officer Anna Billingsley (OSO) at 1:00 pm for the partially completed composting

A follow up inspection was conducted with WorkSafe BC engineer for an incident that occurred on Friday 12, 2016.

Regulation, or WorkSafeBC orders may be subject to monetary or other sanctions as prescribed by the Workers
Compensation Act.

The employer has provided a check list of items that need to be inspected before harvest but not provided training on how to
conduct the checklist. Example; upper wheel rail - what are the workers looking for?
This is in contravention of the Workers Compensation Act Section 115 (2)(e).
An employer must provide to the employer's workers the information, instruction, training and supervision necessary to ensure
the health and safety of those workers in carrying out their work and to ensure the health and safety of other workers at the
workplace.
Measures to Ensure Compliance:
The employer must develop and implement training for the pre harvest check list to any workers designated to inspect the
mushroom growing rooms.
