Mar 28, 2012 - The employer is working towards compliance at the time of inspection. This
order has been date extended to April 13, 2012.
Dec 09, 2011 - No progress has been made for have a maintenance schedule/ inspection for
the operations of the boilers at the time of follow up inspection. This
order has been date extended to December 23, 2011.
Initiating order:
At the time of inspection the two boilers where observed in Flame Failure.
One boiler was leaking water and the another boiler appeared to be dry.
This is in contravention of the Occupational Health and Safety Regulation

Section 3.5.
Every employer must ensure that regular inspections are made of all
workplaces, including buildings, structures, grounds, excavations, tools,
equipment, machinery and work methods and practices, at intervals that
will prevent the development of unsafe working conditions.
The employer must provide documentation of regular inspection of the
boilers.

Mar 28, 2012 - The employer has completed training of the mushroom platform picking
system. No workers where observed without the guard rails at the time of
inspection.
Dec 09, 2011 - A worker was observed picking mushrooms over 10 feet in barn 16 without
guard rails. Upon questioning the worker he stated that he was told by
another worker "he only had to use the guard rails if he felt scared".
In discussion with the quality assurance manager no additional training
has been conducted on training of how to use or install the guard rails,
and a discipline system for when the workers do not use them. This order
has been date extended to December 23, 2011.
Initiating order:
Mushroom picking ladder system was observed without adequate guard rail
system with workers working over 4 feet. Upon the request of this Officer
guard rails where installed at the time of inspection. It was observed
that the workers where unfamiliar with installing the guard rails.
Section 4.55(a).
An area accessible to workers must have guards or guardrails installed if
a raised floor, open-sided floor, mezzanine, gallery, balcony, work
platform, ramp, walkway, or runway is 122 cm (4 ft) or more above the
adjacent floor or grade level.
The employer shall provide and ensure that all worker are protected by a
guard rail system when picking mushroom. The employer will also ensure
that workers are instructed on how to use the mushroom ladder picking
system.

Mar 28, 2012 - An exposure control plan has been submitted and is in the process of
being reviewed.
Dec 09, 2011 - The employer has not had any progress on completing an Exposure Control
plan. The employer has been provided with another copy of the sample of
WorkSafe BC Exposure Control Plan at the time of the follow up inspection
report delivered. This order has been date extended to December 23, 2011.
An exposure control plan has not been implemented indicated that a worker
might be exposed to an carbon monoxide levels that may in excess of 50% of
its exposure limit. Carbon monoxide levels have a TWA of 25 ppm during the
casing stage of mushroom production this TWA level may be exceeded. Oxygen
levels less than 21.5% indicate that a hazards to the workers may exist
resulting in worker injury.

Initiating order:

Section 5.54(1)(a).
An exposure control plan must be implemented when exposure monitoring
under Subsection 5.53(3) indicates that a worker is or may be exposed to
an air contaminant in excess of 50% of its exposure limit.
Implement an exposure control plan which incorporates the following
elements:
(a) a statement of purpose and responsibilities;
(b) risk identification, assessment and control;
(c) education and training;
(d) written work procedures, as required;
(e) hygiene facilities and decontamination procedures, as required;
(f) health monitoring, as required;
(g) documentation, as required.
Without delay, the employer is required to use locks and signs prohibiting
entry into the mushroom growing rooms during those stages when outside air
is not being supplied to the room or there is not enough outside air being
supplied to the room to ensure normal oxygen levels in air and to ensure
carbon monoxide and carbon dioxide levels are below the acceptable
exposure limits outlined in part 5 of the Occupational Health & Safety
regulation.

proximity of the farm if assistance is need when the farm boiler operator
is away.
To ensure that the employer suggestion is in scope I have contacted the
Boiler, Pressure Vessel Section of the BC Safety Authority for
clarification. Instruction, with respect to the employer's suggestion,
will be provided by this officer when that opinion is received.

INFORMATION ABOUT ADMINISTRATIVE PENALTIES
Section 196(1) of the Workers Compensation Act sets out the criteria for
imposing an administrative penalty. An administrative penalty must not be
imposed if the employer exercised due diligence to prevent the failure,
non-compliance or conditions to which the penalty relates.
Section 196(1):
The Board may, by order, impose an administrative penalty on an employer
under this section if it considers that
(a) the employer has failed to take sufficient precautions for the
prevention of work related injuries or illnesses,
(b) the employer has not complied with this Part, the regulations or an
applicable order, or
(c) the employer's workplace or working conditions are not safe.
Board Policy
The main purpose of administrative penalties and similar levies is to
motivate the employer receiving the penalty and other employers to comply
with the Act and regulations.
The Board will consider imposing an administrative penalty when:
- an employer is found to have committed a violation resulting in high
risk of serious injury, serious illness or death;
- an employer is found in violation of the same section of Part 3 or the
regulations on more than one occasion;

- an employer is found in violation of different sections of Part 3 or the

regulations on more than one occasion, where the number of violations
indicates a general lack of commitment to compliance;
- an employer has failed to comply with a previous order within a
reasonable time;
an employer knowingly or with reckless disregard violates one or more
sections of
Part 3 or the regulations. Reckless disregard includes where a violation
results from ignorance of the Act or regulations due to a refusal to read
them or take other steps to find out an employer's obligations; or
- the Board considers that the circumstances may warrant an administrative
penalty.
If violations or other circumstances requiring consideration of a penalty
have occurred, the following additional factors will also be considered in
deciding whether to propose or to levy the penalty:
- whether the employer has an effective, overall program for complying
with the Act and the regulations;
- whether the employer has otherwise exercised due diligence to prevent
the failure, non-compliance or conditions to which the penalty relates;
- whether the violations or other circumstances have resulted from the
independent action of workers who have been properly instructed, trained
and supervised;
- the potential seriousness of the injury or illness that might have
occurred, the number of people who might have been at risk and the
likelihood of the injury or illness occurring;
- the past compliance history of the employer, including the nature,
number and frequency of violations, and the occurrence of repeat
violations;
- the extent to which the employer was aware or should have been aware of
the hazard or that the Act or regulations were being violated;
- the need to provide an incentive for the employer to comply;
- whether an alternative means of enforcing the regulations would be more
effective; and
- other relevant circumstances.
Amount of Penalty
The amount of an administrative penalty can range from $1,000 to $500,000
depending on the following factors:
- The firm's assessable payroll;
- A serious injury, illness or death as a result of the violation;
- A high risk of serious injury, illness or death from the violation;
- Non-compliance that is willful or with reckless disregard;
- The number of prior penalties for a similar violation; and
- Other mitigating or exacerbating factors.
The Board may also recover the amount of any costs saved or profit made by
the employer through committing the violation and recover the cost of an
injury claims arising from the violation.

May 18, 2012 - Exposure Control plan (ECP) has been reviewed by Carol Anne Boufford
(SRO). The following deficiencies are:
- The ECP provide is for two operations and the employer has failed to
provide separate ECPs for each operation.
- Missing the address
- Missing contact information for ECP
- Missing some of the worker responsibilities, for example know how to
report exposure incidents.
- Inaccuracies have been identified in the document for example the
document states 20.5 % oxygen is normal, when in fact 20.9 % is normal.
- Additional points: There is no reference to Training topics, monitoring
equipment, health surveillance, no reference to cleanup and
decontamination.
- Risk assessment table is not acceptable (incomplete and inaccurate). For
example they state low levels of C02, CO (under 2000PPM)This is incorrect
for CO. I am not sure how they arrive at the low, moderate and high risk
levels

H.Q. Mushroom Farm Ltd is one of the sites that has been selected for
inspection for the Agriculture Industry Strategy, hence a work site
inspection occurred on June 19, 2013 by Officer Anna Billingsley
Prior to arriving at the site the Officer took the following bio-security
measures:
~vehicle washed
~vehicle tires washed down with Virkon
~rubber boat washed in solution of Virkon
~hands washed with isopropanal disinfectant
WorkSafeBC has initiated a Province wide Agriculture Industry Strategy
that will focus on reducing fatalities, the serious injury rate and the
injury rate in the top exposure categories in the agriculture sectors,
specifically, falls on same levels, falls from heights and struck by
injuries. The Strategy will also raise awareness of health & safety
rights and responsibilities within the agriculture sector.
In addition to the above goals, the Strategy will continue to develop and
implement an industry outreach and communication program in support of the
focused enforcement activities.
In response to the Mushroom Farm Coroner Inquest and the Jury
recommendations, WorkSafeBC will be working with the Farm and Ranch Safety
and Health Association (FARSHA) to develop and implement a Centre of
Excellence for Confined Space Entry.
The Strategy involves a standard inspection process that will focus on
high hazard areas in the specific agriculture operations including the
requirements for formal and informal Occupational Health & Safety
programs. Employers who have a higher injury rate than the industry
average will be inspected as part of this strategy as well as those
employer operations which have a high risk of injury.
Issues discussed with the employer during this inspection revolved around
the deficiencies at this workplace which result in corrective orders
outlined and detailed on the following page(s).

agriculture industry strategy as it relates to identified hazards:

1. Health & Safety Program requirements:
Occupational Health & Safety Programs enable an employer to control its
occupational health and safety risks, improve health and safety
performance, communicate its health and safety commitments and policies to
staff, and provide a framework for attaining its health and safety goals
and objectives. Further, OHS programs assist with implementation by
defining roles, responsibilities, and accountability for tasks,
including checking and corrective action as the program evolves. A
properly implemented OHS program can be expected to reduce injuries and
the associated costs of disability and lost production hours.
Other areas of the OHS program that will assist the employer in achieving
a safe work environment are identified below:
a) Records & Statistics
Records and statistics are important components of occupational health and
safety programs for the prevention of injuries and illnesses. They help
employers, managers, supervisors and the Joint Health and Safety Committee
members:
identify the nature, extent and cause of health and safety hazards
set prevention activities
determine if control measures are working
Section 3.3(f) of the Regulation requires that the occupational health and
safety program must be designed to prevent injuries and occupational
diseases, and without limiting the generality of the foregoing, the
program must include the maintenance of records and statistics, including
reports of inspections and incident investigations, with provision for
making this information available to the joint committee or worker health
and safety representative, as applicable and, upon request, to an officer
of the Board.

b) Incident Investigations
Section 173(1) of the Act requires that an employer must immediately
undertake an investigation into the cause of any accident or other
incident that:
(a) is required to be reported by section 172,
(b) resulted in injury to a worker requiring medical treatment,
(c) did not involve injury to a worker, or involved only minor injury not
requiring medical treatment, but had a potential for causing serious

injury to a worker, or
(d) was an incident required by regulation to be investigated.
Section 3.4 of the Regulation requires that an employer must ensure that
an incident investigation report, required by Division 10 of Part 3 of the
Workers Compensation Act, contains:
The place, date and time of the incident
The names and job titles of injured persons
The names of witnesses
A brief description of the incident
A statement of the sequence of events which preceded the incident
Identification of any unsafe conditions, acts or procedures which
contributed in any manner to the incident
Recommended corrective actions to prevent similar incidents
The names of the persons who investigated the incident
The investigators, per Section 174(1) of the Act, must:
Be knowledgeable about the type of work involved
Include the employer or a representative of the employer
Include a worker representative
The investigation process and outcome, per Section 174(2) of the Act, must:
Determine the cause or causes of the incident
Identification of any unsafe conditions, acts or procedures which
contributed in any manner to the incident
Recommend corrective action
The recommendations need to be clear and specific so that it is clearly
understood what action(s) will be taken.
Distribution of the incident investigation report, per Section 175(2) of
the Act, must include:
The joint committee or worker representative
The Board (WCB)

c) Workplace Inspections
A key activity in the prevention of workplace incidents is the
identification of hazards to which workers may be exposed and contact.
The intent being to identify such hazards and take appropriate action to
prevent contact. To this regard the Occupational Health and Safety
Regulation requires that the employer ensure regular workplace inspections
are conducted.
----------------------------------------------------------------------2. Confined Space identification and requirements:
A confined space is an enclosed or partially enclosed area that is big
enough for a worker to enter. It is not designed for someone to work in
regularly, but workers may need to enter the confined space for tasks such
as inspection, cleaning, maintenance, and repair. A small opening or a

layout with obstructions can make entry and exit difficult and can
complicate rescue procedures.
It is vital to identify all confined spaces in any workplace. Examples of
confined spaces include tanks, silos, storage bins, process vessels,
pipelines, sewers, underground utility vaults, and vats in short, any
area that can have a confined atmosphere. (see order #5)
----------------------------------------------------------------------3. Working from heights requirement:
The employer must ensure that workers required to work from heights be
protected from a fall.
The hierarchy of fall protection consists of:
- guardrails
- fall restraint
- fall arrest
- procedures
Occupational Health & Safety Regulation 4.54 defines working from a height
as being an opening in a floor or along the open sides of stairs or a
ramp, landing, work platform, balcony, mezzanine, raised walkway or any
other area that a fall to a lower level could happen.
The employer is to ensure that the above mentioned areas accessible to
workers must have a guard or a guardrail installed.
A guard is described as a barrier and a guardrail consists of a top rail
102 cm to 112 cm (40 in to 44 in) above the work surface, and a midrail
located approximately midway between top rail and the work surface.
Occupational Health & Safety Regulation Section 4.55 identifies that a
guardrail must be installed if a raised floor is 122 cm (4 ft) or more
above the adjacent floor or grade level. (see order 1)
----------------------------------------------------------------------4. Machine Safeguarding requirements:
Occupational Health & Safety Regulation Section 12.2 requires the employer
to ensure that machinery and equipment is fitted with adequate safeguards
to protect workers from contact with hazardous power transmission parts
and to ensure that a worker cannot access a hazardous point of operation.
Occupational Health & Safety Regulation Section 12.3 requires the employer
to meet the CSA Standard Z432-94 for Safeguarding of Machinery.

----------------------------------------------------------------------5. Machine and equipment lockout requirements:
Lockout of energy isolating devices is required for all equipment and
machinery in the workplace. Written procedures are to be made available to
all workers required to work on the machinery or equipment. The procedures
must be equipment specific, not be generic in nature, and should identify
items such as specific lockout points for the various energy sources in
this workplace (e.g. electrical, hydraulic, pneumatic, etc).

----------------------------------------------------------------------6. Respiratory program requirements:
As discussed with the employer a respirator program has been developed and
delivered to the employers workers at this work site which identifies the
selection, the process for fit testing fit testing and procedures for
workers to follow during the required work task.
----------------------------------------------------------------------7. Pesticide safety requirements:
Occupational Health & Safety Regulation Section 6.72 to 6.109 apply to any
workplace where pesticides are used, stored or handled. Under the Pest
Control Products Act (PCPA), there is a requirement for pesticides to be
registered with the Pest Management Regulatory Agency (PMRA) of Health
Canada before they can be imported, manufactured, sold, or used in Canada.
The registered pesticide is assigned a PCP registration number. This
number, along with permitted uses, will appear on the product label.
It is the employers responsibility to ensure that a pesticide for use in
the workplace has been registered and labelled by the manufacturer in
accordance with the Pest Control Products Act (Canada) and the label and
MSDS (material safety data sheet) is readily available and has been
reviewed by the worker prior to mixing, loading and application to ensure

all safety precautions are followed.

A review of compensation claims has shown that about half of all
cases of occupational disease attributed to pesticides involved in mixing
and application. Safety must play a major role in every aspect of
pesticide use, from the proper choice of pesticides to their
transportation, storage, mixing, loading, application, and disposal.
Safety is also a key concern during re-entry to treated areas, equipment
maintenance, and emergency procedures.
(see order #8)
----------------------------------------------------------------------8. Exposure control plans requirements:
As discussed with the employer the employer has prepared and implemented
an exposure control plan which identifies the exposure hazards and the
development of written procedures and training of workers in the plan at
this work site.
----------------------------------------------------------------------9. Mobile equipment and ROPS (rollover protective structure) requirements:
At the time of this inspection it was determined that the employer does
not have any tractors of forklifts for use at this work place. How ever
the employer does have a bobcat used for the purpose of moving mushroom
compost. The bobcat is equipped with a FOPS (falling object protective
structure) which protect the operator from falling objects as a result of
the bucket. The employer must ensure that workers operating the bobcat use
the provided seat belt has identified in Occupational Health & Safety
Regulation Section 16.33.(1):
If mobile equipment has seat belt the operator must use the seat belt
whenever the equipment is in motion.
The employer will also need to ensure that operators are conducting a preshift inspection as identified in Occupational Health & Safety Regulation
16.34 Start of shift inspection:
The operator must inspect the equipment before the start of operation on
the shift and thereafter as required to ensure the safe operating
condition of the equipment.
----------------------------------------------------------------------10. First aid requirements:
The employer must provide for each workplace such equipment, supplies,
facilities, first aid attendants and services as are adequate and
appropriate for promptly rendering first aid to injured workers and
transporting injured workers to medical treatment. These requirements must
be no less than is required by Schedule 3-A. This employer has two current

level 1 first aid attendants to render first aid to injured workers at

this work site.
This employer is recognized as "Moderate" based on the assigned hazard
rating list. The employer would be required to review Schedule 3-A Minimum
Levels of First Aid and table 4:
This table applies to a workplace that an employer determines under
section 3.16 (2) (b) of the Regulation creates a moderate risk of injury
and that is 20 minutes or less surface travel time away from a hospital.
Procedures:
The employer must keep up-to-date written procedures for providing first
aid at the work site including the equipment, supplies, facilities, first
aid attendants, how to call for first aid, how the first aid attendant is
to respond to a call for first aid, the authority of the first aid
attendant over the treatment of injured workers. The procedure will also
need to identify the responsibility of the employer to report injuries to
the Board, who is to call for transportation for the injured worker, and
the method of transportation, prearranged routes in and out of the
workplace.
The employer must post the procedures conspicuously in suitable locations
throughout the workplace and ensure that the information is effectively
communicated to workers and first aiders alike. The employer did have a
copy of the site procedures posted in the mushroom barn next to the phone.
First Aid Records:
The employer must maintain at the workplace, in a form acceptable to the
Board, a record of all injuries and exposures to contaminants covered by
this Regulation that are reported or treated. First aid records must be
kept for at least 3 years, kept confidential and not disclosed except as
permitted by this Regulation or otherwise permitted by law.
At the time of this inspection the employer could not provide a copy of
these records or that the employer had established a process for recording
of this information. (See order # 6)
----------------------------------------------------------------------11. MSI (Musculoskeletal injuries) program requirements:
A review of claims shows MSI's account for a number of injuries sustained
at this workplace.
Section 4.47 of the Regulation requires that the employer must identify
factors in the workplace that may expose workers to a risk of
Musculoskeletal injury (MSI).
Risk factor identification is the first step in a process involving
identification, assessment, control, and evaluation. Section 4.49 of the
Regulation lists factors that must be considered during the risk

identification process. Risk identification will be conducted by persons

who are knowledgeable of work procedures, and the associated MSI risk
factors.
Section 4.53 requires that the joint occupational health and safety
committee or worker health and safety representative, as applicable, must
be consulted on risk identification.
----------------------------------------------------------------------12. Working alone requirements:
Working alone is defined as a worker may work in circumstances where
assistance would not be readily available to the worker in the event of an
emergency, in case a worker is injured or if the worker becomes ill.
Occupational Health & Safety Regulation Section 4.20.2, 4.21 and 4.22
require the employer to identify, develop procedures and ensure that all
are trained in the written procedure for checking the well-being of
workers required to work alone or in isolation.
----------------------------------------------------------------------13. Contractor safety requirements:

The employer has a responsibility as identified in the Workers
Compensation Act (WCA) to ensure the safety and coordination of
contractors hired to conduct work activities at this site.
Coordination at multiple-employer workplaces is identified as a workplace
where workers of 2 or more employers are working at the same time.
The prime contractor is identified in relation to a multiple-employer
workplace as the directing contractor, employer or other person who enters
into a written agreement with the owner of that workplace to be the prime
contractor for the purposes of this Part, or if there is no agreement
referred to in paragraph, the owner of the workplace. The prime contractor
of a multiple-employer workplace must ensure that the activities of
employers, workers and other persons at the workplace relating to
occupational health and safety are coordinated, and do everything that is
reasonably practicable to establish and maintain a system or process that
will ensure the safety of all at the workplace. Each employer of workers
at a multiple-employer workplace must give to the prime contractor the
name of the person the employer has designated to supervise the employer's
workers at that workplace.

As discussed with this employer. The employer must ensure that before a
young or new worker begins work in a workplace, the young or new worker is

new worker's workplace. The employer has and is providing new and young
workers with documented orientation and training at this work site.
The following topics must be included in the young or new worker's
orientation and training:
- the name and contact information for the supervisor;
- rights and responsibilities including the reporting of unsafe conditions
and the right to refuse unsafe work;

The employer does not currently have a formalized health and safety
program (OHS program)as required by Occupational Health and Safety
regulations. I have visited several of this employer's workplaces and
important elements of an OHS program are not implemented. As evidence by
the absence of the following:

Section 3.3.
The occupational health and safety program must be designed to prevent
injuries and occupational diseases, and without limiting the generality of
the foregoing, the program must include:
(a) a statement of the employer's aims and the responsibilities of the
employer, supervisors and workers,
(b) provision for the regular inspection of premises, equipment, work
methods and work practices, at appropriate intervals, to ensure that
prompt action is undertaken to correct any hazardous conditions found,
(c) appropriate written instructions, available for reference by all
workers, to supplement this Occupational Health and Safety Regulation,
(d) provision for holding periodic management meetings for the purpose of
reviewing health and safety activities and incident trends, and for the
determination of necessary courses of action,
(e) provision for the prompt investigation of incidents to determine the
action necessary to prevent their recurrence,
(f) the maintenance of records and statistics, including reports of
inspections and incident investigations, with provision for making this
information available to the joint committee or worker health and safety
representative, as applicable and, upon request, to an officer, the union
representing the workers at the workplace or, if there is no union, the
workers at the workplace, and
(g) provision by the employer for the instruction and supervision of
workers in the safe performance of their work.
The employer must develop a formalized health and safety program and
implement it in all of the employer's work places.

On July 10, 2013 a meeting was held at the WorkSafeBC Abbotsford office
with the mushroom farm employers to review the three serious incidents
that occurred over the last several months in the mushroom growing
industry. Two of the incidents involved workers falling from height due
to the mushroom picking ladder system detaching from the railing system.
The third incident involved cable damage or wear.
Inspections of the picking ladder system involved in the three incidents
has determined that the employers do not have manufacturer instructions
and any standard the equipment is required to meet for the installation,
testing, repair and maintenance for the picking platform equipment and
therefore, are required to be specified by a professional engineer. In
addition, the picking platform does not meet the requirements of a
professional engineer.
FARSHA has carried out research to assist the mushroom farmers with
respect to the options that are available to achieve compliance with the
orders issued in this report.
With respect to the design of the picking ladder system the following
recommendations and comments are provided:
1. The employer is required to secure the platform with pins, otherwise
the platform is considered to be a suspended work platform and
Occupational Health & Safety (OH&S) regulation 13.33 applies with respect
to the use of a personal fall protection system.
2. The employer may be required to consider alternatives to the platform
such as equipment already available on the market, such as a scissor lift.
3. The support system of the platform frame should restrict vertical
movement of frame (rollers) from rails attached to bed, prevent horizontal
movement of bottom of frame (outwards and away from beds), ensure fail
safe connection of frame to rail attached to mushroom beds, ensure
connections of rails to mushroom bed are rated for maximum load.
4. Design considerations for winch and wire rope system for a manually
moving platform should include winch rated and designed to support
personnel or the platform to be dogged in place and correctly sized wire
rope for winch and sheaves. In addition, determine maximum load for
platforms, guardrails and fixed ladder connections and ensure system is
designed for this load. Determine maximum platform load that can be
safely raised with the winch.

The employer uses a mushroom picking ladder system (work platform) for
workers to pick mushrooms during the harvesting stage in the mushroom
growing barns. The work platform is a system of several components, for
example, ladder, winch, frame, wire rope, wire rope clips, track system,
guard rails and work platform that attach to the mushroom growing beds by
a system of rollers and rails. There is no applicable standard under
Occupation Health & Safety regulation 13.2 (1)(a) or (b) for this work
platform and the employer has not ensured that the platform meets the
requirements of a professional engineer.

A ladder, window cleaner's belt or work platform must meet and be used in
accordance with the applicable CSA or ANSI standard in effect when the
equipment or structure was manufactured, except as otherwise determined by
the Board
Without delay, the employer shall engage in the services of a professional
engineer to ensure the picking work platform meet the requirements of a
professional engineer. The employer is referred to the inspection text
for more information.

Dec 18, 2013 - The engineer has submitted a structural review report with noted
deficiencies for the employer to repair and to have the system certified
no later than the end of January.
- Install 2"x2"x1/4" angle bracket under rail for support at all columns.
- A stabilizing splice plate is to be inserted at the joint of the rail
sections where a smooth transition is not present. If the ladder frames
rolls smoothly over the joint and there is no disruption to the joint a
splice plate to stabilize the joint is not required.
- Ensure all lag screws are at least one inch to the edge of the wood.
- Ensure all lag screws and bolts are in good condition, exhibiting no
signs of corrosion or movement. If lag screws and/or bolts are corroded,
damaged or exhibit any movement, replace with minimum 1/2 diameter or
greater, galvanized lag screws or at least one size larger than the one
removed, whichever is greater. Keep all bolts / lag screws that have been
review by engineer.
- Ensure all rails are clear of debris, and obstruction of the rail track.
- Ensure bolted / screwed connections on the ladder frames have good
connections and are free of cored or damaged parts.
- Ensure no other obstruction of the rail track.
- Ensure all bolts are in good condition (no rust). If bolts are rusted /
damaged, replace with new stainless steel bolt on size larger than
existing bolt or alternatively replace with a stainless steel thru bolt.
- Some of the ladder frames on the farm are iron with a 2" flat bar
instead of a 1 1/2" x 1/2" HSS. This may require an adjustment of the
connection for the locking device design.

Mar 14, 2014 - The locking mechanism was being distributed to the farms and it was discovered that a serious fabrication error
had been made that caused the handle of the pin device to interfere with the winch operation. Finding that the issue resided with
the fabricator inverting the original drawing, which in turn, resulted with the handle located at the top of the mechanism rather
than the bottom as designed. There were 300 devices recalled for prefabrication, and the location of the pin for the remaining 900
devices was able to be altered to correct the error.
This recall has now cause a delay for Roos Engineering to do the Certifications.
This order has been date extended to March 31, 2014.

INSPECTION NOTES
At the time of this inspection there was work activity observed in the mushroom growing barn. There was mushroom harvesting
and multiple workers were using the mushroom ladder picking systems (work platforms) at the time of this inspection.
In room 13 - I observed eight (8) ladder frames, all attached to the rail system of the mushroom beds and 6 ladder systems where
observed without the required locking mechanism to secure the work platform to the ladder frame to prevent a worker falling from
height as identified in the engineers structural review report No 1.

The worker representatives conducting the inspection with Officer Anna Billingsley and SRO Carol-Anne Boufford was asked if the
locking mechanism would be installed prior to the next mushroom harvesting shift, they answered, they could.
Based on the evidence gathered during this site inspection, this officer directed the worker representative and the employer not to
allow workers to use the work platforms until the employers engineer can inspect them to ensure they are safe to use by workers.
The worker and employer representative acknowledged this.
A meeting was held with the owner at approximately 12:30 pm where I stated that the platforms at this site could not be used until
the employers engineer could inspect them to determine if they are safe to use. This direction was also give to the Human
Resources Manager and that a Stop Use Order would be issued on this site as well with respect to the work platforms.
Prior to conducting this inspection the following precautions were undertaken; by Officer Anna Billingsley and SRO Carol-Anne
Boufford:
- Application of 2% Virkon solution to safety boots prior to entering work site.
- Followed the required bio-security precautions as set out by this mushroom farming operation and the request of the employer.

May 26, 2014 - I observed the mushroom ladder picking systems (work platforms) at this mushroom growing facility not installed,
inspected, and repaired as specified by a professional engineer. For example;The employer did not address the following critical
deficiencies:the locking mechanisms have not been installed, and the employer has not had the mushroom ladder picking
systems (work platforms) inspected by the engineer as specified in the engineers structural review report No.1.
Workers were observed on the mushroom picking platforms without locking mechanisms installed.
Workers were observed on mushroom picking platforms with locking mechanisms installed on the picking platform, however, not
engaged. This was due to the fact that the holes in the frame did not go below approximately 5 feet.
Some cables were observed frayed and in one case installed incorrectly on the winch.
Measures to Ensure Compliance:
Pursuant to section 190(1) of the Workers Compensation Act, H.Q. Mushroom Farm Ltd. is ordered to stop use of the mushroom
ladder picking systems (work platforms). Pursuant to 190(4) of the Workers Compensation Act. The mushroom ladder picking
systems(work platforms) subject to this order must not be used until the Board is satisfied that this mushroom ladder picking
systems(work platforms) are safe and complies with the Workers Compensation Act and the regulations and this order is
cancelled by the Board.

It was discussed with the employer that the mushroom ladder

picking systems (work platforms) cannot be used for harvesting
activities until the employer can meet the engineering
specifications as set by the engineer in the structural review
report No.1. For example: the locking mechanisms must be
installed and inspected by the engineer on the mushroom
ladder picking systems (work platforms) to ensure the platforms
workers are required to work from are secured and not
supported by the cable and winch system.
It was discussed with the employer that the order to stop use
can only be cancelled after a follow-up inspection is conducted,
and the mushroom ladder picking systems (work platforms) are
confirmed as being safe and being in compliance with the Act
and Regulation.

Section 196, Workers Compensation Act (the Act)
On July 25, 2013, an inspection of a workplace at 28265 58 Avenue, Abbotsford, BC determined there was a violation of section
4.3(2)(b) of the Occupational Health and Safety Regulation (the Regulation). Inspection Report 2013163210194 was issued to
the employer, H.Q. Mushroom Farm Ltd. (the Employer) which described the violation.
Upon consideration of all available evidence, and in accordance with section 196 of the Act and applicable Prevention Policy,
WorkSafeBC is imposing an administrative penalty because the Employer:
1. has failed to take sufficient precautions for the prevention of work related injuries or illnesses;
2. has not complied with section 4.3(2)(b) of the Regulation;
3. has not maintained a safe workplace or safe working conditions; and
4. did not exercise due diligence to prevent these circumstances.
The amount of the penalty is $8,380.80 and was determined in accordance with Prevention Policy D12-196-6 based on the
following:
1. the Employers payroll; and
2. the nature of the violation (determined as Category B).
The Employer, a worker, a union, or other person identified under section 96.3 of the Act who is directly affected by this decision
may request a review of the decision by the Review Division of WorkSafeBC.
If you wish to request a review you must notify the Review Division in writing within 90 days of the date on this report. A Request

If the Board has reasonable grounds for believing that a thing that is being used or that may be used by a worker is not in safe
operating condition the Board may order that the thing is not to be used until the order is cancelled by the Board.
Stop use of the picking platform on the top rail until inspected by a professional engineer.

The employer failed to ensure that the top rail on the mushroom picking platform was adequately secured to the mushroom beds
support structure, resulting in an injury to worker.
This is in contravention of the Occupational Health and Safety Regulation Section 4.3(1)(a).
The employer must ensure that each tool, machine and piece of equipment in the workplace is capable of safely performing the
functions for which it is used.
Due to the level of the risk associated with the use of the mushroom picking platforms the employer is required to stop use of the
mushroom bed and picking equipment in room 21 (C & D). Until the following items have been completed:
- Structure of mushroom beds, top rail, guard rail, and ladder system have been assessed for structural integrity by a professional
engineer.
- Any deficiency noted by the professional engineer need to be corrected and a final inspection conducted, of which a copy will
be submitted to this Officer for final review before cancellation will occur.

WorkSafeBC has initiated a Province wide Agriculture Industry Strategy that will focus on reducing fatalities, the serious injury rate
and the injury rate in the top exposure categories in the agriculture sectors, specifically, falls on same levels, falls from heights
and struck by injuries. The Strategy will also raise awareness of health & safety; safety rights and responsibilities within the
agriculture sector.
In addition to the above goals, the Strategy will continue to develop and implement an industry outreach and communication
program in support of the focused enforcement activities..
The Strategy involves a standard inspection process that will focus on high hazard areas in the specific agriculture operations.
Discussion held with the employer, included the requirements of the agriculture industry strategy as it relates to identified hazards:
1. Struck by (animals, product, equipment, machinery, etc)
2. Falls from elevation
3. Falls from same elevation
4. Confined Space identification and requirements
5. Informal and formal health and safety program
6. Tractor safety
7. Equipment and machine safeguarding and lock out
8. Documented new and young worker training
9. Pesticide / chemical storage and use.
An inspection was conducted on February 3, 2016 in accordance with the WorkSafe BC agricultural strategy. The following
comments are noted with regard to: scope of inspection, deficiencies and discussions at the workplace.
SCOPE OF INSPECTION
The supervisors aided in an inspection with Officer Anna Billingsley (OSO) at 1:00 pm for the partially completed composting
facility. We discussed the following items:

conduct the checklist. Example; upper wheel rail - what are the workers looking for?
This is in contravention of the Workers Compensation Act Section 115 (2)(e).
An employer must provide to the employer's workers the information, instruction, training and supervision necessary to ensure
the health and safety of those workers in carrying out their work and to ensure the health and safety of other workers at the
workplace.
The employer must develop and implement training for the pre harvest check list to any workers designated to inspect the
mushroom growing rooms.
