1.

This Godawns was erected for food Corporation of India to

store Food Grins in The year 1997. On an agreement to
hire for 5 years on Plot No. 746.
2. Nagar Palika Bangarmau (Distt. Unnao) Raise a recovery
for House Tax and water Tax on the above Godawns in
1982 as a land Reve nue recovery through SDM Safipur
(Distt. Unnao).
3. We were compelled to pay under protest the above illegal
Tax to save the kurki proceedings on our Godawns.
4. We filed a civil suit in Unnao Collectrate for the refund of
unlawful money recovered from us a House Tax and Water
Tax liabilities.
5. The copy of judgment of civil suits is enclosed herewith.
The Judgment of which was in our favor that the Nagar
Palika , Bangarmau (Distt. Unnao) is prohibited to collect
any Tax outside Nagar Palika Limits as our Godawns was
situated on Plot No. 746

which lies outside the municipal

limits under Gaged notifications

6. We applied to Nagar Palika Bagarmau to refund our money

back to us along with interest accrued upon till date, which
is still not refunded to us by them.
7. Since then no Notice/ Or Demand Charges for house Tax
and Water Tax charges were made to us till 07-09-2016.
8. On 08-09-2016 a fresh notice of areas was issues for
payment of house Tax and Water Tax for various years,
period is not mentioned so we could not understand from
which year to which year out tax liabilities stands in
municipal records of Nagar Palika Bagarmau.
9. Our Godawns was hired for 5 years initially and later hired
for one more year further.

The rental of above Godawns was so minimal so we
could not maintain the Godawns in store warthy condition
or

recover

maintenance

charges,

watch

and

ward

expenses or interest on investment made in this regard.

The Godawns detoritiated & depilated and became
un storewathy within first 10 years of construction, as a
construction was Temporary in nature having Asbestors
Cement Sheets roofing which or prone damage due to hail
storm or Andhi.

Further Godawns were vacant and never further
haired by any agency i.e. Food Corporation of India, UP

State where housing, regional food controller or any one

elce.
13.
Till August 2008 the Godawns were outside the
Munisipal limits of Nagar Palika Bagarmau (Distt. Unnao).
14.
A fresh Gaged notification to inhence the municipal
limits of Nagar Palika Bagarmau was undertaken in the
months of September 2008, through which we fell in to
municipal limits of Nagar Palika Bagarmau.

The Godawnss where more than 30 years old till
2008. So we are entitled for 40% Tax debit as per the
municipal act guidelines. Which

which year to which year we have a outstanding of House
Tax and Water Tax in mentioned in the demand notice, we
have been issued a consolidated demand which is unlawful

We are ready to pay the bonafied and Justified Tax
as per the UP municipal act 1916, after adjusting the
already deposited House Tax and Water Tax recovered
from us as land revenue arrears by Tehsil Dar Safipur in
the year 1986.

We are enclosing the Photo Graphs of above Godawns
in depleted condition.

There is no light or Fan or Power connection from UP

State Electricity Board since 1982 which can we verified by

competent authorities in this regard.

We are still paying land revenue lagan annually
levied on the above plot

No. 746 to Tehsil Bagarmau

(Distt. Unnao) for the latest financial year 2015-2016.

Kindly furnish us, under which Gaudget Notification of
UP Government, above Godawns so erected on Plot No.
746 Falls within Municipal limits since dual taxation from
Nagar

Palika

Bagarmau

and

Tehsil

simultaneously cannot happen as per Law.
