Poltica de Uso Aceptable de Conexin Inalmbrica

Todos los usuarios del Sistema Wi-Fi deben cumplir con esta Poltica de Uso
Aceptable (PUA). Esta PUA pretende evitar usos inaceptables de la conexin a
Internet.
El usuario debe (1) contar con el equipo (incluyendo hardware y software, asistentes
digitales personales, tarjetas de red inalmbricas, etc.) para conectarse al sistema
Wi-Fi, (2) cumplir con las regulaciones estatales y leyes federales e internacionales,
incluyendo pero no limitado a las leyes de derechos de autor y de propiedad
intelectual. El usuario acepta ser responsable y hacerse cargo de todos los riesgos y
consecuencias para (1) la exactitud, integridad, fiabilidad y/o utilidad de cualquier
contenido disponible a travs del sistema Wi-Fi y (2) todas las comunicaciones que
enve o reciba a travs del sistema Wi-Fi. LA EMPRESA no asume la seguridad de los
datos que el usuario enva a travs del sistema Wi-Fi y es responsabilidad del
usuario asegurar dichos datos.
Los siguientes constituyen ejemplos de violaciones de esta PUA.
El usuario se compromete a no usar el sistema Wi-Fi para:
(1) Transmitir cualquier material (por medio de subirlo a la nube, publicacin en
foros y redes sociales, correo electrnico o de otra manera) cuyo contenido sea
ilegal, amenazante, abusivo, acosador, agraviante, difamatorio, obsceno,
calumnioso, invasivo de la privacidad, de odio o racial, tnico o de otro modo
objetable;
(2) Dae, o intente daar, a menores en cualquier forma;
(3) Hacerse pasar por cualquier persona o entidad o declarar falsamente o
tergiversar su afiliacin con una persona o entidad; falsificar encabezados o
manipular identificadores para disfrazar el origen de cualquier material transmitido
a travs del sistema Wi-Fi;
(4) Transmitir cualquier material (por medio de subirlo a la nube, publicacin en
foros y redes sociales, correo electrnico o de otra manera) del que no tenga el
derecho de hacer disponible bajo ninguna ley o bajo relacin contractual o fiduciaria
(como informacin interna, de propiedad y confidencial adquirida o entregada como
parte de las relaciones de empleo o bajo acuerdos de confidencialidad);
(5) Transmitir cualquier material (por medio de subirlo a la nube, publicacin en
foros y redes sociales, correo electrnico o de otra manera) que infrinja cualquier
patente, marca registrada, secretos comerciales, derechos de autor u otros
derechos de propiedad de cualquier parte;
(6) Transmitir (por medio de subirlo a la nube, publicacin en foros y redes sociales,
correo electrnico o de otra manera) cualquier publicidad no solicitada o no
autorizada, materiales promocionales, "correo basura", "spam", "mensajes cadena",
"esquemas piramidales", o cualquier otra forma de solicitud;
(7) Transmitir cualquier material (por medio de subirlo a la nube, publicacin en
foros y redes sociales, correo electrnico o de otra manera) que contenga virus de
software o cualquier otro cdigo de computadora, archivos o programas diseados

para interrumpir, destruir o limitar la funcionalidad de cualquier software o

hardware o equipo de telecomunicaciones;
(8) Interferir o interrumpir el servicio de conexin inalmbrica o servidores o redes
conectadas al Sistema Wi-Fi, o incumplir con los requisitos, procedimientos, polticas
o regulaciones de las redes conectadas al servicio de conexin inalmbrica;
(9) Violar cualquier ley local, estatal, nacional o internacional intencionalmente o sin
intencin;
(10) "Acechar" o acosar a otra persona; o recoger o almacenar, o intentar recoger o
almacenar, datos personales de terceros sin su conocimiento o consentimiento;
(11) Revender el acceso Wi-Fi sin la autorizacin de LA EMPRESA;
(12) Utilizar el Sistema Wi-Fi para la transferencia de datos de gran volumen, las
transferencias de datos de gran volumen especialmente prolongadas, alojamiento
de un servidor web, servidor de IRC, o cualquier otro servidor.
LA EMPRESA pide que cualquier persona que crea que exista una violacin a esta
PUA se dirija a hortega@La Empresa.com e incluya "WIFI " en la lnea de asunto. Si
est disponible, por favor proporcione la siguiente informacin:
(1) la direccin IP utilizada en donde se cometi la presunta violacin;
(2) la fecha y hora de la supuesta violacin, incluyendo la zona horaria;
(3) pruebas de la presunta violacin; y
(4) sus datos de contacto, incluyendo nombre completo, direccin de correo
electrnico y nmero de telfono.
Al informar de un problema con respecto a correos electrnicos no solicitados por
favor proporcione una copia de los mensajes de correo electrnico con los
encabezados completos que tpicamente proporciona todos los datos anteriores.
Otras situaciones requerirn diferentes mtodos para recolectar la informacin
necesaria.

Terminacin
Usted acepta que LA EMPRESA podr denunciar el presente Acuerdo y cancelar su
acceso al Sistema Wi -Fi en cualquier momento, sin previo aviso y por cualquier
razn, incluyendo, pero no limitado a la violacin de cualquiera de los trminos y
condiciones del presente Acuerdo , la seguridad o la seguridad razones , y / o
mediante el sistema Wi -Fi para realizar cualquier actividad ilegal . Asimismo,
acepta que en caso de terminacin por cualquier causa, LA EMPRESA tendr
ninguna responsabilidad hacia usted.

Notificacin de problemas o quejas

Si tiene algn problema para acceder o utilizar el sistema Wi -Fi, reporte el

problema llamando a la extensin 1189 o por correo electrnico a hortega@La
Empresa.com e incluir " WIFI " en la lnea de asunto.

Modificaciones
LA EMPRESA puede, a su discrecin, puede modificar los trminos y condiciones del
presente Acuerdo, incluida la PUA, en cualquier momento. Tales modificaciones
sern obligatorias y efectivas al ser puestas en la pgina del Sistema Wi -Fi ' de
acceso a Internet de registro ' . Usted se compromete a revisar peridicamente la
pgina de " Acceso a Internet de registro " para mantener la conciencia de cualquier
modificacin. Al continuar utilizando el sistema Wi- Fi despus de dichas
publicaciones, usted acepta y est de acuerdo con cualquiera y todas esas
modificaciones.

Indemnizacin
Usted defender , indemnizar y mantendr LA EMPRESA y sus empresas filiales y
sus respectivos funcionarios, directores, accionistas, empleados, contratistas,
agentes, reembolsar prontamente a ellos de ningn tipo y de todas las prdidas,
reclamos, daos , los asentamientos , los costos y pasivos de cualquier naturaleza
( incluyendo honorarios razonables de abogados ) a la que cualquiera de ellos
puede estar sujeto que surja de, en base a, como resultado de , o relacionados de
alguna manera con, su uso de la conexin inalmbrica (Sistema Wi-Fi) o cualquier
incumplimiento de este Acuerdo .

Sin garanta
El sistema Wi-Fi se proporciona " tal cual" y "segn disponibilidad, sin garantas de
ningn tipo. La empresa no garantiza que el servicio ser ininterrumpido, libre de
errores, o libre de virus u otros componentes nocivos. La empresa hace ninguna
garanta expresa y el usuario renuncia a todas las garantas implcitas, incluyendo,
pero no limitado a, las garantas de ttulo, no infraccin, comercializacin y aptitud
para un propsito particular con respecto a cualquier mercanca, informacin o
servicio proporcionado a travs la empresa o de internet en general. Cliente
expresamente reconoce que hay, y no asume ninguna responsabilidad en relacin
con la seguridad, privacidad y confidencialidad riesgos inherentes a las
comunicaciones inalmbricas y la tecnologa y la empresa no garantiza ni garanta
en relacin a dichos riesgos. Ningn consejo o informacin dada por la empresa o
sus representantes constituir una garanta.

Limitacin de responsabilidades

La empresa, sus empleados, agentes, ejecutivos, representantes y licencias no

sern responsables por ningn costo o dao derivado, directa o indirectamente, de
su uso del sistema wi-fi o de internet, incluyendo especficamente cualquier dao
directo, indirecto, incidental, ejemplar, punitivo o especial, consecuente mltiple.

Acceptable Use Policy

All users of the Wi-Fi System must comply with this Acceptable Use Policy (AUP).
This AUP is intended to prevent unacceptable uses of the internet.
You must (1) provide all equipment (including computer hardware and software,
personal digital assistants, wireless network cards, etc.) to connect to the Wi-Fi
System, (2) comply with local, state, federal and international laws and regulations,
including but not limited to copyright and intellectual property rights laws. You
agree to be responsible for and to bear all risk and consequences for (1) the
accuracy, completeness, reliability and/or usefulness of any content available
through the Wi-Fi System and (2) all communications that you send or receive via
the Wi-Fi System. LA EMPRESA does not undertake the security of any data you
send through the Wi-Fi System and it is your responsibility to secure such data.
The following constitute examples of violations of this AUP.
You agree to not use the Wi-Fi System to:
(1) Transmit any material (by uploading, posting, email or otherwise) that is
unlawful, threatening, abusive, harassing, tortious, defamatory, obscene, libelous,
invasive of another's privacy, hateful or racially, ethnically or otherwise
objectionable;
(2) Harm, or attempt to harm, minors in any way;
(3) Impersonate any person or entity or falsely state or otherwise misrepresent your
affiliation with a person or entity; forge headers or otherwise manipulate identifiers
in order to disguise the origin of any material transmitted through the Wi-Fi System;
(4) Transmit any material (by uploading, posting, email or otherwise) that you do
not have a right to make available under any law or under contractual or fiduciary
relationships (such as inside information, proprietary and confidential information
learned or disclosed as part of employment relationships or under non-disclosure
agreements);
(5) Transmit any material (by uploading, posting, email or otherwise) that infringes
any patent, trademark, trade secret, copyright or other proprietary rights of any
party;
(6) Transmit (by uploading, posting, email or otherwise) any unsolicited or
unauthorized advertising, promotional materials, "junk mail," "spam," "chain
letters," "pyramid schemes" or any other form of solicitation;
(7) Transmit any material (by uploading, posting, email or otherwise) that contains
software viruses or any other computer code, files or programs designed to
interrupt, destroy or limit the functionality of any computer software or hardware or
telecommunications equipment;

(8) Interfere with or disrupt the Service or servers or networks connected to the
Service, or disobey any requirements, procedures, policies or regulations of
networks connected to the Service;
(9) Intentionally or unintentionally violate any applicable local, state, national or
international law, or any regulations having the force of law;
(10) "Stalk" or otherwise harass another; or collect or store, or attempt to collect or
store, personal data about third parties without their knowledge or consent;
(11) Resell the Wi-Fi System without LA EMPRESA's authorization;
(12) Use the Wi-Fi System for high volume data transfers, especially sustained high
volume data transfers, hosting a web server, IRC server, or any other server.
LA EMPRESA requests that anyone who believes that there is a violation of this AUP
direct the information to hortega@La Empresa.com and include "WIFI" in the subject
line. If available, please provide the following information:
(1) the IP address used to commit the alleged violation;
(2) the date and time of the alleged violation, including the time zone;
(3) evidence of the alleged violation; and
(4) your contact details including full name, email address and telephone number.
When reporting an issue regarding unsolicited email please provide a copy of the
email messages with full headers which typically provides all of the above data.
Other situations will require different methods of providing the necessary
information.

Termination
You agree that LA EMPRESA may terminate this Agreement and cancel your access
to the Wi-Fi System at any time, without notice and for any reason including, but not
limited to, violation of any of the terms and conditions of this Agreement, security or
safety reasons, and/or using the Wi-Fi System to perform any illegal activity. You
further agree that in the event of termination for any reason, LA EMPRESA will have
no liability to you.

Notice of Problems or Complaints

If you experience a problem accessing or using the Wi-Fi System, report the problem
by calling extension 1189 or by emailing hortega@La Empresa.com and include
"WIFI" in the subject line.

Modifications

LA EMPRESA may, at its sole discretion, modify the terms and conditions of this
Agreement, including the AUP, at any time. Such modifications shall be binding and
effective upon posting on the Wi-Fi System Internet Access Signup page. You agree
to periodically review the Internet Access Signup page to maintain awareness of
any modifications. By continuing to use the Wi-Fi System after such postings, you
accept and agree to any and all such modifications.

Indemnification
You shall defend, indemnify and hold LA EMPRESA and its corporate affiliates and
their respective officers, directors, stockholders, employees, contractors, agents,
successors and assigns harmless from and against, and shall promptly reimburse
them for, any and all losses, claims, damages, settlements, costs, and liabilities of
any nature whatsoever (including reasonable attorneys' fees) to which any of them
may become subject arising out of, based upon, as a result of, or in any way
connected with, your use of the Wi-Fi System or any breach of this Agreement.

No Warranty
The wi-fi system is provided on an "as is" and "as available" basis, without
warranties of any kind. La empresa does not warrant that the services will be
uninterrupted, error-free, or free of viruses or other harmful components. La
empresa makes no express warranties and customer waives all implied warranties
including, but not limited to, warranties of title, non infringement, merchantability,
and fitness for a particular purpose regarding any merchandise, information or
service provided through la empresa or the internet generally. Customer expressly
acknowledges that there are, and assumes all responsibility related to, the security,
privacy and confidentiality risks inherent in wireless communications and
technology and la empresa does not make any assurances or warranties relating to
such risks. No advice or information given by la empresa or its representatives shall
create a warranty.

Limitation of Liability
La empresa, its employees, agents, vendors, and licensors are not liable for any
costs or damages arising, either directly or indirectly, from your use of the wi-fi
system or the internet, specifically including any direct, indirect, incidental,
exemplary, multiple, special, punitive or consequential damages.
