AN ORDINANCE REQUIRING ALL EDUCATIONAL INSTITUTIONS IN THE
CITY OF LIPA A MANDATORY CARDIOPULMONARY RESUSCITAION (CPR)
TRAINING TO BE INCLUDED IN ALL PHYSICAL EDUCATION AND HEALTH
SUBJECT AND/OR CAT CURRICULUMS AS A REQUIREMENT FOR
GRADUATION FROM HIGH SCHOOL AND PROVIDING PENALTIES FOR
VIOLATIONS THEREOF.

DECLARATION OF STATE POLICIES


WHEREAS, Article II, Section 15 of the 1987 Constitution provides that the State shall
protect and promote the right to health of the people and instill health consciousness
among them;
WHEREAS, Article XIII, Section 11 of the 1987 Constitution provides that the State
shall endeavor to make essential goods, health and other social services available to all
the people;
WHEREAS the Local Government Code of 1991 (Republic Act No. 7160) accords every
local government unit power and authority to promote the general welfare within its
territorial jurisdiction, including the promotion of health and safety of its constituents;
NOW THEREFORE, BE IT ENACTED, AS IT IS HEREBY ENACTED, BY THE
SANGGUNIANG PANLUNGSOD OF LIPA CITY, IN SESSION ASSEMBLED, BY
VIRTUE OF THE POWERS VESTED IN IT BY LAW, THAT:
ARTICLE I
Title and General Policy
SECTION 1. Title. This ordinance shall be known as The Mandatory CPR Education
Code of Lipa City.
SECTION 2. Policy Statement. The local government unit of Lipa City as
provided in the Local Government Code of 1991, shall exercise the
powers expressly granted, those necessarily implied there from, as well

as powers necessary, appropriate, or incidental for its efficient and


effective governance, and those which are essential to the promotion
of the general welfare.
Within their respective territorial jurisdictions, local government units
shall ensure and support, among other things, the preservation and
enrichment of culture, promote health and safety, enhance the right of
the people to a balanced ecology, encourage and support the
development of appropriate and self-reliant scientific and technological
capabilities, improve public morals, enhance economic prosperity and
social justice, promote full employment among their residents,
maintain peace and order, and preserve the comfort and convenience
of their inhabitants.

ARTICLE II
DEFINITION OF TERMS
As used in this Ordinance, the terms below shall have the meanings
ascribed to them in this section. Any words or terms not defined shall
be given their plain and customary meanings, unless the context
requires otherwise, and shall be interpreted in a manner consistent
with the purpose and spirit of this Ordinance.
SECTION 1. Cardiopulmonary Resuscitation - (CPR) the manual application of chest
compressions and ventilations to patients in cardiac arrest, done in an effort to maintain
viability until advanced help arrives. This procedure is an essential component of basic
life support (BLS), basic cardiac life support (BCLS), and advanced cardiac life support
(ACLS).
SECTION 2. Department of Education - (DepEd) formulates, implements, and
coordinates policies, plans, programs and projects in the areas of formal and non-formal
basic education. It supervises all elementary and secondary education institutions,
including alternative learning systems, both public and private; and provides for the
establishment and maintenance of a complete, adequate, and integrated system of basic
education relevant to the goals of national development.
SECTION 3. Educational Institutions - an institution dedicated to education such as
schools, colleges and universities.
SECTION 4. First Aid a help given to a sick or injured person until full medical
treatment is available.
SECTION 5. First Aid Philippines - a non-religious, non-political, non-profit
organization that strongly believes in equal opportunity for Filipino citizens which

provides support for children, health and emergency care such as humanitarian action and
other medical assistance.
ARTICLE III
REQUIRED COURSES OF INSTRUCTION AND ENFORCEMENT
SECTION 1. Required Course of Instruction under the Department of Education
and the Educational Institution - In all public and private schools located within the
City of Lipa, here shall be given prior to the completion of the 12th grade at least one
year of instruction of the Cardiopulmonary Resuscitation as part of Physical Education
and Health and / or CAT Subject in the educational institution. The schools shall require
regular courses of instruction by the completion of the twelfth grade within the
jurisdiction of Lipa City.
SECTION 2. Duty of Department of Education, Superintendent and School Boards
- The DepEd board shall, with the advice of the DepEd Superintendent, prescribe the
courses of study covering these subjects for the public schools. It shall be the duty of the
officials or boards having authority over the respective private schools to prescribe
courses of study for the schools under their control and supervision similar to those
required for the public schools.
SECTION 3. Standardized Cardiopulmonary Resuscitation Education - The board
shall cause to be taught in all of the public and private schools of the City of Lipa the
subject of health education, including instruction on cardiopulmonary resuscitation and
first aid.
SECTION 4. Prescription of a Standardized Cardiopulmonary Resuscitation
Education Assessment for Public and Private Schools - The board shall prescribe a
standardized health education assessment to be administered within health, physical
education and/or CAT classes to measure student health knowledge and program
effectiveness.
SECTION 5. Adoption by the Department of Education and Private School Boards The course curriculum requirements and materials for the instruction shall be adopted by
the state board by rule in consultation with the Department of Health.
ARTICLE IV
VIOLATION
SECTION 1. Fine for Violation - Any person violating the provisions of this section
shall be guilty of a misdemeanor and, upon conviction thereof, shall be fined not
exceeding 5,000 pesos for each violation, and each week during which there is a violation
shall constitute a separate offense.

SECTION 2. Person charged is affiliated in and Educational Institution - If the


person so convicted occupies a position in connection with the public schools, that person
shall automatically be removed from that position and shall be ineligible for
reappointment to that or a similar position for the period of one year.
ARTICLE V
FINANCING
SECTION 1. Funding. An initial funding to defray the expenses necessary for or
incidental to the implementation of this Ordinance in the amount of ____________ shall
be sourced from the Lipa City fund and is hereby allocated. Every year thereafter, at least
____________ shall automatically be included in the Annual Budget of the City of Lipa
for the implementation and enforcement of this Ordinance, based on the City of Lipas
plans and programs.
The above expenses include, but are not limited to:
a. Costs of printing copies of this Ordinance, the information,
education and communication materials pertaining to CPR
Mandatory Education.
b. Other expenses associated with

ARTICLE VI
FINAL PROVISIONS
SECTION 1. Repealing Clause. All ordinances contrary to or
inconsistent with this Ordinance are hereby repealed or modified
accordingly.
SECTION 2. Separability Clause. If any part or provision of this
Ordinance is declared unconstitutional or invalid, the same shall not
affect the validity and effectivity of the other parts or provisions hereof.
SECTION 3. Effectivity Clause. This Ordinance shall take effect
fifteen (15) days after its publication in a newspaper of local or general
circulation or posting in at least two (2) conspicuous places in the City
of Lipa.
